Section 2. Subsections 1.05.010 (b), (c), (f), (g), (h), (j), (k), (m), (o), and (p) of the Golden Municipal Code are amended to provide: 1.05.010 Definitions (b) (c) Candidate shall mean any person who seeks nomination or election to the office of Mayor or City Council at any City election, including an election seeking the recall of the Mayor or a member of the City Council. A person is a candidate if the person has publicly announced an intention to seek such election or has filed a nominating petition in person with the city clerk for the office of Mayor or City Council. Candidate shall also mean any elected official who is the subject of recall proceedings, or one who seeks to replace such an elected official upon recall, pursuant to Chapter IV of the Charter. (d) Candidate committee shall mean a person, including the candidate, or persons with the common purpose of receiving contributions and making expenditures under the authority of a candidate. A candidate shall have only one (1) candidate committee. A contribution to a candidate shall be deemed a contribution to his/her candidate committee. A candidate committee shall be considered open and active until the committee has filed a termination report with the City Clerk. (f) Contribution shall mean: (1) The payment, loan, pledge, gift or advance of money, or guarantee of a loan, made to any candidate committee, or political committee; (2) Any payment of money made to a third party for the benefit of any candidate committee, or political committee; (3) Anything of value given, directly or indirectly, to a candidate committee for the purpose of promoting the candidate's nomination, retention, recall or election; or (4) With regard to a contribution for which the contributor receives compensation or consideration of less than equivalent value for such contribution, including, but not limited to, items of perishable or nonpermanent value, goods, supplies, services or participation in a campaign-related event, an amount equal to the value in excess of such compensation or consideration as determined by the candidate committee or political committee. Contribution shall include expenditures that are controlled by or coordinated with a candidate or candidate's agent. Such coordinated expenditures are deemed to be both contributions by the maker of the expenditures, and expenditures by the candidate committee. Contribution shall not include services provided without compensation by individuals volunteering time on behalf of a candidate, candidate committee or political committee. (g) Contribution in kind shall mean the fair market value of a gift or loan of any item of real or personal property, other than money, made to or for any candidate committee, or political committee for the purpose of influencing the nomination, retention, election or defeat of any candidate. Personal services shall be considered a contribution in kind by the person paying compensation therefore. In determining the value to be placed on contributions inkind, a reasonable estimate of fair market value shall be used. Contribution in-kind shall not include an endorsement of a candidate by any person and shall not include the payment of compensation for legal and accounting services rendered to a candidate, candidate committee or political committee if the person paying for the services is the regular employer of the individual rendering the services and the services are solely for the purpose of ensuring compliance with the provisions of this Chapter. (h) Expenditure shall mean the payment, distribution, loan, gift or advance of any money for goods or services by any person or organization for the purpose of expressly advocating the election or defeat of any candidate. An expenditure occurs when the actual payment is made or cost is incurred or when there is a contractual agreement and the amount is determined or when goods are first delivered or services commence, the date of the expenditure being the date when the first of any of these events occurs. (1) If any portion of goods or services obtained or purchased by a person are used in any manner by any person or organization for the purpose of expressly advocating the election or defeat of any candidate, the pro rata value of such portion of goods or services shall constitute an expenditure. (2) “Expenditure” shall not include any cost incurred in covering or carrying any news story, editorial endorsements, opinion or commentary writings, or letters to the editor by any broadcasting station (including a cable television operator, programmer or producer), newspaper, magazine, or other periodical publication, including any Internet or electronic publication, that is viewable by the general public and is primarily devoted to the dissemination of news and editorials to the general public, and is not owned or controlled by a candidate, candidate’s committee, or political committee. (3) Expenditures that are controlled by or coordinated with a candidate or candidate’s agent are deemed to be both contributions by the maker of the expenditures, and expenditures by the candidate committee. (j) (k) Non-committee expenditure shall mean an expenditure by any person other than a candidate, or political committee that is not controlled by or coordinated with any candidate or agent of such candidate or candidate’s committee. (m) Political committee shall mean any person(s), who are elected, appointed or chosen, or have associated themselves, for the purpose of making contributions to a candidate or candidate’s committees or other political committees, or to make expenditures in support of or opposition to candidates, or in support of or opposition to recall questions. Political committee shall not include: (1) Candidate committees as otherwise defined in this section; or (2) Any partnership, committee, association, corporation, labor organization or other organization or group of persons previously established for a primary purpose outside the scope of this Chapter. (o) Termination report shall mean a final report prepared by a candidate committee, or political committee and filed with the City Clerk which discloses the committee's contributions received, expenditures made and obligations entered into, when the following conditions have been met: (1) The committee no longer intends to receive contributions or make expenditures; and (2) A zero (0) balance exists in the account established and maintained under Section 1.05.040 and the committee has no outstanding debts or obligations. (p) Unexpended campaign contributions shall mean the balance of funds on hand in any candidate committee, or political committee following an election, less the amount of all unpaid monetary obligations incurred prior to the election.
Political committee shall not include: (1) Candidate committees as otherwise defined in this section; or (2) Any partnership, committee, association, corporation, labor organization or other organization or group of persons previously established for a primary purpose outside the scope of this Chapter. Section 3. Section 1.05.030 of the Golden Municipal Code is amended to provide: 1.05.030 Registration of committees All candidate committees and political committees shall register with the City Clerk before accepting or making any contributions. Registration shall include a statement listing: (a) The committee's full name, spelling out any acronyms used therein; (b) A natural person authorized to act as a registered agent; (c) A street address and telephone number for the principal place of operations; (d) All affiliated candidates and committees; (e) The purpose or nature of interest of the committee. Section 4. Subsection 1.05.040(a), of the Golden Municipal Code is amended to provide: 1.05.040 Campaign contributions (a) Limits on contributions to candidate committees. No person shall make contributions and/or contributions in kind totaling more than One Thousand Dollars ($1,000.00) to the candidate committee of any candidate for the office of Mayor or more than Five Hundred Dollars ($500.00) to the candidate committee of any candidate for the office of City Council from any district or more than Two Hundred and Fifty Dollars ($250.00) to the candidate committee of any candidate for the office of City Council from any ward. No person shall make a contribution or contribution in kind in the name of another person or knowingly permit one's name to be used by another person to effect such a contribution or contribution in kind. These limitations shall apply to all contributions or contributions in kind, whether made directly to a candidate committee or indirectly via earmarked gifts passed through an intermediary, and to all expenditures by any person that are controlled by or coordinated with a candidate or candidate committee, except that these limitations shall not apply to: (1) Contributions or contributions in kind made by a candidate or immediate family member to his/her candidate committee; (2) Non-com mittee expenditures as defined in Section 1.05.010(k); (3) Monetary loans that are: (a) personally guaranteed in writing by the candidate, the candidate's immediate family or a business entity in which the candidate owns at least five percent; or (b) secured by real or personal property owned by the candidate, the candidate's immediate family or a business entity in which the candidate owns at least five percent; or (4) Contributions made to a candidate committee by another candidate committee established by the same candidate for the office of Mayor or City Council. Section 5. Subsections 1.05.050(a) and (g), of the Golden Municipal Code are amended to provide: 1.05.050 Disclosure; filing of reports by candidates, candidate committees and political committees. (a) All candidate committees and political committees shall report to the City Clerk their contributions and contributions in kind received, including the name and address of each person who has made contributions or contributions in kind in the amount of $20.00 or more and all expenditures. (g) Any candidate committee or political committee that has not accepted any contributions or contributions in kind, made any expenditures, or entered into any obligations during a reporting period, shall file a report with the City Clerk on the days specified in paragraph (c) above certifying that the committee has not accepted any contributions or contributions in kind, made any expenditures or entered into any obligations during the relevant reporting period. Section 6. Section 1.05.060, of the Golden Municipal Code is amended to provide: 1.05.060 Disclosure; filing of reports for non-committee expenditures (a) Any person making non-committee expenditures totaling more than $50.00 shall deliver notice in writing of such expenditures to the City Clerk not later than three business days after the day that such funds are expended or services or materials provided. Any individual volunteering his or her time on behalf of a candidate, candidate committee, or political committee shall be immune from any liability for a penalty imposed if: (a) The volunteer was acting in good faith and within the scope of such volunteer’s functions and duties for the candidate or candidate committee; and (b) The violation was not caused by willful and intentional misconduct by such volunteer. Section 8. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The city council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 10. Violations of this ordinance shall be punishable in accordance with the provisions of Section 1.01.110 of the Golden Municipal Code.
Section 11. The repeal or modification of any provision of the Municipal Code of the City of Golden by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.

The Northwest Lakewood Sanitation District will receive sealed bids at the Engineer's office for the following project until 11:00 A.M., June 15th, 2015. Immediately thereafter all bids will be publicly opened and read aloud at the Engineer's office. All bids must be on a unit price basis. The unit price given will be used in case of a discrepancy with total price extensions.

The principal work to be performed under this contract shall consist an upsizing of approximately 500 LF of 8” pipe to 12”with associated manholes, reconnection to existing main lines and manholes and service connections. Work includes, but not limited to excavation, asphalt removal/replacement, bypass pumping, and replacement of appurtenances thereto. The project is located in the City of Lakewood. Each bid must be accompanied by a bid security in the amount equal to five (5) percent of the bid.
The Northwest Lakewood Sanitation District reserves the right to reject any and all bids, to waive any informality in the bidding and to accept the proposal deemed most advantageous to the best interest of the District.
