A LOCALITY MAY PROHIBIT THE OPERATION OF MARIJUANA CULTIVATION FACILITIES, MARIJUANA PRODUCT MANUFACTURING FACILITIES, MARIJUANA TESTING FACILITIES, OR RETAIL MARIJUANA STORES THROUGH THE ENACTMENT OF AN ORDINANCE OR THROUGH AN INITIA T E D O R R E F E R R E D M E A S U R E; PROVIDED ANY INITIATED OR REFERRED MEASURE TO PROHIBIT THE OPERATION OF MARIJUANA CULTIVATION FACILITIES, MARIJUANA PRODUCT MANUFACTURING FACILITIES, MARIJUANA TESTING FACILITIES, OR RETAIL MARIJUANA STORES MUST APPEAR ON A GENERAL ELECTION BALLOT DURING AN EVEN NUMBERED YEAR (emphasis added); and WHEREAS, Amendment 64 conflicts with federal law, as the possession, cultivation, sale and use of marijuana remains illegal under applicable federal criminal statutes; and WHEREAS, the Board of County Commissioners of Teller County, Colorado ("Board") finds that the licensing and operati on of m ar i j uana es tabl i s hm ents provided for in Amendment 64, by making marijuana more readily available in the community and facilitating the recreational use of marijuana, presents a threat to the health and education of Teller County's children, to the safety of the workplace and the traveling public and to the public health, safety and welfare as a whole; and WHEREAS, the Board finds that the publication and notice of this ordinance was or will be performed in accordance with C.R.S. 30-15-405 and 30-15-406; and WHEREAS, the Teller County Sheriff's Office is the appropriate agency to enforce violations involving the operation of recreational marijuana establishments, includi ng marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities and retail marijuana stores imposed by this ordinance; and WHEREAS, the licensing and operation of medical marijuana centers, medical marijuana infused products manufacturing operations, and medical marijuana optional premises cultivation operations pursuant to the Colorado Medical Marijuana Code and Teller County Resolution No. 06 -28-2012 (31), as well as Resolution No. 06-28-2012 (32) Adopting the Teller County Medical Marijuana Licensing Regulations, Appointing the Local Licensing Authority, and Authorizing Actions by the Local Licensing Authority, shall be unaffected by this Ordinance; and WHEREAS, the Board of County Commissioners hereby finds, determines and declares that adoption of this ordinance is necessary for the preservation and protection of the public health, safety and welfare of the inhabitants of Teller County, Colorado.

(6) "MARIJUANA PRODUCTS" MEANS CONCENTRATED MARIJUANA PRODUCTS AND MARIJUANA PRODUCTS THAT ARE COMPRISED OF MARIJUANA AND OTHER INGREDIENTS AND ARE INTENDED FOR USE OR CONSUMPTION, SUCH AS, BUT NOT LIMITED TO, EDIBLE PRODUCTS, OINTMENTS AND TINCTURES. (7) "MARIJUANA TESTING FACILITY" MEANS AN ENTITY LICENSED TO ANALYZE AND CERTIFY THE SAFETY AND POTENCY OF MARIJUANA. (8) "MEDICAL MARIJUANA CENTER" MEANS AN ENTITY LICENSED TO ANALYZE AND CERTIFY THE SAFETY AND POTENCY OF MARIJUANA. (9) "RETAIL MARIJUANA STORE" MEANS AN ENTITY LICENSED TO PURCHASE MARIJUANA FROM MARIJUANA CULTIVATION FACILITIES AND MARIJUANA AND MARIJUANA PRODUCTS FROM MARIJUANA PRODUCT MANUFACTURING FACILITIES AND TO SELL MARIJUANA AND MARIJUANA PRODUCTS TO CONSUMERS. Section 5: Marijuana Establishments Prohibited. The licensing and operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities and retail marijuana stores is hereby prohibited. Section 6: Enforcement. This Teller County Sheriff and the Sheriff's officers, deputies, designees and agents are authorized by the Teller County Board of County Commissioners to enforce the provisions of this Ordinance. Section 7: Violations. 7.1 Violations of this Ordinance shall constitute a Class 2 petty offense and may be prosecuted in accordance with C.R.S. 3015-402 and 30-15-410, and upon conviction or confession of guilt thereof shall be punished by a fine of One Thousand and 00/100 Dollars ($1,000.00) for each violation of this ordinance. 7.2 The Teller County Sheriff shall have the authority to take a violator or violators into custody for violations of this Ordinance. Criminal prosecution may be brought against a violator in accordance with Sections 30-15-402 C.R.S. and 30-15 -410 C.R.S. 7.3 Each violation of this Ordinance shall be deemed separate and distinct from any other violation of this Ordinance or of any other federal, state, or local law, rule, order or regulations, and each day during which violation of this Ordinance continues shall be deemed a separate offense. Section 8: Effective Date. Pursuant to C.R.S. 30-15-405, this Ordinance shall be effective thirty (30) days after its second publication. Section 9: Conflicts. Where any provision of this Ordinance conflicts with any other provision of this Ordinance, or any other law or ordinance, the more stringent requirement, regulation, restriction or limitation shall apply Section 10: Severability. All personal and commercial uses that are on National Forest System lands must be specifically authorized. Special use permits are often issued to individuals, corporations and city, state or federal governments to maintain and operate certain facilities on National Forest. These permits are issued for a specific period of time. When they expire or there is a change in property ownership, they are re-examined to determine if conditions have changed and it is still appropriate to authorize the use. The Forest Service proposes to re-issue the following permits for existing uses and or for replacement of improvements damaged during the 2012 Waldo Canyon Fire and flood events: 1. CenturyLink. Eagle Camp Lake Communications Restoration Project. Installation of a 12-foot mono pole and approximately 162 feet of ground mounted telephone and electric cable to replace telephone lines and communication improvements damaged during the 2012 Waldo Canyon Fire. The project area is located in the SW1/4 Sec. 12, T. 12 S., R. 68 W. 6th PM, El Paso County, Colorado. 2. Colorado Springs Utilities. Construction of a caretaker facility near the Rampart Reservoir Recreation area. The improvements will consist of a workshop, house, water well, septic and access driveway. The proposed project will replace the facilities that were damaged from flood events after the Waldo Canyon Fire. The project is located in the SW1/4 Sec. 25, T. 12 S., R. 68 W., 6th PM, El Paso County, Colorado 3. El Tesoro de los Angeles Retreat Center. The retreat center is requesting a special use permit for year-round use and maintenance of Forest Road 308. Road length is approximately 0.25 miles and is located in the NW1/4 Sec. 28, T 12 S., R. 69 West, 6th PM, Teller County, Colorado. 4. Emerald Valley Ranch, LLC. Emerald Valley Ranch is requesting a forest road permit for year-round use and maintenance of approximately 1.6 miles of Forest Road 371. The forest road is located in portions of Section 20 and 29, T. 15 S., R. 67 W., EL Paso County, Colorado. 5. Pikes Peak Range Riders. Re-issuance of permit for a 20 year period for an existing water well used seasonally for an annual camping event held by the Pikes Peak Range Riders. The water well is located in the W1/2SE1/4 Sc. 33 T. 14 S., R.69 W., 6th PM., Teller County, Colorado. In light of a recent court ruling (Sequoia ForestKeeper v. Tidwell, 11-cv-00679-LJO -DLB (E.D. Cal.)), the Forest Service will provide public notice, comment, and opportunity for administrative appeal for projects and activities documented with a “Decision Memo” (36 CFR 220.6(e)) until new instructions are issued by the Washington Office, or the Agency issues regulations addressing the Court’s ruling. In addition, the Forest Service will prepare Decision Memos and offer notice, comment and appeal opportunities for timber sales and proposed approvals of oil or gas exploration and development activities that rely upon Section 390 of the Energy Policy Act of 2005. Only those who provide comment or express interest in this proposal during this comment period will be eligible to appeal the decision pursuant to 36 CFR part 215 regulations. How to Comment and Timeframe Written, facsimile, hand-delivered, oral, and electronic comments concerning this action will be accepted for 30 calendar days following the publication of this notice in the Pueblo Chieftain. The publication date in the newspaper of record is the exclusive means for calculating the comment period for this analysis.
