Section 15301(l)(3) exempts the demolition and removal of small commercial structures. Section 15332 exempts in-fill development within the City limits on a project site of no more than five acres, substantially surrounded by urban uses and consistent with the applicable General Plan and zoning designation. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Case No. 11063 TMDB/DR based upon the findings and conditions contained in the draft resolution of approval for the project provided to the Commission. An appeal of the Planning Commission determination, accompanied by a filing fee, may be filed by 5:00 p.m. on the 15th calendar day following the date of the Commission’s determination (10 days for maps). Appeals will be considered by the City Council pursuant to Chapter 1.12 of the Municipal Code.
