OSHA delays compliance and enforcement dates for reinstated vaccine or test mandate

The Occupational Health and Safety Administration (OSHA) on Saturday announced a six-day grace period beyond the Jan. 4 deadline for compliance with its COVID-19 vaccine mandate for private employers, saying that it would not issue citations to give employers more time to adjust.
OSHA said in a Dec. 18 statement that it would not be issuing citations to businesses for noncompliance with any requirements of the Biden administration’s COVID-19 vaccine-or-test mandate for private companies employing 100 or more people until Jan. 10. It will also not issue any citations for noncompliance with the mandate’s testing requirements until Feb. 9.
The announcement comes a day after the U.S. Court of Appeals for the 6th District in Cincinnati ruled that the private employer mandate could proceed, reversing a previous court decision that blocked the measure in the face of legal challenges by 27 Republican-led states, conservative groups, business associations, and some individual firms.
“OSHA is gratified the U.S. Court of Appeals for the Sixth Circuit dissolved the Fifth Circuit’s stay of the Vaccination and Testing Emergency Temporary Standard. OSHA can now once again implement this vital workplace health standard, which will protect the health of workers by mitigating the spread of the unprecedented virus in the workplace,” the agency said. The agency said it was providing the grace period to “account for any uncertainty created by the stay” and that it would “work closely with the regulated community to provide compliance assistance.”
The OSHA rule applies to some 84 million U.S. workers who would be required to be fully vaccinated against COVID-19 or wear masks and be tested weekly.
The rule threatens fines of up to $13,600 per violation, with a potential additional $13,600 fine for each day that an employer does not abate the violation. For willful, or serious, violations OSHA could issue a fine of up to $136,000.
The 6th District’s ruling to dissolve the stay on the OSHA rule was criticized by Arkansas Attorney General Leslie Rutledge, who said in a statement that she would move to ask the U.S. Supreme Court to block it. “The Sixth Circuit’s decision is extremely disappointing for Arkansans because it will force them to get the shot or lose their jobs,” she said. South Carolina Attorney General Alan Wilson, who chairs the Republican Attorneys General Association, also expressed disappointment in the ruling.
“We are confident the mandate can be stopped,” he wrote on Twitter, adding: “We will go immediately to the Supreme Court—the highest court in the land—to fight this unconstitutional and illegal mandate. The law must be followed and federal abuse of power stopped.”

U.S. drug regulators this week formally strengthened a warning to Americans regarding a severe condition linked to Johnson & Johnson’s COVID-19 vaccine.
Blood clots and low blood platelet levels, known as thrombosis with thrombocytopenia syndrome (TTS), are now listed as a contradiction, or a medical reason for somebody not to get the shot.
“Do not administer” the vaccine to individuals with a history of the set of conditions following the vaccine or any other adenovirus-vectored COVID19 vaccine, the Food and Drug Administration (FDA) says in an updated fact sheet (pdf) for health care providers administering vaccines.
TTS has been reported in “a wide range of individuals 18 years and older” since administration of the Johnson & Johnson (J&J) vaccine began earlier this year, regulators say.
The highest reporting rate, approximately 1 case per 100,000 doses administered, has occurred in women aged 30 to 49.
About 15 percent of the TTS cases have been fatal.
“Currently available evidence supports a causal relationship between TTS and the
Janssen COVID-19 Vaccine,” the FDA says in its updated fact sheets. Janssen is a subsidiary of J&J.
J&J did not respond to a request for comment.
In the spring, U.S. health officials recommended a nationwide pause in administration of the vaccine due to TTS cases appearing among people who had gotten it.
The pause was lifted in April.
The FDA and Centers for Disease Control and Prevention (CDC) said at the time that officials were confident the vaccine was safe and effective in preventing COVID19.
The FDA said that the available data showed the known and potential benefits outweigh its known and potential risks.
Paul Stoffels, J&J’s chief scientific officer, said when the pause was lifted that the company would work with health authorities worldwide “to educate health care professionals and the public to ensure this very rare event can be identified early and treated effectively.” More recently, a Mayo Clinic study found J&J vaccine recipients had a higher risk of blood clots.
Three COVID-19 vaccines are available for use in the United States. J&J’s is by far the least used. Just 17.2 million doses have been administered as of Dec. 15, compared to 185.8 million doses of Moderna’s vaccine and 283 million doses of the PfizerBioNTech vaccine.
A Mayo Clinic study in November found J&J vaccine recipients had a higher risk of blood clots when compared to recipients of the other two shots.
Currently, there are no restrictions in place on administration of the J&J jab.
The two contraindications, TTS and severe allergic reaction, typically only apply once a person has suffered an adverse event.
The CDC’s vaccine advisory panel is meeting Thursday to hear presentations from the CDC on J&J’s vaccine.

How PCR tests caused the fake Whooping Cough Pandemic of 2006
The epidemic that wasn’t: In 2006, doctors used PCR testing to cause mass hysteria over a “whooping cough” outbreak that didn’t even exist
It flew under most people’s radar at the time, but 15 years ago there was an alleged whooping cough epidemic that the medical industry warned was a major threat. The only problem is that it did not actually exist, having been the product of false PCR testing.
The same fraudulent tests being used today to identify the Wuhan coronavirus (Covid19) were also used in 2006 to pinpoint a fake whooping cough epidemic that scared a whole lot of health care workers into panicking, taking pharmaceutical drugs and getting injected with vaccines (sound familiar?).
The New York Times reported that nearly 1,000 health care workers at a hospital in Lebanon, N.H., tested “positive” using the PCR tests, resulting in them being furloughed from work. They were administered antibiotics and injected with chemicals, only to have the whole thing be blown open as a hoax eight months later.
“… health care workers were dumbfounded to receive an email message from the hospital administration informing them that the whole thing was a false alarm,” the Times reported in 2007 about the embarrassing incident.
“Not a single case of whooping cough was confirmed with the definitive test, growing the bacterium, Bordetella pertussis, in the laboratory. Instead, it appears the health care workers probably were afflicted with ordinary respiratory diseases like the common cold.” Said It Should Never Be Used To Try To Identify Disease How could it be that people were mistakenly diagnosed with whooping cough when all they really had was the common cold? The answer is simple: PCR tests are not accurate and their results can easily be manipulated to push a narrative.
The only thing PCR tests do is magnify DNA particles in a sample until they become visible. Depending on how they are calibrated, they can pick up almost anything – even things that do not exist.
“The magnification in PCR is measured by the number of cycles needed to make the DNA visible. Known as the Cycle Threshold (Ct) or Quantification Cycle (Cq) number, the higher the number of cycles the lower the amount of DNA in the sample,” explains the Brownstone Institute.
“To convert Cq numbers into doses they have to be calibrated against the Cq numbers of standard doses. If they aren’t, they can easily be blown out of proportion and appear more significant than they actually are.”
An analogy for this might be a car advertisement in which the company used a scale model for the vehicle photo. After applying the right lenses, lighting and other touchups, that model is made to look like a full-size vehicle and consumers are none the wiser.
The only way to truly know whether the vehicle in the photo is a small model or the real thing would be to put something else alongside it for a comparison of scale.
