Welcome to

VISION Greetings, Welcome to this years’ edition of Vision. Next to the preparation for and production of the CLA Annual Meeting, Vision takes the second most amount of staff time and effort. You will notice that this year we have changed up the format. This edition is more reflective of who CLA is and what we do on behalf of you, the member. Speaking of the Annual Meeting, if you were in Loveland, Colorado this past April you had to opportunity to hear from a panel of experts in their respective fields about what they considered to be the most disruptive issues facing agriculture here in Colorado. The panel, moderated by CLA Past President Mark Frasier, touched on the implications of the changing political climate, environmental and legal issues and suggestions on how livestock producers might position themselves to deal with them. Tom Haren, Chris Carrington and Floyd Ciruli all spoke about change. Disruptive change. It’s happening and those of us in agriculture will have to deal with it because the success of your business depends on it. A dictionary definition of the noun disruptor is “someone or something that interrupts an event, activity or process by causing a disturbance or problem or something that drastically alters or destroys the structure of something.” The use of the term “disruption” is not all that new in the world of business. In Clayton Christensen’s 1997 book, The Innovator’s Dilemma he introduced the idea of “disruptive innovation.” Some 20 years later as a buzzword it has taken on a life of its own. But whether you think of it as disruptive or innovation the factors that are at play will have a significant impact on how you do business in the future. Recently, we have all witnessed the turmoil caused by Beyond Meat and veggie burgers, Colorado solidly becoming a “blue” state with the influence of the unaffiliated voter, Lyft, WeWork, Door Dash and this list goes on. If you will, might I get you to consider that disruption is not always a bad thing. Many years ago, Henry Ford created a great amount of consternation within the wagon and carriage businesses by making the automobile available to many. Okay, so that was a long time ago and even though there may be those of you who think I witnessed that, I did not. But I did witness what took place 20 years ago when the Colorado Cattle Feeders Association became the Colorado Livestock Association. Was this a disruptive event? In the eyes and minds of some, yes it was. In 1958 the Cattle Feeders had been founded by the giants of the industry. They were visionaries. In 1998 another group of visionaries saw the need to broaden the “power of oneness” beyond just the cattle feeding community. Those individuals recognized that there was a need and a purpose for an organization that became CLA. You will have an opportunity to see in this year’s edition of Vision what CLA does on behalf of cattle feeders, dairy farmers, swine producers, sheep feeders and to some extent the members of our Industry Partner Council. I would like to mention here that in addition to what took place 20 years ago with the creation of CLA, disruption continues to take place in your organization. An example of this is that Jessica Lemmel lives in Ogallala, Nebraska and she continues to be in the employment of CLA. Remotely, yes remotely. If you haven’t been to the CLA office and one day you have a chance, stop by. It is very likely if all three of the staff are in the office that the first person to greet you will be Jessica. Coming to you in living color on a wall mounted TV screen. It's not the same as having her in the office, but it is the next best thing. Thank you Zoom for making the technology available that allows us to continue to function in an effective and efficient manner. At the time this change was what I considered to be a disruption to our process. But we have made it work. I encourage you to look at the disruptive forces in your business as opportunities and make them work to your benefit! ASSOCIATION Mike Veeman, President

M

y family and I run a fifth-generation dairy farm in Wiggins, and we farm and ranch in Sterling. In April of 2018, I was elected President of the Colorado Livestock Association (CLA). CLA was formed in 1998 through a restructuring of the then 43-year-old Colorado Cattle Feeders Association. CLA members are cattle and sheep feeders, cow/calf producers, dairy farmers, swine operations, and industry partners. Our organziation works on behalf of livestock producers in the regulatory and legislative arenas in Colorado.

There is a significant amount of time and effort that goes into the management of the Association’s assets and I want to thank the members of the Finance Committee for their diligent work in financial oversight of the Association; Tom Wernsman, Chair, Case Gabel, Luke Larson, Dwain Weinrich and Brian DeBrie, Member-at-large. The members of the committee take their fiduciary responsibility very seriously. Each year CLA’s financial statements are reviewed by an independent auditor. Because our previous auditor, Larry Daveline, retired, we have engaged Ron Goodrich as the new auditor. I would like to recognize the members of the Audit Committee for their efforts; Kory Kessinger, Chair, Glenn Benjamin, John Caldwell, Charlie Johnson and Jeremiah Lungwitz. It states in our strategic plan that CLA is to develop a succession plan. This past year we formed a Succession Planning Workgroup to develop a departure-defined succession plan. Those members are: Dwain Weinrich, Chair, Britt Dinis, Mike Thoren, Steve Gabel and Tom Haren. Thank you to the members of the Legislative Affairs Committee for their diligence and focus throughout the Legislative Session to ensure that CLA is abreast of the latest issues and that our voice is heard at the State Capitol. Legislative Affairs Committee members are; Julie McCaleb, Chair, Dave Amundson, John Caldwell, Britt Dinis, Mark Frasier, Mary Kraft, Luke Larson, Andrew Mertens, Justin Miller, John Mrozinski, Skip Schneider, Jon Slutsky, Trevor Tuell and CLA lobbyist Steve Holdren. CLA has a long history of working with Colorado State University to improve the livestock industry. It is important that we remain involved to assure that CSU stays true to its land grant mission. We have recently participated as a sponsor of the CSU Ag Innovation Summit. Bill Hammerich served on the search committee for the Animal Science Department Head. Steve Gabel is a member of the CSU Board of Governors and assisted in the selection of Joyce McConnell as the next President of the University. Several members are also involved in the Dean of the College of Agriculture's Livestock Advisory Council.

In June of 2015, a 50-year flood event caused run-off from a feedyard in Eastern Colorado. Subsequently, the Colorado Attorney General's office filed an action against the feedyard, accusing the owners of an “unlawful taking” of fish. The feedyard was compliant with CDPHE regulations. Our concern is that the court may find that compliance with existing permits may not be a valid defense. CLA filed an Amicus Brief, with support from Colorado Corn Growers and Colorado Farm Bureau and are awaiting the decision from the Colorado Court of Appeals.

LEADERSHIP

With the changing political climate, it is more important than ever that we stay engaged with the Governor’s Office, the state legislature and the various department and division directors. Over the past 20 years, Colorado Livestock Association has worked collaboratively with the Colorado Department of Public Health and Environment (CDPHE) to develop water quality regulations that protect our streams and rivers. For the past twelve years, CLA has been engaged with CDPHE, the National Parks Service and the EPA to help find ways to reduce nitrogen deposition in Rocky Mountain National Park. It is our intent that these relationships continue to move forward because it is an excellent example of a mutually beneficial relationship between industry and government.

We focus on a variety of other issues, which will be highlighted in this year’s edition of VISION, including; animal welfare, traceability, Hours of Service regulations, and lab-grown protein…..just to name a few. The one point that I want to leave you with is the true strength of this organization comes from our diversity. We represent cattle and sheep feeders, hog producers, ranchers, and dairy farmers along with our industry partners. Thank you for your membership. The state of our Association is strong!

WHO WE ARE Colorado Livestock Association was formed in 1998 through a restructuring of the then 43-year-old Colorado Cattle Feeders Association. The new name and structure was designed to better reflect the membership of the association. CLA members are cattle & sheep feeders, cow/calf producers, dairy farmers, swine operations, & agribusiness partners. In 1955, what started as a group of cattle feeders working to eradicate a disease (red nose), has grown into a multi-specie organization; working to strengthen & unite animal agriculture in Colorado for future generations. With its headquarters located in Greeley, CLA advocates on behalf of its members in the regulatory & legislative arenas in Colorado.

INDUSTRY FAST FACTS Colorado is home to more than 2.8 million cattle and calves, bringing in $3.98 billion in cash receipts annually.1 There are over 180,000 dairy cows in Colorado. Ranked 1st nationwide in pounds of milk production per cow.2 There are over 730,000 hogs in Colorado. SAFETY GROUP PROGRAM CLA members are committed to creating safe workplaces for their families and employees. Members have the opportunity to participate in the CLA Safety Group Dividend Program which benefits them by pooling their resources and receiving dividends based on group performance. Over the past 18 years, the CLA Safety Group has worked hard to develop a safety culture that members and their employees can believe in.

Since 2001, the CLA Safety Group Program has paid out over $1.9 million in dividends to its policyholders.

ROCKY MOUNTAIN NATIONAL PARK Perhaps nowhere is ammonia from livestock under greater scrutiny than along the front range of Colorado. In 2005, the Colorado Department of Public Health and Environment (CDPHE), the Environmental Protection Agency (EPA), and the National Park Service (NPS) formed the Rocky Mountain National Park (RMNP) Initiative to address nitrogen deposition within the park.

ADVOCACY

For the last 14 years CLA has been at the table representing our members and has been successful in an effort to avoid mandatory regulation of ammonia emissions on livestock operations.

CLA leads the effort in the development of a pilot project known as the Early Warning System which provides a list of Best Management Practices that producers have the option to implement during an upslope event.

2017 MILESTONE REPORT HIGHLIGHTS On May 10, 2019 the RMNP Initiative held a stakeholder meeting to discuss the final draft of the 2017 RMNP Milestone Report.



The evidence indicates that the deposition rate has plateaued. The MOU agencies will not trigger the RMNP Deposition Contingency Plan which could have started agriculture down the path toward regulation of ammonia emissions.

THE AIR EXPERT

Dr. Shaw is a licensed engineer in the State of Texas, former Chairman of the Texas Commission on Environmental Quality, and current owner of Shaw Engineering. Dr. Shaw attended Texas A&M University where he obtained both his BS and MS degrees in Agricultural Engineering before receiving his Ph.D. in Agricultural Engineering from the University of Illinois at Urbana-Champaign.

ADVOCACY

Dr. Bryan Shaw is working with the Colorado Livestock Association to address environmental and regulatory challenges facing the Colorado livestock industry. Specifically, he will bring his expertise and experience to issues such as identifying appropriate innovative voluntary solutions to nitrogen deposition in Rocky Mountain National Park and ensuring that the progress made by production agriculture is considered in developing future plans.

REGULATION 61 & 81 All Concentrated Animal Feeding Operation's (CAFOs) in Colorado, whether permitted or not, are required under Regulation 81 to protect Colorado’s water. Regulation 61 assures clean water through federal law, and applies to permitted CAFOs and Housed Commercial Swine Feeding Operations (HCSFOs).

ENVIRONMENTAL AG PROGRAM In 2005, Colorado Livestock Association members were instrumental in the formation of the Environmental Ag Program to the benefit of Colorado’s livestock industry. The Environmental Ag Program administers air and water quality protection regulations specific to animal feeding operations, including permitting, conducting site inspections, developing and implementing policies and regulations, providing technical assistance and initiating enforcement actions in coordination with the Air and Water Quality divisions. CLA continues to work with the Environmental Ag Program to foster a relationship based on common sense & compliance assistance rather than command and control to protect one of Colorado’s most precious resources.

REGULATION 85 Effective September 30, 2012, this regulation was adopted as a first step to reduce the levels of nitrogen and phosphorus in Colorado’s water bodies. Currently, provisions in the regulation encourage producers to voluntarily adopt best management practices that are effective and cost efficient. The clock is ticking - 2022 is the deadline for agriculture to demonstrate its efforts to mitigate nutrient run-off.

SOLID & HAZARDOUS WASTE 'AGRICULTURAL WASTE' DEFINITION

In the spring of 2018, the Colorado Department of Public Health and Environment's (CDPHE) Solid and Hazardous Waste Division (SHWD) proposed changes to the definition of "agricultural waste" and "environmental media." CLA's Natural Resources Committee members requested a stakeholder meeting to voice agriculture's concerns. As a result of the discussion, changes were made to the proposal that agriculture producers supported.

ADVOCACY

In 2016, CDPHE's SHWD staff conducted a stakeholder process to make changes to Section 14 of Colorado's Solid Waste regulations regarding the composting rules. As a direct result of CLA’s participation in the stakeholder process, livestock operations remain exempt from this rule.

WASTE TIRES

Agricultural producers re-purpose waste tires in numerous ways that are beneficial to the environment. The CDPHE SHWD regulates the processing and use of waste tires according to Section 10 of Colorado's Solid Waste Regulation. CLA represents livestock producers on this issue and continues to be involved in discussions surrounding regulation of the use and reuse of waste tires on ag operations.

ANIMAL IDENTIFICATION CLA supports an effective, permanent and mandatory animal identification program that is technology neutral and that is developed by industry partners who agree on an acceptable plan that can be implemented in the most cost efficient manner that does not limit, inhibit or prevent commerce and is uniformly accepted and eliminates variation from state to state.

STATE BOARD OF STOCK INSPECTION

There are 61* full-time and part-time brand inspectors in Colorado.

ADVOCACY

As an organization we support brand inspection for range cattle, but believe there is reduced value in the inspection of cattle in confinement especially when they do not change ownership. CLA has a longstanding involvement with the brand laws in Colorado. The Association led the effort to develop the Certified Feedyard Program by directly engaging with the Brand Board and other users of the system. The Certified Feedyard Program reduces fees by allowing a feedyard to selfinspect cattle that are not changing ownership. The feedyard is subject to an audit by the Brand Board on a quarterly basis to verify that all cattle were inspected accurately.

There are 21* feedyards participating in the Certified Feedyard Program in Colorado. *These numbers are according to the Colorado State Board of Stock Inspection at the time of publication in June 2019.

Political Respect and Decorum, Is it Gone Forever? Steve Holdren, Capitol Strategies

And “AGREE” they did not! What a difference an election makes, an election where Democrats won the trifecta of politics. Democrats swept the House with a 41-24 majority, took the Senate back with a 19-16 majority and won the Governor’s seat. No more had the back slaps and congrats ended on the first day of the new session, the Democrat's agenda was already taking center stage. Aggressive, bold and over the top, it appeared to many, with and with out stake holder in-put at times, the Democrat Train rolled down the tracks, only to have the Republicans in the engine working as the brakeman and bringing the fast rolling train to a screeching stop for hours! And there went the respect and decorum out the window, which is a requirement for this process to work. In my 34 plus years of working in this crazy business, I have never witnessed a session quite like this one! Colorado’s political landscape has changed and will continue to change with an influx of new residents, with a voter registration split, that is equal between Democrats, Republicans and Unaffiliated voters. If the two traditional political parties have any chance of majority control, they MUST work with the new third party of Unaffiliated voters! And, if there is any hope of regaining respect and decorum, they need to remember, they do not represent an ideology or political party, they represent the people! So, we shall see when they reconvene in January, if those under the Gold Dome, can make the process work for “we the people”!

LEGISLATIVE AFFAIRS COMMITTEE CLA would like to thank the members of the Legislative Affairs Committee for their input and engagement throughout the session. The Committee monitored 36 bills this session. Below is a summary of the bills that CLA supported or opposed throughout the session.

HB 19-1102 Nonanimal and Lab-grown Meat Misbranding

CLA appreciates Representative Pelton’s forward thinking and effort on this bill. He postponed the bill indefinitely due to the fact that it may have been a bit ahead of it’s time as it will need to be acted on by the FDA and USDA first. (Postponed Indefinitely)

SB 19-038 Agricultural Trailers Port of Entry Clearance

This bill was supported by CLA, but Senator Sonnenberg postponed the bill once he became aware of the Colorado State Patrol efforts to develop a plan to take care of the issue. (Postponed Indefinitely)

SB 19-139 More Road & Community Safety Act Offices

CLA strongly supported this bill that passed and has been signed by the Governor allowing up to 10 additional sites across the state to be opened. (Passed and Signed by the Governor)

SB 19-181 Protect Public Welfare Oil and Gas Operations

CLA opposed this bill and unfortunately it passed. It was signed by the Governor on April 16, 2019. (Passed and Signed by the Governor)

ANIMAL WELFARE The Colorado Livestock Association has a long standing presence in the area of animal well-being and husbandry. CLA is proactive in developing coalitions amongst those who both support and oppose current livestock management practices.

ANIMAL ACTIVISM IN COLORADO

ADVOCACY

In 2008, a law known as Senate Bill 08201 was passed in Colorado which banned gestation crates for sows and crates for veal calves. Prior to its passage, CLA engaged in a collaborative process which included other livestock organizations in Colorado as well as the Humane Society of the United States (HSUS). The parties were assisted in negotiations by Dr. Bernard Rollin, a wellknown animal ethicist from Colorado State University.

In 2013, House Bill 13-1231 was introduced which would have prohibited the routine practice of docking dairy cattle tails. Ultimately HB 13-1231 did not pass, but the effort was continued by the Humane Society of the United State with the introduction of several ballot initiatives in 2014. On behalf of the livestock industry in Colorado, CLA led the effort by seeking legal counsel and supported filing an appeal and the supporting briefs with the Colorado Supreme Court challenging the validity of the initiatives language. In May of 2014, this headline appeared in a press release from the HSUS, "The HSUS to Defer Ballot Initiative to Protect Dairy Cows from Abuse this Election Cycle." Although this might sound like it, this effort was not about winning and losing. It was about making sure that livestock producers were not saddled with unreasonable regulations that would inhibit their ability to operate according to generally accepted husbandry practices.


We have all seen ugly videos showing unacceptable and inexcusable animal abuse or neglect. The Association has been at the forefront in the adoption of policy on the proper handling and care of livestock. CLA members are committed to adhering to the Animal Care Code of Ethics adopted by the Association.

ANIMAL CARE CODE OF ETHICS We are devoted to the animals in our care. We therefore affirm our obligation to provide responsible animal care using sound animal husbandry practices, based on practical experience and scientific research. Because all species of livestock are produced in diverse environments and geographic locations, we recognize there is no single set of production practices that can be recommended for all livestock producers. Personal experience, training, best practices and professional judgment can serve as valuable resources for providing appropriate animal care for the well-being of livestock and worker safety. To that end we commit to:

• Provide ready access to fresh water and adequate nutrition. • Follow applicable disease, injury prevention and treatment practices to ensure herd health. • Provide a species appropriate environment. • Using appropriate methods to humanely euthanize terminally sick or injured livestock and minimize the animal’s pain and distress. Whether death occurs by euthanasia or natural causes, remains should be disposed of by approved methods that will minimize risk of disease and infection to people or to other animals. • Provide personnel with training to properly handle and care for livestock. • Keep updated on advancements, research and changes in the industry and make decisions based upon sound production practices with consideration for animal well-being. • Provide facilities and handling practices that allow for the safe, humane, and efficient movement and/or restraint of livestock. The willful mistreatment or abuse of livestock is not acceptable under any circumstances.

FEDERAL ISSUES

LABOR & IMMIGRATION Agricultural employers in the United States face a shortage of available domestic workers and subsequently require a dependable source to obtain foreign workers. The H-2A program has seasonal implications that impact the usability of the program by all agriculture segments. Proposals to address these implications through legislation have created certain proposed inconsistencies between livestock industries. CLA supports a guest worker program that provides work authorization for a minimum of three years, and treats all segments of the livestock industry fairly and consistently.

PROTEIN LABELING

Ensuring that all lab-grown meat products are safe and accurately labeled remains one of CLA's top priorities. Under the terms of an agreement between U.S. Department of Agriculture (USDA) and Food and Drug Administration (FDA), USDA will be responsible for inspecting all facilities that harvest, process, package, or label cell-cultured products derived from livestock or poultry. A similar dilemma has existed for years in the dairy industry with the mislabeling of plantbased beverages as "milk." The FDA already has a clear definition of what constitutes milk: “Food products made exclusively or principally from the lacteal secretion obtained from one or more healthy milk-producing animals.” Plant-based beverages don’t meet that standard.


FEDERAL ISSUES TRANSPORTATION For the past several years CLA has been engaged in the issue of the Federal Motor Carriers Safety Administration's (FMCSA) Hours of Service regulation for livestock haulers. Livestock haulers need the flexibility within Hours of Service to protect the animals in their care. The Hours of Service regulation limits the maximum driving hours for property-carrying drivers and also limits the total consecutive on-duty hours for those drivers.



Livestock haulers are exempt from the Hours of Service rule until September 30, 2019.

WATERS OF THE UNITED STATES Waters of the United States (WOTUS) defines all bodies of water that fall under U.S. federal jurisdiction. In the U.S., cattle graze on nearly 654 million acres - over 1/3 of the nation's continental land mass.

An expansive WOTUS definition impacts the cattle-raising population disproportionately, potentially leaving less grazable land available for productive and sustainable use.

ADVOCACY

As the country's largest collective landowner, America's cattle producers stand to lose the most from either a vague regulatory scheme or a WOTUS definition that attempts to combat clarity issues with overly broad categorical jurisdiction.

early 300 producers, industry partners, students, government and agency representatives came together for the Colorado Livestock Association (CLA) Annual Meeting & Colorado’s Finest Celebration on April 3-4, 2019 at the Embassy Suites in Loveland. CLA’s Annual Meeting is one of the largest gatherings of livestock producers and trade show vendors in Colorado.

Thursday morning kicked off with the Annual Membership Meeting at which the membership reelected Tom Wernsman, Wernsman Feeders, LLC, Fleming, to serve as the Treasurer for a 1-year term. Case Gabel, Magnum Feedyard Co., LLC, Wiggins, was re-elected to serve a 3-year term as a Board Director. John Mrozinski, Producers Feedlot, LLC, Greeley, was elected to serve a 3-year term as a Board Director. Russ Moss, Rusco Land and Cattle, LLC, Ault, was elected to serve a 3-year term as a Board Director. The membership recognized and thanked outgoing Board Members Grant Bledsoe and Trevor Tuell for their service to the Association on the Board.
