Hello everybody and welcome to the January issue of Fast Lane Biker. This issue is a year in review loaded with photos of the best of the events of 2106. It’s been a crazy year nothing about 2106 has been typical. We experienced the wildest Presidential campaign and election this year. I’m not sure if any future election will be able to top that one. We will now have a Vice President who rides a Harley. I don’t think that has ever happened before. The next time I type this letter it will be one month until Daytona bike week. Winter isn’t over yet, so lets just hope it goes fast and we get a early spring.

WHO CARES COMMITTEE

30th ANNUAL ST. CHRIS TOY RUN December 13, 2015 • HICKSVILLE, ny The motorcycle riders started arriving around 930am at the Sears parking lot for a kickstands up time at noon The WHO CARES COMMITTEE volunteers helped to register and collect from each rider a new unwrapped toy for the children of ST Christopher Residential Treatment Center in Glen Cove, NY. The weather was unbelievable for this time of year - in recent years the weather was that of sub freezing temperatures, high winds, and a mixture of rain and snow. The recording breaking temperature of 68 degrees and sunny skies on Sunday brought out over 400 riders – well done BILLY! Santa and his elves were on hand giving a warm welcome and a candy cane to the assembled riders that came out to support this great annual event. The volunteers packed a full sized pickup truck with the collected toys – more than I recall in recent years. The Nassau County Police Department responded to the huge turnout by providing more than enough equipment and personnel to safely escort the riders to the destination. The start of the run took the riders out of the massive parking lot and onto public streets and as they joined other riders in the procession it seemed as though the line of riders would go on forever. I attempted to take a photo of each of the riders as they passed in review – check the photos to see if I was able to catch your ride. Archie from KIckstart Towing provided support should any of the riders break down on the journey. He told me later that it was a safe run and that no one had broken down. The WHO CARES COMMITTEE arranged for the after party at the VFW Post 3021 not far from the starting point. The riders were treated to a massive hot buffet of a turkey dinner and all the trimmings with beverages, coffee and dessert. There were drawings for a 50/50, raffles, and door prizes. Live entertainment was provided by a great band I had not heard before The Basement Boys, they were great. One of the riders even volunteered to sing a tune or two with the band, she did a great job. It was a bit of a surprise after all for me – of all the live entertainment shoots I’ve done I can’t recall a band with 2 drummers and drum sets as part of the kit. Catch them if they are in your area - they were great. Thanks to the WHO CARES COMMITTEE and all of the folks that contributed to make this event successful they really put the meaning of the season and support for the children above their own wants and needs. Thanks also go out to the riders for taking the time out of their day to provide a little cheer for the children of St Christopher’s. See you next year!!

AMC Neshaminy Valley Chapter

Antique Motorcycle Show

story ridin’ & pics by Lutz

june 6 2015 • langhorne, Pennsylvania

What a great journey I took over to Pennsylvania, to go check out what has to be one of the few real genuine ride in antique bike show hosted by the Neshaminy Valley Chapter of the Antique Motorcycle Club of America which is held in the parking lot of Brian’s Harley Davidson. I’ve heard good things about this one for a while and definitely was not disappointed. These are not trailer queens your gonna find over here, I would have to say they all look like what was on display get rode quite often and why shouldn’t they? It’s a motorcycle! American to metric, mostly stock with some custom mixed in… there was some way cool iron to checkout! Chrome to “well lubricated” motorcycles mixed the parking lot with plenty of eye-candy for the camera..i love this old stuff, especially when the owners have so much pride in restoring and maintaining the rides many back to the way they came off the dealership floor. Don’t forget the show was held at Brians Harley Davidson dealership and you could go inside and maybe checkout all the new stuff Harley has to offer and with a great staff more than willing to show you around! ...a little new with the old! Going back outside again, there was many a trophy to be hand out and many a smiling face as their bike was picked as the winner in their class! A special note going out to a special trophy handed out this year in honor of Joe “mouse” Rakowski a member of the club and personal friend of mine for years who recently passed on, that was truly a special moment when that was awarded, RIP my brother. With that being said the show looked to be very successful and well see what comes out next year! Fast Lane Biker

hill

climb & bike show 2015

story ridin’ and pics by Lutz

september 13, 2015 • bethlehem, pennsylvania

Every year for the last few years I so look forward to this event. The ride from Jersey to Bethlehem, Pennsylvania is a treat in itself, but even as the ride is very enjoyable, more fun awaits at the end. For many, many years Bushkill Motorcycle Club promotes the AMA pro hill climb much to the delight of many bikers that enjoy the uphill battle that has many motorcycles racing, all hoping to make it to the top for the win. Getting to the hill climb location is mobbed heavily with lots of bikes, all crowding down a 2 lane back road that seems like it takes forever to get to. Once at the end of the road, it never seems to amaze me how such a piece of land can hold so many bikes, and seeing the bikes blasting up the side of a mountain is always breathtaking! Once parked it’s time to go checkout the vendors, maybe get a bite to eat or grab something to drink. Hannums Harley Davidson has a stand set up showing some cool bikes and selling shirts. Of course where are here to see the hill climbs but there’s a lot more other things to do. Like I said the property is loaded with bikes of all types, again making my camera very happy! The bike show also has without a doubt a lot of eye candy in it too, metric and American, all different, all competing for that trophy! The racing continues through the day and the sea of people watching lets you know this is a popular run. So, if you really want to see motorcycles seemingly do the impossible... racing up a steep hill... this is the place... take a ride next year and check it out, you wont be disappointed! 15th Annual MTA Swap Meet & Military Vehicle Show by Momma Iz & Pit

Well, we set our clocks to Spring forward and I’m not sure how forward we were supposed to spring but im calling it too far. I haven’t complained all winter but finally a beautiful day and we just happen to have a Military Swap Meet and Vehicle Show sponsored by the Military Transport Association right here in our backyard at the Sussex County Fairgrounds. Lots of bike’s and biker’s in the parking lot, cause as we all know many biker’s are veteran’s. The vendor tents were endless, selling everything from survival food to camo hats. There were military vehicle’s to climb on, sit in, and explore. You were also allowed take photos next to the tanks, which were the coolest in my opinion. The Association setup museum type reenactments of what our soldier’s would live in, eat in, hide behind, and even pray in. I couldn’t help but feel, wow, what a special breed the men and women of our Armed Forces are that when called upon will protect the citizens of our great country. Support our active duty troop’s and veteran’s whenever possible, thank them for there service with a handshake and a smile and let them know you stand behind them 110%. Several of the clubs participated in a military truck pull, not sure of the winner’s but fun was had by all and the children enjoyed it. Plenty of good chow in the food court as evidenced by all the smile’s. It’s starting to feel like Spring is finally here to stay and hopefully the next forecast that calls for ice and salt is a margarita recipe. Safe riding, and remember “Which lane are you in”. Hawg ridin fools m/c clam bake 2015

story ridin’ and pics by Lutz

july 18, 2015 • south jersey

One of the advantages of living in New Jersey is we have a great selection of seafood, living so close to the Atlantic ocean and a plus also is that south Jersey offers thousand of acres of pine lands with miles of open road riding running through it. One of my fav “ride to eat” events is put on by a great bunch of guys from south Jersey called the Hawg Ridin’ Fools M/C, who as I mentioned above, love riding those backroads and throwing great parties, and cooking up some great seafood like at their yearly much anticipated clam bake. The Hawg ridin’ fools pull out all the stops to cook up the best food that one can get at a bike run... burgers, dogs, salads, chicken, beans, but tons of clams are what is at the top of the menu at this one! Raw, half shell, steamed, tabasco or butter, your choice and plenty of them! In the past, since this is a July party its been hotter than hell but this year was perfect. That was noticeable by many clubs, friends and family, young and old coming out to get there share of good times. The property was packed with many a bike and a little tough to find a seat at the picnic table. It was the kinda day that many ate and stood around and talked with many a friend, good vibes at this party. As it got later on in the day and the clam shells piled up and many a belly full you looked around and saw many a smile on the Hawg Ridin’ fools members knowing their hard work paid off with another clam bake well done!

Benjamin moore memorial scholarship/poker run story ridin’ and pics by Lutz

August 16th, 2015 • fieldsboro, new jersey

I can’t imagine nothing can hurt as much as the loss of a child and especially one lost to the casualties of war. The Moore family has endured just that with the loss of their son Army SPC Benjamin Moore. So I’m honored in helping to keep his name alive with Rolling Thunder Chapter 2 NJ and many of his friends and family (which many are veterans too!). Yearly, the Rolling Thunder Chapter 2 NJ hosts a poker run in honor of his memory. The proceeds benefit graduating firefighters, EMTs and BRHs seniors... hows that for giving back to the community? Last years poker run was held at the Cool Cricket in Fieldsboro, New Jersey, a popular bar that also caters to a motorcycle crowd. Rolling in on my bike it looked like it was going to be another good one! Many bikes, vendors and people were out to show support, even some friends and family from Canada came down..now that’s a ride! The smell of food was inviting while across the street some of Benjamin’s friends brought out several custom cars and trucks for display. Under the overhead a word of silence was had as well as words from the Moore family thanking all that came out. As motorcycles came and went that day it was nice again to know that when there was an event that needed support bikers are always there to lend a hand! JANUARY, 2017

Reading motorcycle club 101st anniversary party story ridin’ and pics by Lutz

July 2015 • oley, new jersey

What can be said about Reading Motorcycles Clubs Anniversary parties that hasn’t and isn’t know by those that have been to one... simply one of top shelf bike parties out there! Oh you say you have never been too it?! Well, that being the case let me fill you in... Reading Motorcycle Clubs Anniversary party is in its 101st year and if a party sucked you know they wouldn’t keep going that many years. As mentioned earlier, this one is a bucket list gig to check out! Got to love a party that has a pre party the weekend before... which is the rope off party. A popular party like this has many coming out to claim there camping spot and if you snooze you loose! At the stroke of midnight 100s scramble to get that hot property to get ready for the real deal the following weekend. The party runs from thursday to saturday night and with many things to keep one occupied while there! One price at the door gets you camping and a bottomless mug for the weekend. For the early birds Thursday night is a real treat with the frozen t-shirt contest, you gotta see it to believe it! Then it even gets better with Tug of War, Sky Divers, Helicopter Rides, Dunk Tank, Burn Out Pit, Shit House Bike Drags, Bike Show, Tattoo Show, Hammer Game, Field Meet, Parts, Food, Vendors and Saturday night’s Beauty Pageant certainly packs them in. Live music rocks the house during the event with local and regional bands Le Compt, the Razorbacks, Snappa Head and many more. If you happen to get bored (NOT!) there are plenty of things to checkout with a nice ride on the scoot… The pagoda is a favorite and worth the ride… don’t forget to stop in and say hey and get some breakfast and a shower down the street at “the tent” at the New Life Bible Church… its a tradition! Sadly all good things come to an end all and the party ends on Sunday morning with just enough time to get you home and ready for Monday. Are you interested yet?!! Fast Lane Biker

2016 Lanz’s North Country Thousand Island’s Biker Weekend by Momma Iz & Pit It was that time of the year again and the Pit Stop crew made it’s annual trek North to Lanz’s 10th Annual North Country Thousand Island’s Biker Weekend on June 10-12th. The Pit Stop crew has ranked this weekend high up on it’s list as one of the best biker weekend’s any righteous biker could attend. Great riding, great people, great food, and plenty of places to visit, what more can an on the road biker ask for. Usually, when we’re on the road the crew talks about our adventure’s and place’s we’ve been but this year we thought about this. Did ya’ ever go on a biker vacation and think any of these things? Wow, I’m in the best hotel and I can’t get a soda after 9. Wow, im 500 miles from home and im eating in a fast food restaurant. Or wow, I’m broke but this feel’s like every other vacation spot and could be called anywhere USA. Our trip started by leaving our home state of New Jersey and heading North for the beautiful Thousand Island’s Region of New York State. Our destination, Lanz’s Motel and RV Campground located in Clayton, NY for it’s annual North Country Thousand Island’s Biker Weekend. Lanz’s perfect location on the St. Lawrence River is just a stone’s throw from the Canadian border. The Lanzione family own’s and operate’s this motel that includes motel room’s, camping, cottages, a beach, and a pool. Every year John and Trudy welcome biker’s from all over the region to their biker weekend in it’s 10th year. This weekend is packed full of fun and adventure. Riding, bands, food, bonfires, booze cruise, they even provide limo “booze run” ride’s to town, what more can one ask for. And let’s not forget about meeting up with friends and old acquaintances from year’s past. This year we were able to get a morning start and arrived at Lanz’s early on Friday. After unpacking and meeting with John we walked down to the river. There is alway’s something new at Lanz’s and this year we were greeted by none other than the infamous Chuckie, the doll from everyone’s worst nightmare. Every year a sculpture of a motorcycle is donated for the party and this year it was donated by a an ol’ school biker named JoJo. He did a great job with this piece as evidenced by all the photo’s taken. All we can say is everybody loved Chuckie on a bike. After our visit with Chuckie it was off to downtown Clayton for lunch and a walk around town. One of our favorite restaurant’s is The Johnston House. Outdoor seating, a Koi pond, and great staff, were always more than happy to stop in and have one their specialties called Lobster Shot’s. Basically a flight with four shot glasses filled with fried Lobster and four different sauce’s. Darn, another one of our hotspots given away, Lol. After a brief stop in what we consider one of the best homemade cheese spot’s around called The River Rat Cheese store we noticed a little commotion down by the river. The town of Clayton is alway’s full of surprise’s and this year we weren’t let down. After turning the corner to the river we saw a dog flying through the air into a giant pool. The Ultimate Air Dog’s were in town doing what they do best, flying through the air. With a running start and a leap towards the pool where a bone hangs high in the air, these well trained dog’s will soar through the air as far as 25 feet. Definitely a sight to see. As Friday night quickly approached we headed back down to the beach for some hamburger’s. While eating, we noticed the band “Ripchord” was setting up for the night. We met George, the bassist from last year and we talked for a bit. His band does so some pretty good 90’s cover song’s and kept us rockin’ all night. The bonfire was lit, the band was rockin’, and we hung out late into the moonlit nite. On Saturday, there is an annual bike run around the Thousand Island’s area. The run makes stop’s at all the hotspots around the Clayton and A-Bay area. This year’s run was in memory of SpongeBob who led the run for the past nine year’s, but sadly past last summer. When the bikers returned they were greeted with pulled pork for dinner and another local band called Minus Mike. Little did the Lanzione’s realize the biker’s had a little surprise for them. The band was stopped and Kurt presented John and Trudy a plaque in recognition of ten years of memories from their friends at biker’s weekend. Another bonfire was started and the party rocked again into the night. On Sunday when most people would be packing up to leave, not so at Lanz’s. It’s down to the beach to board the best pontoon boat cruise around where Bloody Mary’s are served to cure your hangover. After cruising for about an hour, the boat docks in A-Bay and lunch and drinks are served at The Pointe Bar and Grill. After that everyone is feeling good and it’s a boat ride back to Lanz’s for a clambake. While getting toasted on the pontoon ride back we rocked the boat to the Cupid Shuffle, laughed, and just had fun. When we docked, we saw something few people should ever have to see, sorry guy’s, lol. Kurt and Justin, two regular’s at Lanz’s stripped down to their underwear and jumped off the dock into the frigid water. Another great boat cruise on the books. Back on land, it was time for the clambake. As John’s staff served up clam’s, Lanz’s children tattooed guests (with markers) for a 2 dollar donation to St. Joseph’s. As we ate we remembered a couple we met last year, Meg and Eric, that made a killer drink for us. We waited a whole year to find out the ingredient’s. We were told they were expecting there first child any day and couldn’t attend this year. The Pit Stop crew wishes them the best and hope to see them in the future. So now its Monday, everyone is gone and we are packing up to head out. It’s peaceful, its a place I would come back too. It’s a place I would bring my children too. It’s a place where when you go into town, each store and each restaurant is privately owned and operated. You’ll have a great breakfast at the Koffee Kove, a great lunch or dinner at the Johnston House, and you may even run into a dog show like we did. You wont go broke and you wont feel like wow i could of had this at home because you cant, its not anywhere USA, its Clayton, USA.

2016 Rock, Rib’s, & Ridge’s Festival Sussex County Fairgrounds Do you hear it? Do you smell it? Do you feel the bright sun and cool breeze’s on top of the hill’s of an area known for some of the best motorcycle riding in NJ. Well welcome, to the 2016 Rock, Rib’s, & Ridge’s Festival at the beautiful Sussex County Fairgrounds in Augusta, Nj. The Pit Crew has once again found our reader’s a great place to ride to and hangout with some good music, good food, and just have a good ol’ time. The Pit Crew found themselves at the Sussex County Fairgrounds, an area surrounded by natures ridge’s, a rock stage, a midway of rib vendors, camping, vip tent’s and mixed drink’s such as Barenjager Honey Liqueur. What were we up too, you ask? We were about to get down with the Rock, Rib’s, & Ridges Festival, a two day event held in late June. We started by checking out all the festival had to offer and after walking around for a bit we found Howard Freeman, founder and managing general partner of the Rock, Rib’s, & Ridges Festival. Howard was kind of enough to spare a few minutes in his busy day for an interview to explain how he puts on this festival as well as speak about his Quick Chek Festival of Balloons in Readington,NJ. While in Rochester, NY seven years ago he had met a man who ran a rib festival. Having a little down time from the balloon festival that takes place in late July, and thinking of another event to fill in his down time, the idea for Rock and Rib’s was born. Originally held in Vernon, NJ at the Hidden Valley Resort it grew to such numbers it was forced to relocate to the larger venue at the Sussex County Fairgrounds. The festival just celebrated its 7th year and get’s larger by the year. Pitmaster’s come from all over the country and do what they do best and also to win in different contest’s where trophies and prize money are won. After our chat with Mr. Freeman, we had the pleasure to meet Allie, the youngest female Pitmaster in the US and owner of Butch’s Smack Your Lip’s BBQ. Darn good BBQ. We walked around and watched people pour in with their chairs and shade tents. They set up to watch the long list of bands such as the Outlaw’s, Jefferson Starship, Blues Traveler, Kansas, Artimus Pyle, and more, what a line up huh? Now speaking as one half of the Pit crew, i don’t normally do these kinds of events. It’s usually a hundred degrees and torture to me, so let me explain what makes it so different and worth the trip. One, you can camp there which is always a treat, water cooling stations were provided, the vip tent had table service, free water and ice coolers in every corner. The vendors supplied ribs, water, soda, and ice cream. There was shade, there was grass, and yes it was hot but it was not torture. It was a well planned and an enjoyable 2 days. The parking was organized and Rider Insurance sponsored an area just for motorcycles. Our hat’s off to all the staff that endured the heat all day to provide exceptional guest services. We also met a crew from a new radio station out of Nashville, who were running around doing interviews with the bands for Indie Rock 101, the Southern Voice, very cool people live streaming music to you. I’m sure we’ll see them at the Quick Chek Festival of Balloons on July 29-31, 2016. Just remember it goes on every year around the same time. Fast Lane Biker, which lane are you in?

The Gathering of the Tribes 2015 story ridin’ and pics by Lutz

august 8 2015 • columbus, new jersey

Bikers are made up by all kinds of people. All share the love of riding their motorcycles, some like oriented events, some like breakfast runs and some love an old fashion “party all night” event. Personally, I like them all and I do greatly enjoy the “Gathering of the Tribes” which consists of lots of great people that ride and their common bond is religion. Once a year christian faith motorcycle clubs, freinds and family all get together to meet and put together the “Gathering of the “Tribes, which brings awareness about “Bikers Against Drug & Alcohol Abuse”. Funds raised from the event benefit the “Americas Keswick” in Whiting, NJ. This year it was held at a new location at the Burlington county fairgrounds . There were a variety of food trucks, vendors, a live band provided music, a cool bike show and much more. Many came out to support this event, so heres to good things at the new locations and god bless!

The 35th Annual ABATE Toy Run For the Kids story ridin’ and pics by Lutz

november 1, 2015 • philadelphia pennsylvania

Yup, its mid July and its f#uckin hot!!! So what else would be almost as nice as a cool bike ride? How about some pics from cooler times... Every year, this is the big one that is highly anticipated by many, the annual Delaware county ABATE Toy Run For the Kids! In its 35th year, thousands of bikers attend and bring toys that are collected by the United States Marine Corps to help many local Philadelphia children have a merrier holiday. Tons of bikes line up on Columbus Avenue with many restaurants, vendors and local favorite radio station WMMR all come out to participate. At noon a seemingly endless procession of motorcycles all take a ride through Philadelphia and end up at the “Electric Factory” where toys are collected and music is provided by the band “Live At The Fillmore”. Recognition was given to those who organized this event and rightfully so. As motorcycles came and went throughout the day, its nice to know that bikers still do the right thing!

Top fuel, street, modified, all out to win the race and if you like motorcycle racing this is the place! As bike after bike went down the track many in the stands rooted for their favorite ones. In between races you could take a walk and check out the vendors, get something to drink (especially on a day like it was on this hot day!!) After a cold one, you could checkout the swap meet which was loaded with tons of goodies from bike parts from motorcycle related items like jewelry, clothing and leather goods .The band Moroccan Sheepherders belted out live music for those to hear. Iron Cycles had their booth setup displaying their services and featuring “Dynacycle Engine Oil” which is what we hear to be “the” oil for the race and street bikes. Dave Perewitz, master bike builder had his trailer displaying a few of his creations. And local hometown New Jersey “Strip Club Choppers” had their trailer and scooters AND several ladies dressed for the occasion. This isn’t a yearly event so when it comes around be sure not to miss it!

28th annual Jam on motorcycle national swap meet November 15 2015 • PA farm show complex • Harrisburg pA

story ridin’ and pics by Lutz

This swap meet that’s put on by Jam-On Productions is easily becoming my “go to” swap meet! Well worth the ride, because it’s got what your looking for and if you can’t find it there, well I guess they just don’t make it!! As soon as you walk in the Pennsylvania Farm Show Complex it’s very difficult to figure which way to go… too much bike stuff as far as the eye can see. Tins, motors, transmissions, etc… without a doubt you can build a custom or stock Harley Davidson motorcycle, as long as you brought your wallet! Don’t wanna piece one together?! Well thats ok because there are some ready for the road available there too! Plenty for the ladies too see and shop too, that’s if their not attracted to the parts and motorcycles as well. Motorcycle related goodies like clothing, jewelry, helmets, etc… sure too keep all happy. What’s impressive everything is under one roof, and so close to the holidays! Additionally one of the favorite things that this swap meet has as near the end of the meet, there is an auction on various parts and you can get some really great parts if your bid gets it. So break out of the winter blues, take a ride and see for yourself its one of the best out there!

2016 Catskill By PIT & MOMMA IZ

Mountain Thunder I t was that time of year again when motorcycle’s roar across the Rip Van Winkle

Bridge and Rip wakes up from his long sleep. Catskill Mountain Thunder 2016 at Blackthorne Resort. Never been there? Well maybe you should check it out. For us its a regular Pit Stop, so first let’s set the scene.

The property is huge with rolling hills, trees, & ponds. There are camper’s, tent’s, hotel room’s, suite’s, a pool, a bar and restaurant/ dining area. How many campsite’s have a real bar and dining room, not a pavilion,( although they have that too) but a bar, a bar where motorcycle’s are welcome to ride through. Yep, in the front doors and out the back doors where there is always a great band on stage, comedy show’s, and of course the biker build off. CMT actually starts every year on Wednesday with a pub crawl. So here we are, back again to see friend’s we haven’t seen, to see vendor’s we know have things we need to replace or just have hard to find thing’s like Jerky Hut’s Whiskey BBQ Beef Jerky. You can get a tattoo, a massage, and patch’s sewn on by the Slipper Lady. The Wall of Death is always a big crowd attracter. Rhett rotten is a 38 year old man who seems to have an old soul. He built an old school kick start Indian and use’s it to thrill the audience as he rides the Wall of Death from top to bottom. He explain’s how every piece of wood is reclaimed and is dear to him, and he smile’s the entire ride and connects with everyone. We have Christian bikers, like the Melchizedeks MC, who are very dear to our heart’s, and are alway’s available for prayer and they always have coffee. This year they performed a wedding at Blackthorne, and an exorcism on me, just kidding but after all I’ve been through with this crazy neighbor i have, I was wound up pretty tight and CMT was just what the doctor ordered. You become family at Blackthorne, you unplug and recharge at the same time. Oh I can pick out the newbies, they’re the one’s alway’s complaining about something. It’s a bike event people, bring what you need and party down, chill by the fire, watch the fire works, bring a pair of sneakers because biker boot’s are not made for all the walking there, trust me. We camped with the Boozefighters Mc, and it’s always a trip to camp with them, and Pit never skip’s a beat on making our tent comfortable. CMT is a love your neighbor kinda thing, I personally could live there. I mean who couldn’t live on a compound with like minded people, its coming home to reality thats the challenge. Congratulation’s to CS Custom’s for winning the biker build, and thank you to Dale and Roy for giving upstate NY one hell of an annual event. Love and friendship, Momma Iz. JANUARY, 2017

KNOW THE LAW BY ATTORNEY STEVE STAMBAUGH

L

BACs have a minimum sentence of 5 days imprisonment which the Court can extend for up to 6 months plus a one year license suspension followed by a full year of an ignition interlock after your license is restored; Tier 2 BACs have a minimum sentence of 30 days imprisonment which the Court can extend for up to 6 months plus a one year license suspension followed by a full year of an ignition interlock after your license is restored; Tier 3 BACs have a minimum sentence of 90 days imprisonment which the Court can extend for up to 5 years plus 18 months license suspension followed by a full year of an ignition interlock after your license is restored. For third (3rd) time offenders, the following penalties apply: Tier 1 BACs have a minimum sentence of 10 days imprisonment which the Court can extend for up to 2 years plus a one year license suspension followed by a full year of an ignition interlock after your license is restored; Tier 2 BACs have a minimum sentence of 90 days imprisonment which the Court can extend for up to 5 years plus 18 months license suspension followed by a full year of an ignition interlock after your license is restored; Tier 3 BACs have a minimum sentence of 1 year imprisonment which the Court can extend for up to 5 years plus 18 months license suspension followed by a full year of an ignition interlock after your license is restored. As you can see from the foregoing, the penalties escalate quickly as your BAC increases. I have not touched upon the fines but let me assure you that they are substantial in addition to which, when you do get your license back, your insurance rates will have gone through the roof. Also, the maximum period of incarceration is also the period of time that you will be on probation, which means that if you violate the law while on probation, you will have the new offense to deal with as well as the probation violation. As you can see, the more you repeat offend, the harder the law will hit you in terms of mandatory minimum license suspensions and mandatory minimum periods of imprisonment. Other important factors are whether you caused an accident, whether anyone was injured, whether minor children were present in your vehicle, and many others. Suffice it to say that Pennsylvania’s DUI law is designed to hit hard and there are many factors that the District Attorney can use to escalate your charges and thus your penalties. Bottom line, plan ahead so you have a designated driver ready to go. Last and again, as always, if you haven’t joined ABATE, do so. They are the Biker’s Voice in Harrisburg.

ast month I promised to review the ARD Program and the mandatory minimum sentences in this month’s article as we head into the playoff season. Before I do so I can give you three important updates regarding DUI offenses. First, there is increasing pressure on the Pennsylvania Legislature to strengthen our DUI laws, especially where fatalities are concerned. Second and at the same time, our jails and Adult Probation Departments are struggling to keep pace with DUI convictions with the result that some Counties have implemented programs that cut the mandatory minimum sentences and give credit time for Pre-Sentencing Programs / compliance. The bottom line is that the sentences being handed out are starting to vary depending on each particular County’s sentencing programs. Third, studies have proven that alternate treatment programs work, quite well in fact. The only problem with this fact is that these Programs are extremely intensive and therefore require significant government resources. In this era of tight budgets, this means that there are way more applicants than available spaces. I will limit this discussion to mandatory minimum license suspensions and mandatory minimum periods of imprisonment (and thus will not address any of the many variables that go in to sentencing including but not limited to intermediate punishment sentences, etc.). Recall that Pennsylvania law classifies offenders by the level of their BAC (blood alcohol content), which is separated into 3 tiers: Tier 1 is the “lowest” rate and covers BAC’s of .08% to .099%; Tier 2 is called a “high” rate and covers BACs of .10% to .159%; and Tier 3 is the “highest” rate and covers BACs of .16% and above and also includes illegal drugs, prescription drugs not prescribed to you, and prescription drugs prescribed to you but which have rendered you impaired. All first time offenders are eligible to apply for acceptance into the ARD Program. If you are accepted into the ARD Program and successfully complete ARD there is no jail time and no conviction record. You are on probation for six months. Tier 1 BACs have no license suspension, Tier 2 BACs have a 30 day license suspension, and Tier 3 BACs have a 60 day license suspension. If you are NOT admitted into the ARD Program or were admitted but violate your probation and get removed from the ARD Program, then the following apply. Tier 1 BACs still do not have a license suspension. Tier 2 BACs have a minimum sentence of 48 consecutive hours imprisonment but can be sentenced to up to 6 months and also receive a 12 month license suspension. Tier 3 BACs have a minimum sentence of 72 consecutive hours imprisonment but also can be sentenced to up to 6 months and also receive a 12 month license suspension. For second (2nd) time offenders, the following penalties apply: Tier 1 Fast Lane Biker
