INFORMATION

The Circuit Attorney of the City of St. Louis, State of Missouri, upon information and belief, charges that:

Count I The defendant, in violation of Section 568.050, RSMo, committed, acting with Jessica Blackburn, Mark Shelton and

Justin Wright, the class A misdemeanor of endangering the welfare of a child in the second degree, punishable upon conviction under Sections 558.011 and 560.016, RSMo, in that on or about July 10, 2011, in the City of St. Louis, State of Missouri, the defendant acted with the co-defendants with criminal negligence in a manner that created a substantial risk to

the life and body and health of K B. (dab: 2/9/11), a child less than seventeen years old, by leaving the child in a hot car alone without adult supervision.

Count II The defendant, in violation of Section 568.050, RSMo, committed, acting with Jessica Blackburn, Mark Shelton and

Justin Wright, the class A misdemeanor of endangering the welfare of a child in the second degree, punishable upon conviction under Sections 558.011 and 560.016, RSMo, in that on or about July 10, 2011, in the City of St. Louis, State of Missouri, the defendant acted with the co-defendants with criminal negligence in a manner that created a substantial risk to

PROBABLE CAUSE STATEMENT

DATE: July 13, 2011 I, Doug Lindhorst DSN 7979, a law enforcement officer for the City of St. Louis, State of Missouri, knowing that false statements on this form are punishable by law, state that the facts contained herein are true. 1. i have probable cause to believe that Jessica L Blackburn, a W F, Age: 30 DOB: 12/8/80, committed one or more criminal

2. The facts supporting this belief are as follows: An investigation revealed that at approximately 8:00pm on July 10, 2011 the defendants drove to Fazoli's restaurant at the

--above-Iocation-togetherwith-three-children:-a-four-month-old~-K~B~(dob:2/'i/11tand-twin-boys;-Ke~K-:and-Ka~K-:(dob:---9/28/09). Defendant Jessica Blackburn is the mother of all three children. The three adults left the children in a 2001 GMC Savanna alone while they went inside the restaurant. The van was not left on, the air-conditioner was not on, and only one window was left down. There were no car seats in the van for the twins. The defendants placed an order to go for food and drinks, including a kid's beverage, and sat down in a booth. The adults drank the beverages, including the kid's beverage, and ate breadsticks while awaiting their order. The defendants left the three children in the van for approximately 15 minutes before returning to the van. A metereologist, Dave Murray of Channel 2 news, reported to my Sargeant that at the time (approximately 8pm) the temperature outside was 95 degrees with a heat index of 113 degrees. A manager at the Fazoli's notified 911 for a child left in a hot car alone after an employee and concerned citizen reported noticing one of the twins standing in the driver's seat and honking the horn for an extended period of time. Witnesses reported to me that none of the defendants checked on the welfare of the children during this time until immediately prior to my arrival on scene, though Jessica Blackburn acknowledged in the presence of an employee that she could hear the child honking the horn as if to get her attention. When I arrived, I found the three children crying, appearing to be dehydrated, and sweating profusely. EMS Medics took the children to the hospitaL. Medical records report that the children were diagnosed with hyperthermia. They were dehydrated and vomiting from heat exposure.

Jessica Blackburn has the following prior conviction: 08SLCR01225-01 from St Louis County for Robbery in the Second Degree where in she plead guilty on February 13, 2009 and received a 5 year sentence in MDC pursuant to 559.115. She was subsequently placed on probation for a period of 3 years. She is on probation to Judge Steven Goldman until approximately May of 2012.
