Should I be worried about estate or gift taxes? By BRYAN B. JOHNSON, Attorney at Law Almost everyone who reads this monthly publication certainly wonders if they need to be worried about the new federal and Ohio estate and gift law. This is very complicated legislation and this article is meant only to give a very general overview of some of its more salient items. Most importantly to most people, there are currently no federal or Ohio estate or gift taxes imposed on most transfers to a surviving spouse, and this exemption will continue under these new estate and gift tax laws. Estate taxes are paid from a decedent’s estate, while gift taxes are paid by the person making the gift. There are currently no Ohio estate taxes imposed on estates less than $338,333. Ohio estate taxes are then imposed at a 6% rate for any amounts in excess of $338,333, and at a 7% rate for any amounts in excess of $500,000. For a $500,000 estate this would be $23,600 of Ohio estate taxes. However, Ohio’s current estate tax law is set to expire on December 31, 2012, after which there will be no Ohio estate taxes imposed on
