Rape, A empted Rape, or Sexual Assault

Rape, A empted Rape, or Sexual Assault (C0301, C0120 – C0128): Shall respec vely mean sexual intercourse and a empted sexual intercourse without consent of the vic m in both cases or any unwanted sexual behavior commi ed by a perpetrator who is a stranger to the vic m or by a perpetrator who is known by the vic m or related to the vic m by blood, marriage or civil union. Behaviors that fall under this defi ni on include but are not limited to: sexual harassment as defi ned in §763 of Title 11; sexual contact as defi ned in §761(f) of Title 11; sexual intercourse as defi ned in §761(g) of Title 11; sexual penetra on as defi ned in §761(i) of Title 11; and child sexual abuse as defi ned in §901 of Title 10.

Grades K – 5: Level IV Off ense First Off ense Required:

•Staff /student conference •Parent/Guardian mandatory mee ng •Referral to support services and/or social service agencies •Mandatory counseling •Police no fi ca on, if necessary •DOE eSchool Incident Report fi led as required by law Op onal: •Deten on and/or Suspension 2nd - 5th grade only (1-2 days)

Subsequent Off enses Required:

•Parent/Guardian mandatory mee ng •Increase support services and/or social service agency involvement •Police no fi ca on •DOE eSchool Incident Report fi led as required by law •Suspension 2nd - 5th grade only (1-3 days) Op onal: •Referral to Alterna ve Placement
