MATTHEWS – Town commissioners not only are allowing distilleries less than 3,000 square feet as a permitted use in neighborhood business districts, but they also approved rezoning Sept. 13 to allow Oaklore Distilling to open a microdistillery at 11136 Monroe Road.

Owner Matt Simpkins said during the August public hearing that his microdistillery will create a variety of spirits, including moonshine, whiskey, vodka, gin and rum. It will have a small bottling shop where customers can try before they buy. The Matthews Planning Board had reservations about Oaklore Distilling’s proposal. Members recommended town

commissioners deny the company’s rezoning request. Town Senior Planner Rob Will said the planning board’s concerns involved the location of the business, parking, and safety of the ingress and egress from Monroe Road. Nick Tosco, an attorney representing the applicant, said the team added a condition that creates a parking formula for the site after hearing from town

staff. The parking would increase to match any increase to the retail or tasting area as well as the number of employees. Mayor John Higdon had some initial concerns about the potential of an odor coming from the microdistillery, but he realized it wouldn’t be an issue with an operation that size. “I personally would have

MATTHEWS – Vanessa Elias has been practicing immigration law since 2010 and has built a solid firm mostly through referrals. She has big plans for the growth of Elias Immigration Law. Elias has approached town commissioners about rezoning residential property in the downtown area so she can move her firm from 10020 Monroe Road to a house across the street from Aldi. “I am very excited because after all these years renting I’m going to own my own space,” she told commissioners during the Sept. 13 public hearing. “It’s dear to my heart.” Elias doesn’t plan on tearing down the existing home at 556 W. John St. She plans to renovate it for business use as

MATTHEWS – Seven homeowners within Meadows at Matthews want to put six-foot-high fences along the front yard setback along N.C. 51 near the Sardis Road intersection. Last year, three of the owners received code violations for having six-foot fences in their front yard setbacks. The town doesn’t allow fences higher than four feet within Residential - Varied Styles zoning district.

They were denied variances and worked with town staff on crafting a text amendment that would allow the fences, according to Senior Planner Rob Will. Realizing the amendment could impact up to 30 home in town, commissioners opted to apply flexible design standards within the R-VS zoning district to these seven specific homes. “This solution that is proposed by the planning department does sound extremely reasonable for all of our neighbors because it

does solve the unique problems for these seven lots and not going to affect any other properties in our town,” Meadows at Matthews homeowner Oleg Konyk told the board during the Sept. 13 public hearing. Konyk said that with the unique design of the neighborhood, their front yards serve as backyards. In the rezoning application, he wrote that a recent tornado destroyed vegetation that provided a barrier to N.C. 51 and that the 100-foot setback from the street makes it

This view of N.C. 51 and Sardis Road shows the seven homes. Photo courtesy of Town of Matthews impossible to have privacy. Mayor John Higdon and Commissioner Jeff Miller said they support the idea. “I think these seven lots are very unique in Mat-

thews,” Higdon said. “The front yards really serve as a backyard for all intensive purposes.” The board may approve the measure next month.

Matthews Presbyterian needs rezoning to build columbarium Church envisions courtyard that can be enjoyed by greater community by Justin Vick justin@cmgweekly.com

MATTHEWS – Matthews Presbyterian Church has to go through the rezoning process to build a walled memorial garden on its property because the project will include a columbarium, which is a structure that stores urns. The church is trying to convince town leaders to add the definition of an “open wall columbarium” to the orGarner

dinance so that the structures can be exempt from 40-foot setback requirements. Urns would not be visible. Matthews United Methodist Church as well as Cross and Crown Lutheran Church have columbariums on their campuses. “We want to preserve the historic image of our church and this is one way to do it,” Scott Garner told commissioners during the Sept 13 public hearing. “The problem we have is we have a limited buildable area. This will allow us to use some of our setback space in a positive

way that will enhance our image and make an attractive focal point, particularly for people who are walking by.” John Purdie said the church has worked with columbarium designers and landscape architects for the garden, which will go in at the corner of West John and South Freemont streets. “We want to be able to design a columbarium that will blend in with our existing structures. which date back to the 1940s,” he said. Town leaders will vote on the proposal at a future meeting.

(The Center Square) – Despite its history for overspending, the N.C Department of Transportation did not follow guidelines for developing its spending plan, a state audit shows. The NCDOT did not develop its spending plan based on specific projects and operations scheduled for the fiscal year, the Office of the State Auditor said, putting the agency at risk for exceeding its spending plan in future periods. The NCDOT stayed within its budget during the first half of the fiscal year – July to December 2020 – despite straying from spending plan guidelines, auditors found. However,

auditors said it was only by chance. Transportation Secretary Eric Boyette said he agreed with the auditor’s findings in his response to the audit, and the agency has “implemented corrective action.” Boyette said the agency has hired staff and uses statistical tools to create a structured process to monitor its spending for the fiscal year. The chief engineer’s office will monitor each highway’s division spending every month, Boyette said. The chief engineer’s office must approve purchases over $500, and the department monitors the cash balances weekly along with other measures, Boyette said. In March, the state auditor found the NCDOT did not follow auditing standards, leading to possible inaccu-

racies. NCDOT’s Office of Inspector General had not completed a performance audit since 2016, according to an evaluation report completed by the General Assembly’s Program Evaluation Division in August 2020, causing budget and cash flow problems. NCDOT spent $742 million over its spending limit in 2019, a previous audit found. The General Assembly had to route an additional $220 million to the NCDOT to resume projects that stalled because it failed to maintain its cash balance limit between $282 million and $1 billion. The department is now subject to additional oversight by the General Assembly and must base its spending plan on specific projects and operations.

RALEIGH – The N.C. Department of Transportation is urging the public to pay more attention around railroad tracks and crossings as part of Rail Safety Week (Sept. 20 to 26). A person or vehicle is hit by a train every four hours in America, according to the National Highway Traffic Safety Administration. In North Carolina this year, there have been 34 crossing crashes, resulting in six fatalities and eight injuries. Additionally, 20 known incidents of people walking on tracks resulted in 11 fatalities and six injuries.

CHARLOTTE – Gas price averages in the Carolinas rose on the week as the impact of Hurricane Ida, followed two weeks later by Hurricane Nicholas, slowed down oil production and refinery recovery along the Gulf Coast. “We usually see less demand and lower prices at the pump during the post-Labor Day period,” said Tiffany Wright, spokesperson, AAA – The Auto Club Group in the Carolinas. “But this most recent hurricane just further complicated and slowed down the recovery from Ida. The price of crude oil also increased – paired with lower fuel supplies, those factors have definitely put upward pressure on pump prices lately.” North Carolina’s gas price average is $2.96, seeing a 1-cent increase on the week. This is 5 cents more expen-

sive than a month ago and 94 cents more expensive than this time last year. South Carolina’s gas price average is $2.91, seeing a 2-cent increase on the week. This is 3 cents more expensive than a month ago and $1.01 more expensive than this time last year. The national gas price average for Sept. 20 was $3.19, rising two cents on the week and matching a seven-year high last seen in early August. This average is $1.01 more than a year ago. True to seasonal form, the Energy Information Administration reports gasoline demand has fallen 8% to 8.9 million b/d, the lowest since Memorial Day. Approximately 23% of offshore Gulf of Mexico oil production was offline as of Sept. 20. On the web: www.gasprices .aaa.com/

BBB report finds job scams Avoid 6 Costly Errors When BBB Employment Scam Study increased during pandemic Moving to a Larger Charlotte ®

CHARLOTTE – Employment scams are on the rise in the turbulent job market created by the COVID-19 pandemic, a new Better Business Bureau study finds. BBB warns job-seekers to verify employment offers to avoid illegal jobs, identity theft and fake checks to which millions are exposed annually. The study details the many forms employment fraud takes and the scams that often result. Job scams have been a problem for years. In 2020, BBB estimated 14 million victims with $2 billion in direct losses related to job scams. The 2020 BBB Employment Scams Report by BBB Institute for Marketplace Trust found job scams to be the riskiest of all the scams they tracked in 2018 and 2019. However, BBB’s study finds the problem worsened in 2020. Losses reported to the FBI’s Internet Crime Complaint Center about employment scams were up 27% between 2018 and 2020 BBB Institute’s 2020 report on job scams found this fraud most commonly victimized people ages 25-34, with women filing 67% of complaints about this fraud. The median financial loss reported by these victims was $1,000. In addition, they often reported loss of their time, as 32% were never paid for the work they did for an “employer” that turned out to be fraudulent. Identity theft is a common outcome of job scams, as scammers often steal job seekers’ personal information to open bank accounts to further their fraud. BBB found 34% of victims provided their driver’s license number and 25% provided their Social Security or Social Insurance number. Fake checks also frequently accompany job scams, and they continue to grow. This new BBB study finds that 36% of job scam complaints to BBB involved a fake check, with fake check complaints to the Federal Trade Commission increasing by 65% between 2015 and 2020. In the two years since BBB issued an investigative study on fake check fraud, losses absorbed by banks themselves due to fake checks went up 40% to reach $1.3 billion. Common fraudulent job offers involving fake checks include mystery shopping or secret shopper jobs, car wrap jobs, nanny or

caregiver jobs, and small business jobs such For complete report, visit BBB.org/jobscams as photography or painting houses. Employment scam victims frequently become unwitting accomplices in other fraud, used as money mules, to mail fake checks, or to participate in reshipping scams, which represent 65% of the scam job offers reported to BBB Scam Tracker. Scammers “hire” victims from job boards, Facebook or Craigslist, offering to pay them as much as $2,500 to receive and then send on packages. These fraudsters often use stolen credit card numbers to order laptops, cellphones and highend goods and have them sent to reshipping victims, instructing them to repackage the goods and providing shopping labels to send the packages to a new address, often in Russia. The accomplices who were hired for this fraudulent type of work are never paid, and their identities may be used to open bank accounts. The FTC has taken action against job scammers, including a fake job placement company the agency sued in 2019. Associated scams such as reshipping schemes and money mule schemes have been a focus for state and federal law enforcement. In December 2020, the Department of Justice announced the results of a worldwide effort to deal with money mules, resulting in action taken against 2,300 people.

SENIOR GUIDE POST INSURANCE AGENCY LE B A L I A V A S T N OLLME R N E L A U T R I COVID SAFE V Trademarks 101 What is a trademark or service mark? A trademark is any word, phrase, symbol, or design that identifies and distinguishes your goods or services from those of others. “Trademarks go with trade.” A service mark is the same as a trademark, except that it identifies and distinguishes services rather than goods. Why are trademarks important? Consumers use your company’s trademarks to differentiate you from your competition. This makes trademarks valuable to your business. How long does a trademark last? Good news: potentially forever. Unlike patents, trademarks don’t expire. Instead, they last as long as the owner uses them in commerce. Why should I conduct a trademark search? Offensively and defensively, trademark rights deal with the “likelihood of confusion” consumers might experience between and among marks and the goods and services the marks represent. The relevant slogan is “sight, sound, and meaning.” Conducting a specialized search of your mark before initiating use or filing an application may identify potential problems, such as a likelihood of confusion with another mark already in use. A search can reduce or eliminate the chance that you might need to rebrand a new enterprise, or risk infringing on another’s trademark, or sink costs into an unsuccessful application for registration. Do I need an attorney to submit a trademark application? US residents are not required to engage an attorney to file an application for Federal trademark registration. Nevertheless, the USPTO strongly encourages applicants to use an attorney. What are the benefits of using an attorney? An attorney can help make the application go more smoothly, and can save you time and money in the long term. Trademark applications can be confusing to the novice, and mistakes can be costly. The lay person is dealing with “unknown unknowns,” and a guide—an experienced intellectual property attorney—can help.

We’re excited about being here. This is home and we can’t wait to see what we can do.” While the vote to approve rezoning for Oaklore Distilling was unanimous, Larry Whitley was the only commissioner to vote against the measure that would allow smaller distilleries in neighborhood business districts. It also reduced the distance between a distillery and dwellings from 500 to 50 feet. The planning board called for staff to take a more comprehensive look at brewpubs, microbreweries and distilleries in the town’s development ordinances.

He pointed to other businesses operating in that location. He also mentioned a right turn lane leading into the spot. “I support this request wholeheartedly, and it’s the third business during my tenure that will make a try there,” Miller said. “I

well as add a sidewalk, curb and gutter along Lois Street. The planning board will review the project Sept. 28. Commissioners may vote on the rezoning as early as Oct. 11. Commissioner Jeff Miller said he was encouraged by the project. Miller believes it’s on a good corner for de-

velopment on a major thoroughfare. “It’s a blighted property but it has opportunities,” he said. Mayor Pro Tem Renee Garner remembered that her Randolph Middle School bus driver used to live in the house. Senior Planner Nadine Bennett said the town’s landuse plan doesn’t offer a specific recommendation for

the 0.23-acre site but it encourages leaders to preserve the historic nature of the area. The downtown master plan includes the site as part of a potential West John Street Historic District. That plan recommends residential-style office cottages for vacant parcels. The public works department recommended a pad for the bus stop outside of the home.

Coca-Cola 600 returns to speedway

HUNTERVILLE – The Carolina Renaissance Festival is back to celebrate its 28th year Saturdays and Sundays, Oct. 2 to Nov. 21. Located just north of Charlotte, the festival blends imagination, fantasy and history all within a 20-acre outdoor storybook village filled with shopping, feasting and entertainment. A simpler time and place It is the 16th century, and the fictional village of Fairhaven is where revelry and celebration rule the day. Villagers, artists, craftspeople, musicians, performance troupes and food concessionaires create a marketplace festival in celebration of the arrival of their visiting Queen. It is a place where adults can feel and act like children while children are treated as royalty. Non-stop entertainments The day is filled with an abundance of attractions appropriate for all age groups, presented upon 16 outdoor stages, each packed with a unique mix of continuous music, dance, comedy shows and circus entertainments. From barely balanced acrobats to one-of-a-kind oldworld musical instruments, the entertainment options are endless. The stage shows are always spontaneous.

NASCAR has released its 2022 schedule, which includes the Coca-Cola 600 and Bank of America ROVAL 400. Photos courtesy of CMS

Bank of America ROVAL 400 remains in playoff slot History. Tradition. NASCAR. With NASCAR’s 2022 Cup Series schedule now official, fans can make plans to visit Charlotte Motor Speedway for two of the biggest event weekends of the year, the Coca-Cola 600 and Bank of America ROVAL 400, which will maintain their familiar May and October weekend dates next season. As it has for more than six decades, Charlotte Motor Speedway will host the Coca-Cola 600 on Memorial Day Weekend, running NASCAR’s toughest test of man and machine on May 29, 2022. As a prelude to the crown jewel event, Charlotte Motor Speedway will honor the service men and women of the U.S. Armed Forces with a rousing pre-race salute to the troops that’s worthy of being called America’s largest Memorial Day Weekend celebration. Maintaining its elimination slot as the final race in the Round of 12 for the NASCAR Cup Series Playoffs, the Bank of America ROVAL 400 on Oct. 9, will again prove pivotal for drivers chasing the 2022 Cup Series championship. The 2.28-mile, 17-turn course will push drivers to the breaking point and end the title hopes of four worthy contenders. “For more than 60 years, the Coca-Cola 600 has exemplified resilience, determination and grit – characteristics that also define the brave service men and women to whom we pay tribute each Memorial Day – so it’s fitting that the peerless race remains on its traditional holiday weekend,” said Greg Walter, executive vice president and general manager at Charlotte Motor Speedway. “That, combined with the Bank of America ROVAL 400’s pivotal place in the second round of the Cup Series Playoffs gives fans plenty to look forward to next season, and our team is already hard at work making sure 2022 is our best year yet.”

One-of-a-kind attractions Don’t miss the Birds of Prey exhibition where the royal falconer will don his hunting garb and take you on a thrilling trip into the past explaining and demonstrating the use of falcons, hawks, owls and more in the ancient sport of falconry. The festival would not be complete without a depiction of one of the grandest events of the time period – the tournament joust. Occurring three times daily, each joust is full of pomp, pageantry, action, comedy and chivalry as lances shatter, swords clash and daring deeds of bravery all collide for the queen’s amusement. From gallant knights to the marvels of the vast ocean, the lord mayor outdoes himself once again in a bid for the queen’s favor with a personal gift - the return of the swimming mermaids. Action & adventure The Carolina Renaissance Festival is home to a most unusual collection of people-powered rides and games of skill. Inspired by the joust? Try your skill with a lance on the Slider Joust challenge game. You can storm the castle in a paintball battle or try to solve the riddle of climbing Jacob’s Ladder. Mix skillful pleasure and comic adventure by throwing tomatoes at the insulting fools locked in the stocks at Vegetable Justice. Test your skill at games like the Dragon Climbing Tower, the Archery Range and the Maze. Take a ride on Christopher Columbus’ Voyage to the New World, the Piccolo Pony (a rocking horse bigger than an elephant), and Leonardo’s Flying Machine; a people-powered amusement ride based on Di Vinci’s designs for human flight. A family favorite is Mother and Father Goose brought to life with their costumed ducks and geese, the Petting Farm, and Camel rides.

Adult tickets and camping for both the 63rd running of the Coca-Cola 600 and next season’s Bank of America ROVAL 400 can be purchased online at www.charlotte motorspeedway.com or by calling 800-455-FANS. Tickets start at just $49 for adults and are just $10 for children ages 12 and under.

Shopping Early holiday shoppers can peruse over 140 craft shops in a village market which provides a selection of handmade items such as pottery, jewelry, perfume, glass-blown ornaments, ceramics, bath & body products, medieval costumes, hand carved candles, unique musical instruments, children’s toys, a full spectrum of clothing, and much more.

Infrared yoga studio opening at Blakeney CHARLOTTE – Atha Yoga, the first infrared studio in South Charlotte, will celebrate its grand opening Sept. 25 above White House Black Market within Blakeney Shopping Center. The public is invited to stop by from 10 a.m. to 1 p.m. for live music, mimosas, healthy bites, back rubs, wellness treats and gift bags.

There will also be raffle prizes featuring yoga apparel and gear from Lululemon and others, along with the grand prize drawing of unlimited yoga at the studio for one year. Atha Yoga is the result of founder Dr. Olga Dadalko’s decade-long journey of practicing, teaching, and researching yoga. She believes that the transforma-

tional power of yoga stems from exercising the nervous system, which is why Atha Yoga teaches mindfulness first and foremost. Its mission is to create a nourishing and vibrant community of students and teachers that will empower each other through kindness, acceptance and the practice of yoga. “It’s not just our top-notch heat-

ing and air purification technology that we are proud of. Our true pride is our exceptional team of teachers,” Dadalko said. “When you practice with us, we will take you through a wide range of class formats, from intense Hot Yoga to restorative Yin and dynamic Yoga Sculpt to soothing Candlelight Flow.” Blakeney Shopping Center’s ad-

ArtPop Street Gallery issues call for artists LOUD&LIVE CHARLOTTE – ArtPop Street Gallery is accepting submissions from artists interested in having their artwork displayed on donated advertising space throughout the region. The advertising space, spanning billboards, newsstands, shopping displays and displays at the Charlotte Douglas International Airport, is donated through the support of Adams Outdoor Advertising, Awedience Media, Charlotte Center City Partners, Lamar, Kegerreis, Red Truck Media, Kenjoh Outdoor, AdLoad and CEN Media. “It is always a thrill and an honor to continue welcoming a new class of artists to our Charlotte program, but this year is extra special having just been awarded a partnership with the

LendingTree Foundation,” said Wendy Hickey, ArtPop’s founder and executive director. “As a new member of their LendAHand Alliance Cohort in Charlotte, we will have the LendingTree Foundation’s guidance and generous financial backing behind us for the next three years as we navigate an exciting next chapter for ArtPop and the artists we support. And as always, nothing we do would be possible without the incredible support from our advertising partners, who so graciously donate the space to showcase beautiful local art – art that inspires and enhances the lives of everyone in our wonderful community.” New for the incoming 2022 class is a $500 honorarium awarded to each class

participant. Other benefits include increased exposure and the community that comes with participating in the program. The call for submissions is also open to high school seniors pursuing a college degree in the arts. One high school senior will be juried into ArtPop Charlotte’s class of 2022 and receive a $1500 scholarship, in addition to the other benefits. Artists in 13 counties, including Mecklenburg and Union, can apply through Oct. 11 at https://www.artpopstreetgallery.com/open-calls. Those who apply should submit their artwork in specific specs, and a tutorial on how to do so can be found at https://vimeo. com/316360608.
