ith the dust having well and truly settled following our local elections, there is no doubt that there will be a number of specific issues placed high on the agenda. Although the public purse is tight, investment in skills, communications, transport and economic development will be critical to the prosperity of Perthshire. Unemployment continues to be a growing concern and we are liaising closely with those involved to see how we can work together and help as many into employment as possible – particularly our unemployed youngsters. As well as a wealth of experience within this business community which can help prepare individuals for the world of work (through work experience for example) there are incentives for employers to take on a person who is currently classed as unemployed. Over the coming months we will be engaging with our Perth and Kinross Council officials and electorate in order to represent the needs and views of our members and ensure that the area’s economic development is at the heart of newly created plans for the next term. We will also be lobbying to ensure that long standing issues such as the City Hall are resolved as quickly and cost effectively as possible and that the planning process works to encourage business growth and economic development. We also want to know that businesses are encouraged to locate to and stay in Perthshire. If you have pressing issues that you feel are hindering your business operations, growth and development please contact the Chamber office or any of the Directors or myself to ensure we can effectively represent your needs and help you in your business. usiness rates, city centre regeneration, parking charges, business development and the relevance of City status were all high on the agenda at the latest meeting between Perthshire business leaders and politicians. Perthshire Chamber of Commerce president Stephen Leckie and directors hosted a meeting with a cross-party delegation of MSPs, MPs and MEPs to discuss issues affecting the local economy and business community. Following the meeting, Mr Leckie said he was “encouraged by the support and interest” shown by the politicians on matters crucial to local businesses. “It is vital that Perthshire Chamber of Commerce has the ear of our politicians if we are to have a voice in safeguarding and shaping our future,” he said. “We are extremely grateful to our politicians – at all levels of Government – who meet with us regularly to hear our concerns and opinions. They listen to our concerns and opinions and are genuinely interested in what we have to say. Their feedback into the decision-making process and their information stream back to us ensures our voice is heard – and often acted upon.” Mr Leckie said that there were many issues affecting businesses and the economy in Perthshire at present – and a large percentage of these were rooted in government rather than local authority. “If we claim to be the voice of business then we have to make sure we’re loud enough to count,” he added, “and I am encouraged by the support and interest shown by our politicians and their willingness to pursue matters on our behalf. In return, we ensure that they hear and take note of what issues concern and affect the interests of both our town and rural businesses.” Mr Leckie stressed that the politicians were keen to hear from any business which has issues and he said Chamber would be happy to represent them at these meetings. “We’re all anxious to achieve the same things,” he said. “A better place to live and work and a vibrant economy and environment in which to do business.” The latest meeting of business and political representatives included Chamber President Stephen Leckie, Chamber Directors Mike Beale, Steven Stewart, Russell Keiller, Anne Smith, Grant Ager and Sara Wood who were joined by Pete Wishart MP, Roseanna Cunningham MSP, Murdo Fraser MSP, Liz Smith MSP and Annabelle Ewing MSP.

Reach For The Stars Launch of the 2012 Business Star Awards

usinesses throughout Perth and Kinross are being invited to showcase their star quality as Perthshire Chamber of Commerce launches the 2012 Business Star Awards.

The search is on for the best in the business with the area’s most prestigious title up for grabs as well as 11 individual category awards. And organisers are keen to stress that “size doesn’t really matter” as large corporations vie with SMEs and home-based companies to secure the accolades. “Business Star Award winners in the past prove that the wealth of small businesses throughout Perth and Kinross have as much chance of winning as their locally-based nationally – and internationally – recognised competitors,” explained Chamber Chief Executive Vicki Unite. “The majority of companies in Perth and Kinross are microbusinesses – the real backbone of the area’s commerce – and the great appeal of the Business Star Awards is that they recognise and reward business excellence wherever it is thriving and we often see the Davids toppling the Goliaths. This year entries are invited in the following categories:

Hosted by Radio Tay duo Maureen Young and Gary Robinson, this year’s celebratory awards event will be themed “Diamonds Are Forever” in celebration of The Queen’s Diamond Jubilee. Eco Easy Life for Bell Ingram Staff at Bell Ingram’s Perth headquarters are enjoying the benefits of a new, low maintenance, green heating system thanks to the expertise of their in-house microgeneration team. The challenges of heating a large, rambling Victorian property on the banks of the River Tay led the firm to undertake an ‘energy appraisal’ of the property with a view to establishing areas where savings could be made. The appraisal revealed that although additional insulation could be installed in the roof space, the existing old gas boilers were of such an age and condition as to not be operating at optimal efficiency. Once the decision was made to replace the inefficient boilers, the team set about investigating the feasibility of installing an alternative and more environmentally sustainable heating solution.

The team’s deliberations concluded that a self-fuelling biomass boiler would be the most cost-effective and sustainable way to heat the property. With its ease of operation, minimum staff intervention requirement, and compact fuel storage area, the biomass boiler is ideally suited to Bell Ingram’s office environment. Not only does the new boiler cost a comparable amount to run as the old system, it also delivers a 37-tonne reduction in CO2 emissions and an income of approximately £11,000 from the Government’s Renewable Heat Incentive (RHI) Scheme. Bell Ingram’s Managing Director,Graham Lumby, comments: “Being able to heat our office in a cost effective and environmentally sustainable manner is important to our carbon conscious approach.” Cosy winners all around.

Clark Thomson Insurance Brokers Extends Lead on Competition Following the recent appointment of Ben Bailey to the post of Managing Director, Clark Thomson Insurance Brokers also announced that Ian Bowie has been appointed Chairman, taking over from Company founder John Clark. “The Company has grown significantly over recent years and these appointments are a strategic investment in our future,” said John Clark, who remains Chairman of holding company Mountlodge Ltd. Chelsea awards

A pair of Perthshire florists are back home after tasting success at the most famous flower show in the world. Jillian Page and her niece Paula McLagan from Blairgowrie won silver gilt medals at the RHS Chelsea Florist of the year competition held at the prestigious RHS Chelsea Flower Show. This year’s theme, to coincide with the Diamond Jubilee of HM The Queen, was ‘Diamonds are Forever’. The brief was to design and create a chandelier to be hung at HM The Queen’s Diamond Jubilee dinner.

Jillian of Something Special Flowers impressed the judges with her technique and workmanship which were described as “excellent and exquisite” Paula, who works alongside her aunt, impressed the judges with her chandelier which was described as “a very clever interpretation of a traditional chandelier style” and the judges marked her highly on her idea, expression of colour and techniques used. This was the first time either had entered the competition and described it as an emotional rollercoaster overcoming the logistical problems of working so far from home. The enormity of their achievements were emphasised as Chelsea medal winners talked with emotion of the “greatest flower show in the world” Paula and Jillian now look forward to the qualifying heats for 2013.

JOHNSTON CARMICHAEL SHORTLISTED FOR FOUR NATIONAL ACCOUNTANCY AWARDS Johnston Carmichael has been shortlisted in four categories for this year’s Business Insider Scottish Accountancy Awards. The firm, with 11 offices across Scotland, is in the running for the prestigious Accountancy Firm of the Year award. The firm has won ‘Best Medium Firm of the Year’ award for the last four years. The firm has also been included as a finalist in the Insolvency Team of the Year and Advisory Team of the Year - for its corporate finance work – categories. The firm’s Inveruriebased director of learning and development, Iain Abernethy, has also been short-listed as the Training Manager of the Year.

Top Mark for Lovat Hotel dining A young local chef, who honed his skills under the watchful eye of Perthshire culinary A-Listers such as Andrew Fairlie and Graeme Pallister, has been appointed Head Chef at the Lovat Hotel, Perth. Mark Bell (26) took over the kitchens of the Symphony Hotels’ Glasgow Road establishment last month and plans to build on the Lovat’s already good reputation for hotel food. As a pupil at Perth High School, Mark showed great promise in a catering course and was encouraged by his teachers to pursue that career.

Study at both Perth and Glenrothes colleges combined with placements both at Andrew Fairlie at Gleneagles and a Michelin Starred restaurant in France. A year’s fulltime at Fairlie’s top Scottish restaurant was followed by stints in the kitchens of Kerrachers, Ramada Jarvis, The Bothy, 63 Tay Street and the Huntingtower Hotel before securing top slot at the Lovat. “I have learned so much from some outstanding chefs along the way – particularly Andrew and Graeme,” said Mark. “While the Lovat Hotel will not be going fine dining, I can adapt my skills and techniques to make our restaurant the best it can be. “Perthshire has the best natural food larder in the country and I’ll be concentrating on traditional dishes brimming with local produce as well as creating tailormade meals for private functions that clients will love.” Mark intends to take food at the Lovat to the next level and general manager David Young is in no doubt that he will achieve his goal. “Mark’s already making a difference and guests are giving us some very positive feedback on all aspects of the food. – from presentation to taste,” he said. “He’s proving a great asset to the team here.”

In 2009 Ewan Cameron was approached to design a modern guest pavilion that would sit next to an Italianate orangery from 1860 and across from the clients’ main house, an iconic glass and steel pavilion erected in 1971. Ewan Cameron’s response was a formal composition of separate planar elements to frame a formal garden; an architectural haiku. The existing Capel Manor House and pavilion are spectacularly sited upon the raised, arcaded podium of a ruined Italianate mansion on a leafy estate that was the home of Jane Austen’s fore-bears since 1569. It overlooks a wooded valley in the Kentish Weald near Horsmonden, Kent.

The resulting proposal was much inspired by the Architect’s visits to the temples and zen gardens of Kyoto; in particular the idea of a building as a frame through which we contemplate nature. Ewan Cameron Architects worked closely with engineers David Narro Associates, to achieve the “floating” lightweight roof structure, clad in zinc. Kent based builders Green Construction ensured that the minimalist detailing was executed to an exacting standard. In November, The Glasgow Institute of Architects chose the pavilion as the winner of its design award in the Small Works category and in February, the Architect’s Journal awarded the building a High Commendation for its “beauty”. The project featured in the March / April edition of Homes and Interiors Scotland and in The New York Times on 26th April. A further feature is scheduled in The Telegraph on 16th June. In December 2011, Ewan set up an office in Comrie, Perthshire where he now lives with his wife Helen and three daughters. Ewan is a registered Passivhaus Designer.


String of Industry Awards for Speakeasy Perth-based Speakeasy, one of the UK's leading corporate video and event production companies, has kicked off 2012 with a string of industry awards at both sides of the Atlantic. 'BAEutiful Mind', a global sales film produced for BAE Systems, took 'Best Use of Audio Visual Communication' at the IOIC Awards in Glasgow in February, and also the highly sought after World Gold Medal for best Sales Film at the 2012 New York International Television & Film Festival held in Las Vegas. Speakeasy also took a number of finalist certificates in Las Vegas; including one for 'Keeping the Branch Running' - a series of animated training films produced for branch staff throughout Lloyds Banking Group. The Lloyds project also won silver at the coveted IVCA awards in London in March, praised by the judges as one of the best regular video communications produced in the UK during 2011. Speakeasy, which specialises in the production of corporate films, events and interactive media, was founded in 1993 and now boasts extensive production facilities in both Scotland and London, with 30 full

Picking Power at Binnwaste Management Binnwaste Management have installed a third picking station at their Glenfarg recycling complex. The £300,000 investment gives one of the country’s largest independent waste management companies the capacity to process an extra 2,000 tonnes of waste per month at Binn Farm. The Kiverco picking station was commissioned in May and saw a further five employees join the Binnwaste Management workforce – four pickers and a machine operator. General Manager Iain Taylor explained that the decision to invest in additional facilities would help the company reduce any recourse to landfill and offer the most cost effective and efficient service to their customers.

Mountain climber Jalal Al Ibrahimi is planning new heights for Perth’s New County Hotel and Opus One fine dining restaurant after being appointed their General Manager. The Moroccan has returned to Perthshire after spells at the Macdonald Pittodrie House Hotel at Inverurie and New Drumossie Hotel, Inverness. From 2003-2010 he was Assistant Manager and Wedding Planner at Murrayshall House Hotel, Scone, and before that worked at the Salutation and Royal George Hotels in Perth. Jalal’s climbing has taken him from the top of the Atlas Mountains to the 19,360 feet summit of Mount Kilimanjaro. “The New County Hotel and Opus One already enjoy high reputations for quality, service and value,” he commented. “I’m looking forward to working with owners Owen and Sarah Boyle to further improve and extend their offerings and I am very excited about this new challenge.” And the team can already be proud of their achievements, taking a raft of awards recently at the Scottish Hotel Awards. Perth Chef Rory Lovie achieved national recognition only two months after being promoted to Head Chef at Opus One Restaurant being named Rising Star Young Chef of the Year. Perth College trained Rory worked at Let’s Eat and the Huntingtower Hotel in Perth before joining the Opus One team as Sous Chef almost four years ago. Thanks to Rory and his team, the New County Hotel, where Opus One is situated, also won the Bar Food Award for its Gavin’s Bistro & Bar, General Manager Gold Medal for Jalal Al Ibrahimi and a Housekeeping Award for Head Housekeeper Louise Smith.

Speaking the language of trade The British Chambers of Commerce published a survey in April calling for more training in foreign languages to help boost British exports.

Even if your French goes no further than “Bonjour. Comment allez-vous?”, after a few lessons you’ll realise it’s better to tell your contact in Toulouse “I’ll see you at 5 o’clock” than “I’ll see you at close of play” (or worse, “COP”).

Key points from the survey include:

Maybe, though, you’re not interested in exporting. Well, what about attracting trade from foreigners already in the UK? Tourists (think of the spill-over from the Olympics!) or business visitors.

• language skills are vital to exporting • 61% of non-exporters who might consider trading internationally are held back by a lack of language skills • of those business owners that claim some language knowledge, very few can speak well enough to conduct deals in international markets. Only 4% can converse fluently enough in French; for Russian and Chinese, the figure is lower than 1% • foreign languages should be re-established as core subjects in education and training so that the next generation of business owners are “born global” with language skills and a more international mind-set.

By translating your website you’re showing your foreign customers that you care about them and welcome their custom. And if some of your content is in their language, they’re more likely to find your site – and bring you their business.

But, you may ask, which languages should I be learning, to do business overseas? Ultimately, your choice will depend on your export market. The most obvious languages are French, Italian, German and Spanish (the “FIGS”). Euro woes apart, we do much of our trade with Europe. Most of us have travelled there. We’ll have studied at least one FIGS language at school. And with FIGS you don’t need to learn another alphabet! But, to look at language learning from another perspective, stepping into the language learner’s shoes can help you communicate more clearly in English.

Obvious candidates are small consumer businesses – restaurants, shops, hotels, hairdressers…. Why not get some of your promotional material translated? Your website is a good, and cost-effective, place to start. Not necessarily the whole site – a single web-page (per language) containing key information for customers should suffice.

Remember, too, that adding more pages to your site could boost its search-engine performance and ranking. Speaking your customer’s language is a courtesy they appreciate. The big interview - Michael boyle Young Business Person of the Year 2011

Auchterarder stonemason Michael Boyle is director of his family company, carrying out specialist contract work across Scotland. His vision, hard work and success secured him the 2011 Perthshire Chamber of Commerce Young Business Person of the Year title. Here the 29-year-old craftsman who embraced all aspects of the business world to launch his own company talks to journalist Maureen Young about harnessing his ambition and his father’s skills in a recipe for success. As a young man did you imagine yourself as a businessman? No. I just wanted to work with my Dad doing something that I loved and knew I was good at. He was a self employed stonemason and I used to work with him at weekends and during school holidays learning all aspects of the trade. The decision to turn it into a family business came later.

How did you cope with being a boss? Being a boss was a whole new experience and one that I wasn’t really comfortable with at the start. I like to think the men we take on see how hard I work and hope they respect that and follow my example. If they see I’m willing to do the hours they might respect the standards I set and follow suit.

When did you first decide to run your own business? It was about five years ago. As skilled stonemasons, Dad and I were never short of work and I believed the potential was there to go from being merely self-employed to running our own limited company and having people work for us.

Was there additional pressure because it is a family business? Probably. Having pushed my family into it, I really had to make sure the company succeeded. Dad had to be convinced that investing in vans and tools and paying men’s wages would all be covered by our income. After the initial six months to a year he relaxed and agreed we’d done the right thing. And I couldn’t have done it without him.

What were the first steps? Persuading my Dad it was a good idea for one! He had seen other people try and fail and worried that it was an unnecessary risk. I eventually persuaded him to take the gamble and did all the research to find out everything we should do to set up and run a limited company. We were lucky to land a big contract straight away which put us well on our feet from the start. Were you anxious? Yes, very. It is nerve-wracking starting a company. I wasn’t worried about the practical side because I believed there would always be plenty of work. Specialist stone masonry is a dying trade and Dad and I had built up a really good reputation but the administration side of things was a different story. It was a minefield for the firsttimer and it was a steep learning curve getting to grips with tax, wages, health and safety, insurance etc. For the first two or three years I worked 24/7 - out on the tools during the day and attending to office work in the evenings.

Five years on, are you more comfortable with running a business? Much more relaxed and confident. I still spend around 40% of my time on bookwork and the idea is to bring Mum into that side of things to free up more time for me to chase up contracts and work on the tools. What are the most difficult aspects of running your own company? I think it is getting the work/life balance right. It’s just not easy. The way the economy is at the moment we simply don’t want to turn work down and that means working some evenings and weekends to keep on top of things. I do still manage some holidays but I can’t remember the last time I had a Saturday off.


Are you proud of what you’ve achieved? Extremely. We’ve gone from chasing work to having people chase us to do work. The hard work has paid off. What prompted you to enter the Business Star Awards? It was my parents who entered me in the Young Business Person of the Year category. When I received a call to say I had been shortlisted for the finals, I thought it was a joke. I was over the moon to be shortlisted and was happy to go along to the awards ceremony as it looked like a good night out. It was a massive shock to hear my name called out - I couldn’t believe it. I was so surprised and so happy. I was shaking like a leaf when I went up to receive the award. What difference did winning that award make to your life? I have had a massive response. From friends, family, colleagues, business contacts and complete strangers. The publicity the Awards generate really raises your profile and suddenly everyone knew who I was. It was great to be recognised for doing something I love and for the work we’ve put into making the business a success. I put not just the hours - but my heart and soul – into the business and to be named Perthshire’s Young Business Person of the Year 2011 was just amazing. The title also generated several contracts for us which is fantastic – it added tremendously to the company’s reputation. Would you encourage other businesses to enter the Chamber Star Awards? If you are happy with where your company is and you have belief in yourself and the business then go for it. The recognition and rewards it brings are worth it alone. What about advice for those thinking about launching a new company? A lot of it is down to commonsense. Be sure that there is a market for what your business offers and investigate it and your competition thoroughly. And don’t try to be a multi-national overnight. Start small and let your results determine your rate of growth. Know your limitations. Only take on what you know you can deliver. Reputation is everything – one good job can make you but one bad job can ruin you. Do you have any regrets having taken that leap of faith five years ago? No, I wouldn’t change a thing. For me the time was right and, although it’s been very hard work, the results have been great. Where now - any ambitions? Yes - lots of ambitions. I have studied to get qualifications in various aspects of stonemasonry and also business management. The one I would like to study for is my Masters Degree in stone carving which would allow us to tackle special conservation and preservation projects on historic buildings. I also want to try something completely different. I love doing up old properties for resale and I would like to advance that business. I think it makes sense not to put all your eggs in one basket. But for the moment I’m more than happy the way things are.

Perthshire Agricultural Society will stage it’s 150th annual show on the South Inch, Perth, on Friday 3rd and Saturday 4th August.

T

he show was first held in Crieff in 1862 and it travelled around the county for some years then took up permanent residence near Forteviot where it remained. In 1901 the council of Perth asked the Society to bring the show into the town to the Lesser South Inch and it remained there till 1998 when it moved to the larger South Inch. In 2000 the show moved again as flood barriers were being constructed on the South Inch. The show moved to Scone Palace where it stayed through to 2001. Unfortunately Foot & Mouth disease swept through the country and although Perth Show went ahead there were no cloven footed animals at the show. In 2002 the show returned to the South Inch in Perth but fate struck a vicious blow with pouring rain falling the week prior to the show and flooding the South Inch completely which meant the show had to be cancelled. The following year the show returned to its original home in Perth the Lesser South Inch and here it will stay. This year the show boasts the hosting of three national breed shows, Simmental Cattle, Border Leicester Sheep and Zwartble Sheep along with all the other breeds of cattle, sheep, horses, donkeys and goats. Saturday will be Ladies Day as far as the cattle judging is concerned as all the sections will be judged by Ladies, two of whom are well known Perthshire girls Kay Adams and Hazel McNee both Fotheringham daughters from Craighall, Forgandenny. Friday is the light legged horse day with judging taking place all day. Saturday is the livestock day with judging taking place in the morning culminating with the judging of the Champion of Champions which is between the champions of the Saturday sections. Saturday afternoon entertainment commences with the Grand Parade of Livestock, a spectacle worth watching. This is followed by Tug o’War, by the young farmers and pony games. The main attraction of the afternoon is a display by The White Helmets who are The Royal Signals Motorcycle Display Team. Trade, Craft and SWRI stands are in abundance with plenty for all to buy goods from cakes to combine harvesters.

ou’ve probably seen QR Codes all over the place and wondered what they were for. They are the little white squares with pixelated black patterns on them that sometimes appear on business cards, posters, t-shirts and even the sides of buses! They can be any colour at all but most companies tend to use the standard white/black style. The codes can be scanned by any smart phone although you may need to download an app first. Just search for “qr code” or “qr code reader” in your phone’s app store and you should find a suitable free one. When you scan a QR Code you get access to the hidden information stored within it. Most often codes contain a web address that will instantly open in your phone’s web browser but they can also store plain text information, phone numbers or text message templates. Companies might include a QR Code on their printed marketing material so customers can quickly scan them and get to their website without having to type it in or remember a long web address. It’s actually a good idea to send the customer to a landing page rather than just your Home page as this will have more impact and they’ll be more likely to take the action you want them to. Events companies are increasingly using them to encode links to a maps or web pages with directions. QR Codes are great for mystery promotions and product launches and are becoming a greater part of our daily landscape. Generating a QR Code for your business is simple and free. You can do it yourself from a site like www.qrcode.kaywa.com in seconds. Once it’s done you download the code image for later use. Some interesting, if rather impractical, places that QR Codes have been used include the roofs of buildings, the sides of buses and shaved into the back of footballers’ heads! Your QR Code should be somewhere your customers will easily be able to scan with their mobile phones so make sure you think your placement through carefully! MANAGING DEBTORS IN A RECESSION

Businesses can find themselves in trouble when debtors fail to pay what they are due – and sometimes the knock-on effect can be disastrous. Here, Graham Harding, Partner at Thorntons Law LLP, gives some advice on ways in which businesses can effectively avoid and combat difficulties arising from bad debtors.

Business Support What will my solicitor do to recover a bad debt? In the first instance a solicitor will send a pre-action letter by recorded delivery and first class post. In many cases threat of court action from a solicitor will prompt payment. The recorded delivery letter also provides the solicitor with confirmation that the address you have for the client is correct. If payment is not received the next step is to raise court proceedings. The general rule is that the Defender should be sued in the Sheriff Court where he is domiciled and this is always the case if it is a consumer contract. If the debt is due by a business then place of performance of the contract will also have jurisdiction. A sole trader must be sued at his home address and not his business address.

With the country still in recession, cash flow and avoiding bad debt are even more important than ever and hopefully the answers to the following questions will be of some assistance.

How can I improve my cash flow? Consider whether you need to give credit for the supply of goods or services. If possible obtain payment in advance or on delivery. If you are going to grant credit facilities to your customer then:I. Know your customer. Make sure you know if you are dealing with a limited company, a partnership or a sole trader. If dealing with a sole trader, find out their home address. This knowledge is essential if at some point you need to sue them for payment. II. Be sure to obtain satisfactory bank and trade references. III. Issue your terms and conditions in advance of supplying the goods or services. These should clearly state the time limit for payment and the rate of interest if terms are not adhered to. If the contract is between two commercial entities the terms of the Late Payment of Commercial Debts (interest) Act 1998 can be applied and this provides statutory penalties and interest that can be claimed. IV. Have in place effective credit control procedures. If your customer does not pay within your terms of business do not let matters drift. Immediately send a reminder letter requesting payment within seven days. Follow this up with a telephone call to the customer and if there is still no payment refuse to supply any more goods or services until payment is made. If your customer cannot pay last month’s bill they probably will not be able to pay this month’s either and you are simply doubling your exposure. If payment is still not forthcoming then you will probably have to instruct a solicitor to try to recover the debt.

There are three types of procedures in the Sheriff Court depending on the size of the debt. If the sum claimed is up to £3,000 then the Small Claims procedure is used. Debts between £3,000 and £5,000 use the Summary Cause procedure and debts over £5,000 the Ordinary procedure. As the expenses awarded in a defended Small Claim action are usually limited to £150, it may not be economic to instruct a solicitor to represent you, although if you are a limited company you may have to be represented at a full Hearing. Under the Small Claims and Summary Cause procedures there is a Preliminary Hearing where the Sheriff will try to ascertain if settlement can be agreed. If parties cannot reach an agreement then the Sheriff will note the disputed issues and fix a full Hearing at which evidence from both sides will require to be led. The Ordinary procedure rules for debts over £5,000 are quite complex and really require to be undertaken by a legally qualified person.

I have Decree against a debtor does that mean I will get paid? Unfortunately obtaining a Decree for payment does not mean that you will get paid. The Decree gives the authority of the court to instruct diligence against a debtor through the use of Sheriff Officers. The first step is usually to have a Charge for Payment served on the debtor. This gives the debtor fourteen days to pay up, failing which further diligence, including a bank arrestment or earnings arrestment or an attachment of a debtor’s property can be effected. It is important therefore that your records show which bank your customer uses and if he is in employment and who his employers are. The attachment of a debtor’s property is in the main of limited use against private individuals, as most household items are excluded and the costs involved can be quite high. If the debt due is more than £3,000 then it is worth considering raising proceedings and making the debtor bankrupt. The threat of this can sometimes prompt a debtor to make payment. A solicitor will be able to advise you on the most appropriate methods of obtaining payment post Decree.

xporting is a key business growth strategy but many businesses don’t feel that this is for them for a variety of reasons. If your local market is saturated, experiencing low growth, seasonal or your market research has demonstrated a possible demand for your products or services in another country, then no matter what size of business you are operating, exporting is a realistic and viable option for growth. It can of course be a daunting prospect but there is a lot of practical assistance available to help you to successfully work through the process and breakdown any barriers. Any growth strategy has its risks and therefore needs careful planning. The Business Growth team at Perth and Kinross Council (PKC) can give you a sounding board to bounce your growth plans off, give an objective opinion as to the direction your business should be taking and then point you in the right direction for the support you need. There are also potential funding opportunities available through PKC for viable growth projects and also for attending overseas trade shows. The latter are a very effective way for you to test markets, attract new customers, source agents or distributors and make sales. In addition, Scottish Enterprise offers a Smart Exporter programme which has been specifically created to provide expert advice and practical support to potential exporters. They can help you to prepare for exporting, carry out research to identify new markets and overcome any barriers there may be. Their services are either free of charge or heavily subsidised and are available to you regardless of size, sector or previous exporting experience.

I

ain Burnett, the Highland Chocolatier, a family business in Grandtully, began in 2006 and built up a fairly exclusive trade client base including many Michelin star chef and five star hotels – the first of which was Gleneagles. Those clients certainly helped gain the business credibility and the opportunity to have a presence in the exclusive retail outlets of Harvey Nicholls, Edinburgh and McEwen’s in Perth. The business produces high quality, artisan chocolates and has won a number of awards. Iain stated: “Our first toe in the export waters came as a direct result of an SDI lead through their representative in Japan. We were keen to see our products make the journey so we made contact and secured a significant order to an upmarket retail store. That order and contact seemed to open many doors for us, the majority of our orders coming as a result of networking and huge support from Global Scots, SDI, a number of Perth & Kinross Council contacts and our own home client base. “Following fairly closely on Japan, we had orders for the Middle East and Germany. Alongside that, the internet has made the world a much smaller place and we benefitted from orders from Australia, New Zealand, America, Canada and Japan. “Almost overnight our sales revenue was up 30% – and, of course, success breeds success which for us was creating 8 tonnes of artisan chocolates in a year. “The Gulfood Exhibition was tremendously important to us, creating a huge number of contacts and an invitation to tender and be shortlisted for airline supply. P & KC and a number of support groups helped us and without them it would have been a much harder task – at times impossible. “We continue to develop those leads, one almost converted and others very close - so it is exciting and rewarding. It has been a case of thorough preparation and planning on the business side, gaining information and experience from the strong network of contacts. When you add to this the reputation that is out there for quality Scottish exports like whisky and salmon it does make it easier for small companies like ourselves to hang onto their coat-tails, and the support that is available to help overcome the inevitable hurdles is tremendously important.”

n a recent trade mission to Tokyo, John Swinney MSP was delighted to find local honey from Perthshire already placed in the market. Heather Hills Farm, a small company with only 7 employees, has been exporting to Japan, Germany and the USA for over 20 years. “If small companies like Heather Hills can manage to export on their own, there’s nothing stopping others following suit,” declared Mr Swinney. Mark Noonan, MD at Heather Hills, said: ”Our honeys and preserves have the quality and provenance that importers are looking for and we have invested in branding which is an important factor in our success. “Scotland as a brand, especially our food and drink, is well perceived and often traded at a premium in overseas markets. “It also helps if you can find a good freight company and insurer as these costs will be a major factor in your viability in the market and ultimately volume of sales overseas. Freight costs to the Far East are extremely competitive at the moment. It’s cheaper to send a pallet there than across the channel and,if you can find out your product codes and tariffs, you can even offer delivery to their door. With Sterling still at historic lows now is a good time to be looking at export growth”.

ast month, the people of Perth and Kinross went to the Polls and voted in 41 local councillors to steer the district through the next four years.

The public returned 18 SNP councillors who, as the largest group, opted to establish a minority administration on Perth and Kinross Council. The Scottish Conservative and Unionists have 10 councillors, Scottish Liberal Democrats 5, Scottish Labour Party 4, Independents 3 and Perth Independent Candidates’ Party 1. Perthshire Chamber of Commerce put the leaders of the four main political groups on the spot immediately, seeking their views on what they believe are the main issues affecting local businesses and what they plan to do in the next four years to address them. 32

“It is vitally important that as a Council we help to create the right environment in Perth and Kinross for existing businesses to thrive and grow, and one that will also attract new investment into the area.

“After a period of intensive discussions between all parties, here in Perth & Kinross, the Scottish National Party decided to run with a minority administration. The Conservative Group, while still the main opposition group, has entered an informal arrangement with the SNP working with them on an issue by issue basis and we feel that this will be in the best interests of the people of Perth & Kinross.

That is what the last Council administration strived for, and that is what we will continue to do for the next five years. I believe that creating the right business environment starts with our education system. We need to give young people in Perth and Kinross the skills they need to succeed in the modern job market, and do all we can to encourage our youngsters to fulfil their potential. The future prosperity of our local businesses, the local economy and our communities depends on it.

Whilst willing to support them on proposals that we feel are in the best interests of Perth and Kinross residents, we reserve the right to propose alternative proposals we think would be more beneficial. We must now all move forward to meet the challenges which the new council will have to deal with over the next 5 years.

In Perth and Kinross we have some of the best education facilities in Scotland on our new community campuses, and in February the Council announced a further £62m investment in the infrastructure of our schools. This will equip us well for future decades.

The main financial challenge is going to be doing more with less, council tax has been frozen for a number of years and while additional funding has been made available it is not enough to do all that we are being asked to do.

Another crucial strand in creating a vibrant business environment is employability. The Council is making £250,000 a year available to help tackle youth unemployment in Perth and Kinross. This investment will provide modern apprenticeships and professional traineeships within the Council for 40 young people each year. The money will attract further inward investment of at least £100,000 from Skills Development Scotland to support the training of those young people.

The second major challenge is the economy of Perth & Kinross, it has been said that there is little that the council can do to boost the economy. However, the council can make Perth & Kinross a more pleasant place to do business by improving the appearance of the city and town centres, working in partnership with property owners etc.

We are also spending an additional £100,000 on employability support – making sure that local people can find suitable employment with local businesses. This will allow the Council to work with local businesses and our partner agencies to match people with jobs in Perth and Kinross. A very important aspect of a successful local economy is growth. We all realise that these are very hard times for local businesses, but as a Council we are committee to doing all we can to offer help and support to make sure all local firms can be a success. I would like to outline some of the support that is available to local businesses from the Council. In February’s Council Budget an additional £205,000 was announced that will be spent on measures to promote economic growth across Perth and Kinross. These include: • £90,000 to provide advice on small businesses, self employment opportunities, and funding and developing community asset transfers. • £75,000 to fund a bid to attract broadband investment. • £40,000 to market the area as a great place to do business. The Council also now has a dedicated of team of business advisors that supports existing local businesses to realise their growth potential. The Business Growth Team works with smaller companies that might not be catered for by other agencies such as Scottish Enterprise and Business Gateway. Services offered by the team include providing one-to-one advice to businesses; helping businesses to access support and advice from other Council services, and from other business development agencies; helping to source potential funding and offer direct financial support to Council business grants and loans. To date the Team has approved business growth grants with a total grant value of over £100,000. This will help attract additional private sector investment of £285,000. These projects are expected to create new jobs and safeguard existing jobs within the businesses being supported.”

There is of course the future of Perth City Halls which casts a gloomy shadow over the centre of Perth and this issue must addressed sooner rather than later. Unemployment is another issue, particularly youth unemployment. It is probably more important to be employed when young than at any other time of your life. Getting the discipline of good time keeping and the ability to follow instructions at an early age is vital for young peoples’ development. Providing our young people with the necessary employability skills is something which we as a council will have to concentrate on. Not everyone is academically inclined and for many of our young people an apprenticeship is a lot more relevant than further education. We also need to remember rural businesses. There are many vibrant small businesses in rural areas that provide employment for local residents. They deserve the council’s support. Another major challenge is the care of the elderly and vulnerable. Longevity while good news for all of us brings with it challenges, while many of us enjoy good health, well into our later years, there are an increasing number of elderly people who through sheer longevity require support from the NHS and the council. If we continue to deliver services to the elderly and vulnerable the way we do at the moment all our school leavers in twenty years time will be employed in the care industry. Care at home is what most people want and this is how it will be delivered in the future by a partnership between the NHS and the Council. The foregoing are our major challenges and I am sure more will appear over the next five years. I have every confidence however that by working together we will achieve satisfactory outcomes for the people of Perth & Kinross.”

Firstly: Empty shops on the High Street and city centre. People want their city and town centres to be thriving, attractive places with a lot of buzz and excitement.

To help alleviate the problem, this Council will have to consider a number of initiatives starting perhaps with the recognition that we must use a quality retail specialist agent with the necessary contacts to assist current local businesses and attract new ones.

Local people want a sense of security for their young generation and a good start for them into their adult working lives. Everyone knows a school leaver or college and university graduate now struggling to start their career.

We have to encourage the owners of empty properties, whether Council or not, to refit these properties to the highest standards to make them attractive to retailers.

The main issues affecting local businesses and the Council, are how do we work together in partnership to deliver growth in the local economy and make a difference which is visible and tangible to local people.

We have to offer incentives to businesses to encourage them to expand in our towns, as well as the city, ie the first six or nine months to be rent free. Rents thereafter have to be set at the market rate for the area and, if necessary, give serious consideration to granting businesses a turnover rent until the current crisis has passed. We must not forget the needs of independents such as the highly successful Bertie Browns and help others to develop to their standards - and let's have no more nonsense about the colour of that building. We have to co-operate fully with the various businesses and examine whether the current Council policies on planning are proving to be a deterrent to their success and, now that we have achieved City Status, we have to take advantage of the funding opportunities this affords.”

Leadership and effective collaboration between the private, public and third sectors is essential to deliver growth and opportunities for everyone in our community including those furthest from employment. City status needs to be the springboard from which we kick on towards our ambitions for Perth as the economic engine for the whole of our area - it can't be seen as an end in itself. That requires us to ask questions both of the Scottish Government and ourselves: How will the Cities Investment Fund be targeted at Perth and how can Perth lever in additional funding, develop collaborative projects to attract private sector investment and accelerate the pace of investment into our area and economy? We need to grasp the opportunities of the Youth Contract with both hands and work with local employers, who are critical partners in providing the Youth Contract, to give young people the skills and experience they need to be successful in the job market. We need to get the message out to local businesses now, to ensure that this year Perth and Kinross gets its share of the 25,000 new modern apprenticeships and the subsidies available to local businesses. Access to funding for local businesses looking to expand is one area where collaboration, smarter working and innovation can make a real difference. PKC has at any moment in time around £50m on deposit. Instead of money being held in Banks and financial institutions which don't lend to local businesses, we need to ensure that our resources support local businesses and economic growth. I want the council to establish a £1m Business Loans Fund. Other local authorities are already doing this and reaping the rewards from new business startups and supporting established businesses to grow. We are all facing the challenge of increasing demand for services and falling resources. Being a bystander to gradual decline is not an option. The future lies in partnerships where the whole exceeds the sum of the parts, utilising the expertise and flexibility offered by the private sector, harnessing the benefits which social enterprises bring towards creating a more equal society and fulfilment for vulnerable members of our community, and tapping the rich resources in our communities, themselves, creating greater community ownership and responsibility for the common good.”

Employee Benefits can be taxing I recently met a pleasant couple who ran their own business. They understood how to run their business profitably, although openly admitted they were unsure of financial accounts and tax. As they put it “we always thought our accountant looked after these things”. They had been unfortunate enough to receive a visit from the PAYE compliance arm of HM Revenue & Customs. The selection of these types of visit tends not to be random. Often they stem from information provided to HM Revenue & Customs which is inconsistent, strange or wrong. A common area for error will be a P11D form, which returns the benefits provided to an employee. My average couple had a problem. Their visit had arisen from an incorrect return which turned out be a genuine mistake. However, in the brief meeting we had I discovered various issues, most of which the owners did not really understand and felt they had been let down by their accountant. Regardless of the blame, there was a lack of understanding and several glaring errors had been made. Their business traded as a limited company and the shares were owned by various family members. In a rush to obtain a National Insurance saving they, like many other small limited companies, had used dividends to reward working shareholders as an alternative to paying them a salary. There is nothing wrong with paying a dividend if done correctly. However, they had been advised that some shareholders should waive their right to a dividend in order to divide profits tax efficiently. Further the dividends were paid weekly as part of the payroll and no paperwork produced recording the dividend paid. A bigger red flag could not have been waved at HMRC. By paying weekly dividends the payments could be determined to be remuneration. The company will have to pay the underpaid national insurance, penalties and interest. HMRC will, as a matter of course, go back up to four years checking for similar errors.

Unfortunately, it did not stop there. Other problems were apparent with the calculation of company car benefits. A second hand car had been bought and the benefit calculated using the purchase price rather than the list price of the car. Tax was due by the director and Class 1A National Insurance by the company. The directors had also borrowed money from the company for a couple of months to purchase a flat. Although the loan had been repaid the directors had received the benefit of an interest free loan. The beneficial loan interest should have been returned to the HMRC as an employee benefit in kind. This was 3 years ago so back tax, interest and penalties would apply. Although yet to be resolved the cost is likely to run to thousands of pounds and seriously affect the cashflow of the company. The advice to be learned by any business is that cutting corners to save tax does not pay off. HM Revenue & Customs are watching you and the information you submit. Once an enquiry is made any errors or mistakes found in previous years will be costly to your business. cottish Environmental Protection Agency, Tayside Fire and Rescue, Perth and Kinross Council and the Scottish Flood Forum have formed a partnership aimed at introducing a new approach to reducing the risk from flooding to businesses and communities within Perth and Kinross and would like to invite you to be involved. The four agencies have set up this steering group to look at how we can work better together before, during and after flooding and develop options for increasing community resilience against it. At present the group is being set up on a pilot basis. One of the areas we are targeting is Perth City Centre - based on its success we will look at introducing similar groups in other areas across Perth and Kinross. What’s in your shopping basket? When you put potatoes, berries, jam, yoghurt or drinks in your shopping basket do you ever stop to think how they reached the supermarket shelves? Not many of us do but it’s interesting to note that a large number of the most popular potato and soft fruit varieties we enjoy every week started life at the James Hutton Institute in Perth and Kinross. Varieties of potato and soft fruit - raspberries, blackcurrants and blackberries - are developed at the Invergowrie site as part of a crop breeding programme run by the James Hutton Institute and its affiliate Mylnefield Research Services Ltd, which works with commercial partners to bring products to market.

Local grower, Arbuckle Soft Fruit, only grow Glen Ample and produce approximately 100 tonnes of Glen Ample fruit per annum right on the doorstep of the James Hutton Institute in Invergowrie. Angus Soft Fruit Ltd, a leading soft fruit grower and supplier who market 20% of UK fresh raspberries, claim their raspberry business is “built on Glen Ample”. Glen Ample plants are widely available to the public through mail order or from garden centres and nurseries. The Royal Horticultural Society has given Glen Ample their prestigious Award of Garden Merit. This delicious variety is a versatile cultivar that consistently produces a high yield with large fruit and excellent quality.

All of their raspberries, for example, are easily identifiable as they have the prefix Glen. One of the most successful and popular is Glen Ample, which is the number one cultivar in Scotland and forms the backbone of the UK raspberry industry.

Most people will have already enjoyed Glen Ample, perhaps without realising which variety they were eating, as it has been on sale in all the major supermarkets for over 10 years and - thanks to the advent of polytunnels - is available from late May right through until late October.

Other soft fruit to look out for with the Hutton history are blackberries (all varieties are prefixed with Loch) and blackcurrants (all with the prefix Ben).

Even out of season it is possible to enjoy Glen Ample as it is widely used in products such as Baxter’s jam, Sainsbury’s Taste the Difference raspberry yoghurt and even in beer with the Edinburgh Innes and Gunn brewery recently launching Melville’s Raspberry Beer.

The Institute has been working on blackcurrant breeding programmes at Invergowrie since the 1960s and 50% of the world’s blackcurrant crop and more than 95% of the UK crop are varieties developed by their scientists. Did you know for example that every Ribena berry can trace its roots to Invergowrie? So if you have ever had Ribena then you are sure to have tasted these varieties as ALL the blackcurrants used in the famous drink have been bred at the Institute. The number one organic potato grown in the UK, Lady Balfour, is another variety from the Hutton breeding programme. Other potato varieties you could try are Vales Sovereign, a previous winner of Tesco’s 'Variety of the Year' Fresh Produce Awards and the Phureja cultivars, which were the first of their type to be commercialised in Europe, but are the second most widely grown potatoes in the Andes in South America. These Phureja potatoes; Mayan Gold, Inca Sun, Inca Dawn, Mayan Queen, Mayan Star and Mayan Twilight; have a distinct flavour and are best enjoyed roasted. They are available from major supermarkets including Tesco, Sainsbury’s and Marks & Spencer at particular times of year.

The James Hutton Institute was formed last year by the Macaulay Land Use Research Institute in Aberdeen and SCRI, the Scottish Crop Research Institute based in Invergowrie. The Institute encompasses a distinctive range of integrated, world-class strengths in land, crop, water, environmental and socio-economic science. It undertakes a wide range of research for customers including the Scottish and UK Governments, the EU and other organisations worldwide. The Institute has a staff of nearly 600 and 125 PhD students across its campuses. During its first year, the Institute has become recognised as a leader in research and thinking both nationally and internationally. The James Hutton Institute is part of a successful consortium that was awarded a £7 million contract for cereals research, funded in part by the Scottish Government. The aim will be to make an important contribution to global efforts to breed improved cereal crops. The projects hope to shed further light on the genomes of wheat and barley, the two most widely grown cereal crops in the UK. The genome of the potato was published in Nature last July. It was a global project but the UK contribution was led by the James Hutton Institute. The work was supported by the Scottish Government and the knowledge gained by this breakthrough will have far reaching benefits for potato breeding, the fight against potato diseases and pests and will boost the Scottish potato sector. The Institute is constantly working towards new improved crop varieties which will deliver not only better yields but also require less input making them more sustainable. In addition to those crops highlighted previously, their research includes malting barley for the whisky and brewery industries and the challenge to develop more robust, disease resistant varieties. So next time you pop something in your shopping basket - stop to look at the small print because you could be picking up a variety from closer to home than you think.

ummer is here and with it comes the annual migration of caravans and motorhomes from garages on to our roads. But while this great British craze may mean frustration for other road users, it spells business for our tourist sector and the companies dealing with this growing market. Ian McCormack of Perthshire Caravans tells us more: “There has been a noticeable increase in the number of people investing in motorhomes and caravans recently. “You no longer have to compromise on comfort as the new generations of engine in the latest motorhomes give a much more refined ride and can be compared to driving a large car. The hiring of motorhomes can be quite expensive but a lot of people do this before they buy. “Even the most basic models of caravans/motorhomes are coming fully equipped nowadays with items like microwaves and stereos as standard. The higher spec models have wet central heating systems as you would have in your house. Caravans and motorhomes are very simple to operate nowadays. Heating, water heating, fridge etc. can all be turned on by the touch of a button. The days of paraffin lamps are long gone. “There is probably a larger degree of freedom with a motorhome. Many people will take these over to the continent and spend weeks or months touring round. “Motorhomes also lend themselves more to rough camping. This is a term used where you can stop really anyplace for the night without having to go to a park.
