Guardianships TEMPORARY (EMERGENCY) GUARDIANSHIP
Pursuant to NRS 159.0523 and/or 159.0525, a petitioner may request that the Court appoint the Washoe County Public Guardian's Office as Temporary Guardian for the proposed ward or a referral for temporary guardianship may be made directly to the Washoe County Public Guardian. The procedures for referral and assessments in permanent guardianships apply to temporary guardianships on an expedited basis. In addition to the finding and conclusions normally required for a permanent guardianship, the Public Guardian or the Public Guardian's designee must also determine: Whether the proposed ward faces a substantial and immediate risk of physical harm, needs immediate medical attention, and/or faces a substantial and immediate risk of financial loss ;
SPECIAL (LIMITED) GUARDIANSHIP
Whether reasonable efforts have been made to secure a certificate signed by a physician licensed to practice in Nevada which states the proposed ward is unable to respond to a substantial and immediate risk of physical harm, to a need of immediate medical attention, and/or risk of financial harm.
Pursuant to NRS 159.054, a Court may appoint the Washoe County Public Guardian's Office as Special Guardian upon a determination that the Proposed Ward possesses limited capacity. Upon appointment as Special Guardian, the Public Guardian or the Public Guardian's designee should determine the special circumstances warranting the appointment of a Special Guardian and ensure the special circumstances are considered when performing assessments, preparing care plans, and reports on the condition of the ward, ensuring the supervision exercised is least restrictive of the ward's personal freedom consistent with the need for supervision and protection.
If the Public Guardian's designee is unable to secure a medical certificate, the Public Guardian's designee will execute an affidavit stating why the medical affidavit is not immediately available.
NOTE: It is the policy of the Public Guardian's office to exert only as much control over a case as is necessary given the circumstances, regardless of the type of legal relationship.
Whether the proposed ward lacks capacity to respond to the risk of loss or harm or to obtain the necessary medical attention, and;
GENERAL (PLENARY) GUARDIANSHIP
Pursuant to NRS 159.054, a Court may appoint the Washoe County Public Guardian's Office as General Guardian upon a determination that the Proposed Ward required the appointment of a General Guardian. Medicare is our country’s health insurance program for people age 65 or older. Certain people younger than age 65 can qualify for Medicare, too, including those who have disabilities, permanent kidney failure or amyotrophic lateral sclerosis (Lou Gehrig’s disease). The program helps with the cost of health care, but it does not cover all medical expenses or the cost of most longterm care. Medicare is financed by a portion of the payroll taxes paid by workers and their employers. It also is financed in part by monthly premiums deducted from Social Security checks. The Centers for Medicare & Medicaid Services (CMS) is the agency in charge of the Medicare program. But you apply for Medicare at Social Security, and obtain general information about the Medicare program.
Medicare has four parts: • Medicare Part A (Hospital Insurance) - Helps cover inpatient care in hospitals, and services in skilled nursing facilities (following a hospital stay), hospice, and home health care. • Medicare Part B (Medical Insurance)- Helps cover doctors' services, hospital outpatient care, and home health care. Helps cover some preventive services to maintain health and to keep certain illnesses from getting worse. • Medicare Advantage Plans (Part C) are health plans run by Medicare!approved private insurance companies. Medicare Advantage Plans include Part A, Part B, and usually other coverage like Medicare prescription drug coverage (Part D), sometimes for an extra cost.

Medicare Part A ( Hospital Insurance) Most people age 65 or older who are citizens or permanent residents of the United States are eligible for free Medicare hospital insurance (Part A). You are eligible at age 65 if: You receive or are eligible to receive Social Security benefits; or you receive or are eligible to receive railroad retirement benefits; or your spouse is eligible; or you or your spouse (living or deceased, including divorced spouses) worked long enough in a government job where Medicare taxes were paid; or you are the dependent parent of a fully insured deceased child. Medicare Part B ( Medical Insurance) Anyone who is eligible for free Medicare hospital insurance (Part A) can enroll in Medicare medical insurance (Part B) by paying a monthly premium. Some beneficiaries with higher incomes will pay a higher monthly Part B premium. For more information, ask for Medicare Premiums: Rules For HigherIncome Beneficiaries (Publication No. 05-10536) or visit www.socialsecurity.gov/mediinfo.htm. If you are not eligible for free hospital insurance, you can buy medical insurance, without having to buy hospital insurance, if you are age 65 or older and you are— a U.S. citizen; or a lawfully admitted noncitizen who has lived in the United States for at least five years.
Preventive services
Beginning in 2011, your co-payment for most preventive services (Pap tests, flu shots, and screening mammograms) is covered. That includes tests like colonoscopies, bone density tests, prostate cancer screenings, and diabetes tests. It also includes an annual “wellness exam.” You will, however, have to pay your share of any doctor or hospital services for all tests except the wellness exam.
Medicare Advantage Plans ( Part C) If you have Medicare Parts A and B, you can join a Medicare Advantage plan. Medicare Advantage plans are offered by private companies and approved by Medicare. With one of these plans, you do not need a Medigap policy, because Medicare Advantage plans generally cover many of the same benefits that a Medigap policy would cover, such as extra days in the hospital after you have used the number of days that Medicare covers. 30

• Medicare managed care • Medicare preferred provider organization (PPO) • Medicare private fee-for-service • Medicare specialty If you decide to join a Medicare Advantage plan, you use the health card that you get from your Medicare Advantage plan provider for your health care. Also, you might have to pay a monthly premium for your Medicare Advantage plan because of the extra benefits it offers. People who become newly entitled to Medicare should enroll during their initial enrollment period (as explained under Signing up for Medicare) or during the annual coordinated election period from October 15 – December 7 each year. The effective date for the enrollment is January 1 of the upcoming year. There also will be special enrollment periods for some situations.
Medicare Prescription Drug Coverage ( Part D) Anyone who has Medicare hospital insurance (Part A), medical insurance (Part B) or a Medicare Advantage plan (Part C) is eligible for prescription drug coverage (Part D). Joining a Medicare prescription drug plan is voluntary, and you pay an additional monthly premium for the coverage. Some beneficiaries with higher incomes will pay a higher monthly Part D premium. You can wait to enroll in a Medicare Part D plan if you have other creditable prescription drug coverage but, if you don’t have prescription coverage that is, on average, at least as good as Medicare prescription drug coverage, you will pay a penalty if you wait to join later. You will have to pay this penalty for as long as you have Medicare prescription drug coverage. People who become newly entitled to Medicare
should enroll during their initial enrollment period. The effective date for the enrollment is January 1 of the upcoming year. There also will be special enrollment periods for some situations. Changes in the Part D program include higher premiums for people who earn more than $85,000 a year (couples earning more than $170,000 a year). This year also begins the start in the closing of the donut hole.
Extra Help for some low-income people
If you cannot afford to pay your Medicare premiums and other medical costs, you may be able to get help from your state. Adult Day Care/Care Management
Adult Day Care Adult Day Care provides respite care or short-term breaks for informal caregivers, and allows adults in need of daily care an opportunity to spend time in a less restrictive environment other than skilled care. Adult Day Care is defined by Nevada Revised Statute “NRS 449.004,” as a “Facility for the care of adults during the day,” meaning an establishment operated and maintained to provide care, on a temporary or permanent basis, for aged or infirm persons. Adult Day Care can be offered in a social and health care setting. The social model offers nonmedical services that include supervision or assistance with activities of daily living (ADL’s), social activities, a meal or snacks, and socialization with peers. Adult Day Health Care provided in a health care facility can be based on a medical model offering rehabilitative and social services to adults with physical or mental impairments. The centers are ideal for physically, mentally or functionally impaired people who wish to maintain or improve their level of functioning to avoid skilled nursing home care. Adult Day Care provides assistance either half-day or full-day, five or six days a week. Transportation to and from the center is often made available by the local paratransit. Home health agencies provide skilled home care service. The agency may deliver different kinds of home care services through nurses, therapists, social workers, homemakers and home care aides, medical equipment and supply dealers, and volunteers. Some agencies limit their services to nursing and one or two other specialties. Level of Care The majority of the states facilities are licensed for the elderly and disabled, at Category 1- Level of Care (residents must be able to leave their bedroom area in 4 minutes or less with no assistance in case of fire or emergency). There are facilities that are also licensed to care for residents with Category 2 - Level of Care (residents must be able to leave their bedroom area in 4 minutes or less with assistance in case of fire or emergency). These residents may have Alzheimer’s disease and other types of dementia, chronic illness, mental illness and mental retardation.
Adult Group Care/Residential Group Care/Assisted Living Adult Group Care, Residential Facilities for Groups (RFG) or Assisted Living (AL) is a residential alternative that promotes maximum independence through a combination of supportive services and assistance. Services and costs vary depending on the facility, which may also vary in size, style, and optional services. Small family style liv-
ing or larger complex units may be co-located or affiliated with a hospital or nursing facility. An RFG/AL facility is required to provide assistance with daily living activities (ADLs), which include eating, bathing, dressing, and personal hygiene; three meals a day; supervision of selfadministration of medications; laundry service including personalized laundry; housekeeping and 24 hour staffing. Group Care facilities represent the largest number of health care facilities licensed by the Nevada Bureau of Health Care Quality and Compliance. In 2006, the bureau licensed 311 RFG’s statewide ranging in size from three to 150 beds, some licensed for additional endorsements. The bureau also regulates smaller Homes for Individual Care (HIC) serving two people or less.

What is Adult Day Care?
A
dult day services are perfect for families who are caring for an aging loved one in their home, who need time to work, perform errands, or respite from caregiving responsibilities. Adult day care can provide their loved one with a safe environment outside the home that includes socialization, support, and/or supervision during the day. Most adult day care centers operate Monday through Friday, to accommodate the working family. Some offer additional hours on the weekend. What does Your Senior Need? Adult Day Care Centers and Adult Day Healthcare Centers offer different care to meet your loved ones needs. Adult day care is provided in a group care setting that is based on a social model featuring socialization, activities, and support. Social activities seek to enrich the participant’s life through a variety of activities such as 80
arts and crafts, exercise, musical entertainment, games and movies. Daily activities include a nutritious lunch and snacks, and assistance with activities of daily living. Adult day healthcare is a medical model and is offered in a group care setting that is safe, supportive, structured and therapeutic, providing a wide spectrum of services under the supervision of a qualified registered nurse. It is designed for adults who are frail and/or physically, cognitively or emotionally impaired with conditions such as stroke, Alzheimer’s, Parkinson’s and dementias. The program can provide the level of care that families seek as an alternative to institutional care. The site is secured with the capability to handle people with behavior problems or wandering tendencies. The program provides assistance with personal care and other activities of daily living. The variety of choices are dictated by the needs of the individual, but usually include: A Retirement Community (more independent living with lodging and meals), an Assisted Living Facility (provides lodging and supportive services), a smaller Residential Care Facility (usually 10 or fewer residents in a home), a Home for Individual Residential Care (only two residents in a home) or a Skilled Nursing Facility (where more medical needs are met). I thought it might be helpful to provide a check list for use in evaluating each facility as you embark on your selection process:
