www.sjsd.k12.mo.us RESPONSIBLE USE AGREEMENT Our students use technology to learn. Technology is essential to facilitate the creative problem solving, information fluency, and collaboration that we see in today’s democratic societies. While we want our students to be active contributors in our connected world, we also want them to act safely, legally, and responsibly. This Responsible Use Agreement (RUA) supports our vision of technology use and instills in our students a strong sense of digital citizenship. How We Use Technology We use technology to develop in our students the literacy skills they need to contribute in a connected world. We use technology to facilitate creativity and innovation. We use technology to support communication and collaboration. We use technology to extend research and information fluency. We develop in our students a sound understanding of technology operations and concepts. We believe technology can be transformative, and we encourage students to use technology to do what they could not otherwise do. We create a safe online environment for everyone. Filtering software keeps most unwanted sites off our computers. In addition, adults supervise our students’ computer activities at school. Our overarching goal with students is to address the “SJSD Learner” model. This is a forward-looking framework that seeks to inform curriculum as well as instructional practice toward the development of graduates who are ready for success in the 21st Century and beyond. This model is available on the Saint Joseph School District website at http://www.sjsd.k12.mo.us/domain/907 Our Hardware and Software All of the St. Joseph schools have wireless access to the Internet. Digital projectors and interactive whiteboards which facilitate group viewing and discussions are found in many of our elementary and secondary schools. Elementary and secondary students each have access to a standard suite of software to support their learning needs. With wireless access, students are allowed to bring their own devices. These devices generally have internet access but will not have direct access to our internal network. The use of laptops and mobile devices continues to emerge, and we are working towards effectively managing, supporting and utilizing a variety of technologies in our schools. Each student from K-12 has a student email account that supports curriculum activities.

Being a Digital Citizen We strive to show students the safe, legal, and responsible use of information and technology. We embrace the following conditions or facets of being a digital citizen. • •

Respect Yourself. I will select online names that are appropriate. Protect Yourself. I will not publish personal details, contact details, or schedules of activities for myself or anyone else. I will check with my teacher before registering at any website. Respect Others. I will not use technologies to bully, harass, or tease other people. Protect Others. I will protect others by reporting abuse and not forwarding inappropriate materials or communications. Respect Intellectual Property. I will suitably cite any and all use of websites, books, media, etc. Protect Intellectual Property. I will request to use the software and media others produce.

Project Connect St. Joseph School District’s 1 to 1 Pilot Computer User Agreement Qualifications: A student who is actively enrolled in, and who physically attends Benton High School or Bode Middle School full-time qualifies for use of a districtowned student device. In order to possess and use the borrowed device, one must comply at all times with the expectations of the Student/Parent Laptop Handbook and the District’s Technology Usage Policy EHB & SJSD General Technology Guidelines as approved by the SJSD Board of Education. Terms: Qualifying students will be issued a district-owned device at no cost to student/parent/guardian. Financial obligation is not issued to student/parent/ guardian unless loss or damage of the borrowed device occurs as the result of handling, storage, transport, use, or reporting of loss/damage that is not in complete compliance with the Student/Parent Laptop Handbook and District Technology Usage Policy EHB & SJSD General Technology Guidelines. Any failure to comply may terminate qualification and rights of possession effective immediately, and SJSD may repossess the property. Title: The legal title to the borrowed device belongs to the St. Joseph School District and shall at all times remain as such. The user’s right of possession and use of the borrowed device is limited to and conditioned upon full and complete compliance with the expectations detailed in the Student/Parent Laptop Handbook and the District’s Technology Usage Policy EHB & SJSD General Technology Guidelines. Because the borrowed device is the property of the school district, it is subject to monitoring of use and search of contents at any time. There is no expectation of privacy in use or data stored on a district-owned device. Loss: By taking possession of a borrowed device, the user agrees to assume full responsibility for the safety, security, and care of the borrowed property. In a case of complete loss, the borrower agrees to pay replacement cost. The borrower must report the incident to the principal or assistant principal within 48 hours.

handling of the property, the borrower agrees to assume full responsibility for the damaged device as deemed necessary by the school district. In the case of damage to a borrowed device, the user must report a potentially damaging incident to the principal. Failing to report damage or potentially damaging incidents in the timely manner described here will result in an absolute financial obligation for the student/parent/ guardian in the amount of repair costs for the damaged property. Repossession: If user does not fully comply with all terms of the Student/Parent Laptop Handbook and District Technology Usage Policy EHB & SJSD General Technology Guidelines, including the timely return of the property, SJSD shall be entitled to declare user in default and come to the user’s place of residence, or other location of the device, to take possession of the property. Term of Agreement: A user’s right to use and possess the borrowed property terminates no later than the last day of the school year unless terminated sooner by the District for noncompliance or due to a change in schedule/attendance arrangement that no longer results in the user physically attending full time at Benton/Bode. Consideration will be given for use if requested for a summer school class by a teacher. Appropriation: The users failure in the timely return of the property and/or the continued use of the borrowed property for non-school purposes without the District’s consent may be considered unlawful appropriation of the District’s property. By using or taking possession of a laptop owned by the St. Joseph School District, the student and parents/guardians agree to comply with these Terms of Laptop Use Agreement, SJSD Technology Usage Policy EHB & SJSD General Technology Guidelines.

Damage: By taking possession of a borrowed device, the borrower agrees to assume full responsibility for the safety, security, care, and proper use of the borrowed property. In case of accident, fire, flood, or careless

Free Student Usage: • Student laptops and the listed accessories are provided by SJSD to qualifying students at no cost to students or their parents/guardians. If used in compliance with all expectations detailed in this handbook and District Technology Usage Policy EHB & SJSD General Technology Guidelines and then returned without damage as described in the “Repair Costs” section below, no fees or financial obligations will be issued at the time of return of the borrowed property. Replacement Costs: • A student/parent/guardian is only responsible for cost of replacement of a lost laptop if the loss of the borrowed property is not reported according to the “Reporting Loss/Damage” section found on page 6-7 or the borrowed device is lost as the result of handling, storing, or using in a manner not in compliance with the “Security, Storage, and Transport” guidelines found on page 6. • Replacement cost for the current model of student laptop is $920.00 with charger. • A student/parent/guardian is fully responsible for the replacement cost of any laptop accessories lost while on loan to the student. • Replacement costs of laptop accessories are based on the price for which SJSD purchases replacement accessories from 3rd party vendors: Accessory

Compatible Charger/Power Cord Brenthaven Carrying Case Repair Costs: • Repairs will be made to a borrowed device if the nature of the damage makes the device inoperable or leaves the device in a state where the damage is likely to increase after redistribution resulting in need for repair for a future user. • A student/parent/guardian is responsible for cost of repair of a damaged laptop if the damage to the borrowed device is the result of deliberate abuse or neglect, abuse or neglect not reported as detailed in the “Reporting Loss/Damage” section found on page 6-7, or failure to comply with the “Handling, Care, and Use” and/or “Security, Storage, and Transport” expectations found on pages 5 & 6. • Repairs and replacement costs must be made and purchased through the district. • The District MacBook repair Cost Guide is available online at: www.sjsd.k12.mo.us/page/10903

Special Accommodations / Restricted Access: • Parent/Guardian-­‐Initiated Accommodations: It is the belief of the SJSD that every student should be granted equal access to learning. It is not the district’s recommendation that a student be restricted access to any learning resource that is granted to all students. If circumstances outside of school call for a student to have limited or restricted access to district provided resources, a written request by the student’s parent/guardian, in collaboration with a school administrator, must be placed on file with the particular school from which the parent/guardian is requesting the special accommodation. If the request is initiated by parent/guardian, then approved by a school administrator, and placed on file with the school’s technology department, a student may be granted “as needed only” or “by teacher request only” access to a laptop, rather than having it issued permanently into the student’s possession. • Administrator-­‐Initiated Accommodations: Noncompliance with the expectations of the Student/Parent Laptop Handbook or violation of the District Technology Usage Policy EHB & SJSD General Technology Guidelines can result in the loss of privilege with, or restricted access to, district-­‐provided technology as a consequence for misuse or a safety measure for a particular student. If this is the case, a school administrator will collaborate with the student and parent/ guardian to make arrangements that may deny or restrict access to the resource in question. The use of SJSD technology is a privilege rather than a right and can, therefore, be taken away from a user who has displayed a pattern of behavior that is considered by an administrator to be potentially unsafe or unhealthy for the user, other students, staff, the technology itself, or the learning environment. Handling, Care, and Use: • The student user is responsible for all media, Internet usage, downloads, file creation, file deletion, file sharing, file storage, and other actions that involve all software or applications accessed via your assigned laptop. Students shall not allow other users to use the laptop assigned to them. • The laptop is only for creation of, storage of, access to, and consumption of school appropriate content. Students should not access, store, create, consume, or share unauthorized or inappropriate content with their laptops.

• Students should start each school day with a fully charged battery on your laptop. • Students should ensure the device logs on to the school district’s network regularly to receive necessary updates that are critical to keeping the device safe and operational. • Students should not connect anything into any of the ports and/or connectors of the laptop that are not intended for that particular port or connector. • Students should never expose liquids or other foreign substances, including, but not limited to: drinks, paint, ink, glue, cleaners, polishes, or any type of health/beauty aid (lotion, nail polish, perfume, soap, shampoo, etc.) to your computer. • The surface of the device is not to be altered or defaced. Students should not decorate the assigned device or remove labels, stickers, or tags from the assigned device that are affixed by school district personnel. Laptop “skins” designed for the purpose of protection and aesthetics are allowed, but will not be replaced if damaged during district repair. • Only school district personnel troubleshoot, diagnose, or repair your borrowed device. Do not allow 3rd party service people to handle the assigned laptop. Security, Storage, and Transport: • Keep the laptop powered off and in the protective carrying case when not in use. • Do not hold, lift, or suspended the laptop in the air solely by the screen/display. • Transport the laptop within the protective carrying case both within the school and outside of school. • Make sure to power the laptop completely off before inserting it into the protective carrying case if it will be stored there for a duration of longer than 5 minutes. • Handle the laptop with caution, even when in the protective carrying case. Do not throw, slide, drop, toss, etc. the laptop, even while in the carrying case. • Relocate a laptop that is powered on and in use for class, to a secure location to be monitored by a staff member if leaving the classroom at school. Do not leave it on a small or unstable desk in a crowded classroom if the student is leaving the room, even if only for a moment. • Take the laptop home every day for nightly storage. Do not leave it in a school locker for overnight storage or store in extreme hot/cold. • Laptops at home should be kept out of the reach of younger siblings, family pets, or anyone else capable of careless handling or inadvertent damage of the property.

• Students are responsible for making sure they do not share or switch the laptop, its power charger, and/or other accessories with other users. • It is recommended that students should bring their laptop to school fully charged. Students are responsible for any loss or damage that may occur to it, regardless of whether loss/damage occurs at school or away and regardless of who is using it at the time of loss/damage. • Students should power the laptop down and keep it in the protective carrying case while transporting it in a vehicle. • Students will secure the laptop out of view from anyone outside of a vehicle if being temporarily stored in a parked vehicle. Never store a laptop in an unlocked and/or unattended parked vehicle, even when the parked vehicle is at your residence. • Students will communicate with their teachers, coaches, sponsors, supervisors, etc. about ensuring that the laptop will receive secure storage if they have it at school related activities, performances, sporting events, etc. Reporting Loss/Damage: If the student’s computer is lost or stolen: • Student or parent/guardian notifies the building principal within 48 hours or the following Monday morning if incident occurs on a weekend. • SJSD has installed a third party monitoring system on all student laptops for tracing or tracking of a missing device that is in use by another user. This system will track regardless of whether it is in use on district network or off district network. • This system can remotely track user, location, IP address, and changes made in hardware/software. • This third party monitoring system can only provide information useful for tracking and recovery if the device has been in use since the time of loss. • A device that is simply lost and has not ever been used since the time of loss is not providing any data for tracing/tracking purposes. • Student/parent/guardian, in cooperation with the building principal, files a police report with the student resource officer if they believe the device has been stolen. • If a user issues false information in reporting a missing device, he/she will be held responsible for the loss of the device and may face further consequences associated with reporting false information to school resource deputies (of the St. Joseph Police Department).

• Full restitution is made by student/parent/guardian if computer is not found. • Student checks out a loaner computer, which will remain at school until the original device is located or replacement cost is paid. • If it is discovered that the loss of a device is due to damage that has occurred in part because the student is not in complete compliance with the terms of agreement or the expectations detailed in the Student/Parent Laptop Handbook as they relate to storage, security, handling, transporting, or reporting loss of the device, the student will remain responsible for the loss of the device. • Full restitution is made by student/parent/guardian if computer loss is due to damage. If the student is having computer problems: • Student notifies building tech support of the problem. • The building technician will assess whether the issue requires a warrantied repair. If a warrantied repair is required, the student will receive a loaner while their computer is being repaired. The loaner device may be taken home until warranty work is corrected. • If the building technician determines negligence on the part of the student, the technician will follow the computer damage procedures outlined below. If the student’s computer is damaged: • Student notifies building tech support of the damage. • Tech assesses the damage, determines a repair price, and notifies the building principal. • The student is responsible for repairs or full replacement. Student must pay the fee before he/she will receive his/her device. The student will receive access to a loaner device to be used during the school day. Loaner computers will be distributed according to times specified by the school. The student is not allowed to take the loaner device home. • In the instance a student is unable to pay restitution, the building principal can assign student service hours to be completed in replacement of payment. These hours must be completed on District property at the discretion of the principal. For the purpose of this project, one community service hour equals $10.

File Storage / Back-­‐Up: • Every student has a home folder on the network server for document backup. • Content saved on the device’s desktop is not stored on a network and, therefore, can be lost if a device requires repair or maintenance. • Flash drives, SD Cards, etc. formatted as storage devices can be used on SJSD laptops. Home Network Usage: • All SJSD usage expectations and policies pertain to use on home networks just as they do when at school. • SJSD laptops are designed to work as a single, independent workstation in a home network that allows for such, either by cable or wireless device. • SJSD laptops will connect to home wireless networks if the wireless network is open or only requires a network key, or pass code, to connect. • Do not attempt to install or reconfigure virus protection software, security settings, firewall settings, IP configuration, or operating system defaults on your SJSD laptop, even if your home network calls for it. • Many “plug and play” printers that are compatible with Mac OSX will work with an SJSD laptop if connected directly to the laptop via USB cable. Wireless Internet Access: • All SJSD usage expectations and policies pertain to use on public Wi-­‐Fi networks just as they do when at school. • SJSD laptops can connect to any standard Wi-­‐Fi network or secured Wi-­‐Fi network for which the user has the appropriate network key or pass code to connect. • Many public destinations now offer free public Wi-­‐Fi to its patrons that can provide your SJSD laptop Internet access away from school. • SJSD laptops cannot be used with Wi-­‐Fi networks that require installation of networking software, reconfiguration of security settings, manipulation of firewall settings, use of network connection wizards, or manual assignment of an IP address.

Content Filtering: • SJSD employs a 3rd party filtering application on all district computers that is updated regularly. These updates are pushed to student devices each time they are logged on to the district’s network. • The content filter, as configured by the district and as it operates on the device in possession of a student who is using the device in compliance with the Student/Parent Laptop Handbook and the district’s Technology Usage Policy EHB & SJSD General Technology Guidelines, will restrict inadvertent access to unapproved content online and deter attempts to deliberately access unapproved content online. • Because of the nature of the Internet, no content filter is capable of preventing all access to all online content that is not school-­‐related. Although the content filter will provide a degree of protection to the user and the device, the user assumes responsibility for not accessing content that is not school-­‐related, whether blocked by the filter at that particular time or not. • Attempts to disable, reconfigure, or circumvent the content filter is a violation of the aforementioned usage policies and can result in administrative referral for disciplinary consequences or restrictions of a student’s technology use privileges. • If a site is blocked in error, contact your teacher, and they will follow district procedures to determine appropriate action.

SJSD General Technology Guidelines General Rules and Responsibilities The following rules and responsibilities will be followed by all users of the district technology resources: 1. Applying for a user ID under false pretenses is prohibited. 2. Using another person’s user ID and/or password is prohibited. 3. Sharing one’s user ID and/or password with any other person is prohibited. A user will be responsible for actions taken by any person using the ID or password assigned to the user. 4. Deleting, examining, copying, or modifying files and/or data belonging to other users without their prior consent is prohibited. 5. Mass consumption of technology resources that inhibits use by others is prohibited. 6. Unless authorized by the district, non-educational Internet usage is prohibited. 7. Use of district technology for soliciting, advertising, fundraising, commercial purposes, or for financial gain is prohibited, unless authorized by the district. 8. A user who accesses fee services of any sort is solely responsible for all charges incurred. District, school, and classroom-level software purchases must be acquired through the District’s process. 9. Users are required to obey all laws, including criminal, copyright, privacy, defamation, and obscenity laws. The school district will render all reasonable assistance to local, state, or federal officials for the investigation and prosecution of persons using district technology in violation of any law. 10. Accessing, viewing, or disseminating information using district resources, including email or Internet access, that is pornographic, obscene, child pornography, harmful to minors, obscene to minors, libelous, pervasively indecent or vulgar, or advertising any product or service not permitted to minors is prohibited. 11. Accessing, viewing, or disseminating information on any product or service not permitted to minors is prohibited unless under the direction and supervision of district staff for curriculum-related purposes. 12. Accessing, viewing, or disseminating information using school or district resources, including e-mail or Internet access, that constitutes insulting or fighting words, the very expression of which injures or harasses other people (e.g., threats of violence, defamation of character or of a person’s race, religion or ethnic origin); presents a clear and present likelihood that, because of their content, or their manner of distribution, they will cause a material and substantial disruption of the proper and orderly operation and discipline of the school or school activities; or will cause the commission of unlawful acts or the violation of lawful school regulations is prohibited. 13. Any use that has the purpose or effect of discriminating or harassing any person or persons on the basis of race, color, religion, sex, national origin, ancestry, disability, age, pregnancy, or use of leave protected by the Family and Medical Leave Act or the violation of any person’s rights under applicable laws is prohibited. See policy AC and regulation ACR. 9


14. Any unauthorized, deliberate, or negligent action that damages or disrupts technology, alters its normal performance or causes it to malfunction is prohibited, regardless of the location or the duration of the disruption. 15. Users may only install and use properly licensed software, audio or video media purchased by the District or approved for use by the District. All users will adhere to the limitations of the District’s technology licenses and follow all copyright provisions. Copying for home use is prohibited unless permitted by the District’s license and approved by the District. 16. At no time will District technology or software be removed from the District premises, unless authorized by the District. All individually-assigned technology is authorized by the District to be taken home. 17. All users will use the District’s property as it was intended. Technology or technology hardware will not be lifted, moved, or relocated without permission from an administrator. All users will be held accountable for any damage they cause to District technology resources. 18. All damages incurred due to the misuse of the District’s technology will be charged to the user/parent/guardian. The District will hold all users accountable for the damage incurred and will seek both criminal and civil remedies, as necessary. Technology Security and Unauthorized Access 1. All users shall immediately report any security problems or misuse of the District’s technology resources to a teacher or administrator. No person will be given access to District technology if he or she is considered a security risk by the superintendent or designee. 2. Use of District technology resources in attempting to gain or gaining unauthorized access to any technology system or the files of another is prohibited. 3. Use of District technology to connect to other systems, in evasion of the physical limitations of the remote system, is prohibited. 4. The unauthorized copying of system files is prohibited. 5. Intentional or negligent attempts, whether successful or unsuccessful, to interfere with the ability of others to utilize any District technology are prohibited. 6. Any attempts to secure a higher level of privilege on the technology resources without authorization are prohibited. 7. The introduction of computer “viruses,” “hacking” tools or other disruptive/destructive programs into a school or district computer, network or any external networks is prohibited. Online Safety -- Disclosure, Use, and Dissemination of Personal Information 1. All students will be instructed on the dangers of sharing personal information about themselves or others over the Internet. 2. Student users are prohibited from sharing personal information about themselves or others over the Internet, unless authorized by the district. 3. Student users shall not agree to meet with someone they have met online without parental approval. 10


4. A student user shall promptly disclose to his or her teacher or another school employee any message the user receives that is inappropriate or makes the user feel uncomfortable. 5. Users shall receive or transmit communications using only District-approved and District-managed communication systems. 6. All District employees will abide by state and federal law, Board policies and District rules including, but not limited to, policy JO and regulation JOR when communicating information about personally identifiable students. 7. Employees shall not transmit confidential student information using District technology, unless designated for that use. Employees will take precautions to prevent negligent disclosure of student information or student records. 8. Release of student information will comply with Board of Education Policy JO. Electronic Mail 1. A user is responsible for all email originating from the user’s ID or password. 2. Forgery or attempted forgery of email messages is illegal and is prohibited. 3. Unauthorized attempts to read, delete, copy, or modify email of other users are prohibited. 4. Users are prohibited from sending unsolicited electronic mail unless the communication is a necessary, employment-related function, or an authorized publication. 5. All users must adhere to the same standards for communicating online that are expected in the classroom and that are consistent with District policies, regulations, and procedures. Exceptions 1. Exceptions to District rules will be made for District employees or agents conducting an investigation of a use that potentially violates the law, District policies, regulations or procedures. 2. Exceptions will also be made for technology administrators who need access to District technology resources to maintain the District’s resources or examine and delete data stored on District computers as allowed by the District’s retention policy. Waiver Any user who believes he or she has a legitimate reason for using the District’s technology in a manner that may violate any of the District’s adopted policies, regulations and procedures may request a waiver from the building principal, superintendent or their designees. In making the decision to grant a waiver to a student, the administrator shall consider the purpose, age, maturity and level of supervision involved. No Warranty/No Endorsement The District makes no warranties of any kind, whether expressed or implied, for the services, products or access it provides. The District’s technology resources are available on an “as is, as available” basis. The District is not responsible for loss of data, delays, non-deliveries, miss-deliveries or service interruptions. The District does not guarantee the accuracy or quality of information obtained 11

from the Internet or use of its technology resources. Access does not include endorsement of content or the accuracy of the information obtained. Board of Education Policy EHB TECHNOLOGY USAGE The St. Joseph School District's technology exists for the purpose of enhancing the educational opportunities and achievement of district students. Research shows that students who have access to technology improve achievement. In addition, technology assists with the professional enrichment of the staff and increases engagement of students' families and other patrons of the district, all of which positively impact student achievement. The district will periodically conduct a technology census to ensure that instructional resources and equipment that support and extend the curriculum are readily available to teachers and students. The purpose of this policy is to facilitate access to district technology and to create a safe environment in which to use that technology. Because technology changes rapidly and employees and students need immediate guidance, the superintendent or designee is directed to create procedures to implement this policy and to regularly review those procedures to ensure they are current. Definitions For the purposes of this policy and related procedures and forms, the following terms are defined: Technology Resources - Technologies, devices and services used to access, process, store or communicate information. This definition includes, but is not limited to: computers; modems; printers; scanners; fax machines and transmissions; telephonic equipment; mobile phones; audiovisual equipment; Internet; electronic mail (e-mail); electronic communications devices and services, including wireless access; multi-media resources; hardware; and software. Technology resources may include technologies, devices and services provided to the district by a third party. User - Any person who is permitted by the district to utilize any portion of the district=s technology resources including, but not limited to, students, employees, School Board members and agents of the school district. User Identification (ID) - Any identifier that would allow a user access to the district=s technology resources or to any program including, but not limited to, e-mail and Internet access. Password - A unique word, phrase or combination of alphabetic, numeric and non-alphanumeric characters used to authenticate a user ID as belonging to a user.

Authorized Users The district's technology resources may be used by authorized students, employees, School Board members and other persons approved by the superintendent or designee, such as consultants, legal counsel and independent contractors. All users must agree to follow the district’s policies and procedures and sign or electronically consent to the district's User Agreement prior to accessing or using district technology resources, unless excused by the superintendent or designee. Use of the district’s technology resources is a privilege, not a right. No potential user will be given an ID, password or other access to district technology if he or she is considered a security risk by the superintendent or designee. User Privacy A user does not have a legal expectation of privacy in the user's electronic communications or other activities involving the district’s technology resources including, but not limited to, voice mail, telecommunications, e-mail and access to the Internet or network drives. By using the district's network and technology resources, all users are consenting to having their electronic communications and all other use monitored by the district. A user ID with e-mail access will only be provided to authorized users on condition that the user consents to interception of or access to all communications accessed, sent, received or stored using district technology. Electronic communications, downloaded material and all data stored on the district=s technology resources, including files deleted from a user’s account, may be intercepted, accessed, monitored or searched by district administrators or their designees at any time in the regular course of business. Such access may include, but is not limited to, verifying that users are complying with district policies and rules and investigating potential misconduct. Any such search, access or interception shall comply with all applicable laws. Users are required to return district technology resources to the district upon demand including, but not limited to, mobile phones, laptops and tablets. Technology Administration The Board directs the superintendent or designee to assign trained personnel to maintain the district’s technology in a manner that will protect the district from liability and will protect confidential student and employee information retained on or accessible through district technology resources. Administrators of district technology resources may suspend access to and/or availability of the district’s technology resources to diagnose and investigate network problems or potential violations of the law or district policies and procedures. All district technology resources are considered district property. The district may remove, change or exchange hardware or other technology between buildings, classrooms or users at any time without prior notice. Authorized 13

district personnel may install or remove programs or information, install equipment, upgrade any system or enter any system at any time. Content Filtering and Monitoring The district will monitor the online activities of minors and operate a technology protection measure (Acontent filter@) on the network and all district technology with Internet access, as required by law. In accordance with law, the content filter will be used to protect against access to visual depictions that are obscene or harmful to minors or are child pornography. Content filters are not foolproof, and the district cannot guarantee that users will never be able to access offensive materials using district equipment. Evading or disabling, or attempting to evade or disable, a content filter installed by the district is prohibited. The superintendent, designee or the district's technology administrator may fully or partially disable the district's content filter to enable access for an adult for bona fide research or other lawful purposes. In making decisions to fully or partially disable the district's content filter, the administrator shall consider whether the use will serve a legitimate educational purpose or otherwise benefit the district. Online Safety, Security and Confidentiality In addition to the use of a content filter, the district will take measures to prevent minors from using district technology to access inappropriate matter or materials harmful to minors on the Internet. Such measures shall include, but are not limited to, supervising and monitoring student technology use, careful planning when using technology in the curriculum, and instruction on appropriate materials. The superintendent, designee and/or the district's technology administrator will develop procedures to provide users guidance on which materials and uses are inappropriate, including network etiquette guidelines. All minor students will be instructed on safety and security issues, including instruction on the dangers of sharing personal information about themselves or others when using e-mail, social media, chat rooms or other forms of direct electronic communication. Instruction will also address cyber bullying awareness and response and appropriate online behavior, including interacting with other individuals on social networking websites and in chat rooms. This instruction will occur in the district's computer courses, courses in which students are introduced to the computer and the Internet, or courses that use the Internet in instruction. Students are required to follow all district rules when using district technology resources and are prohibited from sharing personal information online unless authorized by the district. All district employees must abide by state and federal law and Board policies and procedures when using district technology resources to communicate information about personally identifiable students to prevent unlawful disclosure of student information or records. 14 Â Â


All users are prohibited from using district technology to gain unauthorized access to a technology system or information; connect to other systems in evasion of the physical limitations of the remote system; copy district files without authorization; interfere with the ability of others to utilize technology; secure a higher level of privilege without authorization; introduce computer viruses, hacking tools, or other disruptive/destructive programs onto district technology; or evade or disable a content filter. Closed Forum The district’s technology resources are not a public forum for expression of any kind and are to be considered a closed forum to the extent allowed by law. The district’s webpage will provide information about the school district, but will not be used as an open forum. All expressive activities involving district technology resources that students, parents/guardians and members of the public might reasonably perceive to bear the imprimatur of the district and that are designed to impart particular knowledge or skills to student participants and audiences are considered curricular publications. All curricular publications are subject to reasonable prior restraint, editing and deletion on behalf of the school district for legitimate pedagogical reasons. All other expressive activities involving the district=s technology are subject to reasonable prior restraint and subject matter restrictions as allowed by law and Board policies. Records Retention Trained personnel shall establish a retention schedule for the regular archiving or deletion of data stored on district technology resources. The retention schedule must comply with the Public School District Records Retention Manual as well as the General Records Retention Manual published by the Missouri Secretary of State. In the case of pending or threatened litigation, the district's attorney will issue a litigation hold directive to the superintendent or designee. The litigation hold directive will override any records retention schedule that may have otherwise called for the transfer, disposal or destruction of relevant documents until the hold has been lifted by the district's attorney. E-mail and other technology accounts of separated employees that have been placed on a litigation hold will be maintained by the district's information technology department until the hold is released. No employee who has been so notified of a litigation hold may alter or delete any electronic record that falls within the scope of the hold. Violation of the hold may subject the individual to disciplinary actions, up to and including termination of employment, as well as personal liability for civil and/or criminal sanctions by the courts or law enforcement agencies.

Violations of Technology Usage Policies and Procedures Use of technology resources in a disruptive, inappropriate or illegal manner impairs the district=s mission, squanders resources and shall not be tolerated. Therefore, a consistently high level of personal responsibility is expected of all users granted access to the district=s technology resources. Any violation of district policies or procedures regarding technology usage may result in temporary, long-term or permanent suspension of user privileges. User privileges may be suspended pending investigation into the use of the district’s technology resources. Employees may be disciplined or terminated, and students suspended or expelled, for violating the district=s technology policies and procedures. Any attempted violation of the district's technology policies or procedures, regardless of the success or failure of the attempt, may result in the same discipline or suspension of privileges as that of an actual violation. The district will cooperate with law enforcement in investigating any unlawful use of the district's technology resources. Damages All damages incurred by the district due to a user's intentional or negligent misuse of the district's technology resources, including loss of property and staff time, will be charged to the user. District administrators have the authority to sign any criminal complaint regarding damage to district technology. No Warranty/No Endorsement The district makes no warranties of any kind, whether expressed or implied, for the services, products or access it provides. The district's technology resources are available on an "as is, as available" basis. The district is not responsible for loss of data, delays, non-deliveries, misdeliveries or service interruptions. The district does not endorse the content nor guarantee the accuracy or quality of information obtained using the district's technology resources.
