General Terms and Conditions A new Cell C subscriber agreement in which the customer will accept all Terms and Conditions must be completed. If the customer enters into a subscriber agreement with Cell C during the month, the first month’s subscription fee will be prorated for that month. Thereafter, the customer will be billed monthly for the service subscription and will receive full allocation of the inclusive value (specific to the package subscribed to) on the first of each month. Cell C may amend, modify or otherwise change these Terms and Conditions in its sole and absolute discretion and the amended version will be displayed in the same media as these Terms and Conditions. Cell C will notify the customer before Cell C amends or otherwise changes the Terms and Conditions. International calling and roaming are excluded from inclusive benefits. All standard Terms and Conditions of the Cell C Service Provider apply. Standard RICA rules and processes apply. All prices and usage rates advertised include VAT, unless otherwise stated. Once-off SIM and connection fee of R195 applies to all contracts and SmartData packages. A post-paid customer will be billed for out-of-bundle usage in the month following such usage. Downward migrations and cancellations will attract penalty fees. Offers are subject to availability, while stocks last.

Contract Terms and Conditions SmartChat The SmartChat offering is applicable on post-paid and Top Up for new and existing customers. A SIM-Only deal is available on variable length contracts. Handset plus SIM deals are available on a 24-month contract only. On activation of the SmartChat product, the customer will receive the following inclusive benefits monthly: Anytime data; Nite data (from 12am – 6am) and Any-net minutes (voice calls to any local network in South Africa). Where customers have fully depleted the inclusive data and minutes before the end of the month, out-of-bundle rates will apply.

Straight Up The SIM-Only option is offered on a month-to-month, 6, 12, 18, or 24-month agreement. The SIM plus handset option is offered on a 6, 12, 18 or 24-month agreement. Straight Up tariff plan rates will apply for out-of-bundle usage.

SmartData Contract Data The SmartData contract offerings are available for a monthly fee, which includes a Cell C data-enabled SIM card; data which shall be equally allocated every month for 12 or 24 months, other than the first month when the data and monthly subscription will be prorated according to the number of days remaining in the month; and a device where applicable. The initial data bundle will be valid until the end of that calendar month. New data bundles will be loaded on the first of every month at 00:00:00. Bundles will expire at the end of every calendar month at 23:59:59. The monthly inclusive Nite data can be used only between 12am and 6am. Upon expiration there shall be no rollover of unused data to the following month or year.

SmartData Prepaid Data The Top Up SmartData offerings are available on a monthly fee, which shall include a Cell C data-enabled SIM card and data, which shall be equally allocated every month for 12 or 24 months, other than the first month when the data and monthly subscription will be prorated according to the number of days remaining in the month. The initial data bundle will be valid until the end of that calendar month. New data bundles will be loaded on the first of every month at 00:00:00. Bundles will expire at the end of every calendar month at 23:59:59.

SmartData Bundles (30 Days) SmartData Bundles are available to all prepaid, post-paid and hybrid customers. Customers can load bundles via USSD, by calling Customer Care on 140, or by visiting any store that sells Cell C data and requesting that the data bundle to be added to their account. The SmartData bundles will be available as once-off or recurring. Data is valid for 30 days for once-off bundles or one calendar month for recurring bundles. Unused data does not carry over to the next month.

WhatsApp Bundle The WhatsApp bundle on prepaid packages will be valid for 30 days upon activation. A fair usage limit of 1GB applies. WhatsApp Calling and international roaming are not included in the usage. Usage only for WhatsApp, other Internet usage will be billed from customers’ normal data bundle or airtime. Available on USSD – dial *109# and *147#. Should Cell C elect to extend this promotion, the extended date will be in the Terms and Conditions on cellc.co.za

Epic Buyout The Epic packages are available on both post-paid and Top Up packages for new and existing customers. Customers who take out a SIM-Only Epic package deal have a choice between 12-, 18- and 24-month contract length. Epic package deals comprising of both a handset and SIM card are available on 24-month contracts only. The first month’s inclusive benefits will be prorated depending on the date of activation of the package; thereafter the benefits will be credited monthly on the 1st of every calendar month. The inclusive airtime can only be used for calls to any local network in South Africa and cannot be used for international calling and roaming. There is no carry-over of any unused rand value. Any unused rand value will be forfeited. Inclusive airtime cannot be used to purchase data bundles. Data bundles purchased will be charged at the applicable data bundle rates and added to the customer’s monthly invoice as an additional charge. Epic Top Up customers will have to recharge with data vouchers or purchase bundles using prepaid airtime. The buyout value, determined at Cell C’s sole discretion, will be presented to the customer in the form of a Value Gift Card and is subject to an Epic plan activation. The Contract Buyout offer is available to all new and existing customers and only on Epic plans. Customers must hand in their old handsets on their current contract with the other service provider as one of the conditions of Contract Buyout. Customers will be credit vetted and must be up to date with their current contract. Customers will be required to provide confirmation of cancellation of their current contract with the other service provider where required. Customers must be the legal owner of their current contract and handset.

Epic The Epic packages are available on both post-paid and Top Up for new and existing customers. Epic package deals comprising of both a handset and SIM card are available on 24-month contracts only. There is no carry-over of any unused rand value. Any unused rand value will be forfeited.

Pinnacle Plans The Pinnacle packages are available on both Post-paid and Top Up for new and existing customers. All standard Terms and Conditions of Cell C (Pty) Ltd and Cell C Service Provider Company (Pty) Ltd apply. Customers who take out a SIM-Only Pinnacle package deal have a choice of month-to-month, 12, 18 and 24-month contract length. All prices and usage rates advertised include VAT, unless otherwise stated. The first month’s inclusive benefits will be prorated depending on the date of activation of the package; thereafter the benefits will be credited monthly on the 1st of every calendar month. There is no carry-over of any unused value from month to month. Any unused value will be forfeited. The Contract Buyout amount you qualify for will depend on the amount outstanding on your current contract.

Contract Buyout All Contract Buyout amounts given to new and existing customers will be determined at the sole discretion of Cell C, taking into consideration the maximum values per package as set out by Cell C. All standard Terms and Conditions of Cell C (Pty) Ltd and Cell C Service Provider Company (Pty) Ltd apply. Value cards are only applicable to Contract Buyout customers. The customer is responsible for the safekeeping of the value card. Should the value card be lost, misplaced or stolen, or the value on the value card be used by an unauthorised person, Cell C shall not be held liable.

Trade Up, Trade In The service is open to all qualifying new and existing Cell C customers. In order to participate in the service, customers must: have lawful title to the device presented for trade-in. In the event that the customer does not have lawful title to the device, Cell C reserves the right to bar and/or suspend the customer from utilising the services and/or using the trade-in value; if during the review and grading process, Cell C determines that a device is blacklisted, Cell C shall immediately return the device to the customer and the customer shall be barred from utilising the service. Once the trade-in value has been displayed to the customer, the value shall be final and Cell C shall not be obliged to enter into any discussions with the customer regarding the value displayed as the trade-in value. Cell C has the right to withdraw, or shorten the duration of the service, in its sole discretion and absolute discretion and will notify customers if it chooses to do so.
