Policía perjudica a inmigrantes para futura legalización Por Rosario Vital El Observador l pasado 10 de abril se realizó otro retén en las esquinas de Story Rd & Lido Way. El Departamento de Policía de San José (SJPD) reportó que 919 vehículos fueron inspeccionados. En este retén se hicieron 9 arrestos por estar bajo la influencia de alcohol, una persona fue arrestada porque tenía

orden de arresto , 31 conductores fueron citados por no contar con licencias, 5 conductores fueron citados por tener licencias suspendidas y al final de reporte la institución indica que fueron incautados 33 vehículos. El 8 de abril el Jefe de la Policía, Robert Davis informó a EO que las personas que no tienen licencia tienen la opción durante el proceso de detención de llamar a un familiar para que se presente con licencia y

recoja el vehículo. “Estamos dando la oportunidad a las personas que no tienen licencia llamen a un familiar. Ellos tendrán 30 minutos para llamarlos y así evitar que se les incaute el vehículo”, dijo que Davis . Sin embargo en la práctica esto no está pasando. Cuando EO llegó al operativo del retén preguntó a los afectados y algunos dijeron no saber de esta nueva medida. “Los vehículos incautados son de

aquellas personas que no contactaron a algún familiar para recuperarlo. Pero fueron 12 los vehículos devueltos y ayudados con esta nueva disposición”, dijo el oficial José Garcia de la Oficina de Información del SJPD. Inelegibles para una amnistía “Las personas que son citadas por conducir sin licencia no reciben una infracción de tránsito sino una cargo de “delito menor”. Estos delitos menores originan un gran problema para los inmigrantes . “En la Amnistía de 1986 cuando una persona tenía

tres delitos menores no calificaba. Por esta razón en esta próxima reforma migratoria estamos proponiendo eliminar la barrera de los tres delitos menores o tener una claúsula que diga que conducir sin licencia no debe ser considerado”, dice el abogado de inmigración Mark Silverman. Silverman sostiene que algunas personas tienen diversas condenas por manejar sin licencias, lo cual ocurre porque les resulta imposible conseguir licencia debido a su condición de indocumentados. Δ

Costs of New Climate Change Rules Threaten Our Businesses and Families

By James Duran Times are tough in California. Here in the Silicon Valley, the unemployment rate was at 10% as of February, almost twice as high as just a year ago. And the Mercury News recently reported that in San Jose alone, roughly 4,000 homes are in various states of foreclosure. Add to that the state’s multi-billion dollar budget deficit, and it’s plain to see we’re in trouble. What’s equally troubling, however, is the fact that the California Air Resources Board (CARB) seems to be completely oblivious to all this. The agency is moving forward with a plan that will cost California businesses and families billions of dollars to fight global warming. Even in the best of times this would be hard, but today it will be devastating. Senator Robert Dutton has introduced legislation – SB 295 – which if signed into law by the Governor, would force CARB to calculate the real costs of its global warming plan and to put off imposing costly new policies on consumers until the state’s economic climate improves. We believe this bill is reasonable and very necessary for a number of reasons. CARB’s climate change battle plan is full of contradictions. The agency’s widely published conclusion is that we can reduce global warming emissions virtually for free. But the fine print says there will be billions of dollars in increased energy, fuel and building costs, which will fall disproportionately hard on small businesses and low income families. And California’s non-partisan Legislative Analyst and CARB’s own panel of economic experts concluded CARB’s economic analysis was seriously flawed and grossly understated the plan’s cost to consumers. Those costs, according to CARB’s own plan, include higher energy bills – 8% or more for natural gas, 11% or more for electricity, and $11 billion for lower-carbon fuels. There will be billions more in building costs, investments in new “green” technologies and equipment, and energyefficient buildings, to name a few. These costs won’t fall just on big businesses – they will be passed along to everyone who uses energy, transportation and virtually every kind of product and service, including food. The Hispanic Chamber of Commerce of Silicon Valley has made this a priority issue, since our

members and communities will be among the hardest hit by the costs of global warming regulations. We’ve shared with CARB our concerns about these costs and repeatedly asked for a meaningful accounting of what these programs will cost various industries, business sectors, and communities and families, not just on average over many years, but in real time starting now. We were told as individual rules were developed; the necessary cost studies would be done. But now CARB is proceeding with adopting those individual rules, and they’re still not answering those critically important questions about what these rules will cost. We are concerned that by the time anyone figures out what the true costs are, even more people will be losing their businesses, losing their jobs, and maybe even losing their homes. We need to take stock of the real economic impacts, weigh their effect on our already-struggling economy, and adjust accordingly. We’re not advocating doing nothing about global warming, but we believe what we do must be well researched, must be cost-effective and must take current economic conditions into account. Sadly, CARB’s actions have demonstrated they can’t be counted on to do this. That’s why the Hispanic Chamber of Commerce of Silicon Valley, along with the California Hispanic Chambers of Commerce and California Black Chamber of Commerce support SB 295. SB 295 won’t stop the fight against global warming, but it will force CARB to do the right thing by merely requiring a new economic analysis and postponing new rules until California’s unemployment rate falls below 5.8% for three consecutive months. The global climate is important, but the economic climate is equally important. Especially for small and minority-owned businesses and low income and minority families, SB 295 is the protection we need not only for the environment, but for our economy as well. El Observador was “observing” the operation and these are the results: 919 vehicles were screened 9 arrests were made for DUI 1 warrant arrest 31 drivers were cited for driving without a license 5 drivers were cited for suspended driver’s licenses 33 vehicles were impounded On April 8th Police Chief Rob Davis informed EO that people without licenses would have a chance to call a friend or family member who has a driver ‘s license to pick up his or her car and avoid impoundment. “We are giving an opportunity to the immigrants that don’t have a driver license to get their cars back. They will have 30 minutes to call a member of his or her family,” said Davis. But this was not happening when EO arrived and observed the DUI checkpoint. El Observador asked people who were stopped during the DUI checkpoint and

certain people stated they weren’t informed about this alternative. “The vehicles that were impounded belonged to drivers that had a chance to call a family member but didn’t have any response. SJPD returned 12 vehicles during this checkpoint. We are flexible”, said José García, Public Information Officer. Garcia stated, that the SJPD has always done that, but activists said this is not true. Drivers that were affected said the same thing, and El Observador corroborated this version. Ineligible for immigration reform The 31 drivers cited for driving without a license will get a misdemeanor, not an infraction for their “crime”. These misdemeanors are getting immigrants in trouble. “During the amnesty of 1986, people who had three misdemeanors were ineligible for amnesty. For this reason, we are demanding the elimination of the bar of three misdemeanors in this immigration reform or have a clause that says that driving without a license won’t be considered a misdemeanor,” stated immigration attorney Mark Silverman. “Many persons have several convictions for driving without a license - convictions which happened because of their inability to get a license due to their undocumented status.”

ome key 2010 Census activities accompanied by scheduled dates are presented here for all to become informed. The first and most important fact is the purpose of any census is to count all residents, both citizens and non-citizens. Undocumented individuals need to permit themselves to be enumerated (counted) because, in the future, our government distributes tax funds to various programs which provide services to all--based on the official census data. An undercount hampers local governments and their agencies when they receive funding based on official census data only to experience that the community has qualified recipients of that service in numbers which exceed the official census count. Therefore, undocumented individuals, aka ‘illegal aliens,’ need to come out of their shadow location when the census enumerators do their work. The information the 2010 Census collects is not shared with any other federal agency. So trust them just to count you and that is all. Here are the key dates for the conduct of the 2010 Census by the U.S. Census Bureau: * Fall 2008...Recruitment begins for local census workers & staff to fill jobs and perform preparatory operations. This began last fall and is going on now. * Spring 2009...Census workers go door-to-door to update address lists. *Fall 2009...recruitment begins for enumerators (census counters) needed for peak workload occurring during the 2010 Census. *February to March 2010...Census questionnaires are mailed or delivered to households. *April 1, 2010...CENSUS DAY (the official day). *April to July 2010...Census takers visit house-

holds that did not return a questionnaire by mail. *December 2010...By law, the Census Bureau delivers the 2010 Census data (population counts) to the President for apportionment purposes. *March 2011...The Census Bureau completes delivery of redistricting data to states. NALEO (National Association of Latino Elected Officials) encourages all individuals to participate in this census because: a) fair funding allocations are based on the population counts deemed official and b) re-districting of all election jurisdictions will be based on these official population information. Efforts have been made to ensure that bilingual census staff is hired, especially those who will reach growing immigrant populations who are not English language proficient. The Latino Census Network, composed of some 30 organizations focused on census issues because an undercount must not happen. For example, if just 3% of the Hispanic population of Census 2010 occurs, then 1,400,000 Latinos will be missed (as the Census Bureau admits happened during the 2000 Census). That number translates to two Congressional districts (seats in Congress). Democracy requires accurate census data which is translated to fair representation in Congress, state assemblies, city councils, etc. Raul Cisneros, of the Department of Commerce, explains that the census count is used to award more than $300 billion in federal funds to states and communities to support a variety of programs and public services. So the 2010 Census needs the involvement of all of us. It is in the best interests of all to be counted in order to be included in the population counts which are used to allocate funds and support for education, health care, and local economic development.Δ

ing, drinking, and generally having good time, all legal inside a club, may be startled to realize that the moment they exit onto public property-the sidewalk, they are in another world owned by police. The alcoholic beverages for relaxation and to cool off from the crowed dance floor are suddenly converted into penal code 647(f)— public intoxication. By officer discretion alone, one may end the evening in a jail cell, possibly injured by a police club or taser. One man was shot in the face after he “interfered with an officer” who tasered his wife. The question asked by the task force is: are these arrests necessary, especially when the DA deems only 15% prosecutable? In prior times, inebriated individuals were offered a taxi home, allowed to call someone to pick them up, or taken to a “drunk tank” to sleep off their drunkenness. Davis pleads, “arrests are the only legal way to taken them into custody and save them from greater harm to themselves or others.” But contacts with police and city hall insiders and community groups offer these observations: “The Chief is stubborn, will never admit a mistaken policy damaging police-community relations.” “Davis fought the Police Auditor, not realizing she was his loyal opposition whose recommendations could save his job.” “The chief sets the tone for officers, or fails to do so, so they do whatever they want.” “Davis is not a cop’s cop, never a street officer, doesn’t have respect of street cops, so he can’t push too much.” “The support he has is because they have plenty of overtime pay, force and arrest policies work for them, and he muzzled the police auditor.” “Davis has the support of the mayor, the council, and city manager-as long as they’re happy with Davis, he stays, the public be damned!” The question for Mayor Reed, City Council and City Manager Figone and most importantly, San Jose residents, is: If Chief Davis cannot restrain aggressive officers quick on the draw with tasers or firearms, arresting non-violent inebriated individuals with sober designated drivers, then who can police the police? he San Jose Police Department has been featured almost weekly in news reports of six taser deaths since 2005, racial profiling, selective vehicle stops, and drunken arrests. An October Mercury News report that San Jose police arrested 4,600 in one year for public intoxication, and a disproportionate 56% were Latinos, resulted in hundreds attending a public hearing. After hours of angry and some tearful testimony of unjust arrests, mistreatment by officers, and a woman whose father was killed by police taser, City Manager Debra Figone initiated a task force to study the issue and find a just resolution. The task force of 25, selected by Figone, has a fair representation of stakeholders, including Asian, African-American and Latino communities, Police Chief Rob Davis, the District Attorney and Public Defender, downtown business, city and county government. I have attended most of the 69 pm Thursday meetings, and here is my review: Chief Davis diplomatically explains that what seems as targeted arrests are in fact compassionate efforts “to protect the public, especially downtown club-goers, from injury by falling down, getting hit by cars, or aspirating their vomit.” Davis cheerfully related, “in some cases officers even give the inebriated a ride home to ensure their safety.” When asked how often officers provide such front door service, he offered to try to get the data. But the reality is that club-goers are ushered out of clubs at closing time, channeled by the 60 or more police on crowded sidewalks, and arrested when showing signs of inebriation-such as walking clumsily, bumping into others, jaywalking (even on streets closed to traffic by police), shouting, slurring speech. More egregious offenses are failing to follow orders from officers, asking questions, talking back or videotaping arrests. Community advocates call these “failing the attitude test” or “annoying an officer” arrests that may include the serious additional charge of “resisting arrest,” which can be elevated to a felony. By Osvaldo Castillo- El Observador aret Silva, a 17 year-old senior from Carlmont High School in Belmont, CA passed away on April 4 of Acute Myelogenous Leukemia. Saret was the daughter of Cesar and Flor Villamont Silva, who are natives of Peru. The family resides in Redwood City. Saret was diagnosed with leukemia in May 2007. She relapsed in December of 2008. In a statement released by her father, Saret was known as a smart little girl and had received acceptance letters from the University of California Los Angeles and University of California San Diego. “Saret wanted to study medicine, and specialize in oncology to help other children with cancer who were in a similar situation as she,” her father said. Ramona Garcia, outreach coordinator of Hispanic/Latino Community for The Asian American Donor Program, said Silva was in need of a bone marrow donor in order to save her life. Unfortunately, her chances of finding a donor were slim because there are not enough minorities registered in the National Bone Marrow Program. “Most of the time, donor matches are found in people of the same ethnicity,” Garcia said. According to the Asian American Donor Program, 7.1 percent of registered donors are Asian, 7.6 are African American, 5.3 are Latino, 1.1 are

Native American and 73 percent are Caucasian. Bone morrow is fluid that is produced in the pelvic bone. It produces white cells that fight illness. “When someone has Leukemia, the white cells cannot fight back against the cancer and organs cannot function properly,” Garcia said. The National Bone Marrow registration process is simple. A potential donor has to be between the ages of 18-60, have no serious ongoing lower back problems, and be in good general health. “Four Q-tips are used to gather a sample to determine your tissue type,” Garcia said. “You are then placed in the national registry and are notified if your are a potential donor.” The Silva family is asking for the public’s help in order to pay for funeral expenses. Tax deductible donations to help defray funeral costs for Saret Silva, can be given at the Asian American Donor Program web site. Just visit www.aadp.org and click on the “donations” button. Designate that your contribution is for Saret Silva. In addition, people can phone the Asian American Donor Program at 1-800-593-6667 to make a donation by credit card or obtain the address to mail a check. ssembly Majority Leader Alberto Torrico (DNewark) has introduced

legislation that will enable companies to work with schools to assist students and ensure they receive a proper education. “AB 1508 cuts through the red tape and allows employers to enter our classrooms and get students interested in subjects such as math and science,” said Assembly Majority Leader Alberto Torrico. “Most of these students are not ready to join the 21st century workforce. They need math and science to be able to work.” Torrico held a press conference on April 10 at James Lick High School in San Jose to outline the importance of the bill (AB 1508). Attending were elected officials,

community organizers and former National Football League players Eric Wright Guy McIntyre of the San Francisco 49ers, and Mervyn Fernandez of the Oakland Raiders. “We need people who are willing to donate their time to work with our youth and give them guidance and direction,” Torrico said at the press conference. “This is not just the responsibility of our schools. We are all in this together.” According to Torrico’s office, California has lost $46.4 billion in total economic losses from every 120,000 twenty-year-olds who never complete high school. Two-thirds of all high school dropouts use food

stamps during their working life and are 68% more likely to be on a welfare program. In addition, California’s students remain far behind those in other states on many measures of achievement and are dropping out of school in astonishing numbers. For example, California ranked seventh from the bottom in eighth grade math and second from the bottom in science on the 2005 National Assessment of Education Progress. About one-quarter of all California students who enter the ninth grade fail to earn a diploma four years later. According to Torrico’s office, California has displayed an alarming

trend in corrections spending, while cutting back on more productive and preventative investments like education. This type of spending has revealed dire consequences as California’s economy has become increasingly dependent on a skilled and highly educated workforce to remain competitive. “That is why we’ve had to import foreign workers to work in our companies,” Torrico said. “We need to get our students interested in the work that our companies do.” The bill was introduced to the legislature on February 27, 2009. Governor Schwarzenegger will review it in the coming weeks.

Esto es realidad con Latino Community Foundation, la cual ha hecho posible otorgar dinero y ayuda a organizaciones comunitarias que ajustan su presupuesto y cumplen sus metas a pesar de las circunstancias. Latino Foundation ha otorgado 250 mil dólares en financiamiento a 14 organizaciones del Área de la Bahía. “Nos sentimos satisfechos de haber superado las expectativas del año pasado. Estamos ayudando a 4 organizaciones más que el año pasado”, dijo la Directora Eje cutiva Raquel Donoso. Entre las organizaciones comunitarias be neficiadas está Somos Mayfair, una organización que ha conectado a las familias a través de sus diferentes programas. Somos Mayfair ha recibido 20 mil dólares para seguir desarro llando programas que permitan promover y ayudar a familias. “Uno de los aspectos que nos ha encantado es la capacidad de conexión que tiene Somos Mayfair en unir a las familias a trabajar juntas. crados en los programas que ellos dirigen y ese espíritu se revela en cada trabajo comunitario que hacen. El trabajo que las promotoras han venido ejerciendo es de gran valor y clave para una comunidad”, dijo Donoso. Por su parte Rebecca Bahuer de Somos Mayfair elogió el esfuerzo de Latino Community Foundation y consideró que Somos Mayfair ha encajado en las necesidades que esta organización no lucrativa ha querido promover El valor familiar es la clave y por eso considero que nos van a seguir ayudando. Donoso destacó que gracias a un gran esfuerzo de grandes compañías ha sido posible recaudar fondos para otorgar ayuda a estos programas comunitarios. Fundaciones como Walmart, Kaiser Permanente, Union Bank of California, United Way del Área de la Bahía y la Fundación de San Francisco. Latino Community Foundation ha otorgado un total de $450 mil dólares, cerca de la mlitad de la meta de 1 millón en financiamientos en cuatro años. Es una organización que desea promover participación e inversion que promueven comunidades saludables y activas. l Presidente Barack Obama hizo muchas promesas durante su campaña. “ El cambio está llegando y si se puede,” repiten estas populares frases muchas personas que están bajo la lucha de diferentes causas. El pasado 14 de abril, dife rentes grupos comunitarios de San José pidieron al Presidente Obama de mantener su promesa en presentar una reforma migratoria justa y humana. “Estamos aquí porque no queremos que se trate a los inmigrantes como criminales”, dijo Salvador Bustamante de la organización Reforzando Nuestras Vidas (SOL siglas en ingles). “ No queremos familias que se queden aisladas y queremos que los inmigrantes sean recompensados por el trabajo que hacen”. Los grupos también demandan la eliminación de los procesos de inmigración que tienen un gran retraso. “Estos retrasos hacen más difícil que inmigrantes se conviertan en ciudadanos”, dijo Adel Olvera Directora del Programa de Ciudadanía e Inmigración para el Centro de Entrenamiento y Trabajo, CET. “ Muchas veces estos retrasos causan que familias no estén juntas”, explicó. Han pasado 10 mil días de espera para que se cumplan las sus necesidades básicas y humanas y a su vez se les conceda sus derechos bajo de la Declaración Universal de los Derechos Humanos”. Como muchas personas en este país, los inmigrantes están sufriendo de los efectos de la actual recesión económica. “Antes el costo de hacerse ciudadano estaba por el orden de los $400 dólares, ahora cada persona deberá pagar $675 para hacerse ciudadano. Muchos no lo hacen porque no cuentan con ese dinero”, dijo Olvera. Marcha pacífica Se ha previsto para el viernes 1 de Mayo llevar a cabo una marcha pacífica que se iniciará en la Story y King culminando en el Municipio de la ciudad. (200 E. Santa Clara St. ) Los organizadores exhortan a las personas de todos los grupos étnicos a participar. La cita es a partir de las 4pm . “Pase la voz a sus amigos, vecinos y cada uno comprométase a llevar a una persona”, dijo Adel Olvera. Mayores informes en el (408) 534-5451.

On April 14, 2009, various community groups in San Jose asked President Obama to keep his promise and introduce just and humane immigration reform. “We are here because we do not want immigrants to be treated like criminals,” said Salvador Bustamante of the Strengthening Our Lives (SOL) organization. “We do not want families to be torn apart and we want immigrants to be rewarded for the work they do.” The groups are also asking for the elimination of immigration backlogs. “Immigration backlogs make it more difficult for immigrants to become citizens,” said Adel Olvera, director of the immigration and citizenship program, for the San Jose Center for Employment and Training. “Sometimes, backlogs prevent families from being together.” Richard Hobbs, interim executive director for the Services, Immigrant Rights, and Education Network (SIREN), said that last time the US government passed a law that would legalize the status of undocumented immigrants was in November of 1986. The Immigration Reform and Control Act of 1986 legalized the status of anyone who entered the U.S. prior to January 1, 1982. “Next month, on May 18, 10,000 days will have passed since December 31, 1981,” Hobbs said. “Undocumented immigrants have been waiting 10,000 days for a law that would meet their basic human needs and grant them globally recognized human rights under the Universal Declaration of Human Rights.” Like many people in this country, immigrants are also suffering from the effects of the current economic recession. “Before it used to cost $400 to apply for citizenship,” Olvera said. “Today, immigrants have to pay $675 to apply for citizenship. Many immigrants cannot afford that because the do not earn enough money.” At the May 1st march organizers believe they will be marching along side thousands when their moment arrives. They believe elected officials will be at their side as well. The march will be on Friday May 1st at 4 pm. It will start on Story and King Rd and end at San Jose City Hall. The organizers encourage people of all ethnicities to participate. Participants should wear comfortable shoes, bring water and an American flag. “We are asking the community to have a non-violent peaceful march in order to bring reform,” Olvera said. “Call your friends, your neighbors, bring everyone.” For more information call (408) 534-5451 or email aolvera@cet2000.org.

The protest ended with a confrontation between conservatives and pro-immigrant activists. One of the Tea party participants yelled, “Go back to Mexico,” pushed a counterprotester, and lost control.
