With LEAVE, BREXIT and UKIP winning the most votes in the UK Referendum on EU membership, David Cameron decides to “throw in the towel” and it looks as though Teresa May will be accepted the PM’s POISON CHALLICE. Those - winner or loser - in the Referendum will be livid if she activates Article 50 or whether she doesn’t. Boris wants no part of this “Lose Lose” situation and will laugh all the way to replace the next PM when public opinion forces them out of office. But then again “I love a story with a happy ending”. 120 Barristers clarify Brexit

Dear Prime Minister 1. The referendum result must be acknowledged. 2. Our legal opinion is that the referendum is advisory. The European Referendum Act does not make it legally binding. 3. Our opinion is that in order to trigger Article 50 of the Lisbon Treaty, there must first be primary legislation. 4. It is of the utmost importance that the legislative process is informed by an objective understanding as to the benefits, costs and risks of triggering Article 50. The reasons for this include the following:

a. There is evidence that the result of the referendum result was influenced by misrepresentations of fact and promises that could not be delivered. Since the result was only narrowly in favour of Brexit, it cannot be discounted that the misrepresentations and promises were a decisive or contributory factor in the result. b. The parliamentary vote must not be similarly affected. c. The referendum did not set a threshold necessary to leave the EU, commonly adopted in polls of national importance, e.g. 60% of those voting. Donating your body is NOT that easy Donating one’s body for medical research was a selfless way of helping trainee doctors, in the years before funeral plans and Englishspeaking undertakers. It has also been chosen for the ‘last journey’ by people who begrudge the (exorbitant - according to some claims) cost of a cremation, and the Department of Human Anatomy in San Juan has a surplus of cadavers, and an ever-increasing monthly bill from Undertakers for transportation from the place of death to the university department.

These developments have brought changes. Donors still alive, have received a demand itemising the consequences and enclosing updated paperwork in English for the donor to sign and have witnessed. The Department can no longer afford to ‘buy’ donated bodies - the ‘cost’ of moving the cadaver charged by an undertaker. There have always been exceptions, where donors once dead - were rejected, leaving the family to cope with decisions they’d never discussed with the donor. Continued on page 8

4 Jávea men arrested for attempted murder and arms trafficking

The Civil Guard have arrested four men, two of British nationality (37 and 54) and two Spaniards (38 and 47 years old) suspected of a crime of murder attempted against two guards at the Pedreguer Post; arms trafficking; deposit and possession of weapons of war; tenure (short carbine) weapons; attack on law enforcement and conspiracy to commit murder. A patrol of Civil Guards was on duty, and identified a British citizen in Pedreguer. As the man, was identified, he pulled a hidden pistol, targeting agents with the intention of shooting, but, was disarmed and arrested despite his being a very big man.

Jávea Councillors voted unanimously in favour of local State schools in the Arenal, Graüll, Trenc d’Alba and Port moving to schooling between the hours of 9am and 2pm, leaving the afternoon for extra-curicular activities. The meeting approved other matters of a routine nature regarding finance and considered a Grant to repair the sewer in Camí Vell de la Mar.

Experimental Agricultural centre launched

The Valencian Farmers Association (AVA-Asaja) has launched an experimental centre in Polinyà del Xúquer, Finca Sinyent (near Sueca), where they are testing and evaluating the results of various cropping practices for passing on to farmers. In the words of Cristóbal Aguado, President of the centre, "our aim is to try everything on crops (almost 500 variables) so the risks remain here and farmers can avoid making mistakes." He said "in the short time we have been testing we have been wrong in varieties and treatments, which is normal, but we can recommend alternative practices to farmers." The second objective of the Finca Sinyent (25 hectares, nearly 3€ million investment and up to 7€ million when the project is finished) is to work "on the development of sustainable agriculture

Welcome to Formentera, the island that wants its cars electric

The tiny Mediterranean island of Formentera has taken delivery of six electric cars as part of an ambitious plan to be the first island in Europe to banish traditional cars from its shores. At 12 miles (19km) from end-toend and with a population of about 12,000, Formentera is the smallest of Spain’s Balearic Islands. In summer, however, 15,000 cars are in circulation, arriving by ferry or rented on the island. The six e-Mehari cars were donated by Citroën as part of a pilot scheme for transport on the island to be all electric, although no target date has been set. As the distances are short, the e-Mehari’s range of 124 miles is not an issue.

For two years, since May 2014 Jávea has been subject to an emergency drought situation. The town has benefited from the desalination plant, but the wells in the municipality and 5 wells in Pedreguer are in a worse situation than last year. A pressure regulator has been installed by AMJASA in the area of Pinets (near the desalination plant) to establish some four kilos of pressure down near the Arenal and Port against the seven currently in these areas in order to

ensure supply in other areas of the town. Fines and penalties are planned for cases of "water theft" (last week six actions were taken on illegal practice). There is a need to strengthen inspection to detect illegal practises as well as information campaigns and public awareness to try to achieve savings of about 10% of daily consumption per inhabitant.

Poundland comes to Benidorm

Poundland trades as DEALZ in Spain and has opened a new store at the La Marina shopping Centre between Benidorm and Finestrat. Dignitaries, including the Mayor of Finestrat and the Spanish Consul joined senior staff from Poundland UK for the opening of the 6,000 square metre shop. Alvaro Villamiz, director of Dealz España, said the location was perfect for British expats, Spanish and tourists alike and that DEALZ are very excited about this new store and hope to continue expansion in Spain. The shop stocks 3,000 branded products, including food and drink, home, garden, children’s products and toiletries. All are priced at €1.50 and all are quality brands, many familiar to the British living over here or just visiting.

Charlie Reese, a retired reporter for the Orlando Sentinel, has hit the nail directly on the head, defining clearly who it is that in the final analysis must assume responsibility for the judgments made that impact each one of us every day. It's a short but good read. Worth the time/worth remembering!

545 vs. 300,000,000 People - by Charlie Reese

Politicians are the only people in the world who create problems and then campaign against them. Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits? Have you ever wondered, if all the politicians are against inflation and high taxes, WHY do we have inflation and high taxes? You and I don't propose a federal budget. The President does. You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does. You and I don't write the tax code, Congress does. You and I don't set fiscal policy, Congress does. You and I don't control monetary policy, the Federal Reserve Bank does. One hundred senators, 435 congressmen, one President, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country. I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank. I excluded all the special interests and lobbyists for a sound reason. They have no legal authority. They have no

ability to coerce a senator, a congressman, or a President to do one cotton-picking thing. I don't care if they offer a politician $1 million dollars in cash. The politician has the power to accept or reject it. No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes. Those 545 human beings spend much of their energy convincing you that what they did is not their fault. They cooperate in this common con regardless of party. What separates a politician from a normal human being is an excessive amount of gall. No normal human being would have the gall of a Speaker, who stood up and criticised the President for creating deficits. The President can only propose a budget. He cannot force the Congress to accept it. The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. Who is the speaker of the House? Paul Ryan. He is the leader of the majority party. He and fellow House members, not the President, can approve any budget they want. If the President vetoes it, they can pass it over his veto if they agree to. It seems inconceivable to me that a nation of 300 million cannot replace 545 people who stand convicted - by present facts - of incompetence and irresponsibility. I can't think of a single domestic problem that is not traceable directly to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist. If the tax code is unfair, it's because they want it unfair. If the budget is in the red, it's because they want it in the red. If the Army and Marines are in Iraq and Afghanistan it's because they want them in Iraq and Afghanistan . If they do not receive social security but are on an elite retirement plan not available to the people, it's because they want it that way. There are no insoluble government problems. Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power. Above all, do not let them con you into the belief that there exists disembodied mystical forces like “the economy”, “inflation” or “politics” that prevent them from doing what they take an oath

to do. Those 545 people, and they alone, are responsible. They, and they alone, have the power. They, and they alone, should be held accountable by the people who are their bosses. Provided the voters have the gumption to manage their own employees. We should vote all of them out of office and clean up their mess.

Valencian economy expects to be hit by Brexit

In 2015, Valencian exports to the UK reached nearly 3000 million Euros, in addition 2,700,000 British tourists visited the area comprising some 35% of foreign tourists in the community. The introduction in tariffs and fall in the pound would have negative impacts, according to ABC.

Reservoirs at their lowest levels for 8 years

Lack of rain in the Valencian community since the start of the hydrological year has left reservoirs at the start of Summer at their lowest levels in the last eight years. According to the Hydrographic Confederation of Júcar (CHJ), midmonth there were 1,295, 226 hectometres less water than last year, equating to 38% capacity. The cost of extra irrigation to farmers is expected to be €10 million.

The Tangled net of Recreational Fishing

There is a long list of regulations regulating recreational fishing. Some types of fishing are strictly prohibited: Spear fishing using SCUBA gear, fishing with rod and line in protected areas; fishing in Port harbours; spear fishing at night; collecting sea urchins without a licence; selling your catch; Other types require the purchase of a licence. These include: Spear fishing without SCUBA gear, fishing from a boat and (controversially) fishing from the beach. As regards fishing from the beach, until recently a licence was not required for this activity. After the licence was made mandatory in 2014 (fine up to 1200€) the Valencia Anglers Association appealed against it, resulting in the Valencia superior court ruling in favour of the anglers. The Ministry of Fisheries and Agriculture has appealed to the Supreme court. To date there is no information on the outcome of this appeal. Licenses can be obtained by completing an On-line form, paying at a collaborative bank and sending off the form and requisite documentation to the Ministry of Agriculture. Alternatively you could take the documentation to a PROP office. The closest one is in Benidorm.

The Red Cross has set up a web page showing state of beaches for which it is responsible on the Web. These include those in Jávea. Unfortunately the site

Start of the tourist season sees fall in unemployment

In the Comunidad Valenciana the number of unemployed decreased by 12,067 people last month and 42,960 over the previous year, to a total of 438,663. The sector where the lowest unemployment last month was services, with 8,143 fewer unemployed, followed by industry (2153), construction (1,107) and the group without previous employment (-760), Nine out of ten jobs are temporary.

Spanish peaches and plums for China

The Chinese Government has sent officials from the Ministry of Agriculture to Spain review the conditions of production, harvesting and packing of stone fruits, to organize the fulfillment of the established phytosanitary protocols and prepare the first shipments to that country. Last April the governments of Beijing and Madrid signed an agreement that opens the doors of China to stone fruits (peaches, nectarines, plums) as they have already been doing for citrus for some years. The first fruits to be authorized to export to China have been peaches and plums, Spain is the first country in the world authorized by the Executive Beijing to send peaches.

Jalón and Lliber drinking water crisis

Jalón has drinkable water in only 30% of its supply network, and in Lliber it's only in the pueblo. A couple of months ago both locations had to ban human consumption of tap water due to turbidity and the high level of aluminum. Local wells are extremely low and although they receive water from the Parcent treatment works, things will be difficult this summer. Lliber and Jalón have asked for supply from the Lucifer well (lust below Isbert's dam in the Barranco del Infierno) which currently supplies Calpe, but there is no prospect of a quick agreement. Jalón will be spending some 600,000€ renewing its network of pipes and meters, which will be a major challenge, but will reduce water losses through leaks. They are even looking at connecting to Jávea’s desalination plant at a cost of €20 million.

Investigation of unexplained defoliation of orange trees

The Department of Agriculture and Valencian Institute of Agricultural research is investigating why some orange trees are losing their leaves and yellowing in the Plana Baixa and other citrus growing areas. Having ruled out high concentrations of salt in irrigation water, pathogenic fungus, and excessive fertilisation, investigators think that it might be due to ailments in the plant's physiology or cropping patterns rather than pathogens. They are still investigating.

Bluefin Tuna return to the Marina Alta Coast

In the mid-nineties, indiscriminate fishing of bluefin tuna brought a brutal decline of the species as seen first hand in the fish markets of Denia, Xàbia and Moraira. Since then restrictions on capture, an annual quota system (which limits the total catch for each country, region and even boat) and extreme vigilance have enabled their recovery. As a result the International Commission for the Conservation of Tuna (ICCAT) the regulating body, has increased the quota for Spain for 2016 by 20%, to a total limit of 3,524 tonnes. By 2017 this share will

hopefully increase to 709 tonnes. It is reported that up to 40% of the tuna sold in Spain has a fraudulent origin. The European Parliament approved the final agreement on the Regulation that will from now on settle the multiannual recovery plan for bluefin tuna in the eastern Atlantic and the Mediterranean. According to the text "Member States will use transparent and objective criteria, especially the environmental, social and economic ones, for the national allocation of quotas, giving particular attention to the preservation and prosperity of smallscale, artisanal, traditional fishermen using traps and other selective fishing methods, and to the promotion of such methods."

First year of commercial fishing in San Antonio marine reserve yields 1,900 kilos of fish

The first year that the Department of Environment has authorised commercial fishing in the marine reserve of Cap de Sant Antoni has enabled the fishermen guilds of Denia and Javea to capture about 1,900 kilos of fish valued at 10,400 euros. Qualifying Recognized Overseas Pension Scheme (QROPS)

Since the introduction of the Qualifying Recognized Overseas Pension Scheme (QROPS) in 2006, there have been a number of product changes / updates as well as a number of new product providers vying for your business. Her Majesty’s Revenue & Customs (HMRC) have continually reviewed legislation and have even gone so far as to close schemes and some jurisdictions that did not, for whatever reason, fully meet their rules and regulations. In 2014, HMRC had to confirm that no further schemes would be removed from their approved list, in order to ‘calm’ the market.

Although HMRC permit members of UK pension schemes to transfer their pension assets to an overseas scheme (QROPs), they are very specific regarding the requirements. A transfer of a member’s benefit rights in a registered pension scheme to an overseas pension scheme is classified as a recognized transfer if the receiving scheme is a QROP. This makes the transfer an authorized payment and does not give rise to any tax penalties. For a recognized overseas pension scheme to be a qualifying recognized overseas pension scheme, the scheme manager of that scheme must have: Notified HMRC that the scheme is a recognized overseas pension scheme, and provide evidence of that if required;

Informed HMRC of the name of the country in which the scheme is established. If this is not an EEA Member State or a country with which the UK has a double taxation agreement that includes exchange of information and non-discrimination provisions, the scheme manager must also provide evidence that scheme meets certain specific requirements;

This would not be very expensive. 237 diving permits had been issued compared to 1455 in 2014, and licensed divers were valuable in helping to control poaching. Xàbia and the Ministry of the Environment finalized a cooperation agreement under which clubs can apply electronically for diving permits through the Helpdesk (Portal del Clot), with a response from the Ministry within two or three days within two or three days. Also the clubs can manage a quota system through software.

Civil war air raid shelter to be recovered for visitors

Experts suggest it will be feasible to recover the entrance and first 6 metres of the Civil War air raid shelter in La Caleta in the Port. Built in 1938 and closed for 40 years. They plan to replace the surface slabs which are slipping and unstable and remove the low brick wall in the front. Most of the 20 metres of tunnels are dangerously unstable. This shelter is one of the few preserved examples of architecture from the Civil war, and the only one in public hands.

In 2012, the European Union made moves to implement new rules on the labelling of vehicle tyres for sale. Much like washing machines or fridges, and even properties for sale, an easy indication of the tyres characteristics would be displayed on the label, enabling the buyer to choose their product based on such elements as efficiency, safety rating and noise.

Noise level is also included in the tyre rating, again, this can be determined by other factors such as the road itself. In many places, so called “quiet tarmac” has been installed to reduce noise, but the tyre noise rating is based on an average. When buying new tyres, always check the labelling system to ensure you know the quality of the tyres to be installed on your vehicle. A rare “silver” 2p coin that was almost discarded as a fake after being spotted in a charity collection tin has just sold at auction for £1,350 – almost 70,000 times more than the actual value of the coin. The coin, which was found by Royal British Legion volunteers in Wiltshire, was confirmed by the Royal Mint to have been struck in error, having been set in the nickel-plated steel used for 10ps as opposed to the usual copperplated steel. It was found in a Poppy Appeal tin by Charles Vernon, treasurer of the legion in Malmesbury, who noticed the abnormal coin while he and his wife were counting donations. Assuming it to be a fake, Mr Vernon took it to the bank to be destroyed. “When we tried to put it in the 10p pile it didn’t fit” he told the BBC. It wasn’t until bank staff told him the 2p could be worth a fair amount more than its face value that it was sent to the mint for inspection.

A rare mistake The rare coin was apparently the result of an unstruck 10p coin finding its way into the press and being printed in a 2p design – an error which rarely happens due to the strict quality control at the Royal Mint. Using X-ray fluorescence spectrometry – a process used to examine metals, glass, ceramics and building materials – the mint confirmed that the coin was the result of an error in production “whereby a nickel-plated steel blank, which would normally be used in the production of 10p pieces appears to have been struck between 2p dies,” the mint said.

I attended the opening evening but thought it was slow starting, in comparison with the first, organised by Helena Ter Velde and the Committee chaired by Ana Vasbinder, following the concept visualised by Mayor Juan Bautista Moragues Pons, 21 years ago. This year a late start was expected, as Mayor José Chulvi had the meeting of Councillors at 8pm, yet he was due to open the Festival an hour later. The Festival was open to the public at 6pm and Ann and I plonked ourselves down near the British tent, as we thought we might meet more people we knew or recognised. Later in the evening a Mariachi Band would be playing and we were treated to a sound check that I

thought might lead to permanent deafness. I was told that, half way back, it was quite pleasant (bearable).

SUMMER IS REALLY HERE

Well Summer is well and truly here, hot sunny days and next to no rain. I rely on a good downpour from time to time to wash the roof of my car. I am reluctant to take it into a carwash because when we first bought the Doblo and took it into a carwash, the machine broke off the back wiper blades. I know some of you are saying, "Why don't you take them off before going into the carwash!" Point taken, but I usually find a quick wash with a sponge and bucket keeps it fairly clean, but I can't reach to clean the roof! The main trouble is that when I park on the unmade car park outside our apartment block (which is quite often), each car that passes mine, sends up a cloud of dust which settles all over my car, so I generally have to wash it two or three times a week. My brother-in-law Pete asks each year if Clive and I are going away during the Summer for a holiday, but as I explained, when you live in Paradise all year round, what is the point in having the hassle of going away, paying all that money out when Clive will probably spend most of the time in the hotel room working! It maybe because we are getting older, but the only time we go away now, is for a Church meeting, or something similar. Mind you, Clive did take me away at the end of September last year for a week to celebrate our 55th Wedding Anniversary, and as a special treat he booked tickets to the Cliff Richard concert in Sheffield. On the subject of Cliff, I am delighted he has been cleared of all charges, because of lack of evidence. The trouble is mud sticks.

Years ago when we owned two apartments in Avenida Lepanto in Jávea Port, we enrolled with a company that arranged house swops. We lived in the apartment on the third floor, but kept the fourth floor apartment (directly above us) for visitors and family to use when they were visiting Jávea. It was very convenient for us because we didn't have to pack away private papers and belongings etc, knowing that strangers were going to use our home, we advertised the apartment on the fourth floor as our swop. It is a lovely apartment, three large double bedrooms, two bathrooms, large refurbished kitchen and a large lounge. Off the lounge there are two balconies that overlook Avenida Lepanto and the sea. the keys to the other apartment with friends and off we went. Our first swop was for three weeks with a family from Amsterdam. They had a ground floor apartment on Prinseneiland, quite spacious but we never got used to the steep stairs. It was almost like climbing a ladder, but we found that most of the houses had steep stairs in Holland. We loved our new home, Clive was happy because there was a spacious office with a large desk, plenty of room for him to spread out all his work. He is not a walker and was quite happy during the time we were there to spend time in the office while I spent most of my time out at the shops or walking. I loved all the canals and the endless line of houseboats which were situated along the sides of the canal. I spent hours and hours just walking and chatting to people I met on the houseboats. One of the days I persuaded Clive to walk with me for a tour of the Anne Frank House. "How far is it?" he asked. "About half-an-hour's walk" I replied. So off we went. After about three quarters of an hour and still walking there, Clive was not a happy bunny. I am a power walker and my half-an-hour is not the same as Clive's steady pace. When we finally got there and found a huge queue of people waiting to go in we decided to give it a miss and go for a cruise of the canals instead, which we both enjoyed immensely. We are very happy on holiday, it wouldn't suit most people, but Clive is quite happy to see me go out on my own each day to shop or sightsee and I am quite happy to leave him in the office working. A perfect marriage! One of the things that amazed us was the thousands of bikes parked in a huge bike park next to the railway station while their owners were presumably out at work. There was floor after floor of closely parked bikes, similar to a multi-storey car park, but with bikes instead of cars. Guus and Ada, are good friends of ours and live about an hour's drive away and were happy to call and see us a couple of times a week and take us out for the day. We saw the beautiful scenery and the windmills, everything was so flat and so green. One of the memories I have of Amsterdam is when I had a safe key cut in one of the hardware shops I used to pass on my way to the supermarket. We had one key to our large safe we had hidden in our apartment on the third floor but we were afraid of losing it and not being able to open it. We used to handle quite

One Fiesta after Another

The dust is still settling from the Fogueres 2016 in the town yet preparations are in full swing for the magical fiesta of the Moors and Christians in the port, celebrations that will take over the streets with wonderful colour and terrific noise.

Carmen Torres for the Christians and the 2016 Captains from Filà Faciners, José Manuel Gracía and Mª José Fernández were joined by Mayor José Chulvi and Councillor Toni Miragall (Fiestas) as well as representatives from other fiesta associations in Jávea. From Saturday 16th July until Monday 25th July - one more day than usual - Jávea will be celebrating the Moors and Christians fiesta. The Junta de Fiestas wanted to use the feast day of San Jaime (Monday 25th July, the day after the weekend of gala parades) to celebrate and honour their patron properly and finally consummate the final location of the image of San Jaime in one of the enclosures of the municipality. The main events of that day will be a special mass celebration in the parish church in the port before the transfer of the image of the saint, in pilgrimage, to the chapel of the Residencia-Asilo Hermanos Cholbi where it will remain throughout the year. Another of the main changes is the traditional offering of flowers to the image of San Jaime and food donations to Caritas at the parish church of Loreto on Wednesday 20th July. This year, the event will be shared with the image of Mare de Déu de Loreto as a sign of good harmony between the two main fiestas of the port area and participants will make the offering to both images. The other new feature is the return of the visit to the Arenal beach area which will take place on Monday 18th July. Participants will be performing an informal parade along the Paseo Tenista David Ferrer, bringing the music and rhythm of the fiestas to the third nucleus of Jávea.

Q Oscar we are thinking about buying

a property in Jávea but have some questions about paperwork and contracts. It seems business in Spain is driven by a signed copy of everything which has to be in Spanish. Are there any pitfalls in not signing documents? If a contract for transfer of business for instance is unsigned can it be legally binding? Why does a person’s NIE number need to be given? Should one sign a document if there is no lawyer or notary present? Are there specific laws in place in property and business matters that dictate the signing and witnessing of papers?

A In Spain - as in the UK, it is

possible to agree a verbal contract with nothing in writing,which is legally binding. However the problem for both parties with this situation is one of evidence. How can either party prove what was said and what the terms of the agreement were/ For that reason it is not advisable to rely simply on a verbal contract as enforcing it in court would be difficult. Independent witness evidence could help but a contract with the agreed terms clearly stated, signed by both sides is much better. As we are in Spain, it is hardly surprising that such contracts are written in the Spanish

language. If the matter were to be disputed and result in court action it would be heard by a Spanish Judge who is entitled to expect that the document is written in the National language. If the contract is in two languages, it is the Spanish version which will always prevail. A contract written in the English language will be perfectly valid and enforceable if both parties understand English. However, if there is a dispute and the matter proceeds to trial, the contract would have to be translated Iegally by a juridical translator into Spanish in order to be used as evidence in a Spanish court. It is advisable that such a contract is translated and signed in both languages from the start because otherwise at trial, both parties could produce different translations of the same document with variations in the interpretation which suits their respective case, which can lead to problems. If you do not understand the contract then you should not sign it until someone independent (i.e. not the other party to the contract or someone acting for them) has translated it for you and if necessary explained it to you. Obviously throughout the course of our daily lives we have to sign a large number of documents from receipt of goods forms to contracts to purchase a property. It would be expensive and impractical to use a lawyer each and every time you sign anything and it is generally a matter of commonsense. However, it is better to err on the side of caution and the more important the document, the more advisable it is to obtain clarification.

An NIE number is normally requested when a transaction has fiscal or tax implications and it identifies the parties with certainty, for residents this is usually the same as the Residency Card number. A passport number could also suffice (although - in the UK - this changes each time you renew your passport). There are no laws which specify the method of signing a private contract. However, there are many important transactions which are often ratified by signing a deed (or escritura) in front of a Notary. Such documents do have to follow a prescribed format which the Notary is responsible for enforcing. For example, the Notary checks the identity and capacity of the parties before they sign and the deed is printed on special notarial paper. If one of the signatories does not speak fluent Spanish, they are required to have an interpreter who must explain the document to them and who themselves must be named in the document and must sign it. Examples of contracts which are formalised by way of Notarial deeds are, the purchase of a property, taking out a mortgage and forming a company. If your problem is different, send it to me. The Delicioso shop next to Casa Segura offered frozen rep-cooked meals (that are still purchasable from their Port La Cocina restaurant. Julie from Bar Picoteo in the Port was quick to spot an opportunity and bakes (and delivers if the order warrants it), Cottage Pie, Liver ad Bacon, Roast Chicken, Pucheros, Paella, Estofados, Potages, Chilli con Carne, Lasanga, Pastas, Canalones, Goulash and Curry. Other suggestions welcome. The portions are ample for ‘Desperate Dan’ but as we tend to eat less as we grow older, each dish can be sectioned to suit the eater’s need, and the remainder placed in the freezer for another day. For those with transport, the preordered meals can be collected from Bar Picoteo. A recent suggestion has been Roast Pork, Crackling, Stuffing, Apple Sauce, Mash Potatoes and Veggies. Each ‘plate’ costs 10€ and I was surprised by the weight of two Cottage Pies, that had been topped-off with cheese I sampled. Continued from page 18 Well the International Festival in Jávea is over for another year, and once again has been a huge success. Clive and I went on the first night from 6 11pm and thoroughly enjoyed our evening there. Clive spent most of his time talking to the other occupants of our table (we were sat outside the British tent), some were English and some were Spanish, but he managed to make himself understood. The music was very loud and I found it difficult to have a conversation but I was happy to watch the Valerie Jean dance school entertainment, and what a wonderful show it was. The older teenagers danced so professionally, but I loved the younger children as they tried to remember their steps and kept glancing at each other for inspiration, they were excellent. I was intrigued to watch a woman on the sidelines of the stage who danced every dance with them, obviously to remind the youngsters what they were supposed to be doing. She was a wonder to watch, and such energy. All the children and teenagers that performed on that first night deserve a good pat on the back. We have had a steady stream of people visit us at the Oasis Centre during the past month. Some come to buy cards from our excellent range at just 1€ each, some come in for advice, and some just call in for a chat. May I remind you that we sell the TV magazines for 1.20€ each, some of our readers may not be aware that we have them. Many of our customers reserve a copy each week to ensure we don't sell out, because sometimes they go very quickly. We also hold a Church meeting each Sunday at 11am with refreshments afterwards and everyone is welcome. Some of our Church members have returned to the UK for the Summer months to avoid the heat, but for those of us who brave the hot sunny days each Summer, I trust you have a peaceful July, and manage to keep cool - and most of all - avoid those horrid mozzies!

Dear Stephen Prior to the 31st March deadline I forwarded 80 completed Winter Allowance Application Forms to Wolverhampton by DHL. I know the 80 applications arrived as I have proof of delivery in respect of Applications by (names deleted in the interest of privacy). Standard letters of rejection are being received, but it is disingenuous for the DWP to impose a ONE MONTH limit on responses, at the same time as routing replies via MALTA, often reducing the response time to 7 days (saving your department money) but denying the applicant of the opportunity to undertake research. THIS IS INTENTIONALLY DETRIMENTAL to the Applicant’s rights. Each of the applicants was in receipt of a UK State Pension, based on contributions, and there is no provision in payment of the WFA to apply a means test. Instead, Spain is among those countries arbitrarily excluded because of their geographic location, when the National average temperature is compared with one of the warmest areas of the UK. The reason for the exclusion is flawed. It is the option of UK Citizens (for the moment) to exercise their right to relocate to any other EU territory, yet your Department is punishing those who choose to do so by moving to Spain. 95% of dwellings (and all of those occupied by British pensioners) have been built without insulation, often of shoddy building materials, and completely unsuitable for winter living. It was for that reason that those who would have automatically qualified had they remained in the UK, came to the Oasis Help Centre <www.oasiscentre.net> where we provided them with WFA Application Forms. This request to receive PROPER CONSIDERATION of their worth is currently in the following 26 names. (Deleted from this article) but others will have replied directly to the DWP. Applicants had been told that in the event of an (automatic) refusal, they would be entitled to apply to a First Tier Tribunal where their individual circumstances would be considered. The reply (the one I have was signed by Rob Lambert) replaced this right of

appeal to a First Tier Tribunal, with writing back to Mr. Lambert who had already decided that applicants would (as a result of appealing to Mr. Lambert) receive a similar rejection to their first. Applicants are being DENIED the LEGAL RIGHT to APPEAL to an Independent Tribunal. Is the DWP scared a Tribunal night find in favour of applicants, and the arbitrary geographic exclusion is flawed. France is equally excluded though temperatures in Northern France are equal with the cold weather of winter in the United Kingdom. The purpose of this letter, on behalf of the 80 pensioners for whom (free of charge) I sent the applications by DHL to Wolverhampton to ensure they arrived in time, is to ask that you reinstate payment to those who have been punished by your Department (following decisions by the Prime Minister and his colleagues) who claim to be subservient to EU rules when campaigning to stay IN the EU, yet chooses to disregard EU legislation relating to equality of Allowances throughout the EU by the country which has a duty of care and payment. Because of the time limit placed by your Department on responding, and the INTENTIONAL reduction of that period by your choosing to send mail to another EU member state via MALTA, I am copying this letter REQUESTING THEIR INTERVENTION to Ms Antonella SchulteBraucks in Bruxelles and Marianne Thyssen, of the EU Social Affairs and Inclusion unit. Firstly, I would like to take this opportunity to thank you for taking the time to discuss your concerns with me and it was a pleasure to speak with you. During our conversation we discussed The Department for Work & Pensions (DWP) security policy in relation to appointing a representative to temporarily act on a customer’s behalf. As a result of this, you confirmed that, at this stage, you did not wish to inconvenience the persons named in your letter by asking them to attend your surgery to provide written authorisation allowing DWP to correspond with you

for the purposes of the Winter Fuel Payment (WFP) dispute. It may help if I first provide you with some background information for the UK Government’s decision not to pay WFPs to DWP customers who permanently reside in Spain, as well as six other countries. Please be advised that regulations were put in place by the UK Government on 15 December 2014 for changes to entitlement to WFP, which became legislation on 21 September 2015. This means that, from the winter of 20152016, WFPs will not be paid to State Pension customers living in a European Economic Area (EEA) country (and associated territories) where the average winter temperature is higher than the warmest region of the UK (South West England). This temperature is 5.6°C. This resulted in State Pension customers who permanently live in Cyprus, France, Gibraltar, Greece, Malta, Portugal or Spain not being entitled to a WFP, as these countries have average winter temperatures higher than 5.6°C. Please note that the Spanish Government treats the Spanish Islands in the same way as mainland Spain. Therefore, the UK Government must do the same to adhere to European law. The Spanish islands: the Canary Islands, the Balearic Islands and the areas of Ceuta and Melilla, have been included in the calculation of the average winter temperature of Spain. The average winter temperature for Spain is 7.3°C with these Islands included and 7.2°C when they are excluded. Therefore, as the average winter temperature in Spain is higher than that of the UK, State Pension customers who permanently reside in Spain are not entitled to the WFP from the winter of 2015/2016 onwards. I would now like to turn to the issue of processing the requests for review made by the persons named in your letter. Please accept this letter as confirmation that we are in the process of contacting the customers named in your letter to provide an explanation why they are not entitled to a WFP for the 2015/2016 qualifying period. Please note that we have accepted your letter as your request for a mandatory reconsideration for your own decision and you will be informed of this mandatory request outcome in writing in due course. I would now like to provide you with written confirmation of the process we adopt when a customer thinks that a decision is wrong and they wish to request a review. Whichever method a customer chooses to lodge their appeal, they will need to also provide HMCTS with written consent confirming. whether they have appointed a representative acting on their behalf for the appeal. When submitting their appeal the customer must include a copy of the formal Mandatory Reconsideration Notice which was sent by DWP. If a customer does not do this the First-Tier Tribunal may not be able to consider the appeal until the customer provides a copy to them, which will delay the process. Customers living outside of the United Kingdom should send their appeal to the HMCTS office, which would normally handle their appeal based on: • The customer’s point of entry into Great Britain if they have opted for an oral hearing, or • The place where the customer was previously resident in Great Britain if they do not intend to attend the hearing. All of the information regarding how to make an appeal is contained in the Mandatory Reconsideration notice sent to customers. Finally I would like to respond to your concerns about the delays for receipt of correspondence issued by this office to the customers named in your letter. It may help if I explain that DWP uses an external post provider which handles all letters which are sent by Newcastle Pension Centre (International Group) to our overseas customers. This column turns the spotlight on otherwise ‘ordinary’ people who chose a job, hobby or profession of which most might remain ignorant - people who brighten the life of our village. Last month we turned on the Spotlight and featured David Cruanyes who talked to us about how he became an official sponsor of the Xábia International Festival.

This month our Spotlight switches to Maria Jose Gisbert Mulas whose story is one of sadness and success. As a child growing up, Maria Jose knew her mother was fighting a battle with cancer but her mother always appeared healthy, happy, strong and it seemed would live forever. Conchi Mulas was a strong woman who despite having cancer led a normal life. She did not talk about her illness to anybody but instead focused her attentions on bringing up her daughter and building up a beauty salon business in the town. Written by Ian Amer

Maria Jose thought the world of her mum and believed that she would continue to work in the beauty salon until she reached her retirement age. With this in mind and having no interest in following in her mother´s footsteps, Maria Jose decided to follow her own dream and pursue further studies in teaching but a turn of events would catapult her into a business where failure was not an option. Maria Jose was born on 9th January 1985 in a private hospital in Gandia to Jaime Gisbert Ern and Conchi Mulas Lopez. Mari Jose was not sure why she was born in Gandia as both her parents were from Jávea. After passing her school exams at Colegio Maria Inmaculada, Jávea, Maria Jose decided in 2005 that she would study for a career in teaching and so she enrolled on a two year teacher training course where she attended the Universities of Valencia and Barcelona. Maria Jose commented, “ My dream job was to become a teacher in main stream and as you know a 20 year old does not always think through their decisions carefully. I did not realise the amount of studying involved and how it might affect my private life but at the time I felt being away from home would be good fun and exciting” she continued. “Instead of listening to my heart which was telling me to find a job in Jávea, my head was telling me the opposite which at the time made more sense to me. I did not realise how difficult studying away from home was going to be as all I could picture were my own illusions about University. To be honest my thoughts were towards having free time and parties but instead I found the opposite and my emotions of being away from my family and friends made the course work harder and the days and weeks appear longer.” Maria Jose did complete most of the course but with her emotions running high she decided that university life was not for her and so she decided in 2007 to return to her home in Jávea. When she returned home her intention was to find a teaching job in a nursery and spend time with her friends, typical of any young person. It was not long before Maria Jose found a job in a local nursery as a teacher but after a while she wanted to earn more money

but could not find enough hours. She decided that teaching in nursery did not offer the salary and looked for another job where she was offered a sales assistants job in a local sports shop. She decided to take the job because it paid higher wages than the nursery although Maria Jose admits it was a crazy move because she was not sporty and knew nothing about the sports market or the retail industry. With the help of her boss she began to learn the trade and how the sports shop worked and very quickly she demonstrated a natural flair for organising the shop and the management of staff. Within 6 months of starting out as a fresh faced girl with no retail experience her boss was so impressed with her work that he decided to transfer her to a branch in the Arenal where she became the manageress. In 2008, she decided that the hours in the sports shop were very long and the chances of earning more pay was very unlikely. Her mother, Conchi, suggested to Maria Jose that she should work with her as a trainee beautician but Maria Jose did not want to do this until her mother offered a wage that she could not refuse. Maria Jose took on the job as a beautician although this line of work was never her intention. Once she began working in the salon, her mother sent Maria Jose to an academy in Denia where she started to study beauty and make up but after a few lessons she felt that her mother was the real expert and that she would be the one to teach her much more. After leaving the academy, Conchi started teaching her daughter the grass roots of beauty and little by little her daughters knowledge about the beauty market and products developed. Maria Jose progressed from manicures and pedicures to learning the methods of waxing where firstly, she learnt about the art of applying warm wax to the body and as she developed confidence and the skill she was allowed to use the hot wax treatment. Eventually Maria Jose had learnt some of

her mother´s craft and everything seemed to be going well for mother and daughter, when in 2010 sudden changes to the Continued on next page

business had to be made. It started when Conchi began feeling more tired than usual and she would have the need to go home and rest. As the weeks and months passed Conchi became bedridden and she knew that the cancer she had been fighting since her diagnosis in 1995 had now taken the advantage against her. Maria Jose was now 25 years old and she could see that her mother was finding it difficult to cope with the running of the salon and so she decided it was time to step in and run the business herself. This was a very brave move for the young Maria Jose who had to show that she had the courage and mettle to take on the responsibilities of running a business but the important question in the back of her mind was the ability to fill her mother´s boots and maintain the high standards of

work that the clients came to expect from which her mother had set the bar. To make her mark on the business, Maria Jose had to teach herself how to complete the business paperwork, accounts, ordering of products, answering the phones and organising the clients therapies with the staff and also to become an expert in applying all the beauty treatments that the salon had to offer. With a brave face she went into the salon each day, acting in a bubbly and carefree manner showing she had the professionalism but she had to get the staff and clients to believe in her otherwise they may disappear and she would have lost the business. The inexperienced business woman managed to face up to the everyday pressures of the business although she lost contact with many of her friends as the time had now come for her to sacrifice certain things and she had to grow up fast as this was her mother´s business and she had to protect it. She remembers some nights being so tired that when she went home she could do nothing but cry herself to sleep. After being bedridden for 9 months and in 2010, Conchi could no longer find

the strength to continue her daily fight which she had done with bravery and courage for so many years but this was going to be the time that Conchi would succumb to this dreadful illness. Being a very sad time and fearing her world had now crashed beyond repair, Maria Jose knew she was now all alone. There would be no more motherly inspiration or advice to receive about the business, nobody to ask what was right or wrong, but from within herself came a spirit of positive energy which burned inside like a torch in the night. Something inside of her gave her the inspiration to carry on and she would now focus on making the beauty salon her mother´s legacy where failure was not an option. Against all the trials and tribulations of taking over a business she is now successfully entering into her 6th year. Maria Jose commented “The beauty salon was a gift from my mum and God because he made me see that walls can be torn down and mountains can be climbed. Although mum is not with me I feel she is inside of me every day. If mum is looking down on me then I am sure she is very proud because she once had a daughter who wanted to become a teacher and through circumstance made a success out of something she created. I am now following in her footsteps as a beautician and a businesswoman which I never thought possible.” The beauty salon is fully equipped with all pampering mod cons such as a Presotherapy machine that gently massages and expels any built up fluids which is brought on by the summer heat. She also related to the fact that years ago a woman would visit a hairdresser and a man would get his haircut from a barber. Today it is common for both men and women to pop into the hairdressers and sitting side by side we have our haircuts together and so why not have a unisex beauty salon? Before leaving the salon I thought I would ask Maria Jose for some trade secrets that I could take advantage of. She said summer is here and everyone will be wanting to lay on the beach and catch the sun but before doing this you should make up a home-made exfoliation mixture. First mix some fine cooking salt in a bowl with almond oil. After making the mixture take a shower and then rub the mixture all over your body. As you rub the mixture over your skin the grains of salt will remove dead skin while the almond oil acts as a moisturiser. After applying leave the mixture on for about two minutes as this will give the almond oil time to soak into the skin. When the time is up take another shower and when finished gently pat yourself dry with a fine cotton towel and then apply a quality body milk lotion all over the body. This method will rehydrate your skin and within reason you should be able to sunbathe without drying out too much. Warning please take precautions to protect yourself against the sun by using a quality suntan lotion as the mixture we have suggested is not intended as a sunscreen. Concluded on page 26

Roughly chop up the mint leaves to release the fresh mint fragrance and add to the mixture. Mix well and apply the paste to the face and leave it on for 20 minutes. POLITICAL INDECISION

• Best-case scenario: Spain will have a new

government by early August. • If parties cannot agree coalition accord, process could drag on longer. • It will be a brave fool who accepts the David Cameron “Poisoned Challice” and activates Article 50 to take UK out of EU, or fails to accept the 52% vote of REMAINERS, and tries to suggest there have breen EU compromises. Teresa May and Andrea Leadsom want the job. Given that no party partipating in Spain’s 26th June general election won an absolute majority of 176 seats in Spain’s 350-member Chamber of Deputies, the country’s political parties are now jockeying to come up with coalition formulas that will deliver enough seats to allow either the conservative Partido Popular (PP) or the Socialist party (PSOE) to govern Spain in coalition for the next four years. No announcement is expected for several weeks, since by law Congress will not be seated until 19th July, after which the lower house of Parliament must go through set administrative and protocol procedures prior to Spain’s Head of State, King Felipe VI, selecting a candidate to stand for investiture vote before the full Congress. The entire process of electing a new Spanish Prime Minister will take at least until the end of July or early August and if the parties cannot come to a firm agreement, as was the case in the negotiating process following the 20th December general election, it could drag on through the summer and into September. Here’s how the best-case scenario shapes up: 19th July: ► At 10:00 am, both chambers of Parliament convene, Deputies and Senators take their seats ► First order of business: Elect President and members of the Mesa of both Congress and Senate ► Authorise legislative work in July and August (normally, Parliament not in session) ► Decide seating arrangement for parliamentary groups 20th-25th July: ► Head of State, King Felipe VI, begins round of contacts with parties to ascertain their preferences regarding formation of a new government

holiday period as opportunist thieves are operating in our area, Statistically the rates for burglaries do increase amongst our residents during the summer time as for some of the reasons we are out and about for longer periods of time than in the winter. Carl is a respected figure in home security and is often called out by the local police and Guardia Civil where he is occasionally asked to legally break into properties to assist the police with their work, or to change a lock after an unwanted guest has paid a surprise visit and made off with a bag of swag from the home and in most cases, the value of stolen property is often of low value but the damage to repair the property can be significantly high and time consuming. Sitting at a table in a local bar, Carl orders the coffees while slipping out a laptop from his bag. He invites me to watch his film that his security surveillance camera had picked up only a few weeks ago. Carl switches on his laptop and commands the video file to play where I begin watching a crisp colour HD image of a front door to someone’s home in Toscal, Jávea. The security camera time and date is displayed in the bottom left hand corner of the screen and it shows the film had been taken on Friday, June 10th 2016 at 11:07am and so many seconds. MORE MONEY FOR OVERDUE PROJECTS

The City Council special committee of accounts, approved a modification of loans worth 963,000 €uros to finance City projects and public works, of which 775,600 €uros is claimed to be the positive remaining balance from the New pumps, filters, lights, previous legislature, and spent on timers etc. financially sustainable projects , explained Urban Councillor Paco Torres. with metal security shutters. From the right hand side of the picture a man appears, but first we only get to see his back until he turns sideways as he casually looks up and down the building. The thief looks for any security cameras and alarms but Carl tells me they are always discreetly concealed. On cue the man turns towards the camera revealing a full faced portrait of himself. Without any hesitation he bends and picks something up from the floor and uses his body to obscure the locked barred gate which is the first line of security before the front door. He fiddles around and in 2 minutes and 25 seconds, according to the camera time lapse, he opens the locked gate. The next part to be tackled is the main door and he turns his back on the camera as he focuses his attentions on the main door. Within 1 minute 6 seconds the door has been opened. He is in the house for at least twenty minutes before making his escape. Being inside for this long may not be that unusual as we all think of a quick in and out but it is possible he had been watching the recurring habits of the owners for a while and knew how long he had. We are also creatures of habit and some of us like to inform people on what we are doing, when and for how

long and therefore criminals can use social media sites to their advantage. The next set of frames sees our thief leave the house carrying a plain white plastic bag of ‘swag’, including a set of car keys. He closed the main door before leaving and then closed the barred gate. The owners returned later that day and thought they’d simply forgotten to lock up, with the burglary undiscovered for several hours until the camera images were replayed. Happily, the thief was caught near Benissa and apprehended by the Guardia Civil. Unfortunately we cannot confirm if the home owners had all their property returned but it is thanks to Carl’s video footage and discreet camera surveillance mounting that the thief will be proved guilty. We also understand the court case is due imminently in Denia and it is for this reason that we are unable to show the still photos of the thief. Carl says that most burglaries and robberies are committed by opportune thieves, to reduce the risk, remove items like tools to a place of safety. Carl offers free and unbiased advice, and will demonstrate his low cost (but highly effective camera surveillance system) called the Abus Smartvest which is a plug and play system. All you need is any internet / wifi access and you can secure your home with no installation costs or monthly subscriptions. You can stream and view live video data to your Android or smart phone which gives many benefits. Should someone try to enter your property you can alert the police whether you are in Spain or the U.K. Video footage can be used in court to convict offenders and so you should seriously consider

Valencia offers Protection

The Valencia Culture Council has approved protection of Windmills on La Plana and the Fisherman's Cliff, in response to a request from Jávea's Mayor. The 'Fisherman's Cliff" allowed anglers to be lowered towards the surface of the water, on a scaffold platform, to fish in the crags and cliffs of the coast between Cap de Sant Antoni and the Morro de Toix.
