BACKGROUND PROJECT DESCRIPTION: Corey Abrams requests approval of a home business permit to operate a Short-Term Rental at 814 N. Osage Street.

PROPERTY HISTORY: The single-family residence, located at 814 N. Osage Street, was built prior to World War II. It was built as a single-family residence. The property is currently a long-term rental but the owners will transition to a short-term rental.

PHYSICAL CHARACTERISTICS OF PROPERTY AND PROPOSAL: The 988-square foot, beige, story-and-a-half, single-family residence lies on an 8,712-square foot lot. The house has a living/dining room, kitchen, bathroom, three bedrooms and front porch on the main floor. The top-floor/attic will not be used by the guests. The basement is unfinished. There is a two-car wide driveway accessed from Mill Street.

The applicant would like to use this property as a Short-Term Rental to be listed on AirBNB.

CHARACTERISTICS OF THE AREA: The surrounding single-family neighborhood features houses constructed around the same time as the applicant’s property. The property has frontage along both S. Osage Street and W. Mill Street.

PARKING: The house has a two-car wide driveway. Two cars could be parked on Osage Street, but it is busy and narrow. The applicant will need to repair or repave the existing driveway. Parking on Mill Street would be a better option, plus more vehicles could park there.

UNRULY GUESTS/SECURITY: If noise levels exceed 79dB for more than 5 minutes, the Minut device will notify the applicant. They will contact the guests and give them the opportunity to rectify the noise issue. If they do not, the applicant will contact the police to handle the situation.


BACKGROUND SHORT TERM RENTAL REQUIREMENTS: The applicant must address the following topics: • • • •

Noise monitoring – The applicant will be using a noise monitoring system called Minut. Trash Removal - Trash pick-up will lbe scheduled with Ted’s for a weekly pickup. Property listing - The property will only be listed on AirBNB. Business operations/security – If noise levels exceed 79dB for more than 5 minutes, the Minut device will notify the applicant. They will contact the guests and give them the opportunity to rectify the noise issue. If they do not, the applicant will contact the police to handle the situation. City’s Short-Term Rental checklist – The form was completed by the applicant covering licensing, future inspections, insurance, onsite information posting, and so forth. Fire safety – A fire evacuation plan had been submitted along with floor plans of the house. The fire escape plan must also be posted per Code requirement. City inspection - The property shall pass the Initial Short – Term Rental Fire and Life Safety Inspection. There are no other Short-Term rentals within 500 feet, therefore this application follows the density limitations of the City Code.

Recommendation Staff recommends approval of this Short-Term Rental with the following Conditions: 1. The Short-Term Rental shall obtain a business license in accordance with the City Code and comply with Article 3, Chapter 5 of the City Code. The occupation license number shall be listed on all advertisements and online platforms. 2. The business must comply with all safety and other standards established by Section 14-424 of the Unified Development Ordinance. 3. The maximum occupancy of the premises shall be limited to six (6) adults and ten (10) persons. The top floor/attic, will not be used by the guests. The maximum number of bedrooms shall be three (3). 4. The noise monitoring system shall be installed and activated in a central location in the house, the Good Neighbor Guidelines, evacuation plan and other notices must be properly posted, prior to approval of the business license. 5. Repair or repave the existing two-car driveway.
