Legal Request Form (LRF): Its Relevance and Importance in the e-pon Biz

To start the process of review, LCD requires every requestor to submit a Legal Request Form or LRF This serves as the service level agreement between the requestor and LCD and defines the latter’s responsibilities for that specific legal request. LCD Successfully Conducted Several Seminars for the Benefit of e-pon Employees

With the initiatives of our Chief Legal and Compliance Officer, Atty. Sheila C. Yutuc, in coordination with the Human Resources Department, LCD successfully conducted the following seminars: Anti-Sexual Harassment and Safe Spaces Acts, Labor 101, and Data Privacy Act of 2012.

We receive a lot of letters from our readers and from those received, we pick one letter to feature in our newsletter For this issue, we chose Ms Lily Cruz Here’s her story.

"Dear Dr. Love,

My name is Lily Cruz. I am married with 2 kids. I am currently working in a BPO company. My husband is an OFW and currently in Dubai. My kids and I are living in my in-law’s house.

I write to seek your advice. Dr. Love, I am having an affair with my coworker, who’s a lesbian.

We have been co-workers for several years now. We started as friends and we have been going out every night. At first with our fellow co-workers then later, just the two of us. That’s where our love story began. This is the first time I fell in love with a lesbian. I didn’t think of myself as one but as they say when cupid’s arrow hit you, it hits you hard. And I have been head over heels in love with her. Yes, I had sex with her and we have been sexually active. We’ve been together for three months and are planning to live together in one roof with my kids. Dr. Love, I am leaving my husband and taking my kids with me to live with my lesbian lover.

My question is: Can my husband file a case against me if I he’ll know that I will be leaving him with another woman? Please enlighten me.

Legal Request Form...

Not all requests are the same. From the length of the contracts to the complexity of the legal questions, and receiving all documents and queries from different departments all at once, its a serious job that requires time.

LRF is an important aspect in monitoring our obligation with our stakeholders. It defines our responsibilities and the timeline within which to finish it. Our Chief Legal and Compliance Officer, Atty. Sheila C. Yutuc, has pre-assigned the handling of LRFs to yours truly. And I, on the other hand, assigns the LRF to staff for preliminary review. LRFs are monitored from the time its assigned to a staff up to its releasing. All reviewed LRFs are then submitted to our CLCO for final review and approval for release.

All LRFs submitted are pre-screened first by our Senior Legal Coordinator, Ms. Lovelene Dimapilis. It is very important that all needed information are completely filled-out. If the LRF is incomplete, we will return it to the requestor for proper completion. LRF serves as the basis for our legal review, hence, it should be complete and signed by both the requestor and his/her immediate superior. Without the signatures, the LRF will not be considered as official request and the same will be returned to the requestor. The signature of your immediate superior certifies that the request is authorized. Don’t forget to read our Disclaimer too!

The LRF is an integral part of LCD's mission to provide effective and timely legal services with the highest quality possible. Not only that, LRF also serves as the yardstick to measure our KPI so we can determine if we achieved our pre-set goals.

LCD Successfully Conducted Seminars...

As part of the initiatives of our Chief Legal and Compliance Officer, Atty. Sheila C. Yutuc, LCD had successfully conducted seminars on Anti-Sexual Harassment and Safe Spaces Act on November 11, 15, and 22, 2022

The seminars have taught the participants on what constitutes a violation of Safe Spaces Act and Sexual Harassment In the seminar, our resource speakers, Atty Philip Frantz Guerrero and Atty Romina Gumal, have explained how the victims can lodge a complaint against the perpetrator and the company’s obligation under the laws.

Aside from the seminars on AntiSexual Harassment and Safe Spaces Act, LCD had also conducted a seminar entitled "Labor 101," which was held on December 12, 2022 at 20F Marajo Tower, BGC. Headed by our CLCO, Atty. Sheila Yutuc, with our resource speakers, Atty Romina Gumal, Ms Kirsty Jazmin and Ms Jovy Bautista, Labor 101 cont

cont has equipped our Human Resources practitioners with the basic knowledge on the importance of due process in admin hearing, rights of employees, types of employment, etc.

A seminar on Data Privacy Act was likewise conducted by LCD, which was participated by HR employees. The resource speaker for this seminar was Atty. Philip Frantz Guerrero, Legal and Compliance Manager of e-pon.

All these seminars have been headed by our CLCO, Atty Sheila C Yutuc Recognizing the importance of imparting legal knowledge, Atty. Yutuc had graciously led the discussions and the question and answer portion of the seminars

For 2023, LCD aims to spearhead more seminars for the benefit of all e-pon employees.

Dear Dr. Love…

Dear Lily,

Thank you for your letter. I hope you and your kids are doing well.

Engaging in sexual intercourse with another man other than your husband, can land you in jail. But in your case, it's different.

According to Article 333 of the Revised Penal Code, adultery is committed by any married woman who shall have sexual intercourse with a man, not her husband and that man, has knowledge of her marriage, even if the marriage be subsequently declared void.

Notably, the law only mentions sexual intercourse with a man. It did not mention having carnal knowledge with a fellow woman. Thus, adultery cannot be successfully pursued against you for having an extra-marital affair with another woman.

However, marital infidelity constitutes a violation of marriage contract. Thus, your husband may file for legal separation on the ground of sexual infidelity or declaration of nullity of marriage when the sexual infidelity is of such nature that it manifests a psychological incapacity to comply with your marital obligations.

Your husband may also file a complaint for damages against your lesbian paramour for meddling with or disturbing your private life or family relations (i.e., alienation of affection).
