The November 1, 2011 public hearing of the Board of Mayor and Aldermen of the City of La Vergne was called to order at 6:30 p.m. by Mayor Senna Mosley.

The November 1, 2011 regular meeting of the Board of Mayor and Aldermen of the City of La Vergne, Tennessee was called to order at 7:00 p.m. at La Vergne City Hall by Mayor Senna Mosley.

Chief Walker presented a Chief’s Award of Excellence to Lieutenant Chris Goins for life saving emergency care that he provided to a self-inflicted gunshot victim, his quick actions were credited with saving the life of a La Vergne citizen. Lieutenant Goins was not present at the meeting.

Chief Walker presented a Chief’s Award of Excellence to Lieutenant Mark Sloan in recognition of his quick actions that resulted in the identification and arrest of two suspects wanted for an armed robbery that occurred in Smyrna. Chief Walker presented a Chief’s Award of Excellence to Detective Bob Hayes in recognition for his efforts investigating a child sex offender for mulitple rapes of a juvenile. Chief Walker presented a Chief’s Award of Excellence to Mary Ann Brewington as the Non-Sworn Employee of the Month for the Police Department.

Chief Walker presented a Chief’s Award of Excellence to Officer Eric Staats in recognition of his quick actions that resulted in the identification and arrest of a suspect wanted for multiple rapes of a juvenile. Chief Walker presented a Chief’s Award of Excellence to Officer Eric Staats as the Commissioned Officer of the Month for the Police Department.

Mayor Mosley explained this item to the board.

A motion was made by Vice-Mayor Farmer, to accept the bid from McCord Communications. Motion failed due to a lack of a second.

A motion was made by Alderman Broeker, seconded by Alderman Waldron, to deny the bids. Alderman Broeker stated that he is not opposed to the actual warning system. He stated that the city has other priorities right now. He stated that there are other options as far as looking for grants and looking for another system that can do it for less to save the taxpayers money. Mayor Mosley stated that she would like to continue to look for grant money. She stated that the city needs to take it’s time and investigate further into this matter. Alderman Waldron stated that he hates that Ricky McCormick has spent a lot of time on it. He stated that Mr. McCormick does his homework and he does a good job for the city.

Alderman Broeker asked if this needed to be removed from the capital plan. Mayor Mosley stated that it will take an ordinance to remove the item from the capital plan and it will be brought back next month. Resolution #2011-26 - A Resolution of the Board of Mayor and Aldermen of the City of La Vergne, Tennessee, Authorizing the Issuance, Sale, and Payment of General Fund Tax Anticipation Notes Not to Exceed One Million Dollars ($1,000,000). A motion was made by Vice-Mayor Farmer, seconded by Alderman Broeker, to approve Resolution #2011-26.

Mayor Mosley stated that this is for General Fund only and will not be used for anything else. She stated that this will be used in case it is needed for operating expenses until tax revenues come in. Alderman Broeker thanked everyone who came out for the Ricky Quinn Softball Tournament. He thanked everyone for being involved.

Alderman Waldron stated that Sunday, November 6th is Daylight Savings Time. He also asked everyone to remember Veteran’s Day on November 11th. Alderman Green asked that everyone be aware of all people that are going hungry. She stated that churches are collecting food and asked that anyone help if they know of anyone who needs help.

Mayor Mosley stated that on November 22nd, La Vergne Middle School will have a Thanksgiving meal for those who cannot afford it. She stated that they are looking for volunteers to help. She thanked those that have supported Ricky Quinn. She stated that there will be a chili cookoff on November 12th to help the Quinn family. She stated that Jonathon Eller has challenged everyone to make a $20 donation to the Quinn family. She asked everyone to remember the Deason family. She thanked the employees for their work.

ORDINANCE #2011-30 AN ORDINANCE TO AMEND TITLE 3, CHAPTER 3 OF THE LA VERGNE MUNICIPAL CODE BY ADDING A NEW SECTION 3-311 RELATING TO THE EMPLOYMENT OF COLLECTION AGENCIES TO COLLECT MUNICIPAL FINES AND COSTS.

WHEREAS, Tennessee Code Annotated § 40-24-105(e) authorizes municipalities to employ the services of a collection agency to collect unpaid municipal court fines and costs; and WHEREAS, such collection agency shall only collect fines and costs which are more than 60 days overdue; and

WHEREAS, Tennessee Code Annotated § 40-24-105(e) requires any municipality to adopt an authorizing ordinance before contracting with any collection agency to do so.

NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY OF LA VERGNE, TENNESSEE, that SECTION I.

Title 3, Chapter 3 is amended by adding a new Section 3-311 which shall read as follows:

D

3-311. Collection Agencies. (1) In accordance with Tennessee Code Annotated § 40-24-105(e), the City of La Vergne is authorized to employ the services of a collection agency to collect fines, court costs and litigation taxes assessed by the municipal court where the fines and costs have not been collected within sixty (60) days after they were due. Any fees of the collection agency shall be assessed as additional court costs in connection with the city offense. Interest will be collected on each account at a rate of ten percent (10%) per annum, in accordance with Tennessee Code Annotated § 47-14-121. (2) Any such contract with a collection agency shall be in writing, and shall include a provision specifying that the collection agency may institute an action to collect fines and costs in a judicial proceeding. The collection agency may be paid an amount approved by the City Administrator which does not exceed any statutorily approved fees authorized by Tennessee Code Annotated § 40-24-105(e). (3) The contract with such collection agency may also include the collection of unpaid parking fines as provided in Tennessee Code Annotated, § 6-54-513, after the notices required by law are mailed to registered vehicle owners.

SECTION II.

Each section, subsection, paragraph, sentence and clause of this ordinance is hereby declared to be separable and severable. The validity of any section, subsection, paragraph, sentence or clause

shall not be effected by the invalidity of any other portion of this ordinance, and only any portion declared to be invalid by a court of competent jurisdiction shall be deleted herefrom.

SECTION III.

That this Ordinance take effect forthwith upon its final passage, the public welfare requiring it.

Bill Griggs of Griggs and Maloney has made necessary calls and there is no reason not to award this bid to them as the low bidder. They have the proper licenses from the State. Bill Griggs and I feel that this should be awarded to USI Environmental. This should not need to be cleaned like this in the future. Thomas Champagne at the Water Treatment Plant will be keeping it clean so that we do not have this build up of sludge again.

Sewer Grinder Pumps Bid

At 1:00 p.m., CST, on Wednesday, November 16, 2011, bids were opened for the Sewer Grinder Pumps. There were three companies that bid on the grinder pumps, all bidding a different type of pump. After talking with Jerry Zemlo, we both agreed it would be best to go with Wascon and the E-One pumps. These are the pumps we feel best meets the needs of the Sewer Department. These pumps can be repaired in house at a reduction in cost. These are the pumps currently listed in our specification manual. Using these grinder pumps should save the city a considerable amount of money in the cost of new pumps and the repairs of the pumps. I recommend that we go with Wascon considering the price and product that is involved.

2011 Library Painting Bid

On November 28, 2011, at 2:00 p.m., we received and opened two bids for the painting of the Library.

After looking at all bids and talking with Teresa Wilberscheid, we have decided that it would be in the best interest of the city to use Sanders Brothers Construction to paint the building. Considering the difference in price and the good recommendations concerning Sanders Brothers there is no question as to with whom this project should be awarded. The Board has approved the yearly budget and this project was budgeted out of the 124 Library Special Revenue Fund.

Ordinance #2011-32 AN ORDINANCE TO AMEND TITLE 1 OF THE LA VERGNE MUNICIPAL CODE REGARDING THE DUTIES OF THE MAYOR AND THE DUTIES OF THE CITY ADMINISTRATOR.

SECTION I.

T

BE IT ORDAINED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY OF LA VERGNE, TENNESSEE, that:

Title 1, Chapter 4, Section 1-402 of the La Vergne Municipal Code be amended to read as follows:

R AF

1-402. Powers and duties. The city administrator shall act under the direction and control of and shall be responsible to the board and shall perform the following duties: (1) Duties listed in Tennessee Code Annotated, § 6-4-101; (2) Act as purchasing agent for the municipality in the purchase of all materials, supplies, and equipment for the proper conduct of the municipality's business, provided that all purchases shall be made in accordance with policies, practices, and procedures established by the board; (3) Prepare and submit the annual budget and capital program to the board for their adoption by ordinance; (4) Such other duties as may be designated or required by the board.

Each section, subsection, paragraph, sentence and clause of this ordinance is hereby declared to be separable and severable. The validity of any section, subsection, paragraph, sentence or clause shall not be effected by the invalidity of any other portion of this ordinance, and only any portion declared to be invalid by a court of competent jurisdiction shall be deleted herefrom.

SECTION III.

This Ordinance shall take effect upon its final passage, the public welfare requiring it.
