IN RE THE ORGANIZATION OF BUCKLEY CROSSING METROPOLITAN DISTRICT NO. 2, CITY OF COMMERCE CITY, ADAMS COUNTY, STATE OF COLORADO
NOTICE IS HEREBY GIVEN that, pursuant to § 32-1-204(1), C.R.S., a Service Plan (the “Service Plan”) for the proposed Buckley Crossing Metropolitan District No. 2 (the “District”) has been filed with the Clerk for the City of Commerce City, and is available for inspection in the office of the City Manager, 7887 E. 60th Avenue, Commerce City, Colorado.
A public hearing on the Service Plan will be held by the City Council of Commerce City (the “City Council”) on August 2, 2021, at 6:00 p.m., electronically via Zoom or as soon thereafter as the City Council may hear such matter. Information to attend the hearing electronically may be found on the City’s website: https://www.c3gov.com/ government/city-council/virtual-meetings
The purpose of the hearing is to consider the Service Plan and to form a basis for adopting a resolution approving, conditionally approving or disapproving the Service Plan in accordance with § 32-1-204.5, C.R.S. The primary purpose of the District is to finance water, sanitary sewer, storm sewer, street, traffic and safety, and park and recreation public improvements and services.
A general description of the land contained within the boundaries of the proposed District is as follows: North of 112th Avenue and South of 120th Avenue, between Buckley Road and Tower Road, and bordering on E-470, containing approximately 200 acres.
Pursuant to § 32-1-203(3.5), C.R.S., any person owning property within the proposed District may request that such property be excluded from the District by submitting a written request to the City Council no later than ten (10) days prior to the public hearing c/o City Clerk, 7887 E. 60th Ave, Commerce City, CO 80022.

FINAL SETTLEMENT

Project Title:Porteos – Phase 5 (Segment 1) Streetlights

The Velocity Metropolitan District plans to accept the above titled project as substantially complete and for Final Settlement to Communication Construction & Engineering, Inc. after July 29, 2021. In accordance with the Contract Documents, the Velocity Metropolitan District may withhold a portion of the remaining payment to be made to Communication Construction & Engineering, Inc., as necessary, to protect the Velocity Metropolitan District from loss on account of claims filed and failure of Communication Construction & Engineering, Inc. to make payments properly to subcontractors or suppliers. Project suppliers and subcontractors of Communication Construction & Engineering, Inc. are hereby notified that unresolved outstanding claims must be certified and forwarded to: Contact Person: Barney Fix, P.E. The Bonds will be issued for the project described below in an aggregate principal amount not to exceed $16,000,000.
Proceeds of the sale of the Bonds which will be issued as qualified 501(c)(3) bonds will be loaned by the Authority to Campus Partners 1 and its affiliates, all single member limited liability companies and disregarded entities of Campus Partners 1 (collectively, the “Borrower”) to be used to finance or reimburse all or a portion of the costs of a project that consists of (1) the acquisition and improvement of a public charter school facility (the “Charter School Facility”) identified below for use in its school operations at the location and in the estimated maximum principal amount listed below; (2) the funding of any required reserves; and (3) the payment of the costs of issuance of the Bonds. The Borrower will lease the Charter School Facility to qualified 501(c)(3) entities or governmental entities. The Charter School Facility will be owned by the Borrower as the initial legal owner.
