Date set for Moreau trial By Matt Minich Mountaineer Editor
If things go as planned, the trial of alleged murderer Richard “Rossi” Moreau will be over well before the next ski season begins. In this case, though, things rarely seem to. Moreau will go on trial for crimes he allegedly committed Nov. 8, 2009, when a security camera shows him entering the Sandbar in West Vail and shooting pa-

trons with a handgun. Gary Kitching, a 70-year-old physician from Carbondale, was killed in the shooting, and several others were injured. Moreau is charged with murder and seven other felonies, and has been held without bail since his arrest that night. His trial has now been delayed sev-

eral times as attorneys on both sides of the case prepare their evidence. Moreau has repeatedly waived his constitutional right to a speedy trial. The most recent delay, which moved the start date for the trial from July 8 to Aug. 26, was requested by Moreau’s attorneys, Public Defenders Dana Chris-
tiansen and Reed Owens. Christiansen and Owens said they would need more time than they were given to craft a response to the results of a court-ordered state mental evaluation, which could be finished as late MOREAU as June 30. Moreau is undergoing that evaluation now at the State Mental [See MOREAU, page 16]

Gulf oil disaster anniversary
Relatives flew over Gulf of Mexico waters yesterday where 11 oil rig workers died a year ago. Residents gathered in prayer vigils onshore and President Barack Obama vowed to hold BP and others accountable for “the painful losses that they’ve caused.”
BP passing the buck
BP is suing Transocean for at least $40 billion in damages, accusing the rig owner of causing last year’s deadly blowout in the Gulf of Mexico that led to the worst offshore oil spill in U.S. history. BP says every single safety system and device and well control procedure on the Deepwater Horizon rig failed. It also says Cameron International provided a blowout preventer with a faulty design.

Dustin Gorton, 30, says a prayer as he visits a memorial yesterday in Littleton, Colo., for those who were killed at the Columbine High School shooting 12 years ago. Gorton, who now lives in White Bear Lake, Minn., was a senior at the school during the massacre. Explosives resembling the ones used by shooters Eric Harris and Dylan Klebold were found in Southwest Plaza Mall yesterday morning, located just two miles from the high school. Although the bomb never detonated, police evacuated the entire mall as a precaution. Officials say a person of interest has been connected to the scare. See the full story on page 4. AP photo.

Reject Homestead open space I’ve read the letters and emails, reviewed the maps and proposals, and attended some of the meetings regarding this matter, and as a result I reject the deal completely. There is simply no value to Homestead. Contrary to claims made in the Vail Daily, this open space proposal provides zero benefits to Homestead or its homeowners. Homestead has not required help with its open space for 30 years; we don’t need the government’s “help” now. There are just too many downsides. Homestead would become a thoroughfare for public access to the County-owned open space easement, and that would mean more traffic on the only road into the community, more cars, more parking issues, and more policing issues. The increase in traffic and people may not be huge, but it will inevitably be more than we currently experience. Then there’s the maintenance, garbage cleanup, paving a parking lot, plowing it in winter, fencing, signage, and who knows what else.
Who will pay for all of this? Yes, it has been said that responsibility for these things would have to be negotiated, but the very fact that the County wants to “negotiate” them means they want Homestead to pay for something, else there wouldn’t be anything to negotiate. We already know the County wants Homestead to cough up $70,000, and Creamery to come up with $400,000. All property owners have paid into the County’s Open Space tax for years, but apparently for the BoCC that’s not good enough. They always want more, more of our land and more of our money. I say NO more. Homestead would receive nothing in return for permanently giving up its land. However, we would lose control of open space land we now own, along with all potential leverage toward unforeseen future negotiations or needs. What does the County and EVLT propose to give Homestead residents for their land and trouble? Not a thing, but it’s
clear they want more than just our land. Claiming the 400 acres could be developed into some sprawling complex of homes is just a scare tactic - not even the fear mongers can possibly believe their own propaganda. Concerns expressed over possible rezoning and development of the land is just hyperbole for several reasons: The BoCC is not likely to grant an up-zone request, let alone a development. In this economic climate, banks are unwilling to lend money for such ventures. There is a glut of homes on the market (resale & new) and prices are still dropping. Eagle County saw 618 foreclosures in 2010, and we’re already at 154 as of April 20, 2011. I urge the Homestead Board of Directors to reject this proposal. Best regards, Buddy Shipley Homestead resident
Letters to the Editor - The Vail Mountaineer accepts letters. To be considered for publication, letters must be concise, timely and relevant to the work at hand; overly cranky, whining, self-serving, racially offensive, and/or libelous missives will be rejected without further adieu, while caps lock-happy text shouting will be lowercased or dismissed altogether. Subject to approval and editing by the Mountaineer staff, letters that include full name and home town for publication, along with mailing address and phone number for verification, should be submitted via email to: Letters@VailMountaineer.com. CORRECTION - An article in yesterday’s Mountaineer titled “Pro Cycling Challenge will follow Coors Challenge” reported the wrong dates for the Vail Valley leg of the race. Time trials will be held in Vail on Aug. 25, and Stage 4 will begin in Avon on Aug. 26. The article also reported the Town of Avon will contribute no cash to the race. This information came from a presentation by the Vail Valley Foundation at the Vail Town Council meeting on April 19. According to Avon spokeswoman Jamie Walker, Avon will give $4,000, along with in-kind services. Adam Luek, a representative with VVF, confirmed that presenter Ceil Folz “misspoke” when she informed the council that Avon was providing only in-kind services.

Graffiti on the rise in county Investigators with the Eagle County Sheriff’s Office are requesting the public’s assistance in the apprehension of the people responsible for what ECSO officials now say could be thousands of dollars worth of damage in vandalism. “There has definitely been an increase in the last few weeks,” ECSO Spokeswoman Jessie Mosher said yesterday. According to police reports, police have encountered bridges, buildings, and electrical boxes over the last few weeks spray-painted with slogans like “Slek”, “Snooze”, and others. The word “Slek” was found weeks ago on the surfaces of a parking garage in Avon, and has been spotted several times since. Urbandictionary.com, which provides unofficial definitions for slang terms and vulgarities, defines “Slek” as a word used to describe an idiot who “has no common sense and usually says stupid crap to attract attention.” If you think you may have any information about the suspects or this crime, please call the Eagle County Sheriff’s Office at 328.8500 or Eagle County Crime Stoppers at 328.7007. If your tip leads to the arrest and indictment of any suspect involved, you could earn up to a $1,000 reward from Crime Stoppers.

Columbine copycat attempted
Bomb in Littleton mall similar to one used in shooting By Peter Marcus The Denver Daily News On the 12th anniversary of the Columbine High School Massacre yesterday, a social couponing website voluntarily pulled a controversial deal for a gun class, and bombs found after a fire at the Southwest Plaza Mall raised fears over a copycat incident. The fire at the Southwest Plaza Mall broke out at about 11:52 a.m. near the food court. It was extinguished within minutes. Officials launched a criminal “domestic terrorism” investigation after finding two propane canisters near an electrical box in the mall near where the fire started, as well as a pipe bomb. The mall is only about two miles from Columbine High School, where 12 years ago yesterday, two students went on a shooting rampage, claiming the lives of 12 students and a teacher. The Jefferson County Sheriff’s Office quickly said a “suspicious device” was found at the origin of the fire, prompting officials to lockout all south end Jefferson County schools. Officials acknowledged that they were being extra cautious on the 12th anniversary of Columbine.
Parents were notified of the lockout, which meant there was a single point of access to each school. “Your child’s school was on lockout for a short time because of a suspicious device that was located in the area of a fire at Southwest Plaza Mall this afternoon,” read an email to parents. “The lockout was simply a precaution. A lockout means that all access into schools was restricted. However, schools will be dismissing as usual.” Deputies evacuated the entire mall, about 6,000-10,000 people, while K-9 units swept the mall. The Jefferson County Bomb Squad was also called. The FBI is investigating the incident as a domestic terrorism case. Meanwhile, social couponing Web site LivingSocial pulled a Daily Deal posted yesterday for a discounted gun class. Concerns were raised over promoting guns on the Columbine anniversary. The deal offered was for a $99 six-hour concealed carry class at Training and Advisory Services. The Washington, D.C.-based social couponing site said it pulled the deal after receiving a complaint from a member. “Once we realized today’s significance we replaced the deal early this morning with a deal for salon
services …” Maire P. Griffin, communications director for LivingSocial, told the Denver Daily News yesterday. “Our thoughts go out to all of our area LivingSocial members and to all Denver residents.” Also yesterday, Rep. Jim Kerr (RLittleton), whose district includes Columbine High School, offered his thoughts on the anniversary of the massacre. “It is a day to acknowledge the many innocent victims who lost their lives that day,” Kerr said in a statement. “We want to let the families of the victims know that their loved ones will never be forgotten.” U.S. Sen. Mark Udall (D-Colo.) issued a similar statement. “Twelve years ago today, Colorado and the nation stood still watching the horrific events unfold at Columbine High School, where 12 students and a teacher were tragically killed, and many others injured,” Udall said yesterday. “Today, let us take the time to remember the victims and survivors of this senseless act of violence and commit ourselves to being there for our youth, whether as educators, mentors or parents. We need to work at all levels of society so that what happened at Columbine will never happen again.”

Living Legends Scarub and Rhymesayers Toki Wright perform The raw, poetic world of underground hip-hop flows its way into Avon tonight, as Scarub and Toki Wright take the stage at Agave. The Living Legends Scarub grew up on hip-hop, whether it was watching Yo MTV Raps or listening to the all hip-hop radio station, KDAY, Scarub immersed himself in the genre. It was during these early years that he first gave himself the name Quaz (The kid who did), and later Mudd Foot, before settling on Scarub as his emcee moniker. Scarub first hit the stage during an eighth grade talent show and he hasn’t looked back since. As a student at L.A.’s Hamilton High, Scarub hooked up with fellow students – Eligh and Murs – forming the trio 3 Meloncholy Gypsy’s, or 3MG. Once part of 3MG, the group became part of a larger crew called the Log Cabin. The trio worked on music as 3MG and the Log Cabin for awhile until they slowly drifted apart. Scarub, like the rest of 3MG, eventually made the move up to the bay area hooking up with Mystik Journeymen and was put down with the Living Legends crew. The Living Legends crew is a family of independent hip-hop creators. Now Scarub brings that legendary sound to Agave tonight with Toki Wright. Raised in a Buddhist household immersed in black history, world

A teenage girl goes out into the world for the first time - and has to battle for her life. Director Joe Wright weaves elements of dark fairy tales into the adventure thriller “Hanna.” Hanna (Saoirse Ronan) is 16 years old, a bright and devoted daughter. But out in the world there is unfinished business for Hanna’s family.
In “Scream 4,” Sidney Prescott, now the author of a self-help book, returns home to Woodsboro on the last stop of her tour. There she reconnects with Sheriff Dewey and Gale, as well as her cousin Jill (Emma Roberts). Sidney’s appearance also brings about the return of Ghostface, putting all of Woodsboro in danger. From the makers of “Ice Age” comes “Rio,” a comedy adventure about taking a walk on the wild side. Blu is a domesticated Macaw who never learned to fly, living a comfortable life with his owner Linda. Blu and Linda travel to Rio de Janeiro to find Blu’s counterpart, Jewel, a street smart bird who teaches him to fly before being captured by bungling thieves.

Kids invited to search for more than 5,500 treat-filled plastic eggs in Easter celebration Relocating? Expanding? By Phil Lindeman Mountaineer Staff Writer Between Christmas and Halloween, no holiday is more gratifying for sweet-toothed youngsters than Easter. It blends the enticement of chocolates and candies with the most ancient of elementary games – hide and seek – by asking little ones to search for their keep. As it has for more than a decade, the town of Eagle will indulge this enthusiastic set with a free Easter egg hunt in the heart of downtown at Eagle Town Park. Beginning at 10 a.m. this Saturday, kids up to 10 can scour the park for over 5,500 plastic eggs, each filled with a variety of candy. According to Mary Lou Yeik, who has been organizing the hunt for 10 years, Saturday’s event will attract
between 350 and 450 children from across the valley. For her, the major draw of a town-sponsored event is variety. “I think there is always something different going on,” Yeik said. “Kids are excited to find lots of eggs and have something to do outside the home.” Much like Easter’s similarly sweet cousin in October, little ones must bring their own basket for the morning, and parents are welcome as escorts. A full-sized Easter Bunny will mill about the crowd and provide photo opportunities for lulls between gathering goodies. Yeik said there will be “golden egg” winners for each age group, though every participant will receive a prize in the end. As for the imitation eggs, Yeik
found crowds in the past tended to prefer them to the organic variety. “These are much more wanted than the hard-boiled type, I would say,” Yeik said. Given the slight chance of rain during this year’s event, plastic eggs are also more likely to withstand the elements. For kids up to 12 years old, the day also features an “Eggernaut” event after the main hunt. A twist on the time-honored science class project, “Eggernaut” challenges little engineers to protect a single, uncooked egg from breaking after a drop from between 30 and 50 feet. Those up to the challenge can use any material for a structure. Firefighters with the Eagle River Fire Protection District will be on hand, along with the ladder engine, to drop the eggs.

Yesterday President Barack Obama told a cheering crowd at Northern Virginia Community College in Annandale, Va. that he welcomed the chance “to get out of the immediate environs of Washington and hear directly from voters.” Obama touted his plan to reduce deficit spending by $4 trillion over 12 years, in part by raising taxes on households making more than $250,000, after 2012. Republicans oppose such tax hikes. In fact, he was barely outside the Capital Beltway, and a short drive from the White House

3,200 abandoned wells lack plugs
One year after a deadly oil-rig explosion set off the worst offshore spill in U.S. history, the environmental minefield of abandoned wells in the Gulf of Mexico is worse than first thought, with no quick solution in sight. A government list obtained by The Associated Press shows that in addition to 27,000 oil and gas wells that were sealed with cement and abandoned without any regular monitoring, another 3,200 old wells have quietly been left unused without any cement plugging to help prevent leaks.

Monumental leak
Residents of 255 homes were evacuated yesterday after a train passing through a residential area was found to be leaking hydrochloric acid. No injuries or health problems were reported in Monument, a town of 6,800 just north of the U.S. Air Force Academy in Colorado Springs. The leak was discovered by another passing train around 1:30 a.m. and was stopped by a magnetic patch by midday. It’s not clear how long it had been leaking as the Burlington Northern Santa Fe train traveled from Kansas toward Denver. Before the flow was stopped, it had been leaking a cup of acid a minute, said BNSF spokeswoman Lena Kent.

requirements for larger children. That law waives the child-seat requirement in older cars with no shoulder restraints. Democrats argued that the loophole put children at risk and threatens federal funding. Several Republicans unsuccessfully argued that requiring older cars to be retrofitted to allow child seats is a meddlesome burden.
Planes fly 60 firefighting runs
Six specially equipped U.S. military planes have flown 60 missions to help fight wildfires in Mexico and Texas. The U.S. Northern Command said yesterday that C-130 cargo planes have flown 28 missions in Mexico and dropped about 63,000 gallons of retardant there. Northern Command is based at Peterson Air Force Base in Colorado. It sent the planes at the request of the government of Mexico and firefighters in Texas.
Explosion kills one at Pueblo metals recycling site
A 30-year-old contract worker from Hammond, La. has been killed in an explosion at a metals recycling business in Pueblo. The explosion occurred shortly before 2 p.m. yesterday at Western Metals Recycling, which is near the Evraz Rocky Mountain Steel Mill in Pueblo and 100 miles south of Denver. Bomb, propane tanks found at Colo. mall after fire
Investigators found two propane tanks and a pipe bomb at a suburban Denver mall after a fire broke out near the mall’s food court. Authorities say the Southwest Plaza Mall in Littleton was evacuated just after the fire, which started before noon yesterday. Jefferson County sheriff’s officials say there are usually about 6,000 to 10,000 people in the mall around noon each day. The mall is about two miles from Columbine High School, where two student gunmen killed 13 people and themselves on April 20, 1999. Unexploded pipe bombs and a propane tank with explosives attached were found in the school after the shootings. The FBI says it’s investigating yesterday’s incident. No major injuries or damage were reported.
Millions in malaria drugs stolen
A global health fund believes millions of dollars worth of its donated malaria drugs have been stolen in recent years, vastly exceeding the levels of theft previously suspected, according to confidential documents obtained by The Associated Press. In internal documents detailing drug thefts, officials identified 13 countries, mostly in Africa, where millions of dollars worth of malaria drugs have gone missing. According to the reports, drug theft in which donated drugs are sold on the black market “appears to be on the rise and (is) becoming increasingly sophisticated.”

Kevin Durant scored 23 points, Russell Westbrook added 21 and the Oklahoma City Thunder built a huge first-half lead on their way to a 106-89 victory over the Denver Nuggets in Game 2 last night. The first-round playoff series shifts to Denver on Saturday night with Oklahoma City leading 2-0. The Thunder relied heavily on their All-Star duo in Game 1, getting a combined 72 points from Durant and Westbrook. But they got contributions from everyone to build a 26-point lead early in the second quarter of a dominant victory. Ty Lawson scored 20 points to lead Denver, which got as close as 10 in the fourth quarter before Oklahoma City put the game away. Nene and Raymond Felton added 16 points apiece for the Nuggets.

The Colorado Rockies managed to salvage the series finale against the defending world champion San Francisco Giants yesterday, and moved to 7-1 in day games this season in the process. Jorge De La Rosa (3-0) went seven innings, giving up two runs and four hits to help the Rockies avoid the series sweep with a 10-2 victory after dropping the first two games to their division rival. For San Francisco, Matt Cain and allowed nine hits in 4 2-3 innings, and was no match for Ty Wigginton’s bat. Cain was roughed up for six runs, including a threerun homer by Wigginton. He ended up striking out six and walking two in his shortest outing of the season. Wigginton, hitting .214 entering the game, connected on an inside fastball from Cain for his first homer with the Rockies and the 1,000th hit of his career. Wigginton said reaching the milestone hit took a backseat to the homer’s significance in the game. “Absolutely,” he said. “I’ll take the three-run homer, especially at that time.” The Giants were without Pablo Sandoval, who was a late scratch after straining his right triceps during batting practice. On the Rockies DL, RHP Aaron Cook (broken finger) has started throwing off a slope. Cook slammed the digit in a door early in spring training. “He’s making strides,” Tracy said.
MLB seizes control of troubled LA Dodgers
Major League Baseball is taking the extraordinary step of assuming control of the Los Angeles Dodgers, a team increasingly paralyzed by its owners’ bitter divorce. Once among baseball’s glamour franchises, the Dodgers have been consumed by infighting since Jamie McCourt filed for divorce after 30 years of marriage in October 2009, one week after her husband fired her as the team’s chief executive. Frank McCourt accused Jamie of having an affair with her bodyguard-driver and performing poorly at work. Baseball Commissioner Bud Selig told Frank Mc-

Court yesterday he will appoint a MLB representative to oversee all aspects of the business and the day-to-day operations of the club. At the same time, Frank McCourt was preparing to sue MLB, a baseball executive familiar with the situation told The Associated Press, speaking on condition of anonymity because McCourt had not made any statements. “I have taken this action because of my deep concerns regarding the finances and operations of the Dodgers and to protect the best interests of the club,” Selig said in a statement. A person familiar with Selig’s thinking said the commissioner may choose to force a sale. The person spoke to the AP on the condition of anonymity because Selig’s statement did not mention that. “I consider it a sad day for baseball and a sad day for the Dodgers,” general manager Ned Colletti said. In December, Superior Court Judge Scott Gordon in Los Angeles invalidated a March 2004 postnuptial agreement giving Frank McCourt sole ownership of the team, allowing Jamie to seek one half of the franchise. Selig’s move came after The Los Angeles Times reported this week that Frank McCourt had arranged a $30 million loan from Fox, the team’s television partner. Selig has not approved a $200 million loan from Fox to the club, which was first proposed by the Dodgers last summer, and the Times said the money was needed to make payroll. Selig’s move might be seen by some as a precedent should the New York Mets have additional financial problems. With owners Fred Wilpon and Saul Katz under pressure from a lawsuit tied to the Bernard Madoff swindle, the Mets borrowed $25 million last year from Major League Baseball. Unlike the McCourts, Wilpon

ATHLETIC STUFF close to Johnson said the incidents had nothing to do with them parting ways. Johnson, coming off a tie for 38th in the Masters, plays next week in South Korea in the Ballantine’s Championship. Winkle said a friend who is “more than qualified” will be his caddie, and that he expects Johnson to give others a trial run before settling on a replacement. “This isn’t about finding a replacement as quickly as possible,” Winkle said. “It’s about finding the right person.” He already has been contacted by several potential replacements, which is no surprise. Johnson is considered one of golf’s top young players, the first since Tiger Woods to go straight from college to win in each of his first three years on the PGA Tour. Brown had been caddying for Eric Axley, and even though Axley had just won a PGA Tour event, left him when Johnson came calling. Johnson and Brown spent most of their time together off the course, and Brown is dating the twin sister of Johnson’s girlfriend. “There’s no bad blood between him and me,” Brown told Golf World. “We are very cool with each other and will remain very close. We’re like brothers.” Colorado Rockies shortstop Troy Tulowitzki forces out San Francisco Giants’ Freddy Sanchez at second base in the first inning of an MLB game yesterday at Coors Field in Denver. Dustin Johnson splits with caddie
Dustin Johnson has decided to split up with his caddie, who was on the bag during two chances to win a major last year and was involved in the American star nearly missing his tee time at Riviera. Johnson’s agent described the split with Bobby Brown as mutual, and that it was not clear whether the move was permanent. “They just decided to take a break for awhile,” David Winkle of Hambric Sports Management said in an email. Brown had been Johnson’s caddie for three years and already was involved in some high-profile situations. Johnson lost a three-shot lead in the U.S. Open at Pebble Beach last summer and wound up with an 82, the highest final round by the leader at a U.S. Open in nearly 100 years. Two months later, Johnson didn’t realize he was in a bunker at Whistling Straits and grounded his club on the 18th hole, a two-shot penalty that kept him out of a playoff. At Riviera this year, Brown gave Johnson the wrong tee time, and he was penalized two shots for arriving late to the tee. Johnson was about 10 seconds away from disqualification. Johnson defended his caddie at every turn, saying the responsibility ultimately was with the player. Those

Gilbert crushes Contador at Walloon Arrow
Belgium’s Philippe Gilbert won his third classic in eight days yesterday, pulling away to win the Walloon Arrow on a closing climb in which Tour de France champion Alberto Contador was never a factor. No one could match Gilbert as he swept to the front with 300 meters to go on the steep Wall of Huy to finish the 123-mile run through the pastures and hills of southern Belgium in 4 hours, 54 minutes, 57 seconds. Joaquin Rodriguez was runner-up for the second year in a row, and fellow Spaniard Samuel Sanchez took third place. Alexander Vinokourov was fourth, while Contador, who came into the race with a cold, placed 11th. Gilbert was coming off victories in the Amstel Gold race Sunday and the Brabant Arrow last week. Going three for three in the classics makes Gilbert the favorite for the Liege-Bastogne-Liege Sunday, one of the biggest races of the season. After winning two tough classics over the past week, Gilbert said went into the Walloon Arrow aiming for an easy ride ahead of Sunday’s race. But when he felt increasingly good and saw other riders falter or let themselves get boxed in on the final climb, he grabbed the opportunity to pull away. “What a surprise. I didn’t expect this at all,” Gilbert said. “Even with 10 kilometers to go, I didn’t believe in myself. Then with 300 meters to go, I made the break and it was pure happiness afterward.” Contador was struggling with a cold in the days before the race and it showed in the final climb. It was his only Belgian classic this year since he wants to focus on the Giro d’Italia, which starts May 7.

At yesterday’s hearing, Christiansen said he was sure his experts would be available for a trial in December, but did not know if they could make it to an August trial. Hurlbert opposed a December trial at yesterday’s hearing, and said one of the victims objected to the delay. The trial is now set to stretch from Aug. 26 to Sept. 9, with a break for Labor Day.
