Don’t let your business be the broken link under the new chain of responsibility obligations

On 1 October 2018, the Heavy Vehicle National Law (HVNL) was amended to provide that EVERY PARTY in the heavy vehicle transport supply chain has a duty to ensure the safety of their transport activities.

In practical terms, this means all parties in the chain must reduce risks related to the safety of transport tasks. The primary duty represents an obligation to eliminate or minimise potential harm or loss (risk) by doing all that is reasonably practicable to ensure safety.

As a party in the supply chain, the best way to do this is to have safety management systems and controls in place, such as business practices, training, procedures and review processes that:

• identify, assess, evaluate, and control risk

• manage compliance with speed, fatigue, mass, dimension, loading and vehicle standards requirements through identified best practice

• involve regular reporting, including to executive officers

• document or record actions taken to manage safety.

AM I PART OF THE HEAVY VEHICLE SUPPLY CHAIN?

Any time you or your business sends or receives goods using a heavy vehicle with a gross vehicle mass of more than 4.5 tonnes, you become part of the supply chain.

You therefore have a shared safety management responsibility to prevent breaches of the law. A person may be a party in the supply chain in more than one way and legal liability can apply to their actions, inactions and demands. Some roles that can influence heavy vehicle safety include loading manager, consignee, operator, consignor, scheduler, packer, loader, employer, executive officer and prime contractor.

This accredited part of the course includes preparing plant for loading, including applicable permits and securing the equipment.

You will go through the process of moving plant and unloading it safely. For this reason it is a requirement that the participant holds a ticket for the safe operation of the plant they will be loading.

If you have supervisors or other workers in the supply chain (who do not hold a plant ticket) they can still be part of the course, but we cannot assess them for the practical component of RIIHAN30E Load and unload plant. They will receive a Statement of Attendance for the non-accredited aspects.

This course further includes the non-accredited module of restraining plant and equipment.
