The Law
The legal status of any Cannabis sativa L. plant is determined by a single factor: the plant’s Δ9tetrahydrocannabinol (THC) concentration.
The Definition
The federal government’s definition of hemp extends beyond the plant itself to include extracts, resins and derivatives.
The Bill
This means that, under the 2018 Farm Bill, CBD derived from hemp is legal, while THC derived from marijuana is illegal.²

In other words, hemp is no longer a controlled substance. Also, by amending schedule I to exclude THC in hemp, Congress has likewise removed THC in hemp from the CSA.’”
