NYS Highway Law 140 (Opns. St. Comp. No. 81-168) states the responsibilities of the town highway superintendent are supervisory in nature only; there may be instances when the superintendent joins the work force in performing physical labor, but he is not required to do so. This law was brought to the attention of the Town Board by the Lapeer Highway Superintendent. Therefore, at the December 12, 2018 board meeting, the Lapeer Town Board recognizes it’s elected highway superintendent as a non-working, supervisory only official, effective immediately.
