VMI superintendent resigns after cadets describe relentless racism IAN SHAPIRA WP- The superintendent of the Virginia Military Institute resigned Monday after Black cadets described relentless racism at the nation’s oldest state-supported military college, and Gov. Ralph Northam (D) ordered an independent probe of the school’s culture. Retired Gen. J.H. Binford Peay III, 80, has been superintendent of the 181-year-old school since 2003. During the retired four-star general’s tenure, multiple accounts of racist incidents have surfaced at VMI. Most recently, The Washington Post documented how one Black student filed a complaint against a White adjunct professor who reminisced about her father’s Ku Klux Klan membership last year in the middle of class. In 2018, a White sophomore told a Black freshman during Hell Week he would “lynch” his body and use his “dead corpse as a punching bag” — but was suspended, not expelled. After The Post’s story was published, Northam (D), a 1981 VMI graduate, ordered an independent investigation into the school, which received $19 million in state funds in fiscal 2020. In a letter announcing the inquiry, Northam and other state officials said they had “deep concerns about the clear and appalling culture of ongoing structural racism” at the school. The school, whose cadets fought and died for the slaveholding South during the Civil War, has long

But the college has come under increasing pressure from Black alumni and cadets to remove the campus’s statue of Confederate Gen. Stonewall Jackson, an enslaver of six people who taught at VMI. In July, Peay defended the statue of Jackson, calling him “a military genius” and a “staunch Christian.” Peay, who was born in Richmond in 1940, graduated from VMI with a civil engineering degree in 1962, according to his biography, which

has now been removed from the school’s website. In college, he was quarterback of the football team. In the Army, Peay served two tours in Vietnam War. Later, he became a senior aide to the chairman of the Joint Chiefs of Staff, served as an executive to the Army’s Chief of Staff and then assumed command of the famed 101st Airborne Division, which he led during Operations Desert Shield and Desert Storm in the Persian Gulf. By the early 1990s, then a general,

he was appointed as the 24th Vice Chief of Staff for the Army. His final role was commander in chief of the U.S. Central Command in Florida from 1993 to 1997, helping oversee military operations in 20 countries in Africa, the Middle East, Persian Gulf, and South Asia. Peay was highly decorated: He was awarded the Silver Star and Purple Heart. He and his wife have two sons, both graduates of VMI. His grandfather, J.H.N. Peay Jr. was a member of the class of 1929.

Blacks fueling the record number of early voters One of the main things missing from the overall electoral equation four years ago has seemingly fueled the 2020 early voting turnout: Black people, who were criticized in part as scapegoats for the election of Donald Trump because their share of the vote plummeted in 2016. But statistics show it’s doubtful that will be true this time around as more Americans have already cast their ballots in the

early voting period than all of the early voting in the election that Hillary Clinton lost. Nearly 60 million Americans have already voted as of Sunday. For perspective’s sake, that’s “more than the 47.2 million 2016 general election preelection votes” in 2016 and “more than the 58 million in-person and mail ballots cast in 2016,” including “mail ballots that were dropped off on Election Day

or post marked by Election Day and received by election offices afterwards,” according to data being compiled and tallied by the U.S. Elections Project. “Nationally, the 2020 early vote is greater than 43 percent of all votes cast in the 2016 election. The pace of some states’ early voting is such that with almost certainty states will begin surpassing their total 2016 total vote this week.” Polling by the Five Thirty Eight data analysis website shows that way more Black people were expected to vote early this year compared to 2016. That’s about 25 percentage points more than four years ago. The share of Black people who said they planned to vote by mail is also up significantly, the highest proportion among Black, white and Hispanic voters. Black people also led all voters who planned to cast their ballots in-person early voting numbers — 33 percent — which is an increase of 9 percentage points from 2016. The telling sign is that Black people, who have traditionally been among the most reluctant to vote via mail, are apparently no longer hesitant to do so. That’s probably because of a myriad of factors that prominently include Donald Trump and the coronavirus — the former has solidified his reputation as an anti-Black racist and the latter has forced Black people, disproportionately affected by the Covid-19 pandemic, to realistically consider voting from afar. It hasn’t been quite that simple for ll Black voters, though. That was especially true in places like Georgia where Black folks have historically had their electoral voices marginalized through efforts to suppress their votes. The long lines there have been just as well documented as — and compared to — the kind of voter suppression the country witnessed there just two years ago when then-Secretary of State Brian Kemp flagrantly rigged the election against Stacey Abrams to secure his victory to become governor. Instances like that along with the nationwide protests that have spurred a racial reckoning of sorts have helped motivate Black voters to endure lengthy waits to make sure their ballots are cast, recorded and counted.

StoryCorps: Reconnecting a divided America

StoryCorps has launched One Small Step, a multi-year national effort to begin “mending the fabric of a country at the breaking point”. The organization, a national nonprofit, that notes it is dedicated to recording, preserving, and sharing the stories of Americans of all backgrounds and beliefs, launched the initiative last week, in Richmond. It is in collaboration with local media, political, religious, and community organizations, and is calling for Richmond residents to participate in 40-minute, one-onone conversations with strangers, to share about their lives, and, in turn, to help people get past the labels of “Republican” and “Democrat,” “liberal” and “conservative.” “Our research shows there is something special about Richmond. Even amid a contentious election year, we believe Richmond residents can show the rest of America that we can once again be neighbors and communities if we have the courage to listen to one another,” said StoryCorps Founder and President Dave Isay. “Every day brings new evidence of how frustrated, angry and disconnected from each other Americans feel. One Small Step aims to remind people of the humanity in all of us, and that it’s hard to hate up close. We believe Virginians can model this change.” By bringing together strangers of divergent perspectives to have courageous, meaningful conversations about their lives, Isay believes One Small Step will help decrease feelings of contempt across political divides, allowing Americans to see one another as humans. StoryCorps has developed the initiative over the past three years with the input of scientists, researchers and psychologists. Conversations recorded for One Small Step are not about politics, but rather about who we are as

people, what we care about, and our dreams for the future. Every interview becomes part of American history at the American Folklife Center at the Library of Dave Isay Congress. Richmond is one of four cities in which StoryCorps is anchoring One Small Step; the others include Wichita, Kansas; Birmingham, Ala.; and Shreveport, La. The organization conducted polling and other research, including a pilot in Richmond in partnership with VPM and determined these cities were particularly likely to carry out the initiative successfully, as residents expressed exhaustion with political divisions and also a willingness to listen across them. StoryCorps first piloted One Small Step in 2018-19. In the time since, data have shown a widening chasm between Americans. A 2019 study showed that about 40 percent of people view the other party as “downright evil”; one in five Republicans and Democrats agree with the statement that their political adversaries “lack the traits to be considered fully human”; and about 20 percent of Democrats and Republicans think the country would be better off if large numbers of the opposition were dead. One Small Step is made possible by the generous support of the Fetzer Institute, Kate Capshaw and Steven Spielberg’s The Wunderkinder Foundation, the William and Flora Hewlett Foundation, the Corporation for Public Broadcasting, and the Charles Koch Institute. Explanation for Proposed Constitutional Amendment To Be Voted on at the November 3, 2020, Election PROPOSED CONSTITUTIONAL AMENDMENT Article X. Taxation and Finance. Section 6. Exempt Property BALLOT QUESTION Should an automobile or pickup truck that is owned and used primarily by or for a veteran of the United States armed forces or the Virginia National Guard who has a one hundred percent service-connected, permanent, and total disability be free from state and local taxation? EXPLANATION Present Law Generally, the Constitution of Virginia requires all property be taxed. However, there are certain types of property that the Constitution specifically says is not subject to taxation. Proposed Amendment This amendment would add to the list of property that is not subject to state or local taxation one motor vehicle owned and used primarily by or for a veteran of the United States armed forces or the Virginia National Guard who has a one hundred percent (100%) service-connected, permanent, and total disability. The amendment says that motor vehicle means an automobile or pickup truck. The motor vehicle would be exempt from taxation beginning on the date the veteran gets the motor vehicle or January 1, 2021, whichever is later. A veteran who claims this tax exemption would not get back any taxes paid on his motor vehicle prior to January 1, 2021. Under this amendment, a motor vehicle that is owned by the spouse of a veteran of the United States armed forces or the Virginia National Guard with a one hundred percent (100%) service-connected, permanent, and total disability could also be free from taxation. The General Assembly is allowed to pass a law that places conditions or restrictions on this exemption. A “yes” vote will mean the Constitution of Virginia will be amended to exempt one automobile or pickup truck that is owned and used primarily by or for a veteran of the United States armed forces or the Virginia National Guard who has a one hundred percent (100%) service-connected, permanent, and total disability from state and local taxation. A “no” vote will leave the Constitution of Virginia unchanged and automobiles and pickup trucks owned and used primarily by or for a veteran of the United States armed forces or the Virginia National Guard who has a one hundred percent (100%) service-connected, permanent, and total disability will continue to be subject to state and local taxes. FULL TEXT OF AMENDMENT [Proposed new language is underlined. Deleted old language is stricken.] Amend Section 6 of Article X of the Constitution of Virginia as follows: ARTICLE X TAXATION AND FINANCE Section 6. Exempt property. (a) Except as otherwise provided in this Constitution, the following property and no other shall be exempt from taxation, State and local, including inheritance taxes: (1) Property owned directly or indirectly by the Commonwealth or any political subdivision thereof, and obligations of the Commonwealth or any political subdivision thereof exempt by law. (2) Real estate and personal property owned and exclusively occupied or used by churches or religious bodies for religious worship or for the residences of their ministers. (3) Private or public burying grounds or cemeteries, provided the same are not operated for profit. (4) Property owned by public libraries or by institutions of learning not conducted for profit, so long as such property is primarily used for literary, scientific, or educational purposes or purposes incidental thereto. This provision may also apply to leasehold interests in such property as may be provided by general law. (5) Intangible personal property, or any class or classes thereof, as may be exempted in whole or in part by general law. (6) Property used by its owner for religious, charitable, patriotic, historical, benevolent, cultural, or public park and playground purposes, as may be provided by classification or designation by an ordinance adopted by the local governing body and subject to such restrictions and conditions as provided by general law. (7) Land subject to a perpetual easement permitting inundation by water as may be exempted in whole or in part by general law. (8) One motor vehicle owned and used primarily by or for a veteran of the armed forces of the United States or the Virginia National Guard who has been rated by the United States Department of Veterans Affairs or its successor agency pursuant to federal law with a one hundred percent service-connected, permanent, and total disability. For purposes of this subdivision, the term “motor vehicle” shall include only automobiles and pickup trucks. Any such motor vehicle owned by a married person may qualify if either spouse is a veteran who is one hundred percent disabled pursuant to this subdivision. This exemption shall be applicable on the date the motor vehicle is acquired or the effective date of this subdivision, whichever is later, but shall not be applicable for any period of time prior to the effective date. (b) The General Assembly may by general law authorize the governing body of any county, city, town, or regional government to provide for the exemption from local property taxation, or a portion thereof, within such restrictions and upon such conditions as may be prescribed, of real estate and personal property designed for continuous habitation owned by, and occupied as the sole dwelling of, persons not less than sixty-five years of age or persons permanently and totally disabled as established by general law. A local governing body may be authorized to establish either income or financial worth limitations, or both, in order to qualify for such relief. (c) Except as to property of the Commonwealth, the General Assembly by general law may restrict or condition, in whole or in part, but not extend, any or all of the above exemptions. (d) The General Assembly may define as a separate subject of taxation any property, including real or personal property, equipment, facilities, or devices, used primarily for the purpose of abating or preventing pollution of the atmosphere or waters of the Commonwealth or for the purpose of transferring or storing solar energy, and by general law may allow the governing body of any county, city, town, or regional government to exempt or partially exempt such property from taxation, or by general law may directly exempt or partially exempt such property from taxation. (e) The General Assembly may define as a separate subject of taxation household goods, personal effects and tangible farm property and products, and by general law may allow the governing body of any county, city, town, or regional government to exempt or partially exempt such property from taxation, or by general law may directly exempt or partially exempt such property from taxation. (f) Exemptions of property from taxation as established or authorized hereby shall be strictly construed; provided, however, that all property exempt from taxation on the effective date of this section shall continue to be exempt until otherwise provided by the General Assembly as herein set forth. (g) The General Assembly may by general law authorize any county, city, town, or regional government to impose a service charge upon the owners of a class or classes of exempt property for services provided by such governments. (h) The General Assembly may by general law authorize the governing body of any county, city, town, or regional government to provide for a partial exemption from local real property taxation, within such restrictions and upon such conditions as may be prescribed, (i) of real estate whose improvements, by virtue of age and use, have undergone substantial renovation, rehabilitation or replacement or (ii) of real estate with new structures and improvements in conservation, redevelopment, or rehabilitation areas. (i) The General Assembly may by general law allow the governing body of any county, city, or town to exempt or partially exempt from taxation any generating equipment installed after December thirty-one, nineteen hundred seventy-four, for the purpose of converting from oil or natural gas to coal or to wood, wood bark, wood residue, or to any other alternate energy source for manufacturing, and any co-generation equipment installed since such date for use in manufacturing. (j) The General Assembly may by general law allow the governing body of any county, city, or town to have the option to exempt or partially exempt from taxation any business, occupational or professional license or any merchants’ capital, or both. (k) The General Assembly may by general law authorize the governing body of any county, city, or town to provide for a partial exemption from local real property taxation, within such restrictions and upon such conditions as may be prescribed, of improved real estate subject to recurrent flooding upon which flooding abatement, mitigation, or resiliency efforts have been undertaken.

Is Virginia Military Institute doomed? L DOUGLAS WILDER That’s probably an overstatement, but we’re not the ones who raised the question — the chair of the General Assembly’s Senate Finance Committee was and, since she’s got some control over the state’s budget, she’s the one who really counts. Let’s back up and offer some context for that rather alarming question: A year in which Confederate statues have been coming down has not been an easy one for the Lexington school where until recently first-year cadets had to salute the statue of one of its former professors, Confederate Lt. Gen. Thomas “Stonewall” Jackson. In June, Roanoke Times education writer Claire Mitzel wrote about how some Black alumni were using social media to describe what they had faced at VMI, including: “being punished for not saluting the Jackson statue; white cadets wearing blackface; the pain of charging across the New Market battlefield; white students using the N-word; getting The LEGACY NEWSPAPER Vol. 6 No. 44 Mailing Address P.O. spit in the face.” She followed up on the article in July with more details about alumni reaction to the issue. VMI itself responded to the alumni in July, saying it would alter traditions but would not take down statues, including the one of Jackson. The Washington Post followed up with stories of its own in September and then again last weekend: “At VMI, Black cadets face pervasive racism, threats.” That prompted Gov. Ralph Northam to order an independent investigation. VMI pledged to cooperate, but the head of its governing board issued a statement declaring that “systemic racism does not exist here.” The LEGACY welcomes all signed letters and all respectful opinions. That prompts two thoughts: First, why didn’t Northam act back in June when these charges first came to light? Instead, he let these pass for months. Richmond TimesDispatch political columnist Jeff Schapiro writes that Northam acted “after taking telephone calls Sunday from Black legislative leaders, among them House Appropriations Committee Chairman Luke Torian of Prince William, alarmed by fresh reporting on the school’s racial culture.” Why weren’t they alarmed in June? Or is this evidence of what we’ve suspected all along — that the new leaders of the General Assembly really have no idea what’s happening west of the Blue Ridge? Second, for VMI to declare that it is free of racism is to believe that VMI is a pristine bubble that is somehow immune to the faults of society at large. That beggars belief. In any case, we now come to the key part. Schapiro reported on a September meeting where VMI Superintendent Binford Peay met with Janet Howell, the Fairfax County Democrat who chairs the

Senate’s budget-writing committee: “Howell signaled to Peay that she is prepared to use VMI’s appropriation from the state — it currently receives $19 million a year — as a weapon to force change at the school.” But here’s what came next: “The senator, in an interview [recently], went further, wondering whether Virginia would be better off without VMI. ‘I’m not sure how important or relevant it is,’ said Howell. ‘It seems to me it’s time has passed, especially if it doesn’t adjust to changing times.’” The budgetary threat is likely real; the question about “whether Virginia would be better off without VMI” is probably a bluff. But it’s also not a question that should be completely ignored. Schapiro, who understands the state’s political dynamics better than many politicians, noted that VMI “is having little luck with a Democratic regime dominated by the General Assembly’s Black caucus and white liberals, many from Northern

Restoring hope

While many of us are counting down the days until Election Day on Tuesday, November 3rd, most Americans, especially Black Americans are looking forward to the start of the New Year. We also witnessed the death of a civil rights icon, the late Congressman John Lewis. While the country briefly paused to mourn his death, their continues to be an outright assault on the right to vote squarely aimed and targeted at Black Americans and people of color. This year was supposed to be a break-through moment because of the magic and mystique around 2020. Unfortunately, we have experienced a resurgence of police brutality, economic and racial turmoil, and the COVID-19 pandemic. Furthermore, over half of black businesses are projected to close, over two million property owners that have government backed mortgages have requested forbearances, and the black unemployment rate is well over 10 percent. This year’s election is about restoring hope to Americans failed by the health care system, left behind by a broken legal system, and locked out of the economy because of failed leadership, sexism, and racism too. If Howell — a legislative veteran — is asking whether Virginia really needs a state-supported military college, what might some of the newer and more liberal backbenchers think? VMI may not want to know, but it needs to. What if the General Assembly really did decide it didn’t want VMI anymore? Mind you, we’re not advocating that outcome — it’s in the region’s economic interest to have as many colleges as possible — but just because a question is unpleasant doesn’t mean it should be ignored. There are lots of small colleges that shut down every year — at least 64 since 2016, according to Education Dive. Those appear to be private colleges that encountered financial difficulties. We can’t find any recent historical examples of state-supported schools that have closed, although there are some in other states in the past. If the state didn’t want VMI, could it go private? Yes, but … VMI is not an independent entity that can do its own thing. It’s a state asset. If, say, alumni wanted to operate VMI

state even be interested in selling? If no, it’s a moot question — or a philosophical one. Would VMI still be VMI if it were someplace else? We have no way to estimate the value of the property, which is not simply on the National Register of Historic Places but a full-fledged National Historic Landmark District. Even if Virginia gave away the property — don’t count on that — there’s the question of operating expenses. Virginia currently supplies about $19 million a year for operating expenses. Where would that come from? Yes, Sweet Briar College alumnae raised $21 million when they were trying to forestall the school’s closure five years ago— and have since averaged $12.6 million a year. VMI is a bigger school and has more alumni, but it would have to raise enough to replace that state funding each year. True, VMI does have a far bigger endowment than Sweet Briar did. The VMI Foundation shows net assets at nearly $478 million. However, many of those assets are restricted for specific uses. Financial documents show the income last year on the unrestricted assets was $8.9 million. Whatever the math, VMI alumni would have

to raise a lot of money to make their alma mater work as a private school. VMI officials looked at “going private” three decades ago when they were facing legal challenges to being all-male. ThenSuperintendent John Knapp said in 1990 “the chances are not good.” He added: “I’m not saying we couldn’t run our school as a private institution. I’m saying there are two grave reasons: One is the sheer economics, and the other is this amalgam of questions about having historically been a state institution, service to the commonwealth, their property, their investment, their opportunity to be a willing seller.” Has any of that changed? Does Howell’s comment suggest it has? The writer is a former governor of Virginia and current political science professor at VCU. BALLOT QUESTION

PROPOSED CONSTITUTIONAL AMENDMENT Article II. Franchise and Officers. Section 6. Apportionment. Section 6-A. Virginia Redistricting Commission

Should the Constitution of Virginia be amended to establish a redistricting commission, consisting of eight members of the General Assembly and eight citizens of the Commonwealth, that is responsible for drawing the congressional and state legislative districts that will be subsequently voted on, but not changed by, the General Assembly and enacted without the Governor’s involvement and to give the responsibility of drawing districts to the Supreme Court of Virginia if the redistricting commission fails to draw districts or the General Assembly fails to enact districts by certain deadlines? EXPLANATION Current Law Under the current Constitution, the General Assembly and the Governor are responsible for drawing new election districts for the U.S. House of Representatives, the state Senate, and the House of Delegates. These districts are required to be compact and contiguous, and to have populations that are equal to each other. Proposed Law The proposed amendment would shift the responsibility of drawing these election districts from the General Assembly and the Governor to a bipartisan commission, made up of 16 persons, half being members of the General Assembly and half being citizens of the Commonwealth. This commission would draw the election districts for the U.S. House of Representatives, the state Senate, and the House of Delegates and then submit the maps to the General Assembly for approval. If the commissioners are unable to agree on proposals for maps by a certain date, or if the General Assembly does not approve the submitted maps by a certain date, the commission is allotted additional time to draw new districts, but if maps are not then submitted or approved, the Supreme Court of Virginia becomes responsible for drawing these election districts. The eight legislative commissioners are appointed by the political party leadership in the state Senate and the House of Delegates, with an equal number from each house and from each major political party. The eight citizen commissioners are picked by a committee of five retired circuit court judges. Four of the retired judges are selected by party leaders in the Senate and the House from a list compiled by the Chief Justice of the Supreme Court of Virginia. These four judges pick the fifth judge from the same list. This selection committee then chooses citizen commissioners from lists created by party leaders in the Senate and the House. Members and employees of Congress or the General Assembly cannot be citizen commissioners. Each party leader in each house gives the selection committee a list of at least 16 candidates, and the committee picks two from each list for a total of eight citizen commissioners. For a plan to be submitted for the General Assembly’s approval, at least six of the eight citizen commissioners and at least six of the eight legislative commissioners must agree to it. Additionally, for plans for General Assembly districts to be submitted, at least three of the four Senators on the commission have to agree to the Senate districts plan and at least three of the four Delegates on the commission have to agree to the House of Delegates districts plan. The General Assembly cannot make any changes to these plans, and the Governor cannot veto any plan approved by the General Assembly. The amendment also adds a requirement that districts provide, where practicable, opportunities for racial and ethnic communities to elect candidates of their choice. A “yes” vote will make a bipartisan commission responsible for the initial drawing of election districts. A “no” vote will leave the sole responsibility for drawing the districts with the General Assembly and the Governor. FULL TEXT OF AMENDMENT [Proposed new language is underlined. Deleted old language is stricken.] Amend Section 6 of Article II of the Constitution of Virginia and amend the Constitution of Virginia by adding in Article II a section numbered 6-A as follows: ARTICLE II FRANCHISE AND OFFICERS Section 6. Apportionment. Members of the House of Representatives of the United States and members of the Senate and of the House of Delegates of the General Assembly shall be elected from electoral districts established by the General Assembly pursuant to Section 6-A of this Constitution. Every electoral district shall be composed of contiguous and compact territory and shall be so constituted as to give, as nearly as is practicable, representation in proportion to the population of the district. Every electoral district shall be drawn in accordance with the requirements of federal and state laws that address racial and ethnic fairness, including the Equal Protection Clause of the Fourteenth Amendment to the Constitution of the United States and provisions of the Voting Rights Act of 1965, as amended, and judicial decisions interpreting such laws. Districts shall provide, where practicable, opportunities for racial and ethnic communities to elect candidates of their choice. The General Assembly shall reapportion the Commonwealth shall be reapportioned into electoral districts in accordance with this section and Section 6-A in the year 2011 2021 and every ten years thereafter. Any such decennial reapportionment law shall take effect immediately and not be subject to the limitations contained in Article IV, Section 13, of this Constitution. The districts delineated in the decennial reapportionment law shall be implemented for the November general election for the United States House of Representatives, Senate, or House of Delegates, respectively, that is held immediately prior to the expiration of the term being served in the year that the reapportionment law is required to be enacted. A member in office at the time that a decennial redistricting law is enacted shall complete his term of office and shall continue to represent the district from which he was elected for the duration of such term of office so long as he does not move his residence from the district from which he was elected. Any vacancy occurring during such term shall be filled from the same district that elected the member whose vacancy is being filled. Section 6-A. Virginia Redistricting Commission. (a) In the year 2020 and every ten years thereafter, the Virginia Redistricting Commission (the Commission) shall be convened for the purpose of establishing districts for the United States House of Representatives and for the Senate and the House of Delegates of the General Assembly pursuant to Article II, Section 6 of this Constitution. (b) The Commission shall consist of sixteen commissioners who shall be selected in accordance with the provisions of this subsection. (1) Eight commissioners shall be legislative members, four of whom shall be members of the Senate of Virginia and four of whom shall be members of the House of Delegates. These commissioners shall be appointed no later than December 1 of the year ending in zero and shall continue to serve until their successors are appointed. (A) Two commissioners shall represent the political party having the highest number of members in the Senate of Virginia and shall be appointed by the President pro tempore of the Senate of Virginia. (B) Two commissioners shall represent the political party having the next highest number of members in the Senate of Virginia and shall be appointed by the leader of that political party. (C) Two commissioners shall represent the political party having the highest number of members in the House of Delegates and shall be appointed by the Speaker of the House of Delegates. (D) Two commissioners shall represent the political party having the next highest number of members in the House of Delegates and shall be appointed by the leader of that political party. (2) Eight commissioners shall be citizen members who shall be selected in accordance with the provisions of this subdivision and in the manner determined by the General Assembly by general law. (A) There shall be a Redistricting Commission Selection Committee (the Committee) consisting of five retired judges of the circuit courts of Virginia. By November 15 of the year ending in zero, the Chief Justice of the Supreme Court of Virginia shall certify to the Speaker of the House of Delegates, the leader in the House of Delegates of the political party having the next highest number of members in the House of Delegates, the President pro tempore of the Senate of Virginia, and the leader in the Senate of Virginia of the political party having the next highest number of members in the Senate a list of retired judges of the circuit courts of Virginia who are willing to serve on the Committee, and these members shall each select a judge from the list. The four judges selected to serve on the Committee shall select, by a majority vote, a judge from the list prescribed herein to serve as the fifth member of the Committee and to serve as the chairman of the Committee. (B) By January 1 of the year ending in one, the Speaker of the House of Delegates, the leader in the House of Delegates of the political party having the next highest number of members in the House of Delegates, the President pro tempore of the Senate of Virginia, and the leader in the Senate of the political party having the next highest number of members in the Senate shall each submit to the Committee a list of at least sixteen citizen candidates for service on the Commission. Such citizen candidates shall meet the criteria established by the General Assembly by general law. The Committee shall select, by a majority vote, two citizen members from each list submitted. No member or employee of the Congress of the United States or of the General Assembly shall be eligible to serve as a citizen member. (c) By February 1 of the year ending in one, the Commission shall hold a public meeting at which it shall select a chairman from its membership. The chairman shall be a citizen member and shall be responsible for coordinating the work of the Commission. (d) The Commission shall submit to the General Assembly plans for districts for the Senate and the House of Delegates of the General Assembly no later than 45 days following the receipt of census data and shall submit to the General Assembly plans for districts for the United States House of Representatives no later than 60 days following the receipt of census data or by the first day of July of that year, whichever occurs later. (1) To be submitted as a proposed plan for districts for members of the United States House of Representatives, a plan shall receive affirmative votes of at least six of the eight legislative members and six of the eight citizen members. (2) To be submitted as a proposed plan for districts for members of the Senate, a plan shall receive affirmative votes of at least six of the eight legislative members, including at least three of the four legislative members who are members of the Senate, and at least six of the eight citizen members. (3) To be submitted as a proposed plan for districts for members of the House of Delegates, a plan shall receive affirmative votes of at least six of the eight legislative members, including at least three of the four legislative members who are members of the House of Delegates, and at least six of the eight citizen members. (e) Plans for districts for the Senate and the House of Delegates shall be embodied in and voted on as a single bill. The vote on any bill embodying a plan for districts shall be taken in accordance with the provisions of Article IV, Section 11 of this Constitution, except that no amendments shall be permitted. Such bills shall not be subject to the provisions contained in Article V, Section 6 of this Constitution. (f) Within fifteen days of receipt of a plan for districts, the General Assembly shall take a vote on the bill embodying that plan in accordance with the provisions of subsection (e). If the General Assembly fails to adopt such bill by this deadline, the Commission shall submit a new plan for districts to the General Assembly within fourteen days of the General Assembly’s failure to adopt the bill. The General Assembly shall take a vote on the bill embodying such plan within seven days of receipt of the plan. If the General Assembly fails to adopt such bill by this deadline, the districts shall be established by the Supreme Court of Virginia. (g) If the Commission fails to submit a plan for districts by the deadline set forth in subsection (d), the Commission shall have fourteen days following its initial failure to submit a plan to the General Assembly. If the Commission fails to submit a plan for districts to the General Assembly by this deadline, the districts shall be established by the Supreme Court of Virginia. If the Commission submits a plan for districts within fourteen days following its initial failure to submit a plan, the General Assembly shall take a vote on the bill embodying such plan within seven days of its receipt. If the General Assembly fails to adopt such bill by this deadline, the districts shall be established by the Supreme Court of Virginia. (h) All meetings of the Commission shall be open to the public. Prior to proposing any redistricting plans and prior to voting on redistricting plans, the Commission shall hold at least three public hearings in different parts of the Commonwealth to receive and consider comments from the public. (i) All records and documents of the Commission, or any individual or group performing delegated functions of or advising the Commission, related to the Commission’s work, including internal communications and communications from outside parties, shall be considered public information.

Va. got just one bidder for a $100m+ radio project VM - Motorola was the only company interested in bidding on an expensive project to update Virginia’s statewide public safety radio system, an outcome that led a competitor to complain the process was one-sided and drew scrutiny from a top lawmaker. The Statewide Agencies Radio System, or STARS, began with a $329 million contract between the state and Motorola in 2004, with the goal of establishing a 24/7, digital voice and data communications system used by nearly two dozen state agencies. Much of that equipment is now aging out, and the General Assembly has already allocated up to $120 million in bond proceeds to

pay for replacements and upgrades. Another $40 million is expected to be allocated before the project’s estimated completion in the summer of 2023. When Virginia State Police procurement officials issued a request for proposals for new radio equipment this summer and convened a mandatory pre-bid meeting for companies interested in the project, only Motorola and its partners showed up, according to state procurement records. L3Harris Technologies, a Motorola competitor with an office in Lynchburg, says there’s a reason they took a pass: They felt the project specifications were written in a way that locked in Motorola as

the winner. “I wish to be very clear that L3Harris is extremely disappointed that the commonwealth apparently did not make every effort to ensure that the STARS procurement would be fully competitive,” Nino A. DiCosmo, the president of L3Harris’s Public Safety and Professional Communications Division, wrote in an Aug. 4 letter to Gov. Ralph Northam and other state leaders. “We do not believe that this active procurement is in the taxpayers’ best interests.” Harris insists the highly technical RFP includes several requirements that only Motorola can meet, mostly dealing with the new equipment having to be interoperable with an

existing Motorola system. The State Police have disputed that claim, suggesting L3Harris’s technology could conceivably work if the company had made a stronger effort to win the contract. In response to L3Harris’s concerns, State Police Superintendent Col. Gary Settle wrote a letter saying the process had been “open, fair and competitive.” “VSP in no way manipulated the process by creating overly narrow requirements,” Settle wrote. L3Harris has pointed specifically to repeaters, the radio equipment installed in troopers’ vehicles that connects their in-car and portable radios to the wireless network.

We knew we had to do something, and this was something we could do using our combined skills.” Barry says that his wife, Lauren, is the person who creates the graphics that they project on the house. “My wife is a really talented graphics artist,” Barry said. “I do the messages, and she makes them look amazing.” The projections are not the Barrys’ first political display, however. Earlier in the year, the couple became caught in a battle with the county over a sign in their yard. Tim and Lauren erected three large yellow letters in their yard after the killing of George Floyd in May. The letters — which spelled out “BLM” — have been a source of conflict between the Barrys and Chesterfield county officials. A zoning ordinance in the county prohibits residential signs from occupying over 14 square feet of space.Most of their neighbors, however, have been supportive. The Barrys received a note from one local resident that read, “Goodness… Can I tell you how much this BLM sign means to me?” The note described the lettering as a “huge sign of hope.” “Our feedback has been 95 percent positive,” said Barry. Another neighbor, speaking to Channel 8 News in Chesterfield, said she was surprised that the sign was so “in-yourface,” and said she wished that it said ALM — all lives matter. The letters are still securely fastened to Barry’s trees, and he has no intention of taking them down. The process to appeal the county’s decision may take several months, Barry said. Unlike the BLM letters in the yard, there are no county ordinances against the projector images. The Barrys start the projector at sundown, and take the image down before they go to bed around 10:30 P.M. Unless it’s raining, they project images every night. Tim Barry said that he is afraid of drawing too much attention to the house, in fear that someone who doesn’t like their message will retaliate. “I don’t want to go in and make it contentious,” Barry said. “We are
