Chesterfield Borough Council’s Bereavement Service provides a caring and sensitive service for people at a difficult time. The Bereavement Service staff can give helpful advice and guidance relating to all aspects of funerals and memorials. This brochure has been produced to provide more information on the cemeteries and crematorium and the service that we provide. We know just how difficult a time it can be when someone close to us dies. The feelings of shock, sadness, loss and bewilderment can take over our lives. It is also a time when there are so many things to be done, just when we feel least able to do them.

Chesterfield Bereavement Service has produced this death and bereavement guide to help you through this difficult time. It provides guidance, support and reassurance and will help you to access all the information you will need to help you through your bereavement. In the guide we give you all the information that we know you are likely to need in the next few weeks and months. We suggest what the first priorities are; explain how, when, and where you register the death; offer help with arranging a funeral ceremony and sorting out the estate and provide lists of organisations and agencies you may need to contact. We let you know what is required by law and what your choices are within it. There is a section on how you can get help to cope with the feelings of bereavement. Losing a loved one presents many challenges and our bereavement guide gives some suggestions of organisations you might like to contact for support. We aim to provide a sympathetic, helpful and considerate service to help you make the necessary decisions and arrangements when someone dies. It is important to us that you have the best and clearest information and guidance to make sure that the arrangements you make are the ones that are best for you, your family and friends.

What must you do when someone dies? When someone dies, you will need to inform a number of people and organisations and complete certain documents needed by law. If you are a relative or friend you can do some of these things yourself. Others will need to be done by the executor or administrator of the estate. There is plenty of support available to help you through this difficult time. What to do in the first few days You won't be able to do everything right away, but in the first few days it's important, if you can, to: • tell the family doctor • contact a funeral director, if you intend to use one ‐ if the death occurs at home or in a nursing home the funeral director will need to be contacted to move the deceased to a Chapel of Rest • Begin arrangements for the funeral ‐ you should check the will for any special requests Information on what choices are available is in section 4 about funerals

obtain a Medical Certificate of Cause of Death signed by a doctor or if the coroner is involved take instructions from the coroner's officers regarding registration of the death register the death at the Register Office. You'll find details of how to do this in the section on registration if relevant, complete the reverse of the white BD8 form and send to the local Jobcentre Plus or Benefits Agency (given when you register the death)

As early as possible: •

contact the executor as soon as you can to enable him/her to start the process of obtaining probate if necessary. The executor is usually nominated in the will

if there is no will, decide who will apply to sort out the deceased's affairs and contact the Probate Registry to apply for 'letters of administration' if necessary

Documents you will need in the first few days You'll need to gather together the following documents as soon as possible ‐ to enable registration of the death and to start funeral arrangements.

* It is not necessary to have these documents but you will need to provide information contained within them, e.g. date and place of deceased's birth, spouse/civil partner's full name, etc.

How do you register a death? How and where you can register a death, and information you will need to provide A death must be registered within five days from when it occurred. This period can be extended in exceptional circumstances and if the coroner is involved. The registration must take place in the district where the death occurred. If it is difficult for you to get to the appropriate register office, you may visit your local office and declare the necessary information. In this case the registration by declaration may result in a delay in the issue of the document needed for the funeral arrangements. A stillborn child is legally defined as a child born after the 24th week of pregnancy who did not, at any time after being born, breathe or show any other signs of life.

What do you need to do to register a stillbirth, either inside or outside Derbyshire

When a child is stillborn, a doctor or midwife will issue a medical certificate of stillbirth. The person who registers the stillbirth must take this certificate to the registrar. Every stillbirth in England or Wales must be registered in the district in which it takes place. A stillbirth may not be registered more than three months after it occurred.

If the stillbirth occurs in Derbyshire

You will be able to make an appointment to attend any of the registration offices in the county. For more information call the Chesterfield Register Office .

If you live outside Derbyshire or if the still‐birth occurs outside Derbyshire

If you live outside Derbyshire and it is not convenient for you to register the stillbirth in the county, you may prefer to make a declaration of the stillbirth at your local register office. Staff from your local register office will be able to offer you advice on the procedure for this or telephone the Chesterfield Register Office on 01246 271405. Please note that registration by declaration does result in a delay in the issue of the document needed for the funeral arrangements.

Who can register a stillbirth? Parents married to each other

If the parents of the child were married to each other at the time of the stillbirth (or conception), either the mother or the father may register.

Parents not married to each other

If the parents were not married to each other at the time of the stillbirth (or conception), information about the father may be entered in the register only in the following circumstances: if the mother and father go to the register office and sign the stillbirth register together, or where the father is unable to go to the register office with the mother ‐ the father makes a statutory declaration acknowledging his paternity which the mother must produce to the registrar (this form may be obtained from any registrar in England or Wales), or where the mother is unable to go to the register office with the father ‐ the mother makes a statutory declaration acknowledging the father's paternity which the father must produce to the registrar (this form may be obtained from any registrar in England or Wales). If the parents of the child cannot register the stillbirth the following are qualified to do so: the occupier of the house or hospital where the child was stillborn, a person who was present at the stillbirth, a person who is responsible for the still‐born child, or the person who found the stillborn child (where the date/location are unknown).

Information to be supplied for the registration of a stillbirth

for the child: • date and place of stillbirth • the forename(s) and surname, if the parents wish to name the stillborn child • sex of the child for the father (where this information is to be entered in the register): • forename(s) and surname • date and place of birth • occupation at the time of the stillbirth or, if not employed at that time, the last occupation for the mother: • forename(s) and surname • maiden surname if the mother is, or has been, married • date and place of birth • occupation at the time of the stillbirth or, if not employed at that time, the last occupation • usual address at the date of the stillbirth • date of marriage, if married to the stillborn child's father at the time of the stillbirth

Chesterfield Crematorium

The Chapel

Chesterfield Crematorium was officially opened on 5th November, 1959 The chapel, built in a modern style, provides seating for 80 mourners, plus a standing area at the rear of the chapel. A 40‐minute period is allocated to each funeral service. The whole funeral service may take place at the crematorium, or a service can be held at a church or other venue followed by a ‘Committal only’ at the crematorium A loop system, disabled access, parking and toilets are all provided.

Music

Music is a very important part of a funeral service. The chapel is equipped with a computerised music system, with a large library of many different types of music. An organ is also provided in the chapel, and an organist will be provided by the Crematorium, upon request.

The Book of Remembrance

The Books of Remembrance are on view daily, providing a lasting memorial to your loved one. The name of the deceased and a suitable epitaph of up to eight lines is recorded on the date of your choice, which could be the date of death, a birthday or an anniversary. The pages will be turned daily so that inscriptions may be viewed on every anniversary of the date requested or any other day by appointment. The lettering is hand‐written in the finest traditions of medieval illuminated manuscripts, and the volumes are richly bound and tooled.

The Garden of Remembrance The garden is split into thirty one sections, representing each day of the month. When cremated remains are laid to rest in the Garden of Remembrance, a record is kept of the section of the garden where the cremated remains are placed, usually that associated with the date of death. If a family member expresses a wish for their own cremated remains to be strewn in the same section of the Garden of Remembrance as their relative or loved one, then this can be arranged. For further information please contact a member of the bereavement staff. An area has been provided for the planting of commemorative trees. A small plaque can be placed in front of the tree commemorating a loved one. For further information please contact a member of the bereavement staff. Relatives and friends of the deceased are respectfully asked to refrain from placing tokens of any kind on the remembrance garden as they quickly deteriorate and become unsightly. Those wishing to bring flowers for special occasions or anniversaries are asked to place them in receptacles beside the Chapel or within the kerb plaques provided. CHESTERFIELD BOROUGH COUNCIL CEMETERIES

Staveley Cemetery

Chesterfield has four cemeteries within the Borough, providing full burial facilities and each having new graves available. Each cemetery has a unique character, and they are all tranquil and safe places for bereaved people and other visitors. They each have both consecrated and non‐consecrated burial sections to provide for all denominations. Dogs are permitted in the cemeteries and owners are requested to respect their special character by keeping their dogs on a lead. The exclusive right of burial in a grave can be purchased for a period of up to 100 years. At the end of the period, the lease may be renewed; otherwise the rights transfer back to the Council. The registered grave owner will receive a Deed to the grave. This is a legal document and should be kept in a safe place. Bereavement Services must be contacted for advice if it is wished to transfer the Deed to a new owner.

Staveley Cemetery

Staveley Cemetery is an old Victorian cemetery, dating back to 1884 and covers just over ten acres. The entrance to the cemetery is off Inkersall Road, on the outskirts of Staveley. It covers more than ten acres and a range of new graves is available. There are sections that are Consecrated for Church of England burials and Unconsecrated for non‐conformists, including Roman Catholics, as well as special areas for babies and young children and for the interment of cremated remains.

Brimington Cemetery

The Cemetery is situated about three quarters of a mile to the west of Brimington, signposted off the A619 Chesterfield to Staveley road. It covers almost seven acres.

Opened in 1878, the Brimington Cemetery features many fine trees that play host to a range of wildlife. New graves are available and a wide range of burial facilities are offered, including a special area for Muslim burials.

Spital Cemetery

Situated three quarters of a mile from the town centre, Spital Cemetery was the first cemetery to be opened in Chesterfield in 1857 to serve the local communities of Chesterfield and Tapton. It provides approximately 10.5 acres of burial space, with the greatest number of burials to date. There are two entrances, off the A632 road at Hady Hill. The cemetery contains a number of fine memorials, which provide an interesting history of Chesterfield's social, political, cultural and economic changes since the 19th century. Many of the memorials refer to those who worked in local industries and those who fought and died during the 1st and 2nd World Wars. The graves also provide a factual record of the various communities who have lived in the town, and the many that continue to do so. The special character of the facility is confirmed by the fact that it is a Grade II listed site on the Register of Historic Parks and Gardens. Our regulations allow a wide range of choice for the bereaved in the size, height and style of the memorials permitted. There is sufficient spare capacity to accommodate burials for a further ten years (from 2009) at current rates of use. There are up to 40 interments annually in the consecrated and unconsecrated areas and there are also special facilities for the interment of cremated remains.

Boythorpe Cemetery

Situated just over half a mile to the south east of the town centre, Boythorpe is the largest and most recent cemetery in Chesterfield. It was opened in 1919 and covers almost fourteen acres, including both consecrated and unconsecrated areas. Since opening there have been more than 14,000 interments. A full range of graves is available at the cemetery.

A full service may be held, followed by the burial, or alternatively a service could be held in a church or other venue and the coffin brought to the cemetery for burial only. The Bereavement Services staff will prepare the grave for the burial, and a Burial Attendant will ensure that the service takes place safely and smoothly. Following the burial, when the mourners have left, the grave will be back‐filled and re‐instated with turf or grass seed, depending on the season. Any floral tributes will be placed on the grave, and will be removed after 10 days. The grave will be checked at this point and again six months following the burial, and will be topped up and re‐turfed or seeded if necessary. The grave will be maintained as part of the general maintenance of the cemetery, although the Council offers an enhanced maintenance scheme for those that require it. Further details are available from the Bereavement Services Office.

Graves Burials take place in graves, which are laid out in regular pattern within the cemeteries. A grave may be un‐purchased, which means that the rights to it remain with the Council, or purchased, which means that the right to bury in the grave and to place a memorial on it are transferred to the owner. The ownership of the land does not transfer ‐ the Council owns all the land within the cemeteries. The rights to a grave may be purchased for 50, 75 or 100 years. At the end of the period the lease may be renewed, otherwise the rights transfer back to the Council. A grave may be purchased in advance of need, or it may be purchased subsequent to the burial. The grave owner receives a Deed to the grave, which is a legal document and should be kept in a safe place. Bereavement Services should be contacted for advice on the procedures required if it is wished to transfer the Deed to a new owner. Up to four burials can be accommodated in each grave, providing that this is requested at the time of the first burial. Once a grave has no room for further full coffin burials, it is possible for up to six sets of cremated remains to be buried in it, thereby extending the life of the grave for future generations.

Family Research Bereavement Services receives many requests from people researching their family history. The registers for the Spital, Brimington, Boythorpe and Staveley Cemeteries and Chesterfield Crematorium are held at the Chesterfield Crematorium Office. Bereavement Services staff can conduct searches for you or you may arrange an appointment with the office to come and view the records yourself. Basic burial records on microfiche are also held at Chesterfield Central Library.

Safety Inspections of Memorials

Bereavement Services are currently carrying out safety inspections on all memorials within Chesterfield’s Cemeteries. The inspections are being undertaken in accordance with advice issued to local authorities by the recent Memorial Safety Guidance 2009 issued by the Ministry of Justice. A safety‐warning label is fixed to any memorial that is found to be unsafe. This is to advise owners to contact Bereavement Services and not to touch the memorial unless they are having the memorial repaired by a qualified memorial mason who is registered with the Council. A List of registered memorial masons can be obtained from the Chesterfield Crematorium Office. Our memorial inspection team will make memorials safe using a temporary support system, or in some cases laying the memorial flat on the ground or setting it into the ground. Memorials must be repaired using a ground‐anchor system. Any new memorial must also be fixed with a ground‐anchor system. __________________________________________ Chesterfield Borough Council Bereavement Service How do you arrange a civil funeral with Chesterfield Bereavement Services? The majority of people may still wish for a 'traditional' funeral service, but an increasing number are beginning to feel that a civil funeral ceremony better reflects the needs of their family. Chesterfield Bereavement Services understand, and are responsive to the needs of people who have expressed a preference for a non‐religious ceremony. A civil funeral ceremony to meet this need is available. Each family has individual needs and requirements. Religious and cultural traditions, personal circumstances and feelings may all affect the type of funeral you choose. Perhaps the deceased may have spoken of their own preferences or left instructions.

What is a civil funeral ceremony?

A civil funeral ceremony remembers, celebrates and reflects on the life of the deceased. It can be held in a wide range of buildings and locations, the celebrant will be able to advise you further. It may not be held in a church or other religious building. Civil funeral ceremonies are conducted by a professional celebrant. The celebrant will compose a ceremony (in close consultation with the family) that is both a personalised memoir and a loving tribute to the deceased. The ceremony will be appropriate for a cremation or a non‐religious burial.

How can you arrange a civil funeral? Please telephone 01246 345888 (Monday to Friday, between 9am and 5.00pm) for information. If you wish, a friend, relative or your funeral director can make the telephone call for you. Our celebrant will contact you and arrange to meet you and your family as soon as possible. During this meeting the celebrant will explain the format of the ceremony and the options available to you. You may wish to include special readings and music, or ask friends and relatives to say a few words during the ceremony. The celebrant will discuss with you all aspects of the deceased's life to form a complete picture. After your meeting the celebrant will produce a ceremony specifically for you. You will be able to check this before the funeral takes place to ensure that the details are right. After the funeral has taken place you will receive a copy of the whole ceremony to keep.

How do you sort out the estate of the deceased? When a person dies somebody has to sort out his or her estate. Their estate includes their money, property and the possessions they've left. If you are the person doing this you collect in all the money pay any debts and share out the estate to those people entitled to it.

You can pay a solicitor to sort out the estate for you. You may already have a solicitor your family uses. If not, you will need to choose one. Ask friends for recommendations and, when you contact them, ask about their charges.

How can you get help to cancel council services? The registrar who registers the death must tell certain departments that this person has died. These departments include the council tax office and the Electoral Registrar.

How do you apply for probate?

To sort out someone's estate, you may need to apply for probate. The Probate Office will give you a grant of probate if the person left a will, or will grant letters of administration if there isn't a will. Your local Probate Registry will send you the forms you need with notes and guidance on what you have to do. A useful helpline telephone number is 0114 281 2596.

What does a grant of probate, or letter of administration, allow you to do? A grant of probate is a legal document which allows the people named in it to collect and distribute the estate of the deceased. You can show it to organisations that hold these assets, such as banks or building societies. Probate is the process of officially proving that a will is valid, but the following information applies equally where the deceased died without leaving a will ‐ in which case the grant is called a letter of administration.

Is a grant of probate needed in all cases? Not always. It may not be necessary to obtain a grant of probate where a home is held in joint names and is passing by survivorship to the other joint owner. Where a joint bank or building society account is held, production of a death certificate may be sufficient for the monies to be transferred to the joint holder and certain institutions may release monies without a grant being produced if the amount held by the deceased was small. You will need to apply to the institutions to see if they will release monies without a grant.

A self‐help and support group for families of organ donors and for those who have received organs. They will also welcome calls from people waiting to receive organs and those whose relatives have died after a transplant or whilst waiting. Offers support and advice to lesbians and gay men bereaved by the death of a same‐sex life partner. All members are comfortable with their own gayness and are well trained and supervised.
