Priority Release

Booking appointment to purchase - Terms & Conditions

To be eligible to purchase in the priority release of nominated properties for a nominated development you must agree to the terms and conditions of the ‘Booking your purchase appointment’ process.

1. These terms and conditions govern the use of the Frasers Property Australia ‘myFrasersProperty app and portal’ and Microsoft Outlook Calendar for securing a Purchasing Appointment to be able to purchase a property at the nominated development during the Priority Release By using the ‘myFrasersProperty app and portal’ and/or Microsoft Outlook Calendar page, you agree to comply with these Terms and Conditions.

2. You will receive access to book your purchasing appointment on the nominated booking date via the myFrasersProperty app or portal, or alternatively by email to book your purchasing appointment. Members must register their interest prior to Purchasing Appointments being made available during the nominated registration of interest period If you do not register your interest during the nominated registration of interest period, you will not be eligible to participate in the Priority Release or gain access to the appointments.

3. On the nominated booking date, access to the purchasing appointments will be given to registered Platinum Members with Priority+ access first, followed by registered Silver Members and lastly approved Family Share referrals if applicable.

4. It is advised that you book the earliest appointment available when your access opens to have access to the preferred property you wish to purchase as bookings are done on a “first come first served” basis Only a maximum of one (1) property per release is permitted to be purchased by any member on the day of the release.

5. For any Family Members of Care & Rewards members wishing to gain access to this release under the Family Share program, there are criteria that need to be satisfied to qualify for this benefit. Firstly, a referral form must be submitted no later than 48 hours before the registration of interest period closes. This can be done here

Secondly, sufficient documents to prove the relationship between Family Members and the Care & Rewards member will also need to be provided no later than 48 hours before the registration of interest period closes in line with the Care & Rewards Terms and Conditions, which can be accessed here

6. Frasers Property may as part of a Priority Release require you to pay a holding deposit for an amount nominated by Frasers as part of that priority release via Electronic Fund Transfer (EFT) in order to secure a Purchasing Appointment to purchase a property in the Priority Release

7. If you are successful in securing a purchasing appointment to purchase a property in the priority release, you will be contacted by the Sales Team via email/telephone following the nominated booking date. You will be contacted in order of Membership tier (Platinum

followed by Silver) and then in order of the appointment time to confirm you are prepared to purchase.

8. During this Priority Release, appointments will be made available first for Platinum Members with Priority+ access, followed by Silver Members, then verified Family Members. Appointments will be for a duration nominated by Frasers Property as part of the priority release. If you have chosen an in-person appointment, please arrive 5 minutes before your appointment time and ensure you bring proof of ID (passport, driver’s license or Medicare card and VEVO if applicable).

9. A holding deposit for an amount nominated by Frasers as part of the priority release will be required to be paid via Electronic Fund Transfer (EFT) on the day. You will be required to sign a Contract of Sale for the property by DocuSign and pay the balance of the 10% deposit within the number of days nominated by Frasers Property as part of the priority release

10. You acknowledge that booking a purchasing appointment does not give you a legal right or guarantee to purchase a property, including during the release at the nominated development

11. There may be more people booking purchasing appointments using the Microsoft Outlook Calendar page than there are properties available for purchase. You agree to not make a claim against Frasers Property Australia if you a not able to secure an appointment to purchase a Property, or you are impaired from purchasing a Property, for any reason, including negligence or error of Frasers Property Australia.

12. You must not provide access to non-Members or other Members to the priority release through ‘myFrasersProperty app and portal’ and/or Microsoft Calendar. If you book a purchasing appointment, this is personal to you and cannot be transferred or used by any non-Member or other Member. If you are found to be in breach of these provisions, Frasers Property Australia may remove you from the priority release or remove you entirely from the Care & Rewards loyalty program

13. Frasers Property reserves the right to cancel your appointment to purchase if you access the Microsoft Calendar prior to your Membership tier’s allocated booking time or you secure a purchasing appointment prior to your Membership tier’s allocated booking time

14. You may be prevented, delayed, or impaired from using the myFrasersProperty app or portal, or Microsoft Outlook Calendar page for a number of reasons, including due to infrastructure failures like internet or telecommunications outages, or impairment of failure of the myFrasersProperty app or portal, or Microsoft Outlook Calendar page (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree to not make a claim against Frasers Property Australia if you are unable to use the myFrasersProperty app or portal, or Microsoft Outlook Calendar page, if you are not provided a purchasing appointment time, or if you are provided a less favourable purchasing appointment time due to any of the problems set out in this paragraph, irrespective of who is responsible.

15. By submitting your personal details as part of the Priority Release, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a property and to promote its products and services. Frasers Property Australia

16. These terms and conditions are governed by the laws in force in the state in which the development is located. References to Frasers Property Australia means Frasers Property AHL Pty Ltd ACN 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)) and includes its offers, employees, contractors or agents.

17. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract of Sale takes precedence over these terms and conditions.

18. These terms and conditions are to be read in conjunction with the Care & Rewards Terms and Conditions, when understanding who is eligible to become a Member and how rewards such a Repeat Purchase Rewards, Family Share or Friend Referrals can be accessed.
