This notice is intended to meet the procedural requirements for activities to be undertaken by the City of Thornton for the Request for Release of Funds (RROF).
Request For The Release Of Funds
On or about March 10, 2023, the City of Thornton will submit a request to the U.S. Department of Housing and Urban Development (HUD), Region VIII, Denver, Colorado, as applicable on behalf of City of Thornton for the release of Community Development Block (CDBG) Program funds under 24 C.F.R. 570, Title I of the Housing and Community Development of the Act of 1974, as amended, to undertake a project known as the Sidewalk Improvement Project- 100th & Riverdale Rd, for the purpose of installing an 8-foot-wide concrete sidewalk along the northwest corner of 100th Avenue and Riverdale Road with two Americans with Disabilities Act (ADA) directional ramps connecting the northwest corner and southwest corner. The sidewalk on the north side of 100th Avenue would tie into an existing sidewalk in front of Pine Lakes Ranch community, just west of the Colorado Agricultural Canal. The sidewalk on the west side of Riverdale Road would tie into the existing sidewalk on the north end of the 10023 Riverdale Road property. This will provide accessibility and a paved connection for pedestrian use. This project will be funded with $149,000 of 2020 CDBG funds for the design and purchase of right of way and $266,224 of 2021 CDBG funds for the construction of the sidewalk. The estimated total project cost is $341,224.
The activities proposed are categorically excluded under HUD regulations at 24 C.F.R Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Thornton Community Connections Division at 9471 Dorothy Blvd, Thornton or by contacting Community Connections staff at 720-977-5800 or cdbg@thorntonco.gov. The environmental records are available for review, copy and/or examination during normal business hours 8 a.m. to 5 p.m., Monday through Friday.
PUBLIC COMMENTS FOR RROF
Any individual, group, or agency may submit written comments on the ERR to Community Connections staff at the City of Thornton as designated above. All comments received within seven days of this notice, but no later than March 9, 2023 by 5:00 p.m., will be considered by the City of Thornton prior to authorizing submission of a request for release of funds.
Environmental Certification
The City of Thornton certifies to HUD that Mr. Kevin Woods in his capacity as City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD, Region VIII, approval of the RROF certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Thornton to use CDBG Program funds.
OBJECTIONS TO THE RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Thornton’s RROF certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, whichever is later, only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Thornton; (b) the City of Thornton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the program, project and/or activity is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at CPD_COVID-19OEEDEN@hud.gov. Potential objectors should contact CPD_COVID-19OEE-DEN@hud.gov to verify the actual last day of the objection period.

NOTICE OF CONTRACTOR’S FINAL SETTLEMENT
NOTICE is hereby given that Adams 12 Five Star Schools will make final settlement on April 1, 2023, with New Style Contracting, PO Box 474, Eastlake, CO 80614 for work performed on a project known as: INTREX Aerospace RTU Replacement 12777 Claude Court, Thornton CO 80241.
Any person, co-partnership, association of persons, company or corporation that has furnished labor, equipment, materials, equipment rentals, sustenance, provisions or other supplies used or consumed by New Style Contracting or its subcontractors in or about the performance of the work on said project is hereby notified to file a verified statement of the amount due and unpaid on account of such claim with the Board of Education of said School District at the Educational Support Center, Facilities Department, 1500 East 128th Avenue, Thornton, Colorado 80241, on or before MARCH 3rd 2023. Final payment is to be made to New Style Contracting on MARCH 10th 2023.
Settlement will be made at the Educational Support Center, Facilities Department, 1500 East 128th Avenue, Thornton, Colorado 80241.
Failure on the part of the claimant to file such statement prior to the final settlement date will relieve the School District from any and all liability for such claim.

This is an action for forfeiture pursuant to C.R.S. §16-13-307 of the currency that was seized in Adams County, Colorado by officers of the North Metro Task Force on October 4, 2022, as being derived from activity constituting a class one public nuisance.
