shall notify his Insurers of, and shall himself note the Auctioneers’ Interest as Bailees in such policy or policies.
The Seller authorises Bamfords Auctioneers and Valuers Limited to deduct commission at the published rate and to retain the buyer’s premium of 15% plus VAT. The seller agrees to pay all special adver tising charges and illustration charges insomuch that they are reasonable.
Warranty of Title The seller warrants to Bamfords Auctioneers and Valuers Limited and to the buyer that he is the true owner of the property or is properly authorised to sell the property by the true owner and is able to transfer good and marketable title to the property free from any third party claims.
Value Added Tax A seller who sends for sale by auction any chatel(s) which is an asset of his business must disclose to the Auctioneer whether or not he is a registered person for Value Added Tax purposes and, if so, his registered number and whether or not he intends to operate the Dealers Margin Scheme covering works of ar t, etc. This information must be supplied to the Auctioneer on or prior to delivery of goods.
Rights to Photographs and Illustrations The vendor gives Bamfords Auctioneers & Valuers Limited full and absolute right to photograph and illustrate any lots placed in its hands for sale and to use such photographs and illustrations and any photographs provided by the vendor at any time at its absolute discretion, whether or not in the connection with the auction. Bamfords Auctioneers & Valuers Limited will reserve the right to make a discretionary charge for any photographs used in the catalogue which will promote the items sale.
Instructions All goods delivered to the Auctioneer’s premises will be deemed to be delivered for Sale by Auction and will be catalogued and sold accordingly unless special instructions are recorded on the receipt.
Electrical and Mechanical Goods The seller or consignor of electrical or mechanical goods warrants and under takes to Bamfords Auctioneers & Valuers Limited that at the date on which the same are consigned to Bamfords or put under Bamfords' control and excepted as previously disclosed to Bamfords the same are safe if reasonably used for the purpose for which they were designed and free from any defect not obviously on external inspection which could prove dangerous to human life or health and will indemnify Bamfords Auctioneers & Valuers Limited, its servants and agents against loss or damage suffered by any of them in consequence of any breach of the above warranty and undertaking. Bamfords Auctioneers & Valuers Limited reserve the right to make a minimum charge of £2.50 per item to have the goods checked by an electrician for the safety of the item.
Reserves Bamfords Auctioneers and Valuers Limited will be pleased to advise on suitable protective reserves but if no reserve have been received prior to the day of sale, the lot will be sold without reserve or at the discretion of the Auctioneer. Reserves must be confirmed in writing or notified on the receipt at the time of delivery. Indemnity Vendors shall indemnify Bamfords Auctioneers and Valuers Limited against any claims in connection with goods sold by Bamfords on the vendors behalf. Collections The Auctioneer’s do not themselves under take the collection of goods but acting expressly as Agents, they will if required, instruct or recommend a carrier on the vendor’s behalf.
Agency The Auctioneers act throughout as Agents only and are not responsible for any default by the buyer. Bamfords Auctioneers & Valuers Limited disclaim liability for paying the vendor until they have received settlement from the purchaser.
Withdrawals Where a seller cancels instructions for sale, or where a lot is withdrawn for any reason other than misattribution or authenticity, Bamfords Auctioneers and Valuers Limited reserve the right to charge a fee equal to 10% plus VAT of the reserve price of the lot, or where no reserve has been fixed, Bamford’s lower estimate of the item(s) withdrawn, together with any expenses incurred in relation with the item(s) withdrawn.
Unsaleable Goods Unless otherwise instructed by accompanying or previously received written notice, all goods delivered to their premises which in Bamfords Auctioneers & Valuers Limited opinion have no saleable value will be disposed of at Bamfords discretion either to a charity or by consignment for destruction.
Insurance Unless instructed otherwise (in which case the property remains at the Owners risk) goods will be insured against all risks whilst on the premises pending sale. The premium cost will be 2.5% of the hammer price. The Auctioneer shall not be responsible for damage to, or the loss, theft or destruction of any goods not so insured. If the vendor has in force policy or policies of Insurance in which the article is specifically mentioned as being insured (whetheror not for an agreed sum of value) the vendor
Payment Payment is due immediately after the sale in pounds sterling and may be made by the following methods: cash, bankers draft, personal cheques and debit card. VISA AND MASTERCARDS have a 2.5% surcharge. We do not accept American Express. Credit card payments are not accepted over the telephone.
