NOTICE OF PROPOSED DECISION

The Colorado Division of Reclamation, Mining and Safety proposes to approve Permit Renewal Application No. 8 (RN-8), submitted by Coors Energy Company for a coal mining permit at the Keenesburg Strip Mine (Permit No. C-1981-028). The proposed renewal will allow for continued mining and/or reclamation operations at the site.

The Keenesburg Strip Mine is a/an surface operation located in Weld County, approximately 7 miles North of Keenesburg, Colorado. Coal interest is state and private, and the surface to be affected is private land. The permit area encompasses approximately 225.55 acres.

This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 33 101 et seq., C.R.S., and the regulations promulgated thereunder.

A copy of the “Proposed Decision and Findings of Compliance”, including any stipulations, is on file for public inspection at the Keenesburg Town Hall, 140 S Main, Keenesburg, CO 80643. House Bill 1356 would provide grants up to $100,000

Small nonprofi ts could receive pandemic-assistance grants of up to $100,000 through a bill proposed in the Colorado House.

House Bill 1356, known as the Small Community-based Nonprofi t Grant Program, is scheduled to get its fi rst hearing April 13 in the House Transportation and Local Government Committee. The bipartisan measure would give $35 million of federal funding from the American Rescue Plan Act to the Department of Local Affairs to be distributed through fi ve “regional access partners” to at least 350 nonprofi ts.

The bill has been spearheaded by a multiethnic coalition of nonprofi t leaders called Communities Lead, Communities Thrive, or CLCT, that serves Black, Indigenous, Latino, AAPI, LGBTQ+ and rural communities.

“A lot of our organizations don’t have access to working capital to rebuild, they’re usually smaller,” CLCT founder Carlos Martinez said. “Some of these challenges sometimes are even larger when you look at organizations that are in rural communities or in communities where there’s very few organizations.”

Pandemic assistance programs have benefi ted larger nonprofi ts, but smaller ones without the infrastructure to compete for grants have often been left behind. These organizations often have deeper connections within communities that lead to a better level of cultural awareness than larger groups. The proposed bill would support these smaller groups that provide critical services to those most severely impacted by the pandemic.

“We’re looking at (these recovery dollars) to be very strategic dollars to get invested to help rebuild not just nonprofi ts, but these communities,” said Martinez, who is also the CEO of the Latino Community Foundation of Colorado. “We’re looking at how we are almost shaping the next generation of these communities who are vastly impacted by COVID.”

The prime sponsors of the bill are Rep. Leslie Herod and Sen. Julie Gonzales, both Denver Democrats, as well as Rep. Edie Hooton, D-Boulder, and Sen. Bob Rankin, R-Carbondale.

“This legislation will direct urgently needed resources to nonprofi ts across our state that need a hand in recovering from the pandemic, allowing them to keep their doors open and continue providing the critical services Coloradans depend on to thrive,” Gonzales said.

CLCT member Ricardo Perez is the executive director of the Hispanic Affairs Project or HAP, a small nonprofi t serving immigrants in Western Colorado. HAP has served immigrants throughout the pandemic, including translating information from Health and Human Services into Spanish and providing assistance in the Western Slope’s “legal desert,” where there are only a few immigration attorneys practice.

HAP doesn’t have the infrastructure to compete for many state or federal grants. Perez said it feels like HAP and other small, rural nonprofi ts receive 20 cents for every dollar that a traditional nonprofi t gets. He supports the bill because it levels the playing fi eld.

“It’s an opportunity for the state of Colorado not only to say that we are promoting equity, but we are putting in practice equity in the way we are doing better investment for small nonprofits,” Perez said.

The Asian Pacifi c Development Center in Aurora expanded its services in response to the pandemic. Grant funding from the government and different foundations were helpful at the beginning of the pandemic, but have fallen off despite the persistence of the virus and anti-Asian hate crimes, President and CEO Harry Budisidharta said.

“Local nonprofi ts like APDC, we are often counted on by our community to respond to a lot of hate-crime incidents, diffi culties they’re having with COVID, whether that is food delivery or ensuring they have a safe workplace,” said Budisidhartha, who also serves on CLCT.

The bill must pass through several committees and votes before it lands on the governor’s desk and is signed into law, but Budisidhartha said organizations could see funding near the end of 2022.

HAP might not be eligible to apply for one of the grants. Still, Perez said it’s about more than money.

“It’s about recognizing the diversity, the cultural diversity, we enjoy in Colorado,” Perez said. “This is the way we are, as a nonprofi t, supporting each other.”

By requiring schools to document all holds that last longer than a minute, Levin hopes to open up more conversations about what can be done to head off student outbursts before they happen.

“Any time a student is placed in any of these types of restraints, whether it is physical restraint or seclusion, it brings up trauma,” Levin said. “And we fi nd students who are suddenly very fearful and anxious about schools, and some of these students don’t have the capacity to verbally express what happened.”

Spurgin said that collecting more data is a necessary step to understand what’s happening in schools and fi nd the right solutions.

“Our students of color are targeted, more specifi cally our male students of color,” Spurgin said. “The disaggregated data we will get from this bill is so important. Often you hear anecdotal reasons why certain student groups are disciplined more, arrested more, handcuffed more, but until we have the data, I think it will be hard to convince educators that there is bias in the system.

“It’s not pointing a fi nger, but pointing out what happens when we see students of color as more problematic than white students.”

It’s not clear whether this measure will face signifi cant opposition. School districts, especially small rural ones, consistently push back against requirements that they share more data or do more training. They say the requirements are burdensome and costly and make it harder to educate students.

The diffi culties of the pandemic and staff shortages have amplifi ed those objections. At the same time, many educators say student behavior problems and mental health needs have grown.

Bill supporters say they don’t intend to cast blame on classroom teachers or district administrators. They want teachers to have more tools, not fewer, to respond to challenging behavior.

“We have a sense that these disparities exist — that isn’t disputed at this point — but the data around this is not easy to fi nd,” Colwell said. “We don’t know what is actually happening. We need that before we can start to fi gure out solutions.”
