Council passes ordinances, discusses amendment to age requirement for bar patrons By Denise Lana At its regular meeting Monday, Aug. 21, the Decorah City Council unanimously passed an ordinance allowing storage containers to be used as building material in residential districts. The second reading took place with no input, the third reading was waived and the ordinance was adopted. All city construction codes still apply, and the shipping containers will be required to have exterior walls and roofs and maintain a complementary exterior in the residential neighborhood. Council passed, by a vote of 6-1, the second reading of an ordinance that would change the mayor and council financial compensation. Currently, the mayor receives a yearly payment of $4,800, and the council members receive $50 per meeting. The ordinance considered would increase the mayor’s payment to $5,200, and council members would also be paid for work sessions and committee meetings where the whole council body is required to attend. The council can vote for changes in compensation, but they will not be in effect until after the next city election cycle. Additionally, no changes can be adopted during November and December in the year of a regular city election, which will be this year. First Ward representative Randy Schissel voted nay, saying he doesn’t think it’s the right time to do compensation increases, citing the increase in

the city’s budget and having to cut some items within that budget. Schissel said, “I think we should leave things the way they are.” The third reading will take place at the Tuesday, Sept. 5, City Council meeting held at City Hall at 5:45 p.m. Bar patron age discussion Council discussed at-length proposed efforts to reduce underage drinking in Decorah. They discussed a potential ordinance to amend the age of patrons of a bar to 21 from the current age of 19. Chief Trish Thein shared that her officers who work night shifts, especially when college is in session, when the bars get so full the groups of patrons can’t be controlled. Thein also cited concerns about underage patrons bringing personal alcohol containers into bars. She said, “It’s time to take a stand against alcohol abuse with people who are there and under 21.” Julie Simiele, owner of Your Place, stated, “As a bar owner, this is a total hardship, we would have to hire more people to man the door, it’s gonna be hard.” Simiele continued, “I also have been approached by multiple parents who say thanks for being a safe place where our kids can go and drink. To be fair, it would be easier to have the group all be 21. But it would be a hardship on our bar, we do have underage bartenders who would not

be allowed to stay and socialize after their shift, and three of our sons work at our bar and they could not sit and drink a soda with mom or dad.” She added that her bar gives wristbands to those patrons who are 21 or older, and during busier times like Nordic Fest, extra employees are on hand to check ID’s in the larger crowds and help enforce “no outside beverages” prevent underage patrons consuming alcohol. Simiele said she felt it would be better to wait for Luther College to start and include students in the age debate. “For us personally, we love having the police come in and walk through, it’s great,” Simiele said, addressing Chief Thein’s concerns. “We are fully in support of supporting our police force and we want to continue to have a good relationship with them as well. The biggest thing for us is the extra staff and the financial hardship it would create.” Mayor Lorraine Borowski said she and Chief Thein were scheduled to meet with Luther College President Jenifer K. Ward and Chief Equity and Inclusion Officer Dr. Robert Clay at the end of August to address concerns regarding underage drinking. Ultimately, the council members voted to table the discussion, and the issue will be taken over by the city’s Public Safety Committee. The next scheduled council meeting will be held Tuesday, Sept. 5, due to the Labor Day holiday Monday, Sept. 4.

Decorah students and family members attended the Backto-School Pool Party hosted by the Decorah FEC (Family, Educator and Community) Organization Thursday evening, Aug. 17. WinnMed continues work to add pharmacy The purchase of Donlon Pharmacy by WinnMed in June means services from the downtown pharmacy would move to the WinnMed Campus. Construction is underway in the North Building for the future pharmacy location, and was initially scheduled for late

fall, and is on schedule to be open in the new location by the end of the year. Donlon Pharmacy will continue operations at its current location until the North Building space opens. The board recently approved leasing space in the North Building for the addition of

Durable Medical Equipment through the Mayo Clinic Store, pending clarification on accepting key insurance contracts, which is in process. Construction on the space for the DME is expected to be complete in February of 2024.

Public hearing for proposed sale of county-owned land A public hearing has been scheduled for the Monday, Sept. 11, Winneshiek County Board of Supervisors meeting at 10 a.m., to receive comment regarding a proposed sale of county-owned land to an adjacent landowner. The parcel sits on 240th Ave. adjacent to the Roger and Rita Fjelstul home. The Fjelstuls agreed to an easement across

their property and the county-owned property for residents of the Timp subdivisions to use during reconstruction of 175th Street near Calmar. The county-owned property is no longer needed for any county purpose, and for consideration of the easement across their property, the county wishes to sell the property to the Fjelstuls.

Festina Wastewater Treatment project approved The Winneshiek County Board of Supervisors unanimously approved the plans, specifications, contract and estimates following a quiet and quick public hearing on the issue held Monday, Aug. 21. Bids were considered for the project following the approval, with bids ranging from local company JB Holland Construction’s low bid of $751,850 up to the high bid of $1,280,000 from Wapasha Construction of Winona, Minn. Supervisors unanimously approved accepting the

low bid on the project. Pending acceptance of the contract for the project, work will likely begin on the project in the spring, with December 2024 set as the timeline for substantial completion. The Festina Wastewater Treatment Project has been awarded $300,000 grant from Iowa’s Wastewater and Drinking Water Treatment Financial Assistance Program, and $110,000 grant from Iowa’s Community Development Block Grant.

In order to ensure compliance with the new law, the Decorah Schools need to contact every parent to learn the approved name or nickname for each child. e.g. may the teachers call Martha, Marty? This is a colossal waste of time and our tax money. It forces educators to focus on trivia rather than the important issues of educating our children. All because our legislators seem to want to punish trans young people. Donations and grants enhance quality of life

The mission of Aase Haugen Foundation is exclusively for the purpose of granting gifts of money and/or property to Aase Haugen Homes, Inc., for direct use in its charitable, religious, educational and scientific activities. This past year, the foundation received generous grants from the Winneshiek County Community Foundation and The Depot Outlet and gifts from churches, families and individuals. The Winneshiek County Community Foundation granted Aase Haugen Foundation $6,380 and The Depot Outlet awarded $5,000 for projects to improve the quality of life for residents at the Aase Haugen nursing facility. Other gifts from area churches, families and individuals helped the foundation

Law Enforcement Winneshiek County Sheriff Dar’Shaun Tobacco, 18, of Cresco, was arrested on River Road in Decorah Aug. 12 at 3:52 a.m., and booked into the Winneshiek County Jail for operating while under the influence and serious misdemeanor possession of controlled substance. Aureliano Godinez Carreto, 35, of Postville, was arrested on Highway 9 in Decorah Aug. 13 at 2:03 a.m., and booked into the Winneshiek County Jail for operating while under the influence and open container. While incarcerated in the Winneshiek County Jail, Ronnie Snyder, 56, of Calmar, was charted with C felony theft, 1st degree. This was from an incident occurring May 24, 2023, involving the theft of a motor vehicle. Kristen Fravel, 24, of Waukon, was arrested Aug. 18 and booked into the Winneshiek County Jail on an arrest warrant for failure to serve jail time. Damien Bruns, 18, of Ridgeway, was cited for failure to obey traffic control device following an accident Aug. 12 on 240th Street. Bruns was traveling east on 240th Street when he failed to stop at the intersection with County Road W14, striking a vehicle driven by Brian Kleppe, 28, of Ossian. The impact caused the Kleppe vehicle to enter the east ditch of County Road W14. Damages totaled $10,000 to Kleppe’s 2011 Acadia SUV and $5,000 to 1992 Sierra truck. Decorah Police Decorah Police Officers were dispatched Aug. 16 at 10:34 p.m. for a report of a male subject passed out in a front yard in the 300 block of Vernon Street. After an investigation, 77-year-old James Anthony was arrested for public intoxication. He was transported to the Winneshiek County Jail without incident.

We also have customized slings for residents who have had amputations which help them to feel safe and balanced during transfers.” Another important feature of the Hoyer is the built-in scale which makes it more efficient for staff to regularly record the weights of residents to evaluate their nutritional needs and changes in health status. Foundation funds were also allocated for resident comfort by purchasing bed ex-

Cool and dry weather throughout the state led to 6.3 days suitable for fieldwork during the week ending Aug. 20, according to the USDA National Agricultural Statistics Service. Field activities included cutting and baling hay and harvesting oats. Continued dry weather meant CRP land was opened for emergency haying and grazing. Topsoil moisture condition rated 15 percent very short, 38 percent short, 46 percent adequate and one percent surplus. Subsoil moisture condition

rated 19 percent very short, 44 percent short, 36 percent adequate and one percent surplus. Corn in the dough stage reached 92 percent this week, eight days ahead of last year and 10 days ahead of the fiveyear average. Thirty-nine percent of the corn crop was dented, four days ahead of last year and three days ahead of normal. Corn condition rated to 60 percent good to excellent. Soybeans setting pods reached 94 percent, one week ahead of both last year and the average. Soybeans starting to turn color was

four percent this week. Soybean condition rated 59 percent good to excellent. Oats harvested for grain reached 98 percent, one week ahead of the average. The state’s third cutting of alfalfa hay reached 82 percent complete, 19 days ahead of last year and 16 days ahead of the average. Pasture condition rated 23 percent good to excellent. Livestock producers continued to supplement with hay due to the prolonged dry conditions, but overall livestock conditions were decent with the lower-than-average temperatures for last week.

of letters. Letters to the editor are an important part of civil discourse. However, I reserve the right to assess submissions for civility, and publish those I see fit to promote respectful, constructive and meaningful discussion, and potentially affect change within our community. To be civil is not to be complacent. It’s an active word, not a passive one. I do not expect to agree with every civilly-crafted submission, but respect and uphold the public’s right to express their opinions on local issues. I personally appreciate the different perspectives that have been shared as civil discourse in the last few weeks’ issues. The engagement in civil discourse is intended to enhance understanding as a function of freedom of speech. It is discourse that “supports, rather than undermines the societal good.” Civil discourse is the “robust, honest, frank and constructive dialogue and deliberation that seeks to advance the public interest”. In contrast, uncivil discourse is, “language containing direct insults, willful misattribution of motive without due reason, and open contempt.” This can also be called a “rant,” offered as comment. The speaker or writer simply rails at an issue, often throwing out ad hominem attacks. No opinions are changed; the rant does nothing but provide a proverbial “stick in the eye.” We are one of few truly independent small community newspapers in the state that print today’s news, which becomes tomorrow’s history. We do our best to be impartial reporters of local events and affairs. Our small business employs 12 local individuals, and those paychecks help support them and their families and get spent right back in the community. I welcome civil discourse from letters to the editors submitted from readers. And those who prefer not to submit civil discourse or follow the letter guidelines can always purchase ad space to rant.

Colleen was born on Oct. 9, 1939, the daughter of Roman and Gladys Colleen Wagner in Hageman Spillville. She attended Catholic School at St. Wenceslaus in Spillville and graduated from Calmar High School. She played basketball in high school and softball in a women’s league in Ossian. She enjoyed working at the Bily Clocks Museum and Spillville Bank in Spillville until she was married. Colleen was united in marriage to Paul Hageman on Oct. 9, 1959. To this union five children were born, and they raised their family east of Calmar on the Hageman Family Farm. Colleen moved to Ossian Senior Hospice in September 2022, and then moved to Assisted Living at Aase Haugen Home in Decorah in November 2022. Colleen was a devoted farm wife and helped Paul to raise hogs, beef cattle and crops. She

Edward Busta Jr.

Edward “Eddie” John Busta Jr., 88, of Lawler, died Wednesday, Aug. 16, 2023, at the Hillcrest Home in Sumner. Edward John Busta Jr. was born Nov. 24, 1934, in rural Winneshiek County, the Edward son of EdBusta Jr. ward John Busta Sr. and Elizabeth Heley Busta. Eddie’s education began in a one-room schoolhouse just north of his family home. At the young age of 19, he was inducted into the U.S. Army on Oct. 5, 1955, where he served most of his time in post-war Germany. His service to his country was marked by an honorable discharge on April 24, 1957. After his time in the military, Eddie returned to Iowa where he met his future wife, Geraldine Lynch, at a dance in Lawler. The couple married on March 31, 1959, at Our Lady of Mt. Carmel Church in Lawler. The couple settled in their current rural Lawler home in March 1963. Eddie and Geraldine worked side-by-side on their farm, which included a dairy operation. Their hard work was a testament to their dedication and love for their land and their family. Eddie was an active part of the local

She loved to attend sporting events at South Winneshiek, and even had a reserved spot at the football field Friday nights. Paul and Colleen enjoyed helping at the Greenhouse in Decorah to deliver flowers for Jim and Linda Lukes. Colleen’s grandchildren remember her famous ham balls, dressing, dumplings and always having Twix bars for them. She saved every article and picture that was in the paper of her grandchildren and kept a book for them until they graduated. Colleen is survived by her husband Paul; four children: Ann Marie (Ken) Kirkestue, Monona, Anna Mae (Dave) Smith, Monona, Scott Hageman, Monona, Joel (Kendra) Hageman, Lanesboro, Minn.; 12 grandchildren: Kyle (Vicky) Kirkestue, West Union, Sara (Jim) Bovia, Pickney, Mich., Shannon Kirkestue, Chan-

American Legion post. His commitment to the community and to his fellow veterans was a testament to his character. Eddie retired from farming but his love for the land and the rural lifestyle continued. In his free time, he enjoyed fishing locally and sharing the fruits of his labor with his family. He had a particular fondness for panfish, crappie and bluegill. He will be remembered for his thoughtful demeanor, his dedication to his family and his community. Eddie’s legacy will live on in the hearts of those who knew and loved him. His life was a testament to the power of hard work, faith and love, and he will be dearly missed. Mark Downing

Mark M. Downing, 74, of Cedar Rapids, passed away Wednesday, Aug. 9, 2023. Mark was born on Nov. 29, 1948, in Marne, Iowa, to Berl and Rilla (Menefee) Downing. His passions in life were his husband, Steve, and his grandsons, Logan, Bladen and Jackson. Mark served in the U.S. Navy during the Vietnam War where he made friends that he stayed in touch with throughout the years. Mark enjoyed fishing all throughout his life and especially being on the water with family. He also enjoyed golfing when the weather was decent and even on days it wanted to rain – he would go to the course and attempt to beat the rain to say he did. As the grandsons got older, he shared his joy of golfing and fishing with them. Mark also enjoyed spending his summer sunny days walking the parks surrounding Cedar Rapids. His love of nature knew no boundaries, except for snakes. Shar-

ing that love of nature with Steve and the grandsons is what kept Mark smiling. Mark and Steve were the ones that we all gravitated to no matter the circumstance. They were there for family, friends and community without being asked. We all will miss their kindness, compassion, generosity, sense of humor, smiles and laughs, and overall love of life. They will both be forever in our hearts. The Decorah Area Chamber of Commerce, together with community partners, will celebrate Decorah’s newly-designated Downtown Cultural & Entertainment District Thursday, Aug. 24, with a ribbon cutting event at 5:45 p.m., on Washington Street. This event follows local video promotion by the chamber to coincide with July’s announcement of the district. The state designation lasts for 10 years and requires an annual report submission. The Cultural & Entertainment District program is managed by the Iowa Economic Development Authority. A toolkit is in development to help businesses and community organizations understand and utilize the designation to their benefit.

Set scores for the night were 25-8, 19-25, 25-18 and 25-19. “For our first night out I feel we did some good things, considering the youth and inexperience we have on the floor,” said Coach Gina Holthaus. “However, we have a lot of work to do, but the girls are ready and up for the challenge.” Individual stats were unavailable at press time. The Vikes are at North Fayette Valley Thursday, Aug. 24, at 7:15 p.m., and keep the opening week rolling with their first tournament Saturday, Aug. 26, at Charles City beginning at 9 a.m.

Heat causes cancellations

Extreme heat and humidity this week forced officials to cancel numerous activities for local teams including cross country meets. The South Winn and Turkey Valley cross country teams were to have competed Tuesday, Aug. 22, at Edgewood-Colesburg in their first meet of the season, while Decorah squads were to open the season at Charles City Thursday, Aug. 24. Both events were cancelled.

New look, Vikings have goals of continuing Decorah tradition The 2023 football season can’t start soon enough for the Decorah squad. A year removed from missing the playoffs, this year’s edition of the team is eager to prove that last year was a fluke. Overseeing a team hungry to reach the Dome is Head Coach Pat Trewin, who is entering his sixth season as the skipper, his 32nd with the football program.

Oh-so-close It was a year of painfully close games and narrow misses for the Vikes in 2022. It started at home against Crestwood, falling, 26-14. Four first-half touchdowns lifted Decorah over Waukon in game two, 27-24. Coming off the big win over the Indians, the Vikes couldn’t keep pace with West Delaware, falling, 42-6. It was a huge defensive effort that pushed Decorah over Charles City to a 28-0 homecoming victory, as the Comets were held to 42 yards of offense. In the district opener against Mason City, the Vikes led with one quarter remaining, but gave up 13 unanswered points to fall 13-7. Western Dubuque then rolled up a 38-22 win over Decorah in another district contest. Facing Marion on the road, scoring prospects were few and far between with the home team edging the Vikes 14-13. Controlling the line of scrimmage, Decorah brought home a 45-6 victory over Waterloo East before finishing its season at home with No. 2 Waverly-Shell Rock, dropping the final district contest 32-13. Decorah finished fifth in the district with a 0-4 record with a 3-6 overall record. For the season, the Vikes, had 2,372 yards of offensive with 1,605 on the ground and 767 through the air, scoring 23 touchdowns. Defensively, Decorah had 257 solo tackles and a total of 367.5 total tackles.

DHS history Decorah boasts a history of success having claimed a conference or district title 30 times. Postseason appearances were the school’s 26th time – 1973, ’74, ’78, ’84, ’86, ’87, ’88, ’89, ’90, ’91, ’94, ’97, ’98, ’03, ’04, ’05, ’08, ’09, ’10, ’11, ’12, ’13, ’15, ’17, ’18 and ‘21. Former head coach Bill Post led the team into the playoffs 11 times (2003 as Decorah-North Winneshiek, ’04, ’05, ’08, ’09, ’10, ’11, ’12, ’13, ’15 and ’17 as Decorah). Nine times the Vikes have landed in the state championship contest — 1974, ’87, ’88, ’89, ’97, ’04, ’08, ’11 and ’12. At the top of the list is quarterback Brady Stille, a first team selection and former quarterback. During his senior campaign, Stille was 58-for122 in passing for 749 yards and carried the ball another 122 times for 552 yards. On defense he had 40.5 tackles including 30 solo stops. Jaden Baker, another first team all-district honoree, stepped up on both sides of the ball. He was second in rushing behind Stille, with 434 yards on 107 carries while tallying 20 solo tackles with 6.5 tackles for a loss. Defensive back Ben Wymer was a part of 48.5 tackles, caught 28 passes for 301 yards offensively and earned a first team all-district nod. Casey Brickley was a second team all-district selection and pulled down eight receptions for 106 yards. Other departed players are Kasey Krauskopf, Tate Johnson, Erik Hjelle and William Einck. Smattering of experience Leading the charge for 2023 are 14 letter winners, including five with starting experience. At the top of the list is senior wide receiver/corner back Kaiden Quandahl who caught five passes for 84 yards. On defense he had 20 solo tackles and one interception.

Kelley Gates had four receptions for 124 yards and scored twice for the Vikings during his junior season to go with 10 solo tackles on defense. Coach Trewin has five returning letter winners on the line as well including second-team all-district honorees William Hahn (6’3”, 272 lbs.) who had 25 tackles as a sophomore and Fisher Tweten (6’2”, 209 lbs.) who garnered 11 tackles a season ago. Also back with 14 tackles on his stat sheet is Andrew Rhodes (6’2”, 232 lbs.) at offensive guard/defensive end. At 6’2” and 198 pounds, Benzing returns as one of the Viking linebackers, as the leading tackler last season with 54 total stops and 33 solo tackles. Offensive guard and defensive end Brady Bohner (6’4”, 207 lbs.) is also back after garnering 16 total tackles a year ago. Dakota Johnson (RB/DB, 6’1”, 182 lbs.) carried the pigskin four times for 19 yards last season and tallied 23.5 total stops to go with a pair of interceptions. Landon Kuennen (6’3”, 208 lbs.) also returns as a letter winner to the offensive guard and defensive end positions. Warriors to be led by experience, strength and speed

After a difficult 2022 season where injuries plagued the South Winn football team, the Warriors are ready to spring into action. Entering his 17th season at the controls, Head Coach Jason Ohrt has put together a 105-60 record with the Warriors. At his side will be assistants Mike Wenthold, Justin Izer and Carter Wenthold.

A brief recap South Winn may not have capped off the 2022 season with a district title or a deep run into the postseason, but with numerous injuries piling up at the end of the season, the Warriors finished the season 2-6 overall. Mental mistakes were hard to overcome for SW on opening night, as the Warriors fell to North Fayette Valley 35-6. In week two, Maquoketa Valley took a district contest from the Red and White, 38-8. The Warriors got one of their two wins in week three, crushing Clayton Ridge, 53-19, on the road. Scoring 35 points in the first half, South Winn was the victor over Starmont, 48-29, in week four. The Warriors then had their homecoming spoiled by North Linn, 42-7, then fell to No. 10 Wapsie Valley, 48-24. The SW offense was shut down in the final quarter against Bellevue, who went on to score the final 14 points and the win 4228. The Warrior season ended with East Buchanan with a 6913 loss. South Winn accumulated 2,138 yards of offense, with 1,919 coming on the ground. Talented corps South Winn will rely on its 11 returning starters in 2023. At the top of the list are two all-district honorees, Parker Timp and Brady Ohrt. Defensively, he was second in tackles with a total of 35.5, with 27 solo stops and 10 tackles for a loss. Calling out the signals, Ohrt (QB/RB/DB), was honorable mention on the all-district team, completing 11-for-30 passes for 183 yards and four touchdowns. As a junior, Ohrt also used his feet to rush for 274 yards on 66 carries. Defensively, he had 22 total tackles, including 15 solo tackles. Also back is senior Brody Tieskoetter (WR/DB), who had two receptions for 40 yards a season ago and 11.5 total tackles, along with junior Nolan Sabelka (RB/DB), who pulled down three receptions for 75 yards and had 10.5 total stops. Kyle Kuboushek (RB/OL/LB) returns with experience for his sophomore season, having had 26 touches of the pigskin for 96 yards rushing and 18 solo tackles (21.5 total). Braiden Todd (QB/TE/DL) had 21.5 total tackles, including 18 solo tackles during his freshman season. Carson Streeter (RB/DB) also made some noise as a freshman

last season with eight solo tackles (13 total). Returning to the offensive and defensive lines are Evan Monroe, Tristen Bodensteiner, Yahir Macario and Shayde Wermers. Holes to fill Graduating five seniors, the Warriors have big holes to fill — especially on the offensive and defensive lines. One loss to note is Keagen Streeter, who was a two-year all-district first team honoree on defense. He led South Winn in tackles with 50 total stops, including 36 solo tackles. He also handled some of the kicking duties with 16 punts for 526 yards, along with going 16-for20 in PATs. Landon Garcia was a mainstay on the offensive and defensive lines and was named second team all-district twice, helping the Warriors gain the 2,138 yards of offense and score 24 touchdowns. What a year The Trojans rolled through the regular season that began with a 46-26 thumping of EdCo on the road in week one. Always a tough opponent, Don Bosco kept control of the pigskin in week two and took home a 48-8 win over TV. After week three’s contest versus Rockford was cancelled, the Trojans tamed the Riceville Wildcats, 62-14. Homecoming was festive with a 61-8 Trojan win over Janesville. With TV in the driver’s seat for the district, the Trojans picked up a 44-34 road win over Clarksville. Facing fellow

undefeated district opponent Tripoli, TV needed overtime to pick up the 42-36 win on a broken pass that fell into Trojan senior Ryan Franzen’s hand, who returned the ball for the touchdown. It was a 73-32 win over West Central to end the regular season, as TV finished undefeated in district play. Moving on to the postseason, the Trojans defeated Ed-Co for the second time in the season, 50-34, in the opening round. A few uncharacteristic mistakes, penalties and lost two-point conversions hurt TV in the second round against No. 3 Gladbrook-Reinbeck. The Rebels stopped the Trojans’ postseason run, 30-28. When the dust settled, Turkey Valley placed 11 on the all-district list, and Coach Scott was also named the coach of the year. The offense produced 3,301 total yards, averaging 7.02 yards per play and tallied 58 touchdowns. The majority of the damage came on the ground with 2,629 yard of rushing, while collecting 672 yards through the air.

The foundation The Trojans will have various voids to fill due to graduation on both sides of the ball – 11 to be exact. Turkey Valley will return to the turf with an abundance of noise makers, including first team all-district honoree Oliver Schmitt and honorable mention Burke Busta. The five returning letter winners are also seniors, so young guns will need to step up quickly in order for the Trojans to find success in 2023. As a junior, Schmitt was second for the Trojans in total tackles with 57.5, taking down 27 on solo stops. Offensively, he tallied 1,077 yards and averaged 6.6 yards a carry and scored 17 touchdowns to earn first team all-district honors. Carrying the pigskin 22 times for 133 yards was B. Busta, who was also a target for a quartet of receptions for 45 yards. On the flip side of the ball, B. Busta had 26 solo stops and two sacks. Box 138 in Decorah, Iowa 52101, until Thursday, August 31, 2023, at 10:00 AM local time. At that time the Bids received will be publicly opened and read. The Project will consist of the following Work, which will include supplying and installing: 100 KW generator and 800 AMP automatic transfer switch. The generator shall be Kohler, Cummins, Winco, Caterpillar, Generac, or approved equal quality and standards. The fuel type of the generator shall be diesel fuel. Prior to bidding, interested bidders will be required to visit the site and confirm sizing requirements of the proposed generator according to load demand. The project will also include the installation of a concrete pad that will need to comply with the manufacturer’s requirements for the generator. The project locations are within the City of Decorah and are generally described as follows: City of Decorah Public Library. The generator will be installed on the south side of the library to the east of the entry door. Location of the generator and specifications on materials can be obtained by doing a site visit with the City IT Director (chopper@decorah.iowa.gov; 563-382-3651) and City Engineer (cityengineer@decorah.iowa. gov; jkuennen@decorah.iowa.gov; 563-3822157) The selected contractor must have a current Iowa licensed Master Electrician or Professional Engineer on staff to certify the installations. Bids will be received for a single prime contract. Bids must be separated into three line items: generator/transfer switch, labor, and materials. Make bids on all items of Work. One contract will be awarded. The Contractor may begin construction upon execution of the Notice to Proceed (NTP) with a Substantial Completion date of June 30, 2024, as shown in the NTP. Final payment will be made upon final acceptance of the Work. The project Contractor will be selected through the use of an evaluation utilizing a scoring system based upon the following criteria of importance with the maximum points possible for each listed criterion: • Contractor has a current Iowa licensed Master Electrician and/or a Professional Engineer on staff (Maximum of 10 points) •.. Contractor’s availability and capability of staff (Maximum of 10 points) • Contractor’s past experience with similar projects (Maximum of 10 points) • Contractor’s geographic location (Maximum of 10 points) • City of Decorah’s familiarity with the contractor (Maximum of 10 points) • Contractor’s ability to complete projects in a timely manner and within budget constraints (Maximum of 10 points) •.. Contractor’s proposed cost to complete the project (Maximum of 10 points) • Contractor’s previous experience with FEMA funded projects (Maximum of 10 points) Maximum possible points: 80 Submit a Bid Bond with each Bid in accordance with the Bidding Documents. The Bid Bond will be a certified or cashier’s check payable to the Owner, drawn on a solvent Iowa bank or a bank chartered under the laws of the United States, or a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States, in an amount equal to five percent (5%) of the Bid, or a Bid Bond executed by a corporation authorized to contract as a Surety in the State of Iowa, in the penal sum of five percent (5%) of the Bid. The Owner may, at their discretion, reject any or all bids, waive informalities, irregularities or technicalities, or accept the bid and award the Project. The successful bidder will be required to furnish bonds and insurance, in accordance with Article 6 of the Contract for Construction of a Small Project, when the Contract is delivered to the Owner. All Work and material are to be in strict compliance with the proposed plans, specifications, form of contract and estimate of cost now on file at the office of the City Engineer, and by this reference made a part thereof as though fully set out and incorporated herein. By virtue of the statutory authority, a preference will be given to products and provisions grown and coal produced within the State of Iowa and to Iowa. In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. Public Notices Board Minutes Monday August 14, 2023 The Board of Supervisors met at 9:30am August 14, 2023 with all members present. The Pledge of Allegiance to the Flag was recited, and the meeting was called to order. Jeff Kuboushek, Road Maintenance Superintendent, met with the Board to discuss road matters. Moved by Vick and seconded by Faldet to approve the consent agenda which includes the minutes of the last meeting and the claims filed with the Board. Motion carried unanimously. Dan Bohr, Winneshiek County Trail Twisters, met with the Board to request the use of the closed portion of Happy Hollow Road as a recreational trail. The Board will work with the County Attorney and Interim Engineer to make sure all of the appropriate paperwork is in place. Andy Van Der Maaten, County Attorney, met with the Board to discuss county issues. Moved by Vermace and seconded by Faldet to approve the Interim County Engineer agreement with Howard County and Nick Rissman. Motion carried unanimously. There being no further business, the special meeting adjourned at 1:47 p.m. Cindy Gooder, Vice-President Darlene Woodhouse, Board Secretary Decorah (Iowa) Public Opinion August 24, 2023 NOTICE OF PUBLIC HEARING DECORAH CITY COUNCIL PROPOSED RIGHT-OF-WAY EASEMENT – 307 OAK STREET, DECORAH, IOWA TO WHOM IT MAY CONCERN: Notice is hereby given that the City Council of the City of Decorah, Iowa, has set September 5, at 5:45 o’clock P.M. at the Council Chambers in City Hall in Decorah, Iowa, on the question of whether the City Council should grant an easement over the City owned public right-of-way. Jaclyn N. Jirak (“Grantee”) is the owner of real estate described as: Lot 10 in Block 4 of Otis & Stevens Addition, in the City of Decorah, Winneshiek County, Iowa, as per the Retracement Plat of Survey filed for record January 23, 2020, and recorded as Document No. 2020-199. Locally known as: 307 Oak St., Decorah, Iowa. That is proposed that the City grant a house encroachment easement to Grantee that is on the Terrace Street right-of-way measuring 7.1 feet on the westerly side, 24.0 feet on the southerly side, and 6.5 feet on the easterly side, with the northerly side being on the southerly lot line of the Real Estate. That the house encroachment easement is proposed to be generally on the following terms: 1. Said easement shall be in force for so long as the house remains in its current location, subject to the following conditions: a. The City of Decorah specifically reserves the right to terminate this Easement, at any time, upon giving to the Grantee 90 days’ prior written notice when the City of Decorah, in its own discretion, determines that the Easement Area must be used for any “essential corporate purpose” or “general corporate purpose” as defined by Section 384.24 of the Code of Iowa, as amended. Grantee shall not be entitled to any reimbursement or compensation if the easement is terminated under this provision; and b. The Current House may not be expanded into the City of Decorah’s right-of-way, and no other structure may be built or expanded into the right-of-way. c. Should the Current House be destroyed by any means, to include remodeling, to an extent of more than fifty percent of its replacement cost at time of destruction, this Easement shall be automatically terminated. 2. Liability. The City of Decorah shall not be liable for any damage to persons or property occurring or arising as a result of anyone using the Easement Area from any cause whatsoever. Grantee shall indemnify and hold the City of Decorah, Iowa harmless for any damages or injuries that occur as a result of anyone using the Easement Area, to include, but not limited to reasonable attorney’s fees and costs. The Grantee further agrees to pay all reasonable costs, attorneys’ fees and expenses that shall be made and incurred by the City of Decorah, Iowa in enforcing this agreement.
