Facts About Buying in Today’s Market Even in a strong seller’s market, on average only about 2 out of 10 listings on the market actually sell in any given month. Reason: a great many properties are simply not priced, marketed or staged to sell effectively. Your chance of finding the right home at the right price is not random. It is about a very specific process that we weill establish from our initial meeting thoughtout the entire course of buying your home. Every neighborhood is different. Even during the downturns in the market, many neighborhoods in our area have maintained their value over the last several years. The ones you look at may or may not be one of them. Understanding and expressing your specific needs and wants in a home will be one step toward finding a home that is suitable for years to come. Buyers who have partnered with a professional Realtor with a specific process have a much higher quality and succcessful experience that working with those who just dabble in real estate or who aren’t methodical and deliberate.


What I Do During Your Transaction ... Here are just of few of the tasks I will perform behind the scenes and ensure your transaction is as seamless as possible. • Research owenership of property

Buyer Expectations: Un The following consists of common questions and concerns during the buying process. Please review this list and of course, call or email me with any questions you have. Resale Value – We are not just nding the home that ts your current wants and needs. It should also have a real potential for resale. If you select a home with potential resale issues that future buyers will likely consider as a negative later, I will give you my professional opinion. Price of Home – When we nd a home you want to make an o er on, I will be able to help you determine if it is overpriced or not. I will provide you with a BPO (Broker Price Opinion), which will give you quanti able opinion of the home’s current value, so you can determine how much to o er. What to Offer – Having me complete a BPO is critical to making sure you don’t pay too much. I caution my clients about submitting “low ball” offers (>5% or more below market value). It can o end a Seller who is then less likely to work with you at any price. Closing Costs – The Seller does not automatically pay closing fees, and they are not the same as a down payment. Closing costs are fees charged by the lender to get a loan; they are in addition to a down payment. If you have cash to cover the down payment + closing costs we can seek a lower sales price, instead of asking the Seller to pay closing costs. If you get a low or no down payment loan because cash is tight, you may consider asking the Seller to pay some or all closing costs. If you do, you will likely pay a higher price for the home. Vendor Referrals - I have a list of vetted contractors. Most of the vendors will get bids and repairs done quickly. I am not responsible for their performance. I do not employ any vendors; they are simply sources my clients or colleagues have used in the past. Use due diligence to ensure they are licensed and insured. I do not track this information. Inspections - Two recommended inspections: general home inspection and radon inspection. Over a three-hour period, they will do a basic inspection of the entire home. Some home inspectors can be “jack-of-all-trades”. If they come across something they are not certain about, I will advise you to hire a speci c industry contractor who can better assess the concern. The items we will consider asking the Seller to repair fall into the following criteria: health, safety and major capital.


nderstanding the Basics Walk Through – The morning of or the afternoon before closing we will do the walk through. This is when we make sure the home is in at least the same condition as when we went under contract and that repairs are complete. The Seller is expected to wipe down surfaces and vacuum, you will likely need to clean more before you move in. If you want the carpets to be professionally cleaned we will include this in the original o er. Transaction Broker - In the unlikely event you purchase one of my listings, I become a transaction broker as stated in our Exclusive Right To Buy Contract. Subsequently, I cannot disclose to you secrets about the Seller and why they are selling. Vice versa, I cannot disclose to the Seller why you are buying or any of your secrets. My Fee - You have hired me to represent you in the purchase of a home and 99% of the time the Seller will pay my commission. Therefore, there is no fee you are required to pay me. I will not use any portion of my commission for negotiation between you and the Seller. You have hired me to do a top-notch job and I am committed to getting you the home of your dreams. Availability – I am available to you during business hours. My evenings are lled with family obligations, volunteer meetings and social functions. I do my best to accommodate evening requests, but will not always be available. Regardless, if you need me, please call or text and I will get back to you as soon as possible. However, if we are in the midst of negotiations, timing is often considered urgent and I will be available to you. Vacations - I have family obligations and I do take vacations. I will do my best to be available to you, but will also ensure that you will be covered by a licensed agent from my o ce who will be familiar with you and your needs. The agent that I pair you with will be there for you and able to handle any important and urgent matters if I’m not able to be reached immediately.


The Home Buying Pro Realtor Agency Fees And Agreements 1. At our first meeting we will discuss the differences between assisting you as Buyer Agents or Transaction Brokers and will review the various forms necessary to establish a Brokerage Relationship. The seller typically pays my fee/commission and is a minimum of 3% of the sale price. The fee may be higher for new homes or For-Sale-By-Owner’s (FSBO’s). By agreeing to work with me as your “Buyer Agent” I am authorized to seek payment from the sellers and you will not be expected to pay the “success fee” unless the seller (some FSBO’s) refuses to do so. 2. Therefore, it is important that you allow me to introduce you to any home you might have an interest in, including new homes or those homes sold FSBO. I may not be able to provide assistance or representation if you visit new homes or FSBOs without me.

Searching For Your New Home 1. The search for your new home begins with a discussion of your likes and dislikes, wants and needs and includes the type of neighborhood, style, and size of home you prefer, lot characteristics, and price/financing considerations. 2. Once I establish your search parameters, I will then search our Multiple Listing Service (MLS) for homes that appear to match your requirements. All homes listed by a REALTOR® are included in our MLS and include El Paso County (Colorado Springs and all outlying communities and the “Ute Pass” community), Teller County (Woodland Park and all outlying areas), and southern Douglas County. I can show you any home for sale in these communities including new homes and those sold FSBO (provided the seller is willing to participate in my “success fee” or you are willing to pay my success fee). If you are unfamiliar with the Pikes Peak Region, I will tour the area to help familiarize you with the types of homes and neighborhoods you can expect to find within your price range. I am also a member of the Colorado and Denver Area Association of Realtors.


ocess: An Overview Financing 1. Visit with 2-3 different lenders to nd out if you pre-qualify for a loan, how much you are qualified for, and to compare rates of lenders. 2. Lenders should give you a Good Faith Estimate (GFE) as required by HUD (Dept. of Housing and Urban Development). The GFE should spell out the amount of the loan you qualify for, interest rate you qualified at, and a detailed listing of miscellaneous fees to obtain a loan from that particular lender. The most important number on the GFE is the APR, not just the loan rate. 3. Once you’ve decided on a lender, obtain a written pre-approval letter (if possible) to bring with any offers we make to purchase a home. 4. Once you are “Under Contract” you will officially apply for the loan for the specific home. 5. Lender will provide a list of required documents you must produce in order to get your loan 6. underwritten. An underwriter reviewing your application is the final process of the loan— the validation of information provided on your loan application. Once the underwriter has processed your nancial information, they will issue a loan commitment. 7. The lender will usually charge you for the home appraisal and a credit report up front. These are part of your closing costs and will show as a credit to you at closing.

Contracting To Buy Your New Home 1. Once we nd the home you wish to purchase, an o er will be written and presented (alongwith your earnest money) to the listing agent or seller. If writing on a new home, the salesrepresentative writes the offer on a builder contract and delivers it to the builder for presentation and acceptance. 2. All other purchase contracts will be written on forms required by the Colorado Real EstateCommission and our Broker. 3. If the seller accepts your o er, it becomes a legally binding contract and you and the sellerwill be subject to “remedies in case of default” if the contract is terminated prematurely. I will discuss this further when we write the contract.


The Home Buying Process: Continued Inspection It is highly recommended that you hire an independent, professional inspector to inspect the property within the time frames established by the purchase contract. See “The Home Inspection and Questions” for a more in depth discussion. (Supplement)

Lender Procedures Upon acceptance of the purchase contract, your earnest money is deposited in a trust account. A copy of the purchase contract is delivered to the mortgage lender who performs the following 1. Orders appraisal of property from certified appraisal company. 2. Processes credit report for the purchaser. 3. Verifies purchaser’s employment. 4. Verifies purchaser’s bank accounts or other monies necessary to close. 5. Orders any required inspection and oversees any necessary repairs. 6. Oversees that all conditions of the purchase and sale agreement are met before closing. 7. Consolidates all of the above into a loan package that is presented to the loan committee for final approval. 8. When final lender approval is completed, all necessary information is forwarded to the designated closing agency.


Title Company Procedures A copy of the purchase contract is delivered to title company/closing agent. The title company performs the following: 1. Orders commitment for title insurance (see discussion on title insurance). 2. Oversees and coordinates solution of any problems revealed in the preliminary title report. 3. Files documents to clear title of all liens, encumbrances, judgments, clouds on title, or easement questions. 4. Verifies that all work orders are completed and re-inspected if necessary. 5. Prorates any rents, taxes, or utilities to the date of closing. 6. Prepares all documents and closing papers for buyer and seller to sign. 7. Arranges for both parties to sign closing documents. 8. Files all documents with the local government to actually close the sale. 9. Upon closing, disburses funds per the closing instructions.

Settlement & Closing Once all the contingencies in the contract (such as title, inspection, appraisal, loan commitment and survey issues) have been met and the lender has issued a loan commitment and approved your loan, we can close on your loan and the real estate transaction. In Colorado, the closing is conducted by a title company and usually takes about an hour. You will be expected to have a cashier’s check or certi ed funds for your final down payment and closing costs. The title company will provide final figures to you several days before closing (if at all possible). When you come to closing be sure to bring a photo ID for notarization of documents. As your professional real estate agent, I will be working hard on an ongoing basis to ensure that all of these steps take place in a timely manner as we work together towards the closing of your transaction.

First: There is a big difference between Realtors who dabble this industry to make commissions, and those who make a career in this industry because they love working with and helping people find the home they want and need. ERA Shields Realtors are career professionals. An Investment of Time: In the typical real estate transaction, when I represent the sellers, my investment in time is between 75-100 hours in addition to the marketing & advertising expenses, which for me are around 1% of the total sales price. I call this time and money spent an investment, some might call it a gamble since I do not earn a dime unless I am successful in getting your home sold. Why Professionals Work with Real Estate Companies? I am an independent contractor working for ERA Shields Real Estate. This simply means I pay ERA Shields to oversee my actions and provide me additional services, which I pass along to my clients. ERA Shields does NOT pay me a salary or any health benefits, my compensation is 100% commission. All of my expenses are mine to bear. My Fees: My professional service fee (the industry term is, commission) is 3% of the actual sales price of your home. This fee is based upon the services I provide, my experience, and the cost of doing business. You are also charged an additional 3% commission (for a total commission of 6%), which goes to the real estate agent who brings the buyer. I also like to remind potential clients that agents are all different, as are the services each provides. Compare agents by what they will do to help you get your home sold, the information they provide and whom you trust.
