Public Accounts Committee report Development site Commons Committee acquired off market for clients in Leicester hits apprenticeship nail on head, says FMB A WARNING from MPs that the Government’s apprenticeships programme must raise skill levels is timely, the Federation of Master Builders (FMB) has said in response to a new Public Accounts Committee report.

A PRIME commercial site is set for redevelopment as purpose-built premises for Western Power Distribution (WPD), the electricity provider for the Midlands, following acquisition involving leading East Midlands commercial property specialist Andrew and Ashwell.

The Leicester-based agent has been working closely with WPD to procure the site of the former Jessops headquarters on Scudamore Road. The building has stood empty since 2013 when the firm went into administration. Founded in Leicester in 1935, Jessops has since been successfully relaunched by TV ‘Dragons Den’ entrepreneur Peter Jones, returning to the city with a new store in Highcross two months ago.

Located just off Leicester’s Outer Ring Road, three miles west of the city centre and half a mile from M1 Junctions 21 and 21A, Scudamore Road is the main artery of the rapidly regenerating Braunstone Frith Industrial Estate. Growing demand for prime commercial property here has led to a series of major refurbishment schemes, including the clearance of the huge warehouse and office complex once occupied by the British Shoe Corporation to make way for a huge, million sq ft distribution hub.

The former Jessops’ site is set on a corner plot spanning 1.9 acres, including a derelict two-storey office and warehouse building of 44,000 sq ft, now set for demolition. The off-market acquisition will result in a new 19,500 sq ft depot and office building for WPD’s Midlands’ operation, to be constructed to BREEAM Excellent standard. Planning permission is already in place, with WPD scheduled to relocate from the current depot on Hamilton Business Park.

Geoff Gibson, at Andrew and Ashwell, said the acquisition was among several similar success stories for the agent in recent months, reflecting buoyant demand for prime commercial properties.

“There is high demand for employment land in Leicester, both among owner occupiers and developers, which has been very hard to come by.

There are few opportunities on offer, so being able to deliver the right site for this development off market is something to shout about.”

Sarah McMonagle, Director of External Affairs at the FMB, said: “The Government is at a crossroads in its apprenticeship programme and Ministers must now choose to either honour their pledge to increase the quality of apprenticeship training, or allow themselves to be consumed by the need to hit targets. The Public Accounts Committee emphasises strongly the need for the Government to be unrelenting in its focus on quality apprenticeships and this is absolutely key. While the temptation may exist to water down apprenticeship standards in order to hit the three million target, this would smack of short termism and ultimately be counterproductive. Unless we act now to increase quality, people will continue to look down their noses at vocational training when it should be viewed with the same respect as other forms of further education such as university degrees. This is the only way to increase numbers and reach our apprenticeship targets we need in the longer term.”

McMonagle concluded: “In construction, it’s particularly important that the Government holds firm in the face of pressure from some larger contractors and house builders to introduce shorter and cheaper apprenticeship standards. The new Trailblazer apprenticeships were conceived as a way of empowering employers by allowing them to develop qualifications that genuinely fulfil their needs. Given that construction SMEs account for 85% of employment in our sector, and train two thirds of all apprentices, their input and concerns should be central to the Government’s skills policy. We urge Ministers to take on board the Committee’s recommendations – it is not just the construction industry’s future that we need to consider but the career prospects of the individuals who are undertaking this training. Let’s give them the broad range of skills they need to flourish in their careers and protect them from unemployment if and when the next downturn bites.”

ProCon Award for rg+p from page 1 THE £2.9M PROJECT, on the former Charles Keene College Annexe site at Abbey Park Street in the Belgrave area of the town, was designed on behalf of Radha Soami Satsang Beas (RSSB), a philosophical organisation which has headquarters in Bedfordshire and required a permanent home for its Leicester meeting space relocating from rented premises in Knighton.

It also needed to accommodate an associate organisation, Science of the Soul (SOS) to host core activities, including meetings, seminars, lectures and spiritual teachings.

Having purchased the site, RSSB appointed rg+p to provide advice on suitability of design, make an application for planning and post planning advice on construction.

Originally Abbey Park Junior and Infant School and now a listed building, the redevelopment of the site was sensitive and included detailed plans and negotiations surrounding the revitalisation of the site and the preservation of elements of the listed building which had been a schoolhouse since Victorian times.

Because of the importance of the existing building the rg+p team worked closely with the conservation department at Leicester City Council together with specialist structural engineer Bob Kumar, eventually producing an Archaeological Heritage Statement for the site.

To enable the provision of the 750 seat lecture hall - which now has two floors and an adjacent 3-storey pre-meeting annex - together with parking expansion for 76 vehicles, some dilapidated postwar buildings were demolished.

The retained school buildings were then refurbished and adapted for ancillary use including further offices, toilets, catering and a crèche. Modern glazed walkways now link the old and new buildings creating light and ease of access for all those using the new centre.

Uniquely, the building was constructed entirely by volunteers from the RSSB, under the guidance of skilled craftsmen adding an extra dimension of commitment and cohesion to the entire project.

Biggest ever expansion of city’s secondary schools

LEICESTER City Council is beginning the next phase of work on a £45million project that will see the biggest ever expansion of our secondary schools.

The proposed expansion programme will create 2,500 extra secondary school places across the city – the equivalent of building two new schools.

The work will be paid for from the city council’s Basic Need capital funding pot. Basic Need funding is used to make sure there are enough school places for children in their local area.

Now, £920,000 is being released from the funds for the next phase of planning and design work at eight city secondary schools.

Under the plans, Babington, Crown Hills, English Martyrs, Judgemeadow, Rushey Mead, Soar Valley, St Paul’s and The City of Leicester schools will all be extended to create more pupil places.

Each school will be expanded to provide at least 300 new places across all year groups. Soar Valley will get 325 new places, and Rushey Mead 378.

Cllr Sarah Russell, assistant city mayor for children, young people and schools, said: “We know that there is a shortage of secondary school places in the city and that more pupils are currently going through primary school who are going to need places in the future. That’s why we’ve committed to invest in our biggest-ever expansion programme for city secondary schools.

“We’re working with eight of our schools which are consistently oversubscribed, where we know there is some space available for extensions, and we’ve conducted feasibility studies to establish what these expansions might look like.

“Now we’re moving onto the next phase, which is drawing up detailed architectural plans for each of the schools.

“We’re working closely with the schools and will aim to keep disruption to a minimum while we do any work. It’ll take a while to build, but we hope that some of these new places will be available from September 2018.

“Moving up to secondary school is a big step for young people, and choosing a school is an important decision for families. We want to do all we can to make the whole process as easy as possible.”

The type of building work carried out will largely be extensions built onto existing wings at the schools. Practical spaces such as dining rooms will be increased, alongside more classrooms.

Cllr Russell added: “We know that there are applications for free schools to open in the city. This will help to ease the pressure on places, but our forecasting shows us we will still need more. Building work takes time, which is why we’re pressing ahead with these plans now, releasing the funding in phases as we go along.”

Construction work is likely to start in autumn 2017, with the intention of carrying out work on as many of the schools as possible at the same time.

Ibstock Footballers Net £2,000 Sponsorship Deal With Taylor Wimpey

Wigston office with potential for alternative use YOUNG footballers in Leicestershire have received a massive boost from leading local housebuilder Taylor Wimpey, which has agreed to sponsor their team over the next two years.

Ibstock Utd U10s team have been given £2,000 to fund a full set of kit and winter training gear, including coats and tracksuits.

The money has been provided by Taylor Wimpey as part of its forthcoming development in the nearby Leicestershire village of Hugglescote.

Darren Barber, assistant coach with the team, says: “It’s a real rags to riches story, as before Taylor Wimpey got involved we only had some old kit that was a few years old and didn’t fit the players.

“It was touch and go whether we would be able to continue, as we had the kids but not the finances to move forward and not all the parents could afford the kit needed.

Proposals for Snibston site

William Davis rewards apprentices at annual awards evening

The proposals are available in a report to the council’s cabinet and would be subject to planning permission from North West Leicestershire District Council.

A county council spokesman said: “Our proposed £1.4 million investment in the Snibston site should enable people to learn about the historic colliery buildings and make more of the country park, with BMX trails and a visitor centre and café.

“It would be funded by £1 million from selling part of the site for up to 133 houses, plus a contribution of £400,000 from our capital budget. Our site surveys have shown that such a development would be suitable.

“The £146,000 annual running costs of the country park and visitor centre should be more than covered by £160,000 income from the car park and visitor centre.”

In a presentation evening held at the company’s Loughborough head office, 20 year old plumber Sam Beaver was announced as Apprentice of the Year, with 19 year old electrician Jack Harrison given the Endeavour Award. With the Chancellor releasing his Autumn Statement on the 23rd November, a host of new commitments were made which could greatly impact the industries which our members operate in.

These commitments cover housing, taxation, infrastructure and the future of low-carbon emission vehicles and this blog will look at the potential impact on each area.

To begin, we welcome the Government’s pledge to fund future house building projects and provide more affordable housing across the country.

We had mentioned in a previous blog that the Government could face difficulties in achieving its target of building one million homes by 2020, yet the new proposals appear to provide some detail as to how the target will be reached. It was proposed that £2.3 billion would be spent on a housing infrastructure fund which could provide 100,000 new homes in high demand areas, coupled with a futher £1.4 billion to deliver 40,000 affordable homes. We are also optimistic about the future of house building due to the announcement of a National Productivity Investment Fund (NPIF). This fund will include a further £7.2 billion to ‘accelerate’ the housing supply and support the infrastructure necessary for property construction.

It was also confirmed that a white paper is currently being developed by the Department of Communities and Local Government (DCLG) which will focus on the issue of housing in more detail which we await with anticipation.

The focus on infrastructure and construction within the Autumn Statement has given us a source of optimism in the years ahead. A National Infrastructure Commission (NIC) has been proposed which would provide advice on the country’s strategic infrastructure needs and how to address them. Investment in infrastructure will be provided by the NPIF and will see an increase of 60% in annual central Government investment from £14 billion in 2016-17 to £22 billion in 2020-21. This focus on infrastructure is ultimately positive for our members, and will hopefully lay the foundations for an economy which is supported by a strong infrastructural base.

Similarly, we welcome the announced decrease in corporation tax to 17% by 2020, alongside reducing the burden of business rates by £6.7 billion over the next 5 years. This reduction in corporation tax will help our members to invest more into the future success of their businesses, employ and train more staff, and give new businesses a further stimulus to find their feet. Alongside corporation tax, we also welcome the proposal to raise the personal tax allowance from £11,000 to £12,500 by 2020, meaning that thousands of people will be taken out of the income tax threshold. The higher rate threshold is also set to be raised from £43,000 to £50,000 by 2020, which will again result in less people having to pay the current 40% income tax rate and provide more disposable income.

Finally, NAPIT are pleased to hear about the Government’s commitment to invest further in low emission vehicles and charge-points for electric vehicles. According to the Autumn statement, the NPIF will invest £390 million by 2020-21 to support ultra-low emission vehicles and renewable fuels. It was also announced that until March 2019 the Government will offer 100% first-year allowances to companies investing in charge-points for electric vehicles. We hope that these allowances will lead to the development and rollout of more charge-points, since the number of electric cars is rising rapidly year on year.

To conclude, we are optimistic about the future and welcome the Governments proposals to invest in infrastructure, lower taxation and increase their efforts to roll out low-emission vehicles. Critically, the commitments to house building are something which we will keep a close eye on and we hope that the proposals will lead to the construction of many more homes in the years ahead.

Builders’ Problems SOLVED

Termination Problem: At the beginning of 2016, my construction company entered into a JCT Minor Works Building Contract 2011, to carry out a major refurbishment to a row of terrace houses.

Progress was quite slow as the client started to remove some large items of work from our contract and give it to specialist contractors who were cheaper, albeit slower to deliver. In addition, there were some major issues with the construction drawings and we were constantly requesting the architect to provide better details.

Back in August, the architect instructed us to construct porches to each of the houses, but his design was insufficient and we requested better details in order to make a start. The architect stated that as far as he was concerned, we were just looking for an excuse not to do the additional work, and instead of issuing better construction details, issued us with a notice of default, stating that by virtue of our failure to progress the construction of the porches, we were failing to progress the works regularly and diligently and threatened us with termination.

A couple of weeks passed and we still were waiting for the details, then out of the blue, we received a recorded delivery letter from the client terminating our employment under the contract on the basis that we had not remedied the default as notified to us by the architect. We are now barred from entering the site and the client is about to employ another building contractor. What can we do?

Response: Hello Kuldip. It is very difficult to determine when a contractor is failing to proceed regularly and diligently.

It is widely understood from case law that to proceed with the works regularly and diligently, the contractor is required to proceed: “…continuously, industriously and efficiently with appropriate physical resources so as to progress the works towards completion substantially in accordance with the contractual requirements as to time, sequence and quality of work.”

That said, from your outline of the matter, regardless of whether or not you were failing to proceed regularly and diligently, the ground that the architect has issued his default notice for is incorrect. Failing to proceed with a variation is not a ground for the architect to have issued a notice of default that could lead to termination. The only remedy that the architect has, is to issue a notice stating that you have refused to comply with an instruction, and if you continue ignoring the instruction within 7 days of the issue of the notice, your client may then instruct a third party to carry out the additional work only.

It is highly likely therefore, that your client is in repudiatory breach of contract by issuing the notice that purported to terminate your employment under the contract, as the default notice was invalid.

Assessors from Investors in People visited Westleigh’s offices to interview 60 of the company’s employees about their current roles, career progression and job satisfaction.

These assessments are carried out every three years and score employers based on their performance in three key areas of staff development - leading, supporting and improving.

Engineering Professional Work underway on new £3.9m Memorial Centre Takes Ambassador Role With East Midlands RFCA

WORK IS well underway on a new £3.9 million Memorial Centre in Mountsorrel.

THE MANAGING director of one of the Midlands fastest growing engineering consultancies has been appointed onto the East Midlands Reserve Forces & Cadets Association (RFCA) Leicestershire and Rutland committee.

Eddie Mewies (pictured above), of M-EC Consulting Development Engineers, has taken on the role of employer ambassador, with specific responsibility for voicing the needs of local employers and how opportunities for Reservists and Cadets can be created within the regional business community.

“M-EC has been supporting and actively promoting the Reserve Forces for over three and a half years, culminating in the business receiving Gold in the Employers Recognition Scheme this year,” explains Mr Mewies. “I’m now delighted to be able to extend this support by sitting on the county committee and hopefully encourage further collaboration between Reservists, Cadets and East Midlands businesses.”

RFCA’s help develop a positive attitude towards the military and Cadet organisations through engagement with government, local authorities, employers, youth organisations, chambers of commerce and the media. Membership is voluntary and the East Midlands RFCA has five county committees, representing Derbyshire, Leicestershire & Rutland, Lincolnshire, Nottinghamshire and Northamptonshire.

Leicestershire & Rutland committee chairman, Richard Cole commented: “As a supportive employer of Reservists and an active member of the business community, Eddie’s input to the working of the committee will be invaluable. We look forward to benefitting from his experience and advice.”

In his role on the Leicestershire & Rutland committee, Eddie meets three times a year at military, business and civic venues across the counties. The committee comprises around 30 people, including representatives of the regular and Reserve Forces, Cadet organisations, county councils, business and local communities. M-EC employs Reservist Private Rosie James as an environmental consultant in its noise & air quality division.

The old hall has been demolished and a new one is being built in its place for the village and surrounding community to use.

The new facility will offer a hall complete with café, two retail units and smaller rooms for the community.. The hall will also feature moveable auditorium style seating for use when required.

As it is one of the village war memorials, the names of the fallen will feature in the new hall.

The new hall has been supported by £2.7 million of Section 106 money which is funding given by developers to improve the community when they receive planning permission to build in the area.

Cllr Eric Vardy, Charnwood Borough Council’s Lead Member for Planning and Section 106 Money, said: “I am delighted that work on this new centre is underway and when complete, this will provide a great facility for the whole community.

“There have been a number of developments in the Mountsorrel area and section 106 agreements are there to make sure that when we get growth, we also get community and infrastructure benefits.”

The rest of the funding for the project has been provided from a range of sources including the Tarmac Landfill Communities Fund, the Mountsorrel War Memorials Trust Ltd and Mountsorrel Parish Council.

The old Memorial Hall was built in 1964 and opened the year later.

Steve Haywood, Chairman of Mountsorrel Parish Council, said: “The new Memorial Centre has been brought about by excellent partnership working involving borough and parish councils and the War Memorials Trust with fantastic support from Tarmac which has provided a very generous grant.”

The new facilities are programmed to be opened in September 2017.

Businesses urged to prepare for major employment law changes in 2017 2017 IS SET to be a very significant year from an employment law perspective, with the introduction of new regulations which will require large compliance projects to take place within most organisations.

Howes Percival Partner and employment law expert, Paula Bailey; “Not only will employers still be tackling issues arising from case law developments, such as who are ‘workers’ within their business and how holiday pay should be calculated, but they will also have to grapple with the continued uncertainty created by Brexit and new legislative changes.

“In 2017 employers are likely to see increases in staffing costs as a result of increases in the National Minimum Wage and other statutory pay rates and, the introduction of the new Apprenticeship Levy.

Paula Bailey continued, “Preparing for significant changes to Data Protection legislation will also be a priority for 2017. While the new rules don’t come into effect until May 2018, the magnitude of the changes coupled with increased penalties for breaches means that it’s vital that employers ensure that they are familiar with the new requirements and have systems in place to make sure they remain compliant.”

Brexit The most significant event anticipated for 2017 is that Article 50 of the Treaty on the European Union will be triggered. This is scheduled for the end of March 2017, but with the current legal challenge it is unclear whether this timetable will remain in place and indeed, if it does, what will happen to UK employment legislation derived from Europe.

The biggest issue initially is likely to be what is to happen to the free movement of persons and the labour on which the British economy relies.

Most employers have workers from the EU on which they rely and will be keen to see how this develops.

Gender Pay Gap reporting begins The final regulations have now been published (subject to parliamentary approval) and are expected to come into force on 6 April 2017.

An employer with 250 or more employees will be required to publish information relating to the gender pay gap within their organisation. In particular, they will be required to publish the difference between the mean and median hourly rate of pay paid to male and female employees; the difference in mean and median

bonus paid to male and female employees; the proportions of male and female employees who receive bonuses and the relative proportions of male and female employees in each quartile pay band.

An employer with 250 or more employees as at 5 April 2017 will have 12 months from 5 April 2017 (i.e. 4 April 2018) to publish the required information. Therefore, employers with 250 or more employees on 5 April 2017 will have to spend 2017 (and the remainder of the 12 month period in 2018) collating the necessary information, deciding what information to publish (and whether to go above and beyond the requirements within the Regulations so as to explain any differentials) and how to deal with any potential equal pay issues and bonus arrangements.

Whilst employees are not defined within the Regulations themselves, the explanatory notes do state that “employment” includes employment under a contract of employment, apprenticeship or a contract personally to do work.

Employers will therefore need to review some of their contractors, consultants and freelance arrangements to identify who may fall within the reporting requirements. In any event, it is likely that businesses will be looking more closely at their ‘worker’ arrangements for nonemployees and whether they should continue to engage people on this basis, due to the Uber decision and the review of the ‘gig economy’.

National Minimum Wage changes and other changes to pay The National Living Wage for employees 25 and over will increase to £7.50 from April 2017, together with other increases to the National Minimum Wage rates.

Statutory Maternity Pay, Statutory Paternity Pay, Statutory Adoption Pay and Statutory Shared Parental Pay and Statutory Sick Pay rates will also increase from April 2017.

A Ministerial Statement proposes that statutory sick pay will increase to £89.35 per week and the flat rate of maternity pay, etc. will increase to £140.98 per week.

Apprenticeship Levy for large employers An apprenticeship levy for large employers will come into force on 6 April 2017. Employers with an annual pay bill of more than £3m will need to pay 0.5% of their NIC pay bill for the tax year on the apprenticeship levy. They will then be able to access funding for apprenticeships through a new digital apprenticeship service account. The Government will apply a 10% top up to the funds

that an employer has to spend on apprenticeship training in England.

Funds will expire 24 months after they enter the employer’s digital account unless they are spent on apprenticeship training.

Employers will need to consider their strategy for employing apprentices and how best to utilise the funding through the digital service account.

Salary Sacrifice Schemes In the Government’s Autumn Statement of 2016 it has confirmed that with effect from April 2017 salary sacrifice arrangements will be curtailed. Going forwards the only benefits that will continue to benefit from tax and NICs relief if provided through a salary sacrifice arrangement will be: enhanced employer contributions to a registered pension scheme; childcare benefits; cycles and cyclists safety equipment provided under the cycle to work scheme and ultra-low emission cars. The limitation will take effect from April 2017. However, arrangements in place before that date will be protected until April 2018 or for cars, accommodation and school fees, until April 2021.

Data Protection Employers will need to prepare for significant changes to Data Protection legislation which take effect in 2018.

The EU General Data Protection Regulation (GDPR) was passed by the European Parliament on 14 April 2016 and came into force on 25 May 2016. Member states have two years to implement the GDPR which means that the latest date the UK can adopt the Regulations is May 2018.

It is likely that the UK will still be in the EU in 2018 but, even if we are not, the UK will probably mirror EU Regulation on this issue so that we can continue to trade and exchange data. Therefore, employers will need to review their data, ensure that they have proper systems and processes in place to process data and more importantly - to keep it secure and deal with security breaches.

With increased penalties of up to 4% of global turnover or 20 Million Euros it will be vital that during 2017 employers familiarise themselves with the requirements and appoint a Data Protection Officer to ensure that they have the systems in place to respond to the changes.

Landscape construction progress at Victoria Park, Leicester

GROUND CONTROL’S Construction team is currently working on an exciting new project at Victoria Park, Leicester, on behalf of Leicester City Council.

The £2.2million contract includes refurbishment and extension of the Granville Road Car Park in Leicester, along with the creation of a new processional route from London Road through the car park to the war memorial at the other end of the park. The development on Park Road, on the site of a former hosiery factory, is a partnership project from Westleigh, social housing and care provider emh group, and Blaby District Council, who contributed £137,400 to the scheme.

It will offer a mix of two and three bedroom homes available for rent through emh homes, the social housing arm of emh group. The properties will be available solely to those in housing need, such as individuals on low incomes, young couples and families.

Westleigh is part of the Homes and Communities Agency Delivery Partner Panel on both the Midlands and Northern lots and works closely together with housing associations to build affordable new homes throughout the East and West Midlands, South Yorkshire and Cambridgeshire.

Nearly two-thirds (64%) said their home was much better than their previous residence, illustrating that standards of new affordable housing are meeting expectations and often exceeding them.

There was a high level of satisfaction with many key aspects of design, such as space, internal layout and security, and residents themselves identified a wide range of positive attributes of their new homes.

In addition over 80% of residents were satisfied with the overall appearance of their housing development and most felt that it integrated well with surrounding buildings and met the needs of residents. However, modern living was found to challenge some aspects of design, particularly the level of storage and parking provision, according to a survey commissioned by the NHBC Foundation and supported by the Homes and Communities Agency (HCA).

Nearly 30% of residents surveyed, were dissatisfied with parking provision.

A further 27% were dissatisfied with storage space, with some residents struggling to store basic household items such as vacuum cleaners, bedding and linen, toys, shoes and even clothes.

The adequacy of ventilation was also a concern, with 55% of those surveyed recognising one or more symptoms of poor ventilation: dampness and/or condensation (41%), mould (28%), or lingering cooking odours (10%). In addition some residents were dissatisfied with the winter temperatures in their homes and, significantly about 20% found their heating controls difficult to use.

The findings are outlined in Affordable homes: residents’ views of quality and compared with the HCA Quality Counts surveys which take place shortly after residents move in. Conducting this survey three-to-four years after residents have moved in means they have had more time to appreciate both the longer-term advantages and consider any issues they have encountered with their new home. The results provide an important new picture of residents’ ongoing satisfaction levels.

Neil Smith, Head of Research & Innovation at NHBC said “The standards of new affordable housing are such that most residents are still pleased even three or four years after moving in, long after the initial euphoria of having a new home has worn off.

“This is great news, but there is still room for improvement. Providing more help to residents on how to run their homes more effectively should be a priority for housing associations and developers. The research highlights increasing expectations for parking and the challenge this creates for the overall design of developments.

Local Construction Firms Are Losing Out On Grant Funded Training SMALL AND medium sized (SME) construction firms in Leicestershire are paying twice as much in levies to the Construction Industry Training Board (CITB) as larger firms but are losing out on subsidised funded training in return, according to new research.

The building sector’s leading professional workplace audit and contract solutions provider, Hudson Contract, which works with SME firms across the East Midlands, has released independent polling data demonstrating the CITB’s minimal impact - despite it collecting almost £200m in levy from the sector.

Hudson Contract, with support from the Association of Independent Professionals and the Self Employed (IPSE), and the Federation of Master Builders (FMB), commissioned YouGov to study the views of SMEs in the construction sector. SMEs pay twice as much levy as larger firms in the sector yet have less power to influence the CITB. The research shows that the CITB has little or no impact on its primary mission of encouraging the provision of training, since the overwhelming majority of SMEs are funding and providing training themselves with little or no CITB grant funding.

Topline results from the research show: • Most levy payers (60%) provide training without CITB grant funding.

• Only 9% of respondents say they receive CITB funding for training employees, and of that 9%, only half receive the full cost of training.

• Only 35% knew that the CITB collects the levy and distributes

grants. Even among levy payers specifically, only two thirds were aware of this.

The CITB was one of about 30 boards created in 1962 to correct a perceived market failure in training.

Only three such boards survive today. The CITB now justifies its continued role by convincing the Government that it is needed to tackle the perceived skills shortage in construction.

Further results from the research show that: • More than half of the firms interviewed have either no knowledge or no opinion of the CITB levy’s effectiveness in ensuring training and skills development.

• 71% say the possibility of a CITB grant to cover training does not influence decisions to send workers on a training course; and a mere 2% say a CITB grant is the main reason for training.

• 38% of firms would continue training even without the possibility of a levy grant.

Ian Anfield, Managing Director of Hudson Contract said: “Despite spending millions on websites, roadshows and PR, the CITB’s influence on training provision is negligible. In reality, the CITB is a hapless bystander while SMEs get on with the day job. More and more stakeholders are questioning whether there is a need for a levy and grant system at all. This needs an answer.”

In 2015, the then-Secretary of State for Business, Sajid Javid, granted a three year extension to the CITB’s levy raising powers on the basis that he was satisfied that the new order had industry support. This purported indication of support was derived from a consensus process through which the CITB consulted specifically

designated trade bodies, known as Consensus Federations, who then offer their support on behalf of their members. Yet of the approximately 70,000 registered levy payers, only an estimated 14-17% are members of a consensus federation, based on the CITB’s own figures.

Asked whether they were aware for the consent process, 10% of respondents said that they were aware; 75% said they were not and 16% did not know. When asked specifically if they supported the CITB’s levy-raising powers, only 17% of respondents said yes.

The CITB’s own accounts show that large businesses receive a 92% return on their levy payment, whereas small and micro sized businesses receive 61% and 52% respectively. Of those who say that they find it difficult to claim back grants, 55% say that the reason for this is that they do not have an administrator to support them, while 50% say the process is too complicated. Anecdotally, many of Hudson Contract’s SME clients have identified the bureaucracy associated with the CITB grants as a barrier to accessing grants, whereas large firms are able to employ administrators whose sole role is to wade through the red tape.

Ian Anfield added: “Training is absolutely vital if the construction industry is to thrive and deliver our country’s much needed infrastructure and house building programmes. As the backbone of the industry, SMEs play a crucial role in this. Yet not only is the CITB offering scant support to SMEs, it is actually putting obstacles in their way by collecting a levy and passing most of it on to major contractors.

Those with the narrowest shoulders bear the toughest burden. That is bad for business and bad for the industry.”

Empty home back on the market with a £15,000 grant

A HOME which has stood empty for more than a year has received a £15,000 grant to help get it back into use.

Charnwood Borough Council is committed to getting empty homes back on the market and can help landlords refurbish properties so they can be rented out.

The £15,000 grant has been used by the property owner towards renovating a house in Queens Road, Loughborough. The property is now ready to be rented out to new tenants.

Councillor Paul Mercer, Deputy Lead Member with responsibility for Strategic and Private Sector Housing said: “We all know there is a housing shortage in this country and that’s why it is important to encourage property owners to bring empty homes back into use if we can.

“Through our Partnership Grants, we can offer funding to help get a home back on the market and available to rent.

“An empty home can cost up to £10,000 per year in lost rent, tax, insurance and other charges. They can also become a magnet for vandals and anti-social behaviour which can have a detrimental effect on the surrounding community.

“I am delighted to see this home in Queens Road being available to live in and would like to thank the property owner for making use of this grant.”

Grants are available for two-bedroom properties in Charnwood. The grants can be used to fund renovation work and will cover 50 per cent of the cost of the work up to a maximum of £15,000.

Breedon Group acquires the Sherburn Minerals Group for £15.7m BREEDON, the UK’s largest independent construction materials group, has entered into a binding agreement to acquire the Sherburn Minerals Group (“Sherburn”) for a total consideration of up to £15.7 million.

Sherburn is a leading independent heavyside building materials business headquartered in County Durham, employing approximately 110 people. It operates four quarries and five ready-mixed concrete plants in County Durham, Northumberland, North Yorkshire and Cumbria. It also distributes cementitious products from two import terminals at Blyth near Newcastle and Dundee in eastern Scotland.

Sherburn reported an underlying EBITDA of £1.8 million on revenues of £16.1 million in the year to 31 March 2016. It has in excess of 21 million tonnes of mineral reserves and resources, together with significant cement storage capacity at its two terminals.

The purchase price will be satisfied by the payment of £9.5 million in cash, funded from the Group’s existing resources, together with the assumption of £6.0 million of debt. A further conditional payment of £0.2 million is payable one year after completion. Following completion of the acquisition Paul Allison, Sherburn’s current Managing Director and a minority shareholder, will remain with the business as a consultant.

Leicester City Council bids for legal powers to buy Waterside land

LEICESTER City Council has made a bid for legal powers to buy land in an area earmarked for an £80milllion redevelopment scheme.

A detailed case for the compulsory purchase order (CPO) of land and property in the proposed Waterside regeneration area, has been submitted to the Government for consideration.

CPOs can be used by local authorities to assemble land for complex regeneration projects which are in the public interest, particularly those which involve multiple land ownerships.

The Waterside CPO will be an essential step in bringing forward an ambitious first phase of regeneration in this part of the city.

This will focus on largely underutilised industrial land to the west of the A50, between the Grand Union Canal and Friars Mill, including Soar Island. The plans will help transform the 17-acre site into a thriving neighbourhood with new homes, modern office space and better access to the city’s riverside.

City Mayor Peter Soulsby said: “Compulsory purchase orders can only be used as a last resort, but they are a vital tool in bringing forward major regeneration schemes that benefit the whole city.

“The Waterside area has suffered badly in recent decades, with the closure of key industries leaving many sites neglected and underused. Its regeneration represents a tremendous opportunity for the city’s growth and prosperity.

“We are determined to move forward with our vision to transform this important part of the city. The CPO is the next critical step to help make this happen.”

Over the last 18 months, the city council has worked hard to obtain land by agreement. So far, the council has acquired around three quarters of the land and property needed through negotiated agreements. A further six sales have been in agreed in principle, and are expected to be completed in the coming weeks.

This leaves just seven plots of land and properties that may ultimately need to be acquired through CPO powers before development can begin.

The council’s submission of its case for CPO will begin a formal process leading to a public inquiry likely to take place in spring 2017.

A decision would then be another three to four months in coming.

If the CPO is confirmed, the city council could take vacant possession of the site by late 2017, when work is expected to begin on site.

The city council has recently appointed Keepmoat Ltd as its development partner for the Waterside regeneration project.

Keepmoat’s scheme will deliver over 300 new homes and 5,500sqm of office space, along with new parks and green space, and bring an anticipated £45milllion of private investment into the area.

Keepmoat will be obliged to complete at least 100 new homes and over 1,850sqm of new office space, along with all required infrastructure, by 2020.

It is anticipated that the entire first phase of Waterside regeneration could be complete by the end of 2023.

Although used rarely in Leicester, CPOs of this nature have been instrumental in major regeneration

schemes including the Highcross development, City Challenge and the construction of the original Shires Shopping Centre.

A resolution to use CPO powers to bring forward the Waterside regeneration project was made by full council at its meeting in April 2016.

The city council has earmarked £15milllion of capital funding to help kick-start the transformation of the Waterside area. The Leicester and Leicester Enterprise Partnership (LLEP) also successfully bid for £20million from the Government’s Local Growth Fund to support the major regeneration project.

Travis Perkins plc named in Britain’s Most Admired Company awards TRAVIS PERKINS plc, the UK’s largest building materials distributor, has been awarded second place in the Building Suppliers category of ‘Britain’s Most Admired Companies’ (BMAC) 2016 awards.

THE next phase of a major revamp of streets in Leicester’s historic Old Town area is set to get underway early in the New Year.

Leicester City Council plans to begin improvement works on Millstone Lane from 9 January and on Wycliffe Street from 16 January 2017.

The carriageway and footpaths on Wycliffe Street will be reconstructed in porphyry stone while Millstone Lane will be improved with high-quality concrete block paving footpaths and carriageways resurfaced in asphalt.

Footpaths will be widened and new trees planted to create a more attractive route for pedestrians though the historic area.

The work will cost around £1.1milllion, and is likely to take around six months to complete.

It is part of a planned £3.7milllion scheme to improve five streets in the Greyfriars conservation area, extending improvements recently completed on Applegate, Peacock Lane and around Hotel Street.

Work already underway on nearby Marble Street, is due to be complete by the end of the year.

Work on the final two streets – Friar Lane and New Street – is expected to begin in summer 2017.

The current traffic regulation order proposals seek to extend the existing restricted zone around Peacock Lane to include the Old Town streets. This means that there will be no on-street parking during the daytime. Parking for Blue Badge holders and daytime loading will be permitted in marked bays, and these will be made available for free parking during the evening.

The city council is also supporting improvements in this area through the Townscape Heritage Initiative. Backed by £1.1milllion from the Heritage Lottery Fund, the five-year programme is focused on buildings and public spaces in the area.

Property owners and businesses can apply for money to repair buildings, restore architectural features such as original windows, fencing and decorative masonry, or to bring empty space back into use.

Businesses set for VAT windfall BUSINESSES that have had trouble claiming back preregistration VAT on their assets may now have a limited window in which to do so, according to a Leicestershirebased firm of chartered accountants.

Newby Castleman says that a recent VAT brief from Her Majesty’s Revenue & Customs (HMRC) could put hundreds of Leicestershire businesses in line for a rebate – provided that they claim back the money within four years of the overpayment.

Traditionally, when registering for VAT businesses were able to claim back any VAT historically paid on their “fixed assets”, such as vehicles, tools or office equipment purchased up to Brent Goodwin, VAT manager four years beforehand, providing those at Newby Castleman assets were still owned at and used in the business at the time of registration.

In 2011, HMRC amended their internal guidance, stating that the tax relief should only be effective from the point the business registered for VAT. In practice, this meant that if a fixed asset, such as a company vehicle, had depreciated in value since it was bought, the business could only claim back a portion of the VAT originally paid, in line with the asset’s drop in value.

However, this amendment was only issued internally and HMRC’s new position was never made public.

This led to inconsistencies, with some businesses being allowed to claim back the pre-registration VAT in full, whilst others were penalised.

The HMRC brief issued last month sought to clarify its policy and has seen the taxman perform a U-turn, with all newly VAT-registered businesses now entitled to claim back VAT on their fixed assets in full.

The four year restriction still applies, however – so businesses that filed their first VAT return in that period and were blocked from claiming the full tax relief now have a limited time in which to do so.

Brent Goodwin, VAT manager at Newby Castleman, said: “Businesses that were only offered a portion of the tax relief can now put in a claim for the difference – and for small business who have just registered for VAT for the first time, that can be quite a significant amount of money.

“Businesses affected by this change of stance by HMRC should take the appropriate steps to reclaim the VAT that was incorrectly denied to them.

“They may also be due interest on the money owed to them, so it would be prudent for any business that has registered for VAT within the last few years to seek professional advice and clarification on whether they have overpaid VAT”.

Terex announces sale of Coventry UK Compact Construction Business TEREX Corporation has announced that it has agreed to sell its Coventry U.K.-based compact construction business to a subsidiary of Groupe Mecalac S.A. Mecalac is a maker of a wide range of innovative compact construction equipment for urban, utility and railway construction sites. The Coventry compact construction business manufactures and sells backhoe loaders, site dumpers and compact compaction rollers. The sale is subject to customary closing conditions and is expected to be finalised in the first half of 2017.

New book celebrates the Quality of Leicester

A NEW book that celebrates the architectural legacy of Leicester’s 2,000 year history was launched last month.

‘The Quality of Leicester’ traces the city’s architectural heritage from its origins in the late Iron Age through to the modern day, capturing a fascinating history of social, cultural and economic change.

The 348-page book brings together the story of how Leicester’s built environment has developed over 2,000 years, with over 500 beautifully photographed views and details of the city’s many architectural treasures.

It features hundreds of buildings, as well as streets and parks, highlighting their local importance and exploring the part they have played in shaping the unique character of Leicester.

The new book has been written by Michael Taylor, a town planner and building conservation specialist, who wrote the original edition of The Quality of Leicester back in 1993.

City Mayor Peter Soulsby said: “In 1993, when the first edition of The Quality of Leicester was published, Leicester seemed to lack an appreciation of its heritage and its many fine buildings, and had little confidence about its future.

“In recent years, we’ve seen a new, rediscovered pride in the city and its place in England’s history. We needed a new Quality of Leicester to reflect and celebrate that. The new book is a fantastic showcase for our great city.

“I hope that it will inspire a new generation to appreciate and value our city’s architectural heritage, much as the first Quality of Leicester inspired me and many others almost 25 years ago.”

Michael Taylor, the book’s author, said: “It has been a real privilege to work on this new edition of The Quality of Leicester. It is a completely new book reflecting a changed and dynamic city.”

Planning cuts make housing targets impossible, says new FMB/LGiU research

Ashberry Homes serves up Christmas cheer at development in Ibstock

NEARLY 90% of local authorities believe that the Government’s housing targets will be impossible to meet due to a lack of planning resources, according to a new joint research report from the Federation of Master Builders (FMB) and the Local Government Information Unit (LGiU).

The report, which is the first of its kind to draw upon the experience of both local authorities and SME house builders from right across the UK, also found that: • 64% of builders and 45% of local authorities see lack of planning resources as a barrier to developing more small sites • More than half of councils deliver fewer than 40% of homes on small sites • Builders and local authorities call for councils to be allowed to raise planning application fees Brian Berry, Chief Executive of the FMB, said: “The Government aim to build one million new homes by 2020 won’t be realised unless more SME housebuilders can enter the housing market. That’s why the barriers that SME house builders currently face need to be removed. We know that the availability of suitable small sites and the difficulty getting planning permission on them are two of the biggest barriers these firms face. In this research, both local authorities and SME builders identify under-resourcing as a key barrier to allocating more small sites and getting planning permissions in place on them. Too often small sites are dealt with entirely by inexperienced officers. There simply aren’t enough senior and experienced planners to make the system work effectively.”

Berry concluded: “Planning departments need a cash injection and we therefore urge the Government to take on board concerns shared by both builders and councils and to allow local authorities the power to increase planning fees. Most small local developers are so concerned by the level of service provided by resource-stripped planning departments, they would be happy to foot the bill, provided the raised fees are ring-fenced and result in an improved service. The Government deserves some credit for the priority it is now placing on house building, but unless planning departments have enough experienced planners on the ground, our housing targets will be nothing more than aspirational.”

Jonathan Carr-West, Chief Executive, LGiU, said: “There is a large untapped potential in small sites, but resource and capacity pressures in planning departments make it difficult to unlock. We need new approaches and new partnerships to build the homes we need. By working with a wider range of local builders, councils can stimulate local economic growth, while providing jobs and training for young people in the area.”

THE LATEST residents at an Ashberry Homes development in Ibstock were given the chance to meet their new neighbours at a Christmas party hosted by the housebuilder.

Christmas-themed food and drink was served up in the sales centre at Woodhurst, a development of 92 new homes which is being built on land off Station Road.

Review barn conversion regulation to address rural housing shortage, says CLA LOCAL COUNCILS are continuing to block around half of all prior approval applications to turn redundant farm buildings into homes.

According to the latest figures on housing supply in England released by the Department for Communities and Local Government there has been a welcome increase in housebuilding across England but barn conversions in rural areas remain stalled. Only 226 homes have been built in 2015/16 using permitted development rights and around half of all prior approval applications in the whole country continue to be rejected by planning authorities.

The CLA which represents landowners, farmers and rural businesses said the high refusal rates prove regulation on agricultural to residential permitted development rights is not working and needs reviewing in order to help counter the acute shortage of housing in rural areas.

CLA President Ross Murray said: “There is no question that the housing shortage is being felt just as keenly in the countryside as it is in our towns and cities. The problem with rural areas is that house prices are on average 22% higher than in urban areas and fewer homes are available.

“The refusal rate for converting old farm buildings is almost three times higher than approvals to convert offices to residential units, which indicates the permitted development rights policy is not working. Some farm buildings are clearly not suitable for conversion so it would be unfair to pin all the blame on planning departments but the high rates of refusal and the small number of completions is a wake-up call to government that this policy requires attention.”

Mr Murray said local planning authorities persistently ignored the government’s intention behind converting farm buildings into homes which undermined the development of sustainable rural communities.

He added: “The Government must make it clear to local authorities that permitted development rights are a vital part of its strategy to deliver new homes in rural areas.

Converting barns into homes is an excellent way to bring redundant or underused farm buildings back into use. It helps to address the rural housing shortage and build a sustainable community but the regulation needs change to realise its full potential.”

Dad-Of-Three Earns Degree In Construction Thanks To Barratt Homes Sponsorship Programme

A NOTTINGHAMSHIRE dad-of-three has earned a foundation degree in Residential Development and Construction thanks to the support of the Barratt Homes’ bespoke site management sponsored degree programme.

Steve Hallam, 35, has achieved a Foundation Degree in Residential Development and Construction after three years of training onsite at various Barratt Homes developments whilst studying at Sheffield Hallam University.

Steve, who lives in Ollerton, worked in modular and residential construction previously but wanted to further his career and was always checking the Barratt Homes website looking for opportunities like this programme.

He applied for the Barratt Homes sponsored construction degree and halfway through his course he was promoted to Assistant Site Manager, a title which he currently holds but is aiming to become a Site Manager in the near future.

Steve now works at Barratt Homes’ Hollygate Park development in Cotgrave and will continue to gain hands on experience whilst working with the Site Manager.

Throughout the course he was able to work at four different developments in Nottinghamshire and received dedicated coaching from different Site Managers.

Steve Hallam, Assistant Site The sponsored Construction degree focuses on the principles of housebuilding and looks into the skills and Manager, at his graduation knowledge of residential construction techniques and their practical use. This includes studies into construction law, technical design and commercial practice.
