In specific, the court indicated that with the definition of subluxation complex, “an authorization to diagnose neuro-physiological aspects of the system is not consistent with the explicit authorization to diagnose only the ‘biomechanical condition’ of it.” It was reported by the TBCE that it appears that it was the specific language “...but not limited to…” that the judge objected to. Steps to remedy this concern are already underway and the appeals process moves forward.

T h e Te x a s M e d i c a l Association and the Texas Medical Board initiated the suit and the Austin American Statesman reported that "the [medical] doctors argued that chiropractors can't diagnose patients because the word "diagnose" isn't mentioned in the law. Judge Yelenosky, however, disagreed. “The statute authorizes chiropractors to 'analyze, examine or evaluate' and therefore 'diagnose' certain conditions…” the judge has said. The Statesman reports:
