Are you looking for an indoor facility to host your next baby shower, birthday party, or board meeting? The City of Emeryville has four indoor facilities that are available to reserve exclusively for your special occasion, gathering, or event:
The Bridgecourt Room
Emeryville Child Development Center, Multi-Purpose Room
Located at 3990 Harlan Street, is perfect for hosting a board meeting, a small gathering, or even an instructional class. The Bridgecourt Room has an urban loft vibe with amenities that include; a seating capacity of up to 40 people, a wet bar/kitchen area, bathroom, and free Wi-Fi. This room also comes equipped with a projection screen and tables/chairs.
Looking for a safe, fun, and very family-friendly facility? The Emeryville Child Development Center, located at 1220 53rd Street, is the perfect location! You will have access to an industrial sized catering kitchen, a 100-person capacity multi-purpose room with a connected outdoor courtyard and a brand new, secure tot lot with playground. You can’t find a better location than this kid-friendly and safe environment.

Recreation Center
Emeryville Senior Center has a wonderful art deco design from the 1930’s that makes it an ideal venue for private parties, receptions, weddings and community functions. Our main hall has vaulted ceilings, hardwood flooring and can host up to 250 people. The Senior Center comes equipped with a stage, P.A. and sound system, tables and chairs and much more. If our main hall is too large for your event, our upstairs room is perfect for hosting smaller functions. Any room in the center is even available for weekday evening and weekend rentals!
The Robert Savage Recreation Center, located at 4300 San Pablo Avenue, is perfect for children’s birthday parties, trainings with break out rooms, meetings, and any type of shower. The Rec is equipped with projector and projector screens as well as TV’s in every room! With six conference style rooms for break out sessions, the Recreation Center can hold up to 30 seated guests in its largest room.

ABOUT US The Emeryville Child Development Center (ECDC) is dedicated to providing children ages four months to five years old with daily experiences filled with learning, laughter, and love. ECDC is operated by the City of Emeryville to provide families living, going to school, or working in Emeryville a safe and caring center for their children year round. The center is staffed by certified, professional teachers who help children achieve growth in all areas of development. Bi-annual assessments are completed for parents to convey the progress of each child in all development areas. Age appropriate lunch and snacks for all ages are served. The center also boasts some of the best caregiver to child ratios anywhere in the Bay Area. Opportunities abound daily for each child to explore, create, experiment, and savor the rewards that come with success!
WHO CAN ENROLL Priority will still be given to families that live in Emeryville, work in Emeryville, have children in the Emery Unified School District, or live in the 94608 zip code. Verification of residence or employment is required when enrolling. The Center also participates in a State subsidized program that allow for families in need to participate. AFTER SCHOOL PROGRAMS ADVENTURE WORKS (GRADES: K-6) Adventure Works is a City of Emeryville after school subsidized program offered in conjunction with the Emery Unified School district through ASES Grant. This full day extended after school program provides a warm, nurturing, and fun environment for students in grades K–6. Our staff maintains a maximum supervision and program creatively throughout the year, providing structured activities and supervision including: homework, assistance, science exploration, gardening, cooperative games, dance, drama, sports, nutritional snacks and more. In this program, emphasis is placed on offering the participants more critical thinking exercises and security in their independence to promote social, emotional, and cognitive development. Children must register with the Emeryville Community Services Department to participate. Children are escorted by staff to and from Anna Yates Elementary School to ensure a safe passage between sites. In the Adventure Works Program, every day is truly a great adventure.
TEEN CENTER AFTER SCHOOL PROGRAM (GRADES: 7-8) Sign your teen up for our awesome after school program specifically designed for the tweens/teens. There will be gaming, dancing, sports, arts & crafts, a mandatory homework hour, tutoring and a host of other popular enrichment classes, activities, games, and snacks! Our teen lounge is equipped with Xbox 360 & Wii, with a few table top games for your teen’s enjoyment. Come and meet your friends for these fun-filled days after a long day at school. Our seasoned Recreation Leader staff will provide the supervision. Pre-registration is required.

IN THE MIX HIP HOP DANCE CLASS Join our dance specialists as they demonstrate and help your child with unique dance routines using basic hand and foot coordination dance moves to more advance moves with a hip hop twist! EMERYVILLE MICRO SOCCER Welcome to The City of Emeryville’s Micro Soccer Program! Program Mission
To develop soccer skills, sportsmanship, team building and having fun. This is a non-competitive league, where the emphasis will be on individual and team improvement versus winning. Teams will focus on passing, player development, technical and tactical knowledge and apply it to games.
Expectations of Parents/ Families
We are keeping very short rosters; it is very important that participants are in attendance at as many games as possible. If your child cannot make a game please let a coach or coordinator know in advance so he/she can make arrangements. This is a non-competitive league, we ask parents to encourage their child, cheering them on by acknowledging their skills, (i.e. nice pass, nice shot, nice turn, good try).

MARTIAL ARTS CAPOEIRA Capoeira (capo-AYE-rah) is an Afro-Brazilian martial art that combines music, dance, acrobatics and self-defense. Do to it’s African roots, music and songs accompanied by percussion are an integral part of each class. Capoeira gives you power, flexibility, endurance and allows for self-discovery that builds your self-confidence. The challenge is within anyone’s reach regardless of age, gender or athletic experience. INSTRUCTOR PROFILE: Professor Malandro
Professor Malandro started capoeira at the age of 16 in Detroit, Michigan. In the year 2000 he moved to the Bay Area to train more intensely under a reputable master. In the year 2013 he became the first African-American to become formado under Mestre Nenel, The son of Mestre Bimba and currently runs the Filhos de Bimba Bay area school for Capoeira. Professor Malandro has taught capoeira classes both nationally and internationally including Japan, Israel, China, Germany, Guam and even various academies in Brazil.

YOUNG WARRIORS CLASS The Young Warriors is a capoeira youth program focused on developing discipline, respect, body awareness, confidence and social skills in a supportive and positive atmosphere. CAPO KIDS CLASS The “Capo-Kids” program is geared towards children ages 5-7. Children learn basic capoeira movements and music in a fun and playful environment. ADULT ENRICHMENT PROGRAMS KAJUKENBO KUNG FU Kajukenbo Kung Fu is an eclectic, modern martial art founded in Hawaii in 1947. Kajukenbo was created as a new fighting system that emphasized effective skills for self-defense within the framework of graceful and powerful movement. The instructors are Sifu Kate Hobbs (seventh degree black belt in the Gaylord Method of Kaj Kung Fu) and assisted by third degree black belt Sifu Lynn Keslar and second degree black belt Sifu Sam Mende-Wong.

Open to family members of all ages, the class structure is built to support brand new beginners as well as students who have a regular Kajukenbo practice. The purpose of the class is to introduce families to Kajukenbo, give them a chance to learn some basic self-defense skills and offer the whole family a healthy start to their weekend. The class includes conditioning, rigorous repetition of basic strikes and blocks, and traditional forms practice. Students are guided through a vibrant and vigorous warm-up for the first hour, then a snack and water break, followed by specific Kajukenbo skills training. AGES

Joseph Emery Skate Park to Open Soon In March 2015, the City of Emeryville contracted with the firm of California Skateparks to construct the Joseph Emery Park Skate Park to be located at the existing linear park on the west side of the CVS/Promenade Center parking lot on San Pablo Avenue. Construction of this Tony Hawk Foundation award winning project is nearing completion. The design was prepared by Wormhoudt Inc. with major input and buy-in from our local skateboarding enthusiasts. The facility includes a series of poured in place concrete skate features placed on each side of a pathway that runs from 45th Street to Park Avenue, a large skateable bowl feature, Public Art in the form of a skate feature and art barrier, and a Portland Loo public restroom facility. The Center receives free tickets to other shows, including ballets, concerts, and various other entertainment throughout the Bay area. Tickets are available on a first come first serve basis and are available to members only—so join the center today!
MONTHLY DINE AROUND Meet for lunch at 11:30am on the third Thursday of the month at a local restaurant, or go out of town on the “Go Van Go” bus. You are responsible for the price of your own meal and tip. ART AND MUSEUM LOVERS GROUPS Art and Museum trips are scheduled to take advantage of the best and most exciting exhibits in the Bay Area. Trip fees include transportation and excursions are planned that coincide with the museum’s FREE days as much as possible. There may be an additional charge for special exhibit entrance, which will be included in the trip cost.
FRIDAY MOVIES The center strives to provide the best entertainment and continues to offer the most current movies, award-winning series, and documentaries. Movies are shown every Friday at 1:00pm. Our projection system makes you feel like you are at the movies! While watching the movie, enjoy popcorn, a drink or other treats courtesy of the center. Don’t like our selection of movies? Please submit your suggestions or volunteer to be one of our “Movie Critics” that select the movie you feel other members would enjoy. Call the office to volunteer for this fun position.
LINK UP! Members of the Senior Center receive our monthly newsletter the LINK, which gives you up to date information about activities and events at the center.
AARP 55 ALIVE DRIVER CERTIFICATION COURSES 8-Hour Certification Class and 4-Hour Refresher Class AARP driving classes provide a comfortable setting for older adults (ages 50 and older) to help protect you and improve the roads for everyone. Participants who complete the course earn a certificate and may be eligible for a discount on their car insurance. Advanced registration required. Call the Center at 510-596-3730 to reserve a space. MOBILITY MATTERS PROVIDE RIDES FOR SENIORS! NEW NAME — SAME GREAT SERVICE. Senior Helpline Services feels so strongly that mobility matters to each of us that the agency has changed its name to Mobility Matters. Those of us who drive often forget there are others in our neighborhoods that are unable to get to their medical appointments or get groceries without assistance. If you have time to donate a few hours a month, you could improve the lives of local seniors by helping maintain independence and freedom. Become a volunteer driver with the Rides for Seniors Program. Volunteers must be: good drivers, 25–75 years old, have a licensed, insured vehicle in good condition to use to provide rides, attend a 3 hour training session, undergo a background check and agree to provide an occasional ride to an ambulatory senior. 8-TO-GO ON-DEMAND SHUTTLE SERVICE Transportation for Seniors and People with Disabilities in Emeryville and Oakland

WHAT IS ‘8-TO-GO’? The ‘8-To-Go’ is an on-demand shuttle service for everyone ages 70+, or people ages 18-69 who are certified to use East Bay Paratransit. Once enrolled in the program, users just place a call to set-up your travel itinerary and location, it’s that simple! Travel is limited to locations to and from the 94608 zip code area (which is all of Emeryville and portions of North and West Oakland including MacArthur BART, Kaiser, Sutter and more).
WHY SHOULD I USE ‘8-TO-GO’? This service is intended to help seniors and people with disabilities travel within the local 94608 area. Whether it’s a trip to the senior center, grocery store, favorite restaurant, medical appointment, or religious services, ‘8-To-Go’ will provide the personalized service and attentiveness not found in other transportation services.

EMERYVILLE TRI-CITY CAFÉ HOT LUNCH PROGRAM The center offers a hot pre-packaged meal daily in our main auditorium. The meals are provided by Nutrition Solutions focusing on using low fat and sodium ingredients. This is a self serve lunch which runs Monday–Friday, 11:45am-12:15pm. Suggested Donation for the meal is $3.00 for adults 60 years and over and $5.00 if under 60. You must fill out an application form to participate in addition to the Senior Center Membership form.
BLOOD PRESSURE CHECK-UPS The Alameda County Fire Department visits the Recreation Center HW Room every first and third Friday of the month at 11:30 a.m. to check your blood pressure (and they maintain records for comparison).
HEALTH CHECK UP AND FOOT CARE A geriatric nurse practitioner from the 60+ Health Center provides bimonthly foot care, diet and medication review, and blood pressure checks at the Recreation Center. Free for members. DATES

Why should I pre-register for activities? Almost all activities require pre-registration. Without pre-registration, our staff will not be able to have the correct supervision or supplies to make sure you have a great experience. Note: A few of our community/special events and senior activities do not require pre-registration. These will be noted in the activity/event description.
There are four (4) ways to register for activities/events in Emeryville:
ON-LINE Please visit www.emeryville.org/activenet to register for almost any program! ActiveNet requires immediate payment, so make sure to have your debit/credit card or electronic check handy. Avoid wasting gas, paper, and time waiting in line…register online today!
WALK-IN Register in-person weekdays at the Recreation Center (9:00am6:00pm) or Veteran’s Memorial/Senior Center (9:00am-5:00pm) for almost every activity and event. Be sure to bring your checkbook or credit/debit card too, fees are due in full to register for a program. If you also want to save time, please download a registration form from http://www.emeryville.org and pre-fill all of the activity information before you arrive.

Membership is only $10 for residents, $20 for non-residents, and entitles you to enjoy the many activities, events, and trips organized by the Senior Center. Members also receive ‘The LINK’, a monthly newsletter that gives up-to-date information that impacts seniors. Membership is open to residents and non-residents alike, so stop by the Senior Center to fill out the form or download it at http://www. emeryville.org/seniorcenter.
How do I register for infant and toddler/child development center activities? The Emeryville Child Development Center (ECDC) only accepts walk-in registrations due to eligibility and availability constraints. Eligibility for enrollment into ECDC programs is open to all families with children ages 4 months to 5 years. Please call to set up a tour for the programs and facility. Please call the ECDC with any questions at 510-596-4343.
Why was the activity canceled or rescheduled? Due to low enrollment, instructor emergencies, weather conditions, or many other reasons, a class may be cancelled or rescheduled at any time. Staff attempts to limit these occurrences, but they are bound to happen. If an activity is cancelled or rescheduled, you will have the opportunity to join a rescheduled activity, join a different activity, or receive a full refund. Please allow four to six weeks for cash or check refunds to be processed. We sincerely apologize in advance for any inconvenience this may cause.

Emeryville, California is now an officially a SeeClickFix partner! The new mobile app will allow citizens, residents and visitors to report problems such as potholes, graffiti, drainage and flooding quickly and easily via web tools and mobile apps. These reports are then forwarded directly to departments throughout the city with all the information needed to get the job done. Furthermore, the platform offers a centralized and integrated management system, whereby city officials can communicate with citizens, track issues and monitor success. This unified and citizen-connected platform will increase both the quality and efficiency of service throughout Emeryville. The mobile app is available for download on Android and iPhone. In addition to the mobile apps, residents can send reports to the city using the widget on the city’s website and seeclickfix.com. Emery Go Round Shuttle Property Based Improvement District (PBID)
Frequently Asked Questions 1. WHAT IS THE EMERY GO ROUND SHUTTLE (EGR)? Emery Go Round (EGR) shuttle is a no-fee service that connects the City to the MacArthur BART Station; provides connectivity through the City; and connects to the West Berkeley shuttle (at Berkeley Bowl West). In 2014, the EGR had almost 1.7 million boardings.
2. HOW IS THE EGR FUNDED? The EGR is primarily funded through the Emeryville Property and Business Improvement District (PBID) – which is a special assessment fee placed on commercial/retail/industrial parcels as well as residential (rental and home-ownership) parcels in the City.
3. WHAT IS A PROPERTY AND BUSINESS ASSESSMENT DISTRICT (PBID) A PBID is a special tax assessment district. As a special assessment district, the services/programs/projects provided through assessment fees must have special benefit to the properties assessed. In the case of the proposed PBID, the special benefit is access to the Emery Go Round shuttle.
4. HOW IS THE PROPOSED PBID ASSESSMENT LEVY DETERMINED? An assessment engineer determines the general vs. special benefit conferred by the proposed PBID and then calculates the special benefit for each parcel. General benefit is benefit that is not associable to any parcel within the proposed assessment district (for example, benefit received from parcels located in Oakland that have access to the EGR) and such costs cannot be included in the proposed assessment district. For the new PBID, the special benefit for each parcel was determined by an assessment engineer according to the trips generated by specific land use. Parcels that have high trip generation land uses (such as retail centers and banks) have been assessed higher than lower trip generation land uses (such as warehouses or light industrial). In addition, each parcel’s assessment levy is further weighted according to whether the parcel is within ¼ mile a stop along a 7-day or 5-day route.
5. HOW WAS THE PBID ESTABLISHED? The Emery Go Round PBID was initiated by the City, ratified by the City’s property owners through a mail in ballot process, and then approved by the City after a public hearing.
6. WHAT WERE THE RESULTS OF THE PBID BALLOT PROCESS? Ballots were mailed to every property owner and each ballot indicated the proposed assessment levy for each parcel owned. Ballots were weighted according to the assessment to be paid by each parcel. Ballots representing 71.25% of the cast ballots (as weighted according to assessment fee to be paid by each property owner) approved the PBID, while ballots representing 28.75% of the weighted ballots cast protested the PBID.
7. WHAT IS THE ASSESSMENT FEE? The PBID management plan and assessment engineer’s report includes the proposed assessment levy for each parcel by parcel number and site address based upon the trips generated according to each parcel’s land use and route access. The proposed management plan and assessment engineer’s report can be downloaded from the City’s website: www.emeryville.org or obtained through the City Clerk’s Office. Residential property owners (home ownership parcels in multi-unit complexes) who live within ¼ mile of a 7-day EGR route stop pay $111.49 per year; within ¼ mile of a 5-day route stop pay $79.60 per year. Property owners who own a stand alone single family home pay either $171.52 or $122.47 (7 vs. 5 day route). Commercial property owners pay according to the specific land use as outlined in the PBID management plan/assessment engineer’s report.
8. WHEN WILL THE PBID ASSESSMENT FEE BE LEVIED? The PBID assessment levy would be placed on the property tax rolls, starting in Fiscal Year 2015-2016.
9. HOW WILL PBID BE GOVERNED? The Emeryville Transportation Management Association (TMA) is responsible for operating the PBID. The TMA consists of all of the property owners that are assessed by the PBID (the general members). Decisions are made by the TMA Board and/or the general members according to the TMA bylaws. The PBID management plan states that the Board composition and bylaws must be based upon an equitable representation of all stakeholders (residential and commercial property owners) and that the City must approve the TMA Board composition and bylaws by incorporation into the TMA/ City agreement. The TMA/City agreement is the basis for the TMA to receive PBID funds for operating the shuttle and is scheduled to be approved by the City Council in November/December 2015.

Neighborhood Clean Up Monday April 11th and Tuesday April 12th, 2016 Emeryville will once again host curbside bulky-waste or “Spring Clean-Up” days on Mon. & Tues., April 11th and 12th on your regular collection day. This event is for residents in residential neighborhoods with curbside collection. If you live in a multi-family property and are not certain whether you can participate, contact your property manager or Marcy Greenhut, at the City: 510-596-3795 or mgreenhut@emeryville.org. Single family residents can also order a bulky collection appointment a second time during the year, and multi-family property managers can order a bulky collection day separately, by calling WMAC at 510-613-8710.
Here are guidelines for setting out items that don’t fit or don’t belong in your regular trash or recycling or compostables bins: • • • •

Purchase Award—Latest Public Art Acquisition in the City’s 25 year old Art in Public Places Program (AiPP) December 10, 2015 the Emeryville arts community gathered in celebration of the City’s continued support of public art with the installation of its newest acquisition, a clay work by Jeff Margolin In the 25th year since Emeryville initiated a 1% for the Arts with commercial developments, the City celebrated with the commission of new pieces under the Powell Street overpass and at the Emeryville Center of Community Life, recommissioning of the Bus Shelter Temporary Art program and commission of an inaugural Public Art Master Plan, to be conducted in 2016. And, as done for the last decade, the City purchased a piece selected from the Emeryville Celebration of the Arts exhibition, concluded in October of this year. The piece by Jeff Margolin, like all Public Art works acquired by the City, was selected by a panel, recommended to the Public Art Committee and approved by the City Council. It has been installed at City Hall, outside the City Council chambers in the grand staircase’s landing.

The clay sculptures of Jeff Margolin convey a strong artistic message, which are a product of astonishing and sensual aesthetics, and include fascinating philosophical statements. Inspired by artists such as Dali, Escher, Giger and their sense of flow and movement, Margolin shapes sculptures that are dynamic in nature, in contrast to their solid façade. The juxtaposition between textured and polished, transparent and opaque, rounded and sharp; makes for an undermining and destabilizing artistic message. The sculptures are prominent in their space, while constantly altering it.
Margolin adds intriguing touches to the porcelain shell. The pieces are built up with coils, just like traditional ceramic ware, then smoothed and carved. During the firing Margolin often tosses sawdust on the hot surfaces and drapes strands of human or horsehair on them, which leaves behind charred freckles and delicate squiggles. Born in California, Margolin is a graduate of the University of California at Berkeley with a degree in political theory and economics. He has worked with clay for over forty years and his pieces, which are

represented in fine art galleries throughout the country and overseas, receive the admiration and praises of collectors and critics alike. He has taught art at the Massachusetts Institute of Technology and at the University of California at Berkeley. Update on Development Proposals PARC ON POWELL RESIDENTIAL PROJECT AND PAPERMILL PARK This four-story project on the corner of Powell and Hollis is now complete. Folks have moved into the two residential buildings. The proposed park in between the building and Stanford Avenue is under construction. Ike’s Sandwiches will open at this location soon.
EMERY STATION WEST (TRANSIT CENTER) Clean-up of soil contamination has begun on the Amtrak parking lot that will accommodate a mixed use transit-oriented development and public parking structure with 250,000 square feet of office and laboratory space. This project will include a new public plaza between Amtrak Station and Emery Station West building and will provide a connection to the existing pedestrian bridge over the railroad tracks.
J-SEI COMES TO EMERYVILLE J-Sei, an organization providing care and services for older adults, has received Planning approvals to move into 1285 66th Street. J-Sei provides bilingual case management, home-delivered lunches, transportation services, and family programs and activities.
NEW STORES AND FACADE AT EAST BAYBRIDGE SHOPPING CENTER In July 2014 the Planning Commission approved a Major Design Review application for 3839 Emery Street. In Fall of 2015 exterior changes were completed and two new stores, Nordstrom Rack and Ulta Beauty, opened. Exterior changes include new signs, expanded landscaping, more trees, new benches, and new bicycle parking areas.
LEPORT SCHOOL OPENS A SECOND LOCATION IN EMERYVILLE Building Permits have been issued to convert existing buildings at 1450 and 1452 63rd Street, the former site of Every Dog Has Its Daycare, into a school. LePort School will serve up to 177 students, from infancy through the first grade.

Projects in Development
This map shows development projects that are in discussion, in the planning approval or building permit process, under construction, or recently completed. People have moved into Emme and Papermill Apartments, the Shell Station, Pixar warehouse and new stores in East Baybridge shopping center. Construction is underway on Emeryville Center of Community Life, Hyatt Place, a new park on Stanford Avenue, and Ocean Avenue townhouses. The Planning Commission has approved EmeryStation West at Transit Center, and three of the Marketplace projects and the adjacent park. The Commission is about to consider proposals on the Sherwin-Williams, Nady, 65th and Marketplace sites. The City is still defining what could be built on its sites north of Bay Street and south of Christie Avenue Park.
Permits for Solar Panels on Houses Get Easier The City Council has given its approval for a streamlined process for building permits for solar panels on single family homes and duplexes. With this State-mandated program (AB 2188) in place, the City will now accept on-line applications for these types of permits. AB 2188 requires local governments to adopt a solar ordinance by September 30, 2015 creating a streamlined permitting process that conforms to best practices for expeditious and efficient permitting of small residential rooftop solar systems. By improving the efficiency of solar permitting statewide, AB 2188 will help lower the cost of solar installations and further expand the accessibility of solar to more
California homeowners who want to control their electricity bills and generate their own clean energy. In addition, making solar energy more affordable will help the state reach its renewable energy and greenhouse gas reduction goals, and create more local jobs. The Emeryville Police Department has a New Chief! Chief Jennifer Tejada has been working in municipal law enforcement for over 20 years and is recognized as one of the most visible advocates for community outreach programs in Marin County. Throughout her career, Chief Tejada has created programs and/or worked in a leadership capacity in several specialized areas including Threat Management, Emergency & Disaster Preparedness, Workplace Violence Prevention, Domestic Violence and Sexual Assault Prevention, and Hostage Negotiation. She has also served on several violence prevention and victim services committees, boards and commissions both locally and regionally in the State of California. Chief Tejada is proactive in her role as Vice-Chair of the Legislative Committee for the California Police Chief’s Association and in this capacity she regularly appears in the State Capitol advocating for legislation that protects communities, funds crime prevention programs, and ensures local control on critical issues such as marijuana legislation and realignment. Chief Tejada is a strong advocate for building trust and community partnerships, and working closely with public and private entities to ensure safety, and deliver efficient and quality service to all community members. EMERYVILLE’S MINIMUM WAGE AND PAID SICK LEAVE ORDINANCE The Emeryville City Council adopted an ordinance that will provide for a higher citywide minimum wage and additional paid sick leave provisions than required by the State of California. The new law requires a higher minimum wage rate than the state rate of $9 per hour; however, different minimum wage rates will be required depending on the size of a local business. Small businesses are ones that have 55 employees or fewer and will be required to pay a slightly lower rate than businesses with over 55 employees until July 1, 2019. For the purposes of this ordinance, an employee is someone who works at least two hours per calendar week within the city limits of the City of Emeryville. This includes full-time, part-time, and temporary employees. For small businesses, the minimum wage rate is $12.25 per hour effective July 2, 2015. Large businesses must provide a minimum wage of $14.44 per hour effective on July 2, 2015. There are two exemptions to the minimum wage and paid sick leave requirements of the ordinance. Employees who are subject to a ratified collective bargaining agreement wherein the provisions of the proposed Minimum Wage and Paid Sick Leave Ordinance are expressly waived are exempt. Further, state minimum wage law allows that “learners” may be paid no less than 85 percent (85%) of the minimum wage for the first 160 hours of employment. As defined by the California Industrial Welfare Commission, “learners” are employees who have no previous similar or related experience in a given occupation. A learner may be of any age. As it pertains to the Emeryville Minimum Wage and Paid Sick Leave Ordinance, an employer shall pay a “learner” no less than 85 percent (85%) of the applicable minimum wage. The ordinance does not allow for any tips or employer-paid health benefits to be used as credit toward achieving the required minimum wage rate. Additionally, the new law includes requirements concerning service charges frequently billed to customers in hospitality establishments. Another important condition of the new law is the provisions related to paid sick leave. On July 1, 2015, AB 1522 went into effect
requiring that all employers in the State of California provide paid sick leave to both full-time and part-time employees, accrued at the rate of one hour paid sick leave for every 30 hours worked. The City’s proposed ordinance includes additional paid sick leave benefits beyond the state requirements: • Maximum of 48 paid sick leave hours accruable for employees of small businesses (55 or fewer employees within Emeryville) and 72 hours for Employees of large businesses • In each year of employment, an employee may use up to the total number of paid sick leave hours accrued, subject to the maximum number of accruable paid sick leave hours, as described above. • AB 1522 allows an employee to use paid sick leave to provide care for a family member. The ordinance broadens the definition of “family member” to include a designated individual (if employee has no spouse or registered domestic partner) for whom an employee can use paid sick leave to provide care. In addition, the employee may use paid sick leave to provide care for a guide dog, signal dog, or service dog of the employee, employee’s family member, or the person designated by the employee. • Eligible employees include private for-profit, private non-profit, and city employees who work at least 2 hours per calendar week within the boundaries of the City of Emeryville. It applies to both part-time and full-time employees, regardless of age or place of residence. Workers exempt from payment of state minimum wage will also be exempt from the citywide minimum wage, such as independent contractors or workers who are the parent, spouse, or child of the employer, if the employer is a sole proprietor. Any individual, partnership, corporation or sole proprietor who wishes to conduct, either directly or indirectly, any business within the City of Emeryville must secure a business license certificate. The City of Emeryville ordinance states that it is unlawful for any person to commence, transact, engage in or carry on business

in the City without first having obtained a valid license and paid the license fee. Organizations operating entirely for the benefit of charitable purposes and those exempt from filing information returns under 26 U.S.C. §6033 (a)(2) are exempt from the payment of business license taxes. However, such organizations must still receive and maintain a current business license and are subject to an annual renewal and statement affirming its status as a charitable organization by March 1 of each year. EMERYVILLE CITY NEWS Looking for Down Payment Assistance to Purchase a Home in Emeryville? The City of Emeryville has two down payment assistance programs to assist income-eligible, first-time homebuyers to purchase residential units in Emeryville through “silent” second mortgages. These low-interest, deferred-payment second mortgages can be used to reduce the amount needed to borrow from a primary mortgage lender, reducing monthly mortgage costs. The two programs are CalHome, available to low-income or below households, and the First Time Homebuyer Loan (FTHB) program, available to households earning at or below moderate income. CalHome may be used to purchase either market-rate or below-market-rate units, while the FTHB program may only be used for the purchase of market rate units. In either program, the borrower must make at least a 3 percent down payment and occupy the unit as a primary residence during the duration of the loan term. The loan is due upon sale, transfer, when the unit ceases to be owner-occupied, or in 30 years, whichever comes first.
The City currently has over $1.5 million available in funding for the CalHome program and $150,000 available in the FTHB program. The funds from the CalHome program must be expended by October 2016. Bicycle and Pedestrian Improvements Installed on Christie Avenue to Link Bay Trail to the Bay Bridge Trail You probably noticed the construction over the last few months by Powell Street Plaza and Bay Street. If you were wondering what was going on, the City of Emeryville was constructing our newest bike and pedestrian path. Now open for use the path is protected by a landscaped median from traffic, linking the Bay Trail from Powell Street to Shellmound Street. It was constructed by taking the north turn lane along Christie Avenue and using it for the raised class I path for cyclists and pedestrians in both directions with a planting strip and curb separating the improvements from the roadway. At Shellmound turning movements will be facilitated by striping (to accommodate cyclists turning left onto the pathway from northbound on Shellmound Street, ramps, and signal enhancements. The improvements were funded by Alameda County’ Transportation Commission’s (ACTC’s) Measure B and Vehicle Registration Fee funding and the City’s Transportation Impact Fee (TIF).
