The final push to Election Day FROM STAFF & WIRE REPORTS Time zone-defying, cross-country travel that leaves little time for sleep. Big rallies of sweaty crowds interspersed with tony, high-dollar fundraisers at celebrity homes. Obsessive polltracking, September scares and October surprises. That’s the typical post-Labor Day path for presidential candidates as they embark on what is traditionally the final, frenetic sprint to Election Day, all with the presumption that one of the contenders would declare victory under a cascade of balloons, while the other affects a gracious demeanor in conceding. The loser heads home to contemplate a post-campaign career, and the winner moves to cabinet-making or preparation of a second-term agenda. When it comes to news and events, the campaign is full of drama: the pandemic, civil unrest over racial injustice, and what would normally be explosive revelations that President Donald Trump deliberately downplayed the danger of COVID-19, insulted military generals and reportedly called those who died serving in the military “losers” and “suckers.” But the campaign competition itself is remarkably static. Polling has remained fairly stable, with Trump trailing Democratic nominee Joe Biden by 7-10 percentage points nationally and by single digits in battleground states. Trump’s own approval rating has also remained about the same – in the low to mid-40s – despite a flailing economy, escalating virus deaths and what

After author Bob Woodward released book excerpts and audiotape featuring Trump admitting he purposely played down the severity of the virus, Democrats were out the next day with TV ads calling Trump a liar and unfit for office. His claim that he was trying to avoid a panic just fueled the fight, with Democrats noting Trump’s daily tweets warning of violent protesters and accusing Biden of wanting to “abolish the suburbs.” That might help Biden a bit, McDonald says, by reinforcing his floor of support. But it’s not likely to shake Trump’s loyal base, experts say.

“The Woodward book is a partisan inkblot,” says Kevin Madden, senior adviser to GOP nominee Mitt Romney’s 2012 presidential campaign. “Reactions to it are largely guided by whether a voter already supports or opposes Trump. There will be bigger forces at play with persuadable voters than the contents of Woodward’s book.” A recent Monmouth University poll buttresses Madden’s point: It shows Biden with a 9-point lead over Trump nationally among registered voters, unchanged from a month ago. And while the survey – taken after a report that Trump insulted American war dead – showed that voters think Biden has more respect for the troops than Trump, the report did not impact the overall race for president.

“People’s views are just so hardened in. Either (Trump) is unqualified to be president, or he’s qualified and people are just out to get him and it’s more of the same,” says J. Wesley Leckrone, a political science professor at Widener University in Pennsylvania. “People who are Trump supporters are not going to believe anything Woodward writes. They probably still blame him for bringing down Nixon,” he adds, referring to Woodward’s role in exposing the Watergate scandal. From a political science perspective, the situation can be explained by things such as historic voter polarization and “media filter bubbles,” in which people hear different information from self-selected news sources, says North Carolina State University professor Steven Greene. This year, “we have to resign ourselves to the fact that this is just nuts,” he says. Dramatically different, too, is the basic machinery of running a campaign this year. Trump, who is most at home in a big crowd of supporters, had to cancel two Nevada airport hangar rallies this weekend because the events, which worked so well for him in 2016, violate the state’s rules on large gatherings during the pandemic. Biden and his running mate, Sen. Kamala Harris of California, begun air travel campaigning – but carefully, eschewing big rallies for small gatherings of pre-selected, masked attendees. At this stage of a typical campaign, candidates and=their 4c x 6.7 26.8spouses inches might hit several states in a day. $294.80 Biden and Trump are set to face off in three debates, events that have had substantial impacts on previous presidential races. Those may also be relatively meaningless this year, experts say – not only because the two camps are so entrenched but because tens of millions of people will likely have voted before the debates are completed. Millions may have voted even before the first debate, Sept. 29. In Virginia, where early voting began on Sept. 18, a Wason Center for Public Policy at Christopher Newport University poll released Sept. 24, shows that Joe Biden holds a 5-point lead in Virginia over President Donald Trump, 48 to 43 percent. Among Virginians who are enthusiastic about voting in the Nov. 3 election, Biden’s lead jumps to 8 points, 51-43 percent. “Enthusiasm is a key to Biden’s lead and will be a key to turnout on Election Day,” Wason Center Research Director Rebecca Bromley-Trujillo said. “We saw an enthusiasm gap of 6 points between Democrats and Republicans in this survey.” Among those voters, Biden shows a 27 percent advantage among women (61 to 34 percent), 18 percent among voters younger voters (56-38 percent), 61 percent among Black voters (75-14 percent), and 36 percent among college-educated voters (66-30 percent). Biden also holds Trump to a draw among enthusiastic voters 45 and older, a bloc that has favored Trump in the past. Trump’s advantage with enthusiastic voters is 17 percent among non-college-educated voters (54-37 percent), 20 percent among white voters (53-43 percent) and 12 percent among men (52-40 percent).

COVID-19 has increased the digital divide, but Blacks facing another threat to tech access HAZEL TRICE EDNEY TEWire – As COVID-19 wreaks havoc on a digital and educational divide that has already severely impacted African-American and other children of color, yet another situation on the horizon could further increase disparities by hindering access to crucial technological tools, according to experts. Two cases pending before the U.S. International Trade Commission (ITC) are being watched by educators and lawmakers who describe them as deeply troubling. Many big names in technology are under attack - including Amazon, Apple, Asus, Dell, HP, Lenovo, LG, Microsoft, Motorola, Samsung, and Sony – and tech experts say the outcomes of these cases are absolutely realistic threats to the ability to obtain certain mobile communication devices – an outcome that would increase the digital divide even further during this unprecedented time of online learning. In a nutshell, Neodron, a company just recently created in Ireland, is seeking to block the import of more than 90 percent of mobile touchscreen devices, like smartphones, tablets and touchscreen laptops, that come into the United States. Neodron doesn’t design or manufacture products within the U.S. Its business plan is to acquire patents and then sue for infringement. The cases have caught the attention of members of Congress, and those in the tech world express major concern. “When we talk about digital divide, you’re talking primarily about the availability of high speed internet and its distribution across our nation. The big problem with

Michael Russell this patent infringement claim is that the vast majority of inner city schools still have barely sufficient internet connection,” says Michael Russell, the lead instructor for information technology, security and forensics at the Pittsburgh Technical College since 2002. Russell points out that “the majority of young people who access the internet today access the internet from their smartphones.” Particularly low income children often use their smartphones in order to get on the Internet. He believes the Neodron case could impact their educational lives. Russell used the term “patent pirate” when describing the activities of companies like Neodron which acquires patents for the purpose of financial gain. Neodron recently obtained patents from Microchip Technologies, possibly with the motive of filing petitions asking the ITC to investigate and close the U.S. market to nearly all smartphones, tablets, and laptops. In short, Neodron is putting the devices that people rely on at risk amidst a season when they need them most. According to a statement by

the ITC, the complaint “alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain touch-controlled mobile devices, computers, and components thereof that infringe patents asserted by the complainant. The complainant requests that the USITC issue a limited exclusion order and cease and desist orders.” Restricting the import of these devices into the United States would cause educational and personal hardships for people largely dependent on their smartphones and other affected devices. The issue is so dire that two

members of Congress formed a bipartisan partnership to deal with it. Suzan DelBene (D-Wash.) and David Schweikert (R-Ariz.) introduced the Advancing America’s Interests Act to stop patent abuse through the ITC and to assure that the agency adheres to a high standard of public interest. “The ITC was established to protect U.S. companies and consumers from unfair foreign competition, but in recent years, patent licensing entities have abused the ITC process for financial gain,” said DelBene in a joint release. “This legislation addresses

Jackson Ward and other neighborhoods in Richmond and across the country have lots of history and rich culture. Much of which still lives on through us, but doesn’t physically exist. Not to exclude, not to be “racist” against others, and I’ve never been one to create double standards. I say all of this to say, there’s been SO MUCH SUPPORT!! (thank you, thank you, thank you)...but then there has also been some unhappy folks stating their opinions. In addition to that, I also understand that a directory is not going to bring about world peace and that our people face more troubles than supporting Black owned businesses may fix. I know that. What I also know is that I have a certain lane to stay in, and I can only confidently do what I’m great at to help make a change. (from page 3) this problem and helps protect American businesses from unfair and unjustified claims.” Schweikert called the legislation “an important step in the right direction towards reforming the ITC’s unfair imports process to ensure that American businesses have equitable access to protection for their ideas.” This potential impact of this case cannot be overlooked as African-Americans and other racial minorities have been so disproportionally impacted by COVID-19. As lives have become almost totally dependent upon access to the internet and remote services, the impact of an ITC exclusion order would have a broad reach. Instead of rushing to get children out the door to catch the school bus and then driving into work, many parents now struggle to manage their children’s education as schools have shifted to remote learning and parents work from home. Government services of all types are now online, from job applications to business licenses to unemployment claims. And then there’s access to health care. Throughout the pandemic, it has become clear that telehealth is surging and is a crucial resource that allows people to protect both their community as a whole and the healthcare workers providing their critical services. According to a recent study, up to 42 million people may not have access to broadband, a figure that is disproportionately made up of African-Americans and other people of color. But without the devices necessary to even access the internet, the problem becomes worse and communities of color are at a great disadvantage. A key concern is that since the

The Greenlining Institute, a 27-year-old multi-racial organization in Oakland, Calif. that aims to end economic discrimination such as redlining, conducted a survey of Oakland and Fresno, Calif. residents before COVID-19. The findings were as gloomy as expected. But all of the common themes were “made more urgent by the pandemic”, the Institute reports on its website. Those common themes include “Internet access is not a luxury; Lack of access creates significant hurdles for everyday life; Smartphone access is insufficient; Internet plans designed for low-income families are inadequate; Lack of access is

a barrier to academic success.” Russell says if Neodron prevails, these issues could expand and get even worse for more people across the nation. “I’m not only talking about just young people,” he said. “I’m talking about the elderly needing to monitor their health care, making appointments with the doctor and things of that nature. All of those things could be adversely impacted. Mostly inner city; mostly Black and Latino families would continue to have the largest impact.” As the issue spirals, even more considerations will come into play. “The educational, financial and personal need for the internet could lead to an even greater conflict than the inability to get online,” says Russell, who also teaches regulatory compliance. “I do believe that technology has a potential of being another form of warfare,” he says. “I’m really concerned about that. Like economic warfare. We have a company located in another country filing a claim against American corporations that could adversely impact the way we live and do business. That’s a real deal.”

Justice(s) on Obamacare’s future The vacancy created by the death of Justice Ruth Bader Ginsburg is certain to have profound implications on the Supreme Court for decades to come as Republicans try to further solidify a conservative-leaning bench with President Donald Trump's nominee. But the impending and likely contentious confirmation battle is expected to have a more immediate ripple effect in the upcoming term with one of the most consequential cases on the docket: the future of the Affordable Care Act. The Obama-era law is facing its biggest test in years as the court reexamines the individual mandate,

the provision requiring Americans to purchase health insurance or pay a penalty. The mandate faces questions again over its constitutionality since Republicans in Congress repealed the penalty and reduced it to zero as part of the 2017 tax cut bill. The ACA, which has been the subject of arguments before the high court half a dozen times, has come under assault from Republicans since its enactment in 2010, and proponents are loudly sounding the alarm with the potential for the entire law to come undone in the landmark case, California v. Texas. A federal court, supported by the

Trump administration, ruled that because the individual mandate has been invalidated, the entire Affordable Care Act should be dismantled, a decision that would have monumental consequences especially amid an ongoing pandemic. If Senate Republicans are able to shepherd through an expedited confirmation process and install Trump’s nominee, Judge Amy Coney Barrett, before the 2020 election and the Nov. 10 arguments for the ACA case, the Supreme Court will have an even stronger conservative tilt with a 6-3 majority.
