Guiding hand

Contractual matters are part of daily life in a scaffolding business and the Contracts Committee exists to offer advice to NASC members. Trevor Clarke reports on a productive year for the Committee involving revisions to key guidance.

015 has been a busy year for the NASC Contracts Committee. The primary focus of the group has been to progress the revision of guidance on the following matters, all of which are long overdue for review: Late Payment of Commercial Debt; Payment under the Construction Act; Adjudication – its use by the Subcontractor; and Preparation of Schedules of Rates. Additionally the committee has been drafting supplementary guidance which has provisionally been entitled as follows: Credit Control. How to Chase Debt. Attention is also being given to the following items, all of which will be issued in the New Year: Preparation of Quotations; Pre-tender information from the Client; Pre-contract Meetings; Engineering and Construction Subcontract. New or revised guidance on the following forms part of the committee’s ongoing agenda: Substance Abuse; Induction Training; and Employment Contracts.

As part of its remit the committee provides representation to the pan-industry Contractors Legal Group. NASC input, as specialists and supply chain representatives, is highly-valued by the principal contractors. There is clear benefit to the NASC membership as a whole from being part of this group. The committee has also continued to reap the benefit of participation on the committee by Liz Bridge of the Joint Taxation Committee (JTC). Her insight on taxation and related matters is welcomed and is greatly appreciated. The NASC membership as a whole is also able to benefit by accessing copies of JTC’s regular monthly Newsline bulletin, copies of which are posted on the NASC website. The committee remains a small but dedicated band which punches above its weight in terms of what it delivers. Geographically speaking, representation is excellent. Member input from the South West, the Midlands, and the North helps to complement the experience of London and

SE-based member committee representatives during committee debate and discussion. Input from Paul Crabtree (Independent Contractual Consultant) is also sought from time to time by the committee and is much appreciated. Management of contractual matters is part and parcel of the daily grind for scaffolding contractors. NASC guidance is therefore a vital part of the service which the confederation can offer to its members. Ultimately the group relies upon input from its members in order to provide this service. Thanks are due to all those who regularly attend committee meetings, prepare draft guidance in between meetings, and represent the committee and the confederation on external bodies. The confederation would be pleased to hear from any members who wish to join the committee.
