Was the driver of a car involved in a near head-on collision on Greystone Drive distracted? A B.C. Supreme Court judge thinks so. Justice Gordon Funt recently ruled Yita Ricci was solely liable when her 1992 Saturn collided with a 2001 Honda Civic that was eastbound on Greystone Drive on Dec. 30, 2010. In a trial held last June to determine who was responsible for the accident, court heard Ricci was on her way to work at a grocery store that afternoon when her car drifted into the
eastbound lane and collided with the Civic being driven by Ehab Al-Tamimi, with his wife Eva in the passenger seat, as they headed home from shopping. A photograph presented to the court of the interior of Ricci’s car showed an open pop can, an unlit cigarette and two small lighters. Ricci conceded she might have been drinking pop while she was driving, and that she sometimes smokes and drives. She said she often keeps a cigarette and lighter on the car’s centre console for convenience. Each side in the case used testimony from accident
reconstruction experts to determine where the vehicles were in the roadway when they collided. Funt ruled the position of gouge marks in the pavement caused by the impact of the two cars supported the notion that Ricci’s car had drifted across the centre line into the eastbound lane. Weighing “the balance of probabilities,” Funt ruled Ricci responsible for causing the collision. “The fact that the defendant may have been reaching for something or similarly distracted would only serve to strengthen the finding,” said Funt.

Essays target impact of child poverty This year’s topic for the 2015 annual Burnaby Teachers’ Association (BTA) essay contest will look at the impact of child poverty on students in B.C. The First Call Coalition reports that one in five children in the province live in poverty, a higher rate than the national average. This year, contest
participants will be asked to write on, “How does child poverty impact students in the B.C. education system?” The contest is open to students attending public secondary schools in Burnaby. The top two prizes are $500 each to winning contestants in grades 11 and 12.
