SENATE PASSES BILL TO OVERTURN ‘BLACKLISTING’ EXECUTIVE ORDER The Senate has passed House Joint Resolution 37, a measure that would repeal the Obama Administration’s so-called “Fair Pay and Safe Workplaces” rule via the Congressional Review Act. This common sense resolution, which has been strongly endorsed by ATA, was passed by the House in early February, and will now be presented to the White House for President Trump’s signature. The Fair Pay and Safe Workplaces Executive Order, an Obama administration regulation scheduled to go into effect this October, would have prevented companies from competing for government contracts if they are facing even the possibility of a labor violation. Specifically, the order would have required contractors and subcontractors to disclose any labor law violations or alleged labor law violations, as well as the state equivalent to those laws for a period of three years leading up to a federal contract bid. This disclosure process would bog down Federal procurement with unnecessary and burdensome processes, and lead to a “blacklisting” of federal contractors, and a decrease in competitive contract bids. ATA Executive Vice President for Advocacy Bill Sullivan expressed the trucking industry’s appreciation for the Senate’s actions, noting that the “repeal of the ‘blacklisting’ rule by Congress is a positive step toward injecting common sense into the regulatory process.” Sullivan further said that “we appreciate Congress stepping up and taking a leadership role in reversing this rule that could have unduly excluded carriers from earning contracts to move freight for the government, and we hope that this type of oversight signals the dawn of a new era of inclusive and data-driven regulations.”

DOT INSPECTOR GENERAL AND FMCSA CONFIRM THAT 2013 HOS RESTART RESTRICTIONS SHOWED NO SAFETY BENEFIT

The Inspector General for the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) have reported out that a congressionally-mandated study found no net benefit from the 2013 hours-of-service (HOS) restart restrictions placed on the trucking industry. The IG report stated that the study “did not explicitly identify a net benefit from the use of the two suspended provisions on driver operations, safety, fatigue and health.” The impact of these reported findings, per the most recent Continuing Resolution passed by Congress in December, is that the two restrictions, which limited professional drivers to one restart period every 168 hours and required that period to contain two periods of between 1 a.m. and 5 a.m., are permanently suspended, marking a significant and resounding victory for ATA and the trucking industry. Following the release of these reports, ATA President and CEO Chris Spear said the findings “close what has been a long, and unnecessary, chapter in our industry’s

drive to improve highway safety. We knew from the beginning that these Obama administration restrictions provided no benefit to safety, and in light of the DOT’s findings – corroborated by the DOT Inspector General – it is good for our industry and for the motoring public that they will be done away with permanently as specified by language ATA lead the charge on including in the most recently passed Continuing Resolution.” This concludes the final chapter of a long battle ATA, state trucking associations, industry coalition partners, and Congress have fought against the 2013 HOS restart restrictions. Furthermore, ATA is hopeful that it also signals a move towards regulations that are based on sound science along with input from impacted parties. Working with the new Congress and Trump Administration, ATA is optimistic that future regulatory endeavors are narrowly tailored, supported by strong and credible data and evidence, and impose the least burden possible while implementing congressional intent.

CVSA’S 2017 INTERNATIONAL ROADCHECK ENFORCEMENT EVENT TO TAKE PLACE JUNE 6-8 WITH SPECIAL EMPHASIS ON CARGO SECUREMENT The Commercial Vehicle Safety Alliance’s (CVSA) 30th annual International Roadcheck will take place June 6-8, 2017. Over a 72-hour period, CVSA-certified commercial motor vehicle inspectors in jurisdictions throughout North America will conduct inspections of commercial motor vehicles and their drivers. Each year, International Roadcheck places special emphasis on a category of violations. This year’s focus is cargo securement. While checking for compliance with safe cargo securement regulations is always part of roadside inspections, CVSA is highlighting cargo securement safety this year as a reminder of its importance to highway safety. Inspectors will primarily be conducting the North American Standard Level I Inspection, which is the most thorough roadside inspection. It is a 37-step procedure that includes an examination of both driver operating requirements and vehicle mechanical fitness. Drivers are required to provide items such as their driver’s license, hours-of-service documentation, motor carrier registration and shipping documentation, and inspectors will be checking drivers

for seat belt usage and the influence of alcohol and/or drugs. The vehicle inspection includes checking items such as the brake systems, cargo securement, coupling devices, driveline/driveshaft, exhaust systems, frames, fuel systems, lighting devices (required lamps), steering mechanisms, suspensions, tires, van and open-top trailer bodies, wheels, rims and hubs, windshield wipers and emergency exits (on buses). International Roadcheck is the largest targeted enforcement program on commercial motor vehicles in the world, with nearly 17 trucks or buses inspected, on average, every minute in Canada, the United States and Mexico during a 72-hour period. Since its inception, more than 1.5 million roadside inspections have been conducted during International Roadcheck campaigns. International Roadcheck is a CVSA program with participation by the U.S. Federal Motor Carrier Safety Administration, Canadian Council of Motor Transport Administrators, Transport Canada, and the Secretariat of Communications and Transportation (Mexico).

PRESIDENT MEETS WITH TRUCKERS AND CEOS On March 23rd, leaders of the American Trucking Associations, accompanied by a group of America’s Road Team Captains, met with President Donald Trump, Vice President Mike Pence and other key Administration staff at the White House (Watch President Trump greet ATA leaders and climb up in the Share the Road Truck on the MMTA’s website under Industry News). The event also featured ATA’s Image Truck – Interstate One – and a trailer provided by Jet Express highlighting Trucking Moves America Forward imaging, hauled by ATA’s Share the Road Truck on the White House grounds. The meeting focused primarily on health care, but ATA was able to discuss additional issues including burdensome regulations, infrastructure investment and trucking’s unique role in the American economy. “It is an honor to be invited to the White House and to meet with the President,” ATA President and CEO Chris Spear said in a press release before the event. “This is a tremendous opportunity for our members and drivers to talk about how the health care debate impacts them and their ability to move America’s goods.” “The 7.3 million people who work in the trucking industry - of which 3.5 million are professional truck drivers – have a common thread –to be safe and dependable and that requires a healthy professional behind the wheel,” ATA Chairman Kevin Burch, president of Jet Express Inc., said during the meeting. “One thing for certain the professional men and women

NEW RESEARCH QUANTIFIES IMPACTS OF NATIONAL REGISTRY OF CERTIFIED MEDICAL EXAMINERS Arlington, VA - The American Transportation Research Institute (ATRI), the trucking industry’s not-for-profit research organization, has released the results of its analysis of the Federal Motor Carrier Safety Administration’s National Registry of Certified Medical Examiners (NRCME), conducted in collaboration with Mayo Clinic. ATRI and Mayo Clinic jointly surveyed over 900 commercial drivers, 300 motor carriers and 1,200 certified medical examiners (CMEs) to better understand the impacts that the NRCME has had on the trucking industry since its implementation in 2014. The NRCME was designed to improve the DOT physical exam process and ensure that medical examiners understand FMCSA regulations and guidance for issuing medical certificates.

ATRI’s research focused on commercial driver and motor carrier impacts and identified the following: A majority of drivers (63.3%) reported increased exam costs following implementation of the NRCME, yet were not experiencing commensurate improvements in exam quality; only 6.2 percent of drivers reported improved exam quality post-NRCME implementation. 26.6 percent of drivers reported spending 20 minutes or less with their CME, with 6.5 percent of those drivers spending 10 minutes or less, an insufficient time to complete all required processes of a DOT physical. Drivers certified by chiropractors were more likely to have important medical checks omitted. Among the 5.9 percent of drivers who were not issued a medical certificate on the day of their physical exam, 22.6 percent cited having a medical condition

Motor carriers still have significant concerns related to the medical certification process, including requests by CMEs for additional medical documentation causing certification delays, driver confusion of how regulatory changes impact the ability to hold a valid medical certificate, and concerns with the competency of CMEs. Nearly 50 percent of motor carriers reported that they specify which CME their drivers see to ensure medical exam quality. Less than one percent of carriers reported no major concerns with the medical certification process. The ability of drivers to find a CME close to where they live may be more challenging in the future as 15.3 percent of CMEs reported that they have quit performing DOT physicals or plan to quit performing DOT physicals. “The data show a polarity in quality of medical examiners,” said Clayton T. Cowl, MD, MS, Chair of Mayo Clinic’s Division of Preventive, Occupational and Aerospace Medicine. “Those examiners who are performing only minimal examinations may

have received substandard training or are not taking their role seriously. The key seems to strike a balance between meeting the regulatory intent of the examinations and communicating with drivers ahead of time to minimize confusion regarding the need to document clinical stability. This is particularly true for drivers with multiple or complex medical conditions from whom medical examiners do need more documentation in order to make a certification decision.” “The inconsistency in quality of exams provided our drivers creates real challenges for us as a fleet. Where in one terminal location a driver may be required to undergo extensive tests and provide additional documentation prior to getting a medical certificate, drivers in other locations are expedited through with cursory exams,” said Victor Hart, Director of Safety for DOT Transportation. ATA SUBMITS COMMENTS TO NHTSA’S NOTICE OF PROPOSED RULEMAKING Reprinted from ATA Dispatch

On April 12 th, ATA submitted comments in response to a National Highway Traffic Safety Administration (NHTSA) Notice of Proposed Rulemaking (NPRM) to establish a new Federal Motor Vehicle Safety Standard (FMVSS) for vehicle-to-vehicle (V2V) communications for new light vehicles. The proposed rule would also standardize the message and format of V2V transmissions. While the V2V NPRM applies only to new passenger vehicles, ATA is supportive of the V2V technology. Deploying this technology in light vehicles will reduce passenger vehicle crashes, which will benefit all road users. By establishing a regulatory framework, the proposed rule will not only enable rapid deployment of V2V technology in light vehicles, but also support

Improving Driver Health Will Decrease DOT Reportable Crashes and Injuries Did you know that unhealthy drivers are 2 to 3 times more likely to cause a commercial motor vehicle crash? A recent study looking at over 38,000 truck drivers who were involved in over 13,000 crashes found that drivers who have three or more health conditions are 2.5 times more likely to cause a DOT reportable preventable crash. The researchers also discovered that those crashes will happen much sooner than those compared to a “healthy” truck driver population. This research presents an opportunity for clinicians and employers to raise driver awareness about the significant impact of poor driver health. Educating truck drivers that they are 2 to 3 times more likely to cause a preventable crash when they have three or more health conditions is critical. Workplace

CMV drivers are incredibly alert when it comes to highway hazards. However, disease prevention and maintaining a healthy lifestyle are hard to do while on the road. For example - a drive thru offering fried food may be quicker and easier than going into a café or sandwich shop that offers salads, fruit or vegetables. But over time, neglecting to identify or manage disease will more than likely place a driver in a downward spiral of declining health. What would it take to help decrease your drivers’ risk of crashes and associated costs (monetary & human)? It’s as simple as educating your drivers to see their primary care provider BEFORE their next DOT Medical Certification exam. The annual “checkup” can help identify and control a long list of conditions such as diabetes,

TIPS FROM DRIVINGHEALTHY.ORG Living Healthy on the Road Living healthy on the road is challenging, but not impossible. By being creative, you can find ways to add exercise to your daily routines. We hope that you’ll use the tips below and look for other ways to add activity when you’re on the road. Exercising on the Road Need some guidance in developing a workout plan? There are numerous exercise resources online and through phone or tablet applications. These resources range from workout podcasts, to videos, to images of exercise instructions. Many of these resources are free and can be completed with little to no added equipment. For example, the National Health Service’s Get Fit with Strength and Flex plan aims to improve your health and wellbeing in five weeks. The plan includes weekly podcasts and videos of all exercises included in the plan (preview the exercises). Several additional plans are also featured on the NHS website. Not sure which type of exercise you prefer? Looking for something new? The Huffington Post Canada has gathered 20 of the best free online workouts. The page includes an overview summary of each video workout series along with a link to the series. If you prefer a do-it-yourself approach to exercising, look for exercise opportunities that you can work into your schedule: • Take a jump rope along with you and jump rope at rest areas. • Walk or jog around rest areas for cardio. • Carry resistance bands or use water bottles or cans as weights for conditioning activities. • Take advantage of truck stop resources like StayFit from TA and Petro. CONDOLENCES David Wells Harmon October 21, 1932 - February 25, 2017 David Wells Harmon of Bradenton Florida, formerly of Falmouth, Maine died February 25, 2017. He was born on October 21, 1932 in Hollis, Maine the son of Dorothy Potter Harmon and Harry A. Harmon. He grew up in Portland in the Rosemont area and graduated from Deering High School. He attended Boston University, graduating with a degree in Business Administration. Following college, he was drafted in to the Army and served as a Cryptologist with the 50th Signal Battalion. Upon discharge, he went to work at Hunnewell Trucking Company and became Vice President. When the business was sold, David went to work at Maine Fisheries as Office Manager and later as Assistant General Manager. He finished his working career at Atlantic Great Dane, Inc. as Office Manager and Accountant. David enjoyed vegetable and flower gardening and after retirement spent time building and flying remote control airplanes. David was an active member of the Falmouth Congregational United Church of Christ and served as a member of the Board of Directors and Treasurer of the Maine Conference, UCC. He was President of the Maine Truckers Association and a member of the Portland Rotary Club. Upon moving to Florida, he joined the First Congregational United Church of Christ in Sarasota, Florida David married Joyce Stearns in 1957 at the Woodford’s Congregational Church and they moved to Falmouth in 1960. They have two children, Jeffrey David Harmon, and Bethany Joyce Harmon.

Family was always the priority for David and they had many wonderful times camping and spending time at the family cottage at Sebago. He was always available to help with Boy Scouts or attend school and sports activities. He never missed the grandchildren’s baseball and field hockey games. David was also a life-long Red Sox fan. In 2011 David and his wife Joyce moved to Bradenton Florida. David is survived by his wife Joyce, son Jeffrey and wife Lisa of Auburn, Maine, daughter Bethany of Parrish, Florida, grandson Matthew and his wife Ashley of Williamstown, MA, granddaughter Katherine of New York City, sisters Ruth Hutchins of Yarmouth, Shirley and husband James Cobb of Scarborough and Englewood, Florida brother Daniel of Naples, Florida and many nieces, nephews and cousins. He was pre-deceased by his parents and a brother Harry Jr. Services were held on March 7, 2017 at the 1st Congregational UCC,1031 South Euclid Avenue, Sarasota. Both members and non-members of the Association can compete. HOW DO WE ENTER THE 2017 PROFESSIONAL TECHNICIANS SKILLS COMPETITION? Simply REGISTER ONLINE (www.mmta.com/ptsc) and send us any requests for extra banquet tickets, and any donations you care to make. We’ll send you the requested forms by return mail so that you can get the application completed and back to us well before the April 21st deadline. IS THERE ANYTHING ELSE WE SHOULD KNOW? Yes, the awards banquet will be held in the evening following the competition. CONTESTANTS and SPOUSES are guests as are JUDGES. Extra tickets are available at $25.00 each, but must be ordered by May 12, 2017. We would encourage every company with contestants to show their support by having representation at the banquet. The evening banquet will be held at Jeff’s Catering in Brewer with social hour from 5:00pm to 6:00pm. Dinner and awards 6:00pm to 8:00pm.
