Pet trusts: Can you PlaCe a value on man’s best friend? “What if” you had to value one of your most prized possessions - your pet. While we treat our pets as part of our family, technically pets are a property right or possession. This means you own your pet and when you pass away you need to give this valuable property to someone else to keep and care for. So, the next logical question is “who” do you trust to care for your pets? Last month we addressed the pet caretaker decision in, “The Importance of Creating an Emergency Plan for your Four-Legged Friends.” Today, we address the “how to” in giving away your pet and how much is too much to set aside for your four-legged friend. (By the way, Leona Helmsley set aside $12 million for her dog, “Trouble,” but later was reduced to $2 million dollars by a judge.) Like any other financial planning decision, the analysis starts with setting your goal and then realistically deciding what your financial ability is to reach that goal. Once you decide on an appropriate amount to set aside for your pet, then we embark (pun intended) on building the gift: • The gift can be made in a will or in a trust. • The gift can be made outright to the caretaker, or it can be in a trust. • And you should note that since 2003, a pet trust in Florida is permitted by statute. Based on the fact that your pet is a possession and not a person or entity, you cannot leave the gift directly to the pet. So, the gift is to a person or entity such as a trustee of a trust for the direct purpose of caring for your pet. Again, “who” do you trust and “how” do you ensure that this trusted individual will follow your wishes? So, first determine the amount you wish to set aside and the amount you can afford to set aside. Look at your annual current cost of care and then multiply that by your pet’s estimated life expectancy. Then, add the unforeseeable veterinary investment that may

be needed for severe illness, end-of-life issues, and kennel or caretaker costs to provide your selected caretaker with regular breaks for vacation, etc. — yes, it all adds up pretty quickly. Then, consider making a separate gift to the caretaker for the service he or she will provide. The pet trust looks like any other trust in structure. You select the manager of the trust, who is referred to as the trustee, and the current beneficiary of the trust, who of course is your wonderful pet. Then, you need to select the remainder beneficiary - who gets the leftover assets when your pet dies? A charity, such as Humane Society Naples, would be a good choice. But you may not want to tie the caretaker’s compensation to this gift. It may be wiser to leave a separate gift to the caretaker and leave the remainder of the trust to charity (regardless of the tax benefits). Leaving excessive money in trust will result in extraordinary income tax that could be better used by your favorite charity or heirs. As always, these are complex decisions that you should seek the advice of competent and appropriate professional advisors. Bark on!

(March 14, 2014) – Overall closed sales decreased 5 percent in the $300,000 and below price segment, which encompasses almost two-thirds of the existing home sales market, from 6,149 in the 12-months ending February 2013 to 5,823 in the 12-months ending February 2014. Conversely, the February report showed a 20 percent increase in closed sales for all homes over $300,000 from 3,159 closed sales in the 12-months ending February 2013 to 3,912 for the 12¬months ending February 2014. The largest decrease in inventory continues to be in the $300,000 and below price segment which saw a 20 percent decrease versus a 12 percent decrease in inventory for all other price segments combined.

• Median home prices in the under $300,000 single-family home market rose 15 percent from $155,000 in the 12-months ending February 2013 to $179,000 in the 12-months ending February 2014.

“Homes under $300,000 made up 66 percent of the market in 2013 but we are starting to see that figure decline in 2014,” said Pat Pitocchi, NABOR® president and corporate trainer at Downing-Frye Realty. “Two factors are driving this change: median closed prices are going up and pushing these homes into a higher price category; and nontraditional sales [short sales and foreclosures] are disappearing.”

• Pending sales in the condominium market rose 6 percent from 5,356 properties in the 12-months ending February 2013 to 5,696 properties in the 12-months ending February 2014.

As the report demonstrated, of the 670 homes that closed in February 2014, only 82 were non-traditional sales. That’s a 10 percent decrease from a year ago when 687 homes closed in February 2013, of which 152 were non-traditional. The report continued to show the majority of activity occurred on either end of the market with the middle market showing stability. Overall median closed prices for homes $300,000 and below increased 14 percent from $145,000 in the 12-months ending February 2013 to $165,000 for the 12-months ending February 2014, while overall median closed prices for homes $2 million and above increased 7 percent from $2,805,000 in the 12-months ending February 2013 to $3,000,000 in the 12-months ending February 2014. Yet for homes priced in between these two price categories (i.e., $300,000 -$2 million) the report shows virtually no change in overall median closed prices from the 12-months ending February 2013 to the 12-months ending February 2014. • Closed sales for condominiums in the $2 million and above price category increased 102 percent from 55 in the 12-months ending February 2013 to 111 in the 12-months ending February 2014.

Layered Spaghetti Pie 3/4 box spaghetti noodles (using 1 lb. box) 3/4 lb. ground beef (can use ground turkey as substitute/or meatless for vegetarian spaghetti pie) spaghetti sauce salt (or sea salt), pepper 8 oz. cottage cheese 1/2 cup sour cream 8 oz. cream cheese 1/4 cup green onions 2 tablespoons butter (melted) Cook spaghetti and drain. Fry ground beef and drain. Add spaghetti sauce, salt and pepper. Remove from heat. In separate bowl, combine cottage cheese, cream cheese, sour cream and green onions. In a 1 quart casserole, spread 1/2 spaghetti, cover with cheese mixture. Add remainder of spaghetti and pour melted butter over. Top with spaghetti sauce. Chill at least 1 hour. Remove from the refrigerator 20 minutes before baking. Bake 350* for 45 minutes (may also be prepared in a crockpot).

Many of us know the feeling of crossing the Jolley Bridge and realizing that Marco Island is different and somewhere we want to spend time. With that thought in mind we felt it would be interesting to find out why others chose Marco as a place to spend their vacation time and maybe even purchase a vacation home. Ian Clausen from Clausen Properties put us in touch with Rochelle Riccobene who, with her husband Patrick, had recently purchased a condo in the Madeira on South Collier Boulevard with Ian’s help and advice. The Riccobenes, together with their three boys,

Keegan and twins Griffin and Gavin, live full time in Chicago and had spent many a family vacation in Orlando visiting the theme parks. About six years ago, friends suggested they try Marco Island as it wasn’t far from Orlando and maybe they could split their time between relaxing on a wonderful beach and joining the lines to visit Mickey and friends. They did and they haven’t looked back since. Initially, they stayed at the Marriott since it gave the three young boys plenty to do while mom and dad relaxed by the pool. Soon enough thoughts turned to owning a second


home in a warm climate and escaping the harsh Chicago winters. Originally from New Mexico and with business connections in Arizona, Rochelle told us that they considered all three states. However, the draw of Marco’s fabulous beach, the water activities and convenient flights from home were the deciding factors. Marco was the choice. The next decision was... home or condo? Having grown accustomed to the conveniences of staying on the beach, with plenty for the boys to do without having to be driven anywhere, it seemed another easy decision was made. Looking up from the Marriott the Madeira next door was beckoning and a call to Ian Clausen followed. An offer was made on a unit but terms couldn’t be agreed upon and then one of the penthouses on the 17th floor became available. As you can see from the pictures, this was probably the easiest decision! Who wouldn’t want 360 degree views for miles and miles over Marco, South Beach, Tigertail and the 10,000 islands? The terraces give views north and south along the beach with plenty of space for entertaining all of those guests trying to escape the frigid cold of Chicago. When they purchased it, the condo did not look like it did when we were lucky enough to be shown around by Rochelle recently. With the help of her Chicago designer, Karen Shap Design Ltd, and Heidi Pavela the designer’s assistant, Rochelle has lovingly remodeled every room. And it is absolutely stunning... with the use of subtle colors and patterns for the fabrics and walls, everything is designed to highlight the fantastic views, they even removed some pillars in the great room because they detracted from them. With top of the line appliances, custom made fittings and custom artwork adorning the walls there is just enough of a beachy feel to remind them they are on Marco when it’s dark and they can’t see the beach or the sun! We asked Rochelle if she thought they would spend more time on Marco in the future and maybe even make it their primary residence. She answered... “the twins keep asking when they can live here and go to school on the island, but our oldest son is graduating High School soon and we need to get him established in college before we think about that. We have been here six to eight times in the past year and no doubt we will be spending even more time on Marco as the years go by”. There is so much for families to do on Marco. The Riccobenes have recently bought a boat and Patrick and the boys love fishing in the backwaters. The binoculars set up on the terrace allow the boys to survey the beach below and decide when it’s time to go for a walk.... it seems that it frequently coincides with pretty girls making an appearance at the pool or strolling by! Even though we can’t all afford a penthouse at the Madeira, the Riccobene’s story is very familiar - we ourselves came to Marco on vacation, enjoyed all the activities, bought a property and, because we loved it here so much, eventually came to live. It’s a story often repeated!
