IN 2009 - CELEBRATING 100 YEARS IN BUSINESS Kinley Corp of NY / Kinley Contracting LLC are family-owned businesses located in Allegany, New York. As General Contractors these companies specialize in commercial construction projects primarily in the Southern Tier of New York and Northwestern Pennsylvania. Throughout the years Kinley has built additional commercial projects located in Florida, Texas and the State of Washington. Our managers have a proven track record of cost-saving results and on-target scheduling. In addition, our field personnel self-perform much of its own work and have a combined experience in construction of over 20 years. Altogether, the team at Kinley Corp of NY pride themselves on safety, reputation and excellent customer service. COMPANY HISTORY Dating back six generations, Kinley has been a family owned and operated business. Adam Kinley began operations in the tannery and timber businesses in the Western New York region in the mid-1800’s. His son, William Kinley continued those operations until he ventured into the production of oil & gas properties located in these same regions, incorporating in 1909 - Kinley Oil Company. Each generation has continued the timber and oil & gas operations until present day.

Headed by J.L. Kinley (son of James H. Kinley) an expansion era began in the early 1980’s by establishing operations in Nebraska, Oklahoma and Texas. In Omaha, Nebraska J.L. & Jim Kinley purchased and re-furbished an existing fuel terminal, which supplied jet fuel to the Offutt Air Force Base. After several years of managing the expansion in Omaha, J.L. Kinley set out to build additional fuel terminals in California, Idaho, North Dakota and other parts of Nebraska. This eventually led to the formation of Kinley Construction Company.

Within this same time period of the 1980’s Bell & Kinley Company was formed in the State of Oklahoma for the purpose of producing oil & gas properties within the states of Oklahoma and Texas. Bell & Kinley’s office and shop are located in Oklahoma City, Oklahoma.

Kinley Construction Company, now known as Kinley Construction Group (KCG), is headquartered in Arlington, TX. Since the 1980’s Kinley Construction Group has been an Industrial Contractor that specializes in industrial projects related to fuel, energy and transportation throughout the United States. These projects include Airports, Energy Facilities, Fuel Flushing, Government Projects, Railroad Yards and Waste Water Treatment Plants. Within our company today, we have experienced personnel both in the office and in the field that have completed a wide variety of projects in relation to these industries - some of our employees have been with our company for 30+ years.

Also in the 1980’s, Kinley had begun its first real estate development project by constructing a 90,000 sq. ft. office building in Arlington, TX. This building was the beginning of Kinley’s interest to develop commercial projects in Texas and New York.

In the year 2000, Kinley foresaw another opportunity to re-establish itself in the southern tier of New York where they had been in business for over 100 years. This resulted in forming a new Division, Kinley Corp of N Y. As a General Contractor, Kinley Corp of N Y was created for the purpose of constructing commercial projects in the Western New York and Pennsylvania regions. DESIGN BUILD PROCESS Design/Build is a method of complete project delivery in which one entity (designer/builder) performs under a single contract with the Project to perform architectural, engineering, design services, permitting and construction. By contrast, the Design/Bid/Build method requires you to engage an architect, engineers and consultants to prepare drawings and specifications under a design contract and then, subsequently, select a Contractor via a bidding process to build the facility under a separate construction contract. Risks In a Design/Bid/Build relationship, the Owner warrants to the low Bidding Contractor that the design documents (plans & specifications) are complete and free from error. In a Design/Build relationship the Design/Builder warrants to the Owner that the design documents are complete and free from error. This eliminates finger pointing between the Owner, the architect and the builder, and provides a single source of responsibility to the Design/Builder.

PRE-CONSTRUCTION Pre-Design Planning We consult with you to accurately define overall development objectives, provide preliminary pricing for initial concept and assist in financial analysis and pro forma establishment. We will also recommend a program for selection of the architect and engineers.

Design Management We work with you on creating a design schedule along with formulation of building concept, project budget, and preliminary construction schedule. We supply analyses of construction market conditions as well as recommend building materials, methods and systems. This early involvement solvesmany of the constructability issues before plans are issued to bidders. We prepare a Conceptual Cost Estimate based on preliminary schematic drawings. A detailed estimate will be provided to you. This advanced knowledge of cost is extremely meaningful to all aspects of your design and budget. We continuously offer time and cost analyses of the overall construction design (value engineering). “Value engineering� results in defining the cost saving alternates for various design components including structural, architectural, exterior facade, interior finish, mechanical and electrical systems, early on. This accelerates your project more quickly than traditional methods. We coordinate all efforts relative to City Engineering municipal authorities. We secure boundary and topographical surveys, tree survey, phase I environmental, landscape, preliminary plat and geo-technical engineering studies, as you require.


BONDING CAPABILITIES All bonding for the Kinley Companies has been provided by St. Paul / Travelers since 1999. Kinley’s Liability Insurance Certificates and Insurance information is available upon request. CONSTRUCTION MANAGEMENT The Design Development Phase We expedite and coordinate professional engineering services for soils investigation and borings as well as site concrete, steel, roofing and other testing requirements. We will assist you on the final selection of MEP, and Structural Engineers. We recognize that the performance of products and systems over time is a major factor in your decision for value-based purchasing. Construction Document We review necessary bidding documents. Bidding or Negotiating We coordinate the preparation of construction bid packages, solicit and pre-qualify subcontractors. We also distribute bid packages and conduct pre-bid conferences. We evaluate bids, proposals submitted by subcontractors. Meetings and Reports We conduct regularly scheduled Construction Progress Meetings with you. These Progress meetings address all areas of the Project with emphasis on budget, schedule, quality, and changes in the work, manpower, safety, and conformance with design, compliance with resolutions of construction issues. Budget Control We regularly monitor and analyze the Construction Budget for compliance with the your Control Budget. We provide you with suggestions and recommendations when potential exist for cost variations and overruns. Schedule Control We track and analyze the schedule for conformity with your overall project objectives and schedule. We also provide you with suggestions and recommendations regarding any potential schedule abnormalities or variations from Project’s critical path. We adhere to a continuous review of the progress of the project, degree of quality and workmanship and adequacy of subcontractor’s workforce.
