pain is one of the world’s leading tourist destinations, with thousands of foreigners visiting the country every year and choosing Spain as a place to live or invest. In the province of Malaga, around 16% of the population are foreign nationals, from the European Union as well as other countries and continents. Whatever their provenance, all foreign nationals must undertake a vast array administrative procedures and paperwork when they arrive in our country, varying in each particular case, and so it is essential to have the support of a professional who can help them to manage the whole process as quickly and simply as possible. Here at the Colegio de Gestores Administrativos de Málaga, we work day in day out to offer our foreign clients the

very best service, and we are fully aware that having the support of professionals is essential when someone from another country comes to Spain to embark on a new stage in their professional career or to live here. It is always important and indeed necessary to legalise all cases and circumstances. For several years now, we at the Colegio have been working with the Foreigners’ Departments of various local councils in Malaga, for example, running informative events and talks in Nerja and Fuengirola in previous years, and more recently with Mijas (a department set up over 30 years ago, a pioneer in Spain), Marbella and Benalmádena. The support provided by Gestores Administrativos in the various official procedures and paperwork required of

foreign nationals spans various fields, including applications for a National Identification Number for Foreign National (NIE), residency permit applications, legalising holiday properties, exchanging driving licences and registering foreign vehicles, renewing residency permits, and managing wills, among others. In recent months, we have focused on advising the foreign population about the latest changes affecting them here. For example, the Modification to the Regulations governing Non-Residents’ Income Tax (Royal Decree 633/2015 of 10 July) and the Legalisation of holiday properties (Royal Decree 28/2016 of 2 February), which in this latter case is causing great uncertainty among this sector of the population.

NIE, an essential document for all foreign nationals > This identity number allows foreign nationals to carry out various processes, such as buying a property or a vehicle.

BTAINING a NIE (Identity Number for Foreign Nationals in Spain) is one of the first things a foreigner must do when they arrive in this country. This personal identification number will allow them to carry out all kinds of procedures and paperwork, including financial transactions, renting a property, submitting a Tax Return, or buying a property.

This identity number allows foreign nationals to carry out various processes, such as buying a property or a vehicle.

Applications for NIE are handled by the Immigration Office (Oficina de Extranjeros) or at the Police Headquarters (Dirección General de Policía) and can be presented by the applicant or by an authorised representative with the power to act on their behalf. If the applicant is still in their country of origin, the application will be processed by diplomatic missions or at a Spanish consulate.

How and why was this department set up, and how have its services evolved since then? Owing to the rise in residential tourism and second-home tourism in our town, the Foreigners’ Department in Mijas was set up in the year 1985, the first of its kind in Spain, given the specific service it provides. Given the length of time it has been in operation, it has naturally evolved, and every year it has increased its information services, adapting to meet the needs of foreign residents and residential tourists in the town.

Do foreign nationals in the area of Mijas who come to the office conform to any common patterns or a specific profile? 42% of the population registered on the Mijas municipal census are foreign, with over 125 different nationalities, the majority British, German, and Scandinavian. The profile has changed over the years: In the 70s – 90s, there was a major boom in the immigration of European pensioners to our town. This phenomenon created an entire network of professional services aimed at foreign nationals, setting up their own businesses and creating jobs, and we now have numerous young people and families who have moved here. We have seen a significant increase in the numbers of foreign students enrolled at our schools, especially in Mijas Costa. Obviously, the economic situation, changes, and the lack of international agreements with regard to tax laws have led to fluctuations in the status of foreign nationals as residents or tourists.

What about occasional visitors/tourists, do they also find answers in your services? We have all been tourists first before making the decision to move somewhere or spend long periods of time there, and they ask us about the procedures and steps they need to take before, during and afterwards: purchase and sale of properties, census registration, building permits, local taxes, fiscal matters, traffic, NIE (Identification Number for Foreign Nationals), Residency Certificate, the Healthcare System, Inheritance, Schooling, etc., and we provide general information, always advising them that they should use professionals.

As a result, every year over 15,000 people use this service, which is highly valued by foreign nationals because it is free, confidential, and totally altruistic. It is also important that we can provide services in their own language, owing to the language and cultural barrier that exists. HE new decree regulating holiday properties in Andalusia is generating a great deal of expectation among foreign citizens. The Colegio de Gestores Administrativos de Málaga, together with the different foreigners’ departments of certain municipalities in Malaga, is organising informative talks aimed at foreign citizens with a view to raising awareness about the official procedures required of this collective in Spain. The latest modifications introduced in Andalusia by Royal Decree 28/2016 of 2 February regarding the Legalisation of Holiday Properties have raised a great many questions among this collective. The first of the talks in 2016, held in the assembly room of Mijas Town Hall, was attended by over 130 foreign nationals from the area and featured the participation of the Mijas Councillor for Finance and Foreigners, Mario Bravo, and the president of the Colegio de Gestores Administrativos de Málaga, Jorge Alcántara, who highlighted the role of this association of professionals: “We are aware that the support of professionals is essential when someone from a different country comes to Spain to embark on a new stage in their professional career or to set up home here. All cases must be legalised”. Anette Skou, coordinator of the Mijas Foreigners’ Department, introduced some of the main functions performed by this department, before giving the floor to María José Cobos, spokesperson and member of the Foreign Citizens Committee at the Colegio de Gestores Administrativos de Málaga. In her talk, Ms Cobos concentrated on the new regulations governing holiday properties, new

changes to the Regulations governing NonResidents’ Income Tax, the new procedure to acquire Spanish nationality through residency, and the major official procedures with regard to Traffic. As for the new decree regulating holiday properties in Andalusia, Cobos examined the legalisation of these properties and the series of obligations required of property owners, such as possessing an occupancy licence, meeting the technical and quality standards required of properties at all times, and ensuring the property is built on land classified as being for residential usage. Close to 42% of the population of Mijas is foreign, with over 125 different nationalities, the majority British, representing around 11,000 residents. Furthermore, the Mijas Foreigners’ Department was set up over 30 years ago, the first of its kind in Spain, and each year it advises 20,000 residents to facilitate their relationship with the Town Hall, help them to integrate into local society, and to overcome the language barrier. For this reason, the Colegio de Gestores Administrativos de Málaga chose Mijas to organise this first talk, which attracted a great deal of interest and drew crowds of resident and non-resident foreign nationals in this town. Every year, the Colegio in Malaga organises various talks covering legislative changes that affect this collective, and so far they have been held in the towns of Nerja, Fuengirola, Mijas, Marbella and Benalmádena. More events are being scheduled in different municipalities around the province.

A citizen is considered to be a permanent resident of Spain when they spend more than 183 days a year in this country

ON-RESIDENTS’ income tax (IRNR) is a direct tax levied on income obtained within Spain by individuals and entities that are not residents of this country. This tax must be paid by persons who obtain income within Spain, unless they pay personal income tax. It must also be paid by individuals with a foreign nationality who are based in Spain owing to a posting or employment, as members of diplomatic missions, consular offices, or active civil servants performing their duties in Spain, always through mutual agreements, along with taxable entities constituted abroad with an operational presence in Spain territory. But what criteria are established to determine the residency of an individual in Spain? A citizen is considered to be a permanent resident of Spain when they spend more than 183 days a year in this country.

The second case considers a taxpayer to

be a resident of Spain when the main core or basis of their economic activities or interests is directly or indirectly based in Spain. Thirdly, in the absence of evidence to the contrary, it will be assumed that a taxpayer’s regular residence is in Spain when, in accordance with the above two criteria, said taxpayer’s spouse (not legally separated) and underage children who are dependents of said taxpayer usually reside in Spain. Form 210 should be used to file a return for this tax. Non-residents with properties they themselves use have to declare an imputed income on the property (normally 1.1% of the registered value), which is charged on the 31st of each year. Owning a property means having to pay tax on imputed income as a regular place of residence, or a declaration of profits if the property is rented out.

N 2 February 2016, the Spanish Cabinet passed a new decree regulating properties rented out as holiday homes in Andalusia, responding to the demands of the tourism industry in recent years. This kind of accommodation had been excluded from previous regulations following the modification of the Urban Lettings Act (LAU) in June of 2013. Royal Decree 28/2016 now includes these properties within the regulated offer of the tourism industry, as another mode of tourist accommodation. These new regulations have brought about significant changes to the situation of thousands of properties throughout Spain. Below we analyse the most important changes.

WHICH RULES AND REGULATIONS MUST HOLIDAY PROPERTIES COMPLY WITH? The Decree sets out a series of measures to regulate activity, control quality standards, and register the fact that tourists make use of this private accommodation. The new legal cover establishes that these properties must be registered with the Tourism Register. To certify that a property meets the regulations, any promotion or advertising of their rental must include the registration code for the Tourism Register. Furthermore, owners are required to declare that the property will be used for tourism before activity commences.

In addition to these obligations, Royal Decree 28/2016 requires that properties have an occupancy licence, and that they meet the quality standards required of holiday rental properties. These requirements encompass technical conditions regarding air conditio-

ning, ventilation, safety, sanitation, equipment and furniture, among other aspects. Owners must also provide users with complaints forms, a contact telephone number, and tourist information.

WHAT IS CLASSED AS A HOLIDAY PROPERTY? According to Royal Decree 28/2016, holiday properties are any properties located on residential land that offer accommodation in exchange for a price. To be considered as such, properties must be regularly advertised and promoted through any medium. The most regularly used channels in this sector are travel agencies and brokers, and webpages. However, the regulations do not apply to properties that are made available to users free of charge, or to properties that are rented out for periods in excess of two consecutive months. They also exclude rural areas, which are governed by their own regulations. In addition, they exclude groups of three or more properties located within the same building, owned by the same owner, which are regulated by Decree 194/2010. On the whole, the changes introduced shed light on the new situation of the tourism market, offering a legal framework for the development of this new mode of holiday lettings. N recent years, there have been several reviews to the Spanish tax system. As part of these reforms, on 11 July, Royal Decree 633/2015 was enacted, which further developed the changes introduced previously to the Personal Income Tax and Non-Residents’ Income Tax legislation by Act 26/2014. The full text of this Decree came into force on 1 January 2016. Below we will analyse the changes that affect Non-Residents’ Income Tax (direct tax levied on income obtained in Spain by persons and legal entities that are not residents of this country).

This scheme is applied when the annual income of non-residents in Spain is less than 90% of the minimum to which they would be entitled (according to their personal and family situation) if they lived in Spain.

WHAT IS THE PURPOSE OF THE NEW REGULATIONS?

Secondly, there is a new distinction made between private individuals and legal entities for non-resident taxpayers with no permanent residence. This change establishes that the deductible expenses for each group will be regulated by the Personal Income Tax or Corporate Tax systems, respectively.

Royal Decree 633/2015 introduces certain modifications to Non-Residents’ Income Tax to adapt it to European regulations and the new legal framework governing Personal Income Tax and Corporate Tax. The ultimate goal set by Public Administrations is to facilitate the free movement of citizens within the European Union.

A third significant modification affects housing. From now on, non-resident taxpayers are permitted to exclude from their tax liabilities any gains obtained from the sale of their regular residence in Spain, in the event that the amount obtained from the same is reinvested in the purchase of a new property.

HE storm clouds are gathering once again over the urban planning situation of one of the jewels of the Spanish coastline: Marbella. Following a few years of relative calm, during which over 16,500 illegal properties were legalised in accordance with the General Urban Organisation Plan, supported and praised by the two majority parties in the city of Marbella, the High Court declared this Plan to be null in law. The term ‘legal insecurity’ rang out once again along the Costa del Sol for a few weeks.

The first consequence is that thousands of people, an important number of whom are foreign property owners, will once again have their property in a state of legal limbo. The relative calm offered by the document that has since been condemned was short lived. The second consequence is due to the uncertainty caused by this decision among some investors. This lack of legal security regarding one of the most important assets for foreigners in Spain, property, has unleashed another earthquake that, from the outset, public administrations have attempted to minimise.

Andalusia’s Regional Government and Marbella’s City Council are already working on a new document that will once again rescue all those illegal properties that have sunk back into a legal vacuum. Many foreign citizens have unwittingly been left without deposits paid to developments that, although there were plans on paper, were never actually constructed; purchasing properties on the understanding that their situation was legal, only to find out that it was not; or with incentives to obtain Spanish nationality if they bought properties with certain characteristics, with public administrations looking to gain capital injections and to reactivate a market that has been flatlining for over five years. But it’s not all about urban planning. This collective is also required to carry out other official procedures that require legal security

and certainty. From the purchase and sale of vehicles, to the legalisation of their situation in Spain – via nationality or residency permits – these are actions that require a Gestor Administrativo to ensure the legality of the process for such important matters. There are 250,000 foreign nationals in the province of Malaga. Registering a foreign car in Spain and exchanging a driving licence > These procedures vary depending on your country of origin. Putting such matters in the hands of a professional is always a good idea.

NCE a foreign vehicle is brought into Spain, the owner has 30 days to register it if the licence plates are from a country outside the EC. If it has EU plates, the owner has 6 months to register it. If the vehicle has EU plates, the length of time it will remain in Spain will be less than 6 months, and the owner’s regular place of residence is in their country of origin, there is no obligation to register the vehicle or to pay taxes. The vehicle can only be driven by its registered owner, not by any resident or by any other non-resident family members. If the vehicle comes from a country outside the European Economic Community, the import must be accredited by means of a DUA document.

If they have been living in Spain for more than 2 years, they are required to renew their licence if it expires and also if its validity period is greater than the validity period of Spanish licences, and also if the licence is soon to expire. If they have been living in Spain for less than 2 years, they must renew their licence if it has expired or is soon to expire, or they must register if it is an indefinite licence (the validity period of the licence is greater than the validity period of Spanish licences).

Non-eu nationals: In order to exchange their driving licence, they must make an appointment at the offices of the Department of Traffic (Jefatura). Driving licences can only be exchanged from countries that have an agreement in place with Spain, and as long as the licence was not obtained after the agreement was put in place and said individual was a resident in Spain. Some cases require the driver to pass some kind of test, which will be different depending on the agreement.

EXCHANGING DRIVING LICENCES: EU nationals (EU countries as well as Iceland, Liechtenstein and Norway):

Driving licences issued by any of the above countries shall not be valid to drive in Spain if they have been restricted, suspended, or withdrawn in any of those countries or in Spain.

María José Cobos Gestor Administrativo and member of the Colegio de Gestores Administrativos de Málaga Our very best for foreign citizens The advantage of using the services of a Gestor Administrativo, both for individuals and companies, is that we can offer a wide variety of services encompassing all their interactions with Public Administrations in every possible area. From buying a property, an event that does not happen too often in life, to quarterly tax returns, a major feature in the dayto-day business of the large group of self-employed professionals and small businesses. For foreign clients, language is ceasing to be a barrier, since Gestores Administrativos have made great strides in terms of learning English, particularly thanks to the incorporation of new generations into this profession.

They are normally used to paying taxes, although the majority of times they expect to receive the relevant tax return drawn up directly by the tax office to be accepted or modified, and it is not easy to make them understand that here in Spain the majority of people have to do their own tax returns.

Foreign citizens come from a different culture and, above all, an administrative system that is in general completely different, making the Gestor Administrativo a key figure in achieving adaptation and integration. This is true for those who have moved to Spain to embark on an activity, and also for those who have simply chosen the Costa del Sol as the ideal place to rest. In many cases, as well as tax and labour advice customers might need professionally, a Gestor Administrativo also deals with many of the issues that arise in day-to-day family life.

what I have noticed in recent years is that the average age has fallen, and it’s no longer only pensioners who come to Malaga to spend their retirement on our beaches. A growing number of professionals are choosing our province to set up a business or continue their career. For that reason, we must view foreign citizens are dynamic agents who are invigorating our economy and, as with all our clients, we do our very best for them.
