We hope all of our readers are finding this publication a useful industry communication tool, to bridge the gap between buyers and suppliers in the rail industry. In this edition, we have our regular features from Christian Wolmar; a writer and broadcaster specialising in transport. He has covered the railways since its privatisation in the mid-1990s and writes regularly for national newspapers and magazines. Starting on page 4, Christian takes a look at the ‘highly ambitious’ refurbishment of London’s oldest station, London Bridge. On pages 18-19, Richard Collins and Paul Loraine from Bond Dickinson share some advice on commercial litigation, setting out practical documentary steps that can be taken to prevent a bad situation becoming worse. Christian continues on pages 20-21, writing about the renationalisation of Network Rail. He looks at how the move will add £30bn to the country’s debt and whether it is, as the DfT insists, just an administrative adjustment or whether the Government will use it as an opportunity to interfere. ondon is enjoying an astonishing renaissance of many of its stations. The list of major refurbishments is long, with St Pancras, King’s Cross, Blackfriars and Farringdon either complete or well under way and a whole string of others to emerge with the completion of Crossrail in 2018. There is a competition among project managers to argue that their station is the biggest and best of these schemes, but in fact there is little doubt that London Bridge wins the prize. It is, as Chris Drabble, who is leading the project points out, the only one that is really a completely new station: “New tracks, new rail, new concourse, new platforms, new signalling – we are doing the lot.” Indeed, the London Bridge refurbishment is so inseparable from the overall Thameslink scheme that led to it that there is no separate estimate of its cost. Thameslink has become a £6.5bn project. In the days of Railtrack, when the scheme was optimistically known as Thameslink 2000, the cost

was estimated to be less than £1bn but the scope has changed radically and increasing the capacity of London Bridge both for train paths and passengers is the key to the whole project. This involves creating more through platforms. Currently London Bridge has six through and nine terminating platforms – a ratio that is going to be reversed. This will allow the separation of services heading for the connecting London stations of Charing Cross, Blackfriars (and beyond up to St Pancras and the north) and Cannon Street, which at the moment have to share tracks and consequently require complex pathing arrangements. Indeed, capacity is currently so constrained that only one peak-hour Thameslink service is possible, whereas when the project is completed in 2018, there will be 16 or even possibly 18 paths available. A couple of new viaducts on either side of the station are being built and the track layout is being expanded and completely renewed. The resignalling involves the most revolutionary development in signalling technology in a generation and possibly ever on the rail network. Between London Bridge and St Pancras, the 24 trains per hour for which the route is being designed will be controlled by Automatic Train Operation (ATO). As Drabble explained, “The driver will switch over to ATO and the computer will then take the train through what will be the busiest section

of the line.” That will be the first time this technology will be used on the national rail network – although the Docklands Light Railway and three Tube lines are automatically controlled in this way. Work at London Bridge started in earnest last year after delays caused partly by objections, especially from the traders and customers of Borough Market, which is tucked in under the railway viaduct near the bridge. There were fears that the market would be killed by the requirement to build a new viaduct to boost capacity. In fact, although some stalls and part of the area have been lost, it nevertheless appears still to be thriving and according to Drabble, “Nearly everyone at the market is happy about the work that has been done.” Drabble then started to describe the work being carried out directly to the station itself. He pointed up to the Shard, the 1,000ft high building that has been constructed directly above it, and told me: “The new station will be longer than the height of the Shard.” That is because the platforms will be staggered somewhat, with some of the through platforms stretching further west than those terminating at the concourse. The owners of the Shard have paid for the work on the upper concourse and will be paying rent, given that it was partly built on Network Rail land, but the precise arrangements have been kept commercially confidential.

Work is being carried out in phases, starting initially with the first three platforms on the southern, St Thomas Street, side being taken out of commission, and resited slightly. In fact all the tracks and platforms will eventually be moved. The biggest change – of many – will be the creation of a vast concourse at street level (the tracks are all higher) running on a north–south axis and giving access to all the platforms. Regrettably, this involved demolishing some of the vault structure underneath the station. But according to Drabble, “It was not like St Pancras where the vaults were all built at the same time. There was a chaotic mess of structures built at different times.” Half the concourse will open in 2016 and when the whole of it opens two years later, it will transform access to the station and provide a major new thoroughfare for the public heading either way. All platforms will be accessible by escalator and it will be far easier for people to find the right one. Indeed, Drabble, who has a background in airports, said there was a clear philosophy behind the new design: “We based everything on four principles. First, there had to be ease of way through the station; second, there had to be permeability north– south, and hence the concourse at

street level; third, there had to be good interconnectivity not only between trains but also with buses, the Tube and even the river boats; and finally there had to be ease of access to the trains.” Drabble is confident that all these will be achieved by the new design. All this work will take place within the context of a functioning station. London Bridge is simply too important to be closed down for more than the odd weekend or holiday period. There will, of course, be disruptions and difficulties over the coming years and various temporary service changes necessitated by the fact that two or three platforms will be out of use for much of the time. However, London Bridge will essentially, as Drabble says, be a new station in fewer than five years’ time. For too long, London’s oldest station, built in dribs and drabs over decades since 1836, has been a chaotic and cramped mess. While there will be no grand external structure as with London’s other termini, although the two side entrances will be impressive, it will become a pleasant and efficient part of the journey for the 100 million passengers per year – double the present total – expected to use it within a couple of decades.

SIEMENS RAIL AUTOMATION SUCCESSFULLY COMMISSIONS MAJOR PROJECTS Siemens Rail Automation has successfully commissioned a number of high profile schemes, including projects at London Bridge, Reading, Victoria and GNGE. Following three days of intense activity, a new train describer (TD) was signed in to use at London Bridge Station on 8th December, the work representing the final contract milestone for the Thameslink programme in 2013. The Victoria Interlocking renewal project, which is also critical to Thameslink delivery, was commissioned in December. Although this scheme primarily encompassed interlocking renewal, the commissioning also covered a variety of signalling infrastructure improvements. Also in December, ahead of schedule, the signalling system was signed back into use at the Thames Valley signalling centre. This was the third of five major re-signalling phases in the Reading Station area remodelling programme. The work was critical to allow other contractors access for completion of the viaduct build and to create the new track alignment in preparation for the final two major phases of the redevelopment programme.

On the Great Northern Great Eastern (GNGE) programme, phase 1 of the signalling programme was successfully commissioned on 3rd January 2014. GNGE Phase 1 covered the re-signalling of the route between the northern fringe with Gainsborough Trent Junction signal box and the southern fringe with Lincoln West solid state interlocking. The commissioning followed the successful hangar testing of the Phase 1 modular signalling equipment at Siemen’s Chippenham facility and its subsequent installation during July and August 2013. The adoption of a modular signalling solution for this scheme has already delivered real benefits, with the use of hangar testing delivering greatly reduced testing times and enabling testing to be undertaken in factory-controlled conditions. The use of data templating, another key element of the modular approach, also brings significant time savings to the overall programme. The project team also commissioned a new Modular Signalling solution for a number of level crossings.

The headline figure of the contract is based on a guaranteed volume for each supplier and includes a degree of flexibility to allow Network Rail and its five suppliers to adapt to meet demand and changing circumstances. Trains covered by the contract include possession trains, high output renewals, rail head treatment trains, snow and ice treatment trains, shunting and support services.

The college, which is expected to open by 2017 when work on HS2 is scheduled to begin, will deliver the specialised training and qualifications needed for high speed rail, benefitting HS2 and other future infrastructure projects across the country. It will offer the necessary technical training to make HS2 a success and ensure it can be built by skilled British workers including; rail engineering, environmental skills and construction. It will be the first new incorporated Further Education College in over 20 years. The new college will provide training in how to make the most of cutting edge technology and use state-of-the-art equipment to deliver programmes designed specifically for the HS2 project. It will also build relationships with a network of affiliated facilities, including existing colleges, private training providers, HE institutions and major supply networks off route. It is expected that HS2 will create up to 2,000 apprentices during the lifetime of construction. Secretary of State for Transport Patrick McLoughlin said: “Creating jobs by delivering better infrastructure is a key part of the government’s long term economic plan. HS2 will not only help businesses expand, creating employment; it will also give young people opportunities to get new skills, get a job and a career. When open, it is predicted that HS2 will underpin the delivery of 400,000 jobs.” HS2 Chairman David Higgins said: “This country produces some of the best engineers to be found anywhere in the world. The problem is that there aren’t enough of them, and there isn’t a long enough guaranteed work-stream to keep them here. HS2 provides us with a unique chance to address both issues. It gives us the chance not just to re-balance the economic geography of the country, but also our national skills base.” This forms part of the government’s work with HS2 Ltd to ensure the new north-south railway delivers a tangible skills legacy that will serve the UK for the next century and continue the proud tradition the UK has for worldwide demand for its engineering expertise.

NETWORK RAIL SIGNS FIVE-YEAR HAULAGE AGREEMENT WITH FIVE SUPPLIERS Network Rail’s National Delivery Service (NDS) has signed a contract with five suppliers to provide haulage for the company’s fleet of engineering trains in control period 5 (2014-2019). DB Schenker, Freightliner Heavy Haul, GBRf, Direct Rail Services and Colas Rail will provide locomotives and drivers under contracts worth more than £600m over five years. Each supplier will provide haulage in different proportions depending on where on the network the trains are required and the respective companies’ strengths in those areas. Martin Elwood, Network Rail’s director of NDS, said: “This is a vital contract for us and will be crucial to delivering the high volumes of work we have committed to in CP5. With a guaranteed volume, we and our suppliers will be able to plan ahead and we are confident this agreement will put us in a strong position to support the biggest investment in our railway in the modern era.”

CROSSRAIL COMPLETES UNPRECEDENTED FORTNIGHT OF MILESTONES Crossrail’s western tunnels are now structurally complete with tunnelling machine (TBM) Ada reaching the end of her journey at Farringdon on 24th January – having set out from Royal Oak near Paddington in August 2012. This follows the arrival of her sister machine Phyllis at Farringdon in October 2013. Over in southeast London, TBM Sophia has completed Crossrail’s first tunnel beneath the Thames, arriving at the North Woolwich Portal on 29th January – having started south of the river in Plumstead last August. TBM Jessica has also completed her tunnelling journey from Pudding Mill Lane and broke through into one of Europe’s largest mined caverns beneath Stepney Green on 3rd February. In addition, tunnelling machine Elizabeth made a spectacular entrance into the new Crossrail station at Whitechapel on 20th January on her journey from Limmo Peninsula to Farringdon. Her sister machine Victoria also broke through into Stepney Green on 30th January. The milestones continue Crossrail’s impressive construction progress, which recently passed the halfway mark on time and within budget. In 2014 the project will transition from major civil engineering work to station and tunnel fitout. 30km out of 42km of bored tunnels are now complete. Andrew Wolstenholme OBE, Crossrail Chief Executive said: “The tunnelling teams deserve tremendous credit for their safe and efficient progress in constructing this major new railway under London. The end is now in sight for Crossrail tunnelling with over 70 per cent of the new rail tunnels now constructed.” Now that Sophia’s journey has finished, her sister Mary will shortly be launched from the Woolwich box to complete the final section of tunnelling on Crossrail’s southeast section. With the arrival of TBM Jessica at Stepney, an eighth tunnelling machine, Ellie, will commence her journey from Pudding Mill Lane to Stepney later this month.

TRANSPORT FOR LONDON ANNOUNCES BOMBARDIER AS WINNING BIDDER FOR CROSSRAIL

Image: Bombardier Aventra train for Crossrail, © Bombardier On 6th February, Bombardier confirmed that it had been notified by Transport for London (TfL) and The Department for Transport (DfT) of their intention to award a contract to deliver rolling stock and a new depot for Crossrail. The intended contract between TfL and Bombardier covers the supply, delivery and maintenance of 65 new trains and a depot at Old Oak Common. The contract award is subject to a 10 day standstill period. Dr. Francis Paonessa, Managing Director, Bombardier Transportation UK, said: “We are absolutely delighted to have been recommended as the winning bidder for the Crossrail rolling stock and depot contract and look forward to closing the contract with the customer.

“This is a resounding endorsement of our proposed Bombardier Aventra train for Crossrail, which has proudly been designed and developed in the UK as an iconic and world-technology leading train for London. “The decision is a credit to the efforts of our entire workforce in the UK, including our 1,600 strong Derby-based design, engineering and manufacturing team who form a global centre of excellence for the rail industry, as well as our outstanding maintenance teams who support train operators right across the country and particularly in London as demonstrated during the London 2012 Olympics.”

GREAT BRITAIN RAIL SAFETY PERFORMANCE AND TRENDS FOR 2013 RSSB has published its high-level Overview of Safety Performance for the calendar year 2013. The performance should be viewed against an overall context of increasing passenger usage, with levels having increased by around 25% over the last five years. The rail industry has sustained improvements in safety performance and risk through the efforts of its employees and is amongst the safest rail transport in Europe. Colin Dennis, Director of Policy, Research and Risk said ‘The risk associated with train accidents resulting in passenger or workforce fatalities remains low, with no such accidents occurring for the sixth consecutive year. However, the potential increase in risk from operating incidents

recorded in 2013 and the occurrence of the significant multiple fatality train accidents in Canada, Spain, France and Switzerland in July 2013 reminds the industry of the risks associated with railway operations and that there is no room for complacency in the ongoing management of risk. Compared to 2012, when no passenger fatalities were recorded, 2013 saw an increase in passenger fatalities at stations to a level more consistent with the longer-term average. Five of the fatalities resulted from accidents at the platform edge, which is an area of risk the industry is targeting over the coming years’.

NETWORK RAIL CHOOSES SUPPLIERS TO DELIVER £2BN PROGRAMME TO ELECTRIFY RAILWAY ACROSS BRITAIN Four suppliers have been appointed by Network Rail to deliver a £2bn programme to electrify more than two thousand miles of Britain’s railway over the next seven years, providing faster, quieter, greener and more reliable journeys for passengers and freight users and cutting the cost of the railway. The successful bidders – Balfour Beatty, AmeyInabensa, CarillionPowerlines and ABC Electrification – will work with Network Rail to plan and deliver a range of schemes which will see key routes in England, Wales and Scotland electrified for the first time. Once electrification schemes including the Great Western and Midland main lines, Liverpool to Manchester and Preston, the Valley lines in south Wales and the ‘electric spine’ from Southampton docks to the West Midlands and Yorkshire are complete, more than half of Britain’s rail network will be electrified with electric trains accounting for three-quarters of all traffic. Simon Kirby, managing director of Network Rail’s infrastructure projects division, said: “Our work to electrify two thousand track miles represents the biggest programme of rail electrification in a generation and will provide faster, quieter and more reliable journeys for millions of passengers every week while cutting the cost of the railway. To deliver this work in the

safest and most efficient way possible, we need to make the most of the huge potential within our supply chain.” Six geographic framework contracts have been awarded, with each having a defined workbank of schemes to be delivered. This approach has been endorsed by the supply chain and industry groups such as the Railway Industry Association. Jeremy Candfield, director general of the Railway Industry Association, commented: “This is a major and very welcome step in the transformation of the railway. It will encourage suppliers to invest in the training and equipment needed for the growing national electrification programme and pave the way for suppliers’ greater involvement to maximise the efficient delivery of the projects.” The inclusion of a significant number of committed projects within each framework will support investment in the training and development of the resource pool, including supporting the proposed development of a Network Rail Electrification Training Academy, as well as providing the investment needed to develop innovation and improvements in the reliability of electrification technology.

£20M STATE-OF-THE ART CENTRE FOR INNOVATION IN RAIL UNDERWAY The Government is providing crucial funding enabling the University of Huddersfield’s Centre for Innovation in Rail (CIR) to go ahead. This £4m Regional Growth Fund grant will be matched by the project partners. The overall investment in the project is over £20m. The CIR will be based within the internationally-renowned Institute of Railway Research (IRR) at the University and will build on the Institute’s strategic partnership with RSSB, with the support of the National Skills Academy for Rail Engineering (NSARE) and technology partners, Unipart Rail and Omnicom Engineering. The new facility will build upon the world-class product design and R&D capability of the project partners, to provide industry and academia with training, research and expert services to develop

COSTAIN JV AWARDED £900M NETWORK RAIL CONTRACT Costain is pleased to announce that its Joint Venture (JV), ABC Electrification Ltd, has been appointed by Network Rail as one of four suppliers to the £2bn National Electrification Programme. The contract is valued at an initial £900m to the JV under a seven year term, extendable by a further three years. ABC Electrification Ltd is an equal share JV comprising Alstom, Babcock and Costain. The JV has been awarded two out of the six geographical areas within the programme: London North West (South) region and the Wales and West region. Andrew Wyllie, Chief Executive of Costain, commented: “We are delighted to have been appointed to this major electrification programme by Network Rail, helping to upgrade and refresh the UK’s transport infrastructure. This repeat order is a consequence of our ‘Engineering Tomorrow’ strategy, whereby we form long-term, strategic partnerships with our customers to deliver a broad range of services across the full life cycle of their assets.”

COLAS RAIL SIGNS FREIGHT HAULAGE CONTRACT WITH NETWORK RAIL

The IRR’s Assistant Director and CIR project manager Dr Paul Allen explained that the Centre will have a dedicated team comprising academics, researchers, business development staff and administrators. “This will include all aspects of vehicle design and track construction to increase safety and reliability, reduce asset costs and drive performance improvement of the railway system. Priority will be given to assisting regional SMEs to develop competitive products and services that can be brokered into the railway supply chain, and result in new job creation and up-skilling of the workforce,”

Colas Rail has signed a freight haulage contract with Network Rail with a value of approximately £90m. Colas Rail Freight will provide haulage for daily network services and possession services mainly for the Western and Southern regions. The Network Rail haulage contract is the largest freight contract in the United Kingdom. Stephen Haynes, Managing Director of Colas Rail Services said: “We are committed to providing a high quality service to Network Rail in an alliance approach given that we benefit from being a major Infrastructure contractor for rail maintenance, track renewals and enhancements”. The requirements of the new contract and the growing demand on its rail freight business will be satisfied by the acquisition of 10 new Class 70 locomotives announced earlier in the year.

CHANCELLOR UNVEILS THE START OF £600M RAIL INVESTMENT IN THE NORTH OF ENGLAND The Chancellor of the Exchequer has officially launched a £600m investment programme which will transform the railway and boost the economy in the north of England. George Osborne MP marked the start of construction of a fourth platform at Manchester Airport station on the 7th February, the first phase of a project which spans the north of England. The £600m Northern Hub project will provide significant long-term benefits to passengers and help stimulate economic growth in the region by providing faster, more regular and reliable connections between towns and cities. Alongside Network Rail’s electrification programme, more than £1bn will be invested in the railway in the north of England by 2019. The Chancellor of the Exchequer, George Osborne MP, said: “Each part of this project, like the first work at Manchester Airport station, will help us build the infrastructure we need to compete in the global race. “This investment will ensure growth is not concentrated in any one place by keeping

Britain connected and creating thousands of local jobs, delivering a brighter economic future for the whole country.” Martin Frobisher, area director for Network Rail said: “The Northern Hub and electrification programme is the biggest investment in the railway in the north of England for a generation and will transform rail travel for millions of passengers every year.” Alex Hynes, managing director, Northern Rail said: “The development at Manchester Airport will mean more reliable connections between rail and air, offering more opportunities to our customers to travel throughout Britain and beyond from the north of England.” Construction will take place between 14th March and 7th April 2014 and will include two weekend closures of the railway at Manchester Airport on 14th and 15th March and 5th and 6th April. The £20m platform upgrade at Manchester Airport station is due for completion by the end of 2015.

Network Rail has announced that it is accepting the Office of Rail Regulation’s conclusion for funding to maintain and improve Britain’s railway over the next five years. Control Period 5, begins in April 2014 and will benefit the rail experiences for four million daily passengers, freight users and strengthen Britain’s economic growth. Over the period, £38bn will be spent in maintaining, renewing and improving the network. More and new trains will be added to the network, new stations built, facilities improved, platforms lengthened and transformational projects, such as the Thameslink programme, the Northern Hub and main line electrification, completed. David Higgins, chief executive, said: “The railway is a complex, long-term, critical element of Britain’s infrastructure and needs sustained, high levels of investment if we are to meet the public’s rapidly increasing appetite for rail travel, and businesses’ desire to move freight off congested roads.” “We were clear in the development of our plans that we would need to do some things very differently in CP5 if we are to be successful in meeting the new challenges that we face and we remain committed to continuing with these changes. “Together with the ORR, we are determined to continue our drive to improve safety. Fundamental to this will be on-going improvements to our safety culture and how we manage our assets. By achieving this we can also deliver on-going efficiency savings and improve the reliability of train services, but getting the balance right between running more trains and improving punctuality will be a major challenge. “We are disappointed that we will start CP5 at a lower level of performance than was assumed at the time of the Final Determination. This is partly because of the weather but we also recognise our responsibility for the missed targets. We can still meet the targets for the end of the control period. Although we cannot do so as quickly as assumed or in all weather, we will work with operators to improve performance as fast as possible.”

EUROTUNNEL COMPLETES THE MOBILE TELEPHONY OFFER IN CHANNEL TUNNEL, 100 METRES BELOW SEA LEVEL Eurotunnel and the British mobile telephone operators EE (formed following the merger of Orange and T-Mobile in the UK) and Vodafone have signed a 10 year agreement to offer mobile services in the Channel Tunnel. Customers of both operators will have access to 2G1 and 3G2 services in the North Tunnel (UK to France)3. Both EE and Vodafone intend to offer 4G data services throughout the tunnel in the future. This will enable passengers of both Le Shuttle and high speed passenger trains to use their mobile phone or tablet device at any point of the journey through the Channel Tunnel. The quality of communication will be equivalent to a call made in Paris, London or anywhere above ground. Providing such a wireless service 100 metres below sea level for the 20 million passengers who travel through the world’s longest undersea tunnel each year is a first. and its partners have overcome a series of technical challenges: the work was conducted without disruption to railway traffic, in a confined environment under stringent safety conditions. Eurotunnel has equivalent agreements with the French mobile operators, Bouygues Telecom, Orange and SFR which cooperated for the successful installation of GSM-P services in the South Running Tunnel in 2012. Eurotunnel’s ambition to continually improve the service it offers to its customers has brought an answer to the increasing need for connectivity on the move. 1 2

THE ART OF SELFPRESERVATION: DOCUMENT CONTROL

Commercial litigation hurts. It can destroy businesses along with both individual and corporate reputations and – win or lose – can be just about the most stressful thing that a person can experience during a career. Richard Collins and Paul Loraine of Bond Dickinson set out some practical documentary steps to take to avoid a bad situation becoming worse.

I

n recent years litigation has been happening across the rail industry, including the legal challenges to HS2, the InterCity West Coast challenge by Virgin and major rolling stock procurement challenges. The odds are that major commercial litigation will be coming your way one day, so it pays to take the time now to prepare yourself in advance.

Anticipating trouble Litigation in the industry includes disputes centred on late payment or non-payment, engineering and maintenance issues and conflicting interpretations of standard documents, to name just a few recurring themes. It is invariably disruptive and frequently expensive. Any steps that businesses can take to de-risk the process are therefore helpful. This article concentrates on good document control. That is because in the course of any litigation, relevant documents (including internal memos and emails) must be disclosed to the other side. This can come as an unpleasant surprise to businesses used to treating internal documents as confidential. That said, the law protects certain categories of documents to ensure that

open and frank discussions can take place both within an organisation and between that organisation and its legal team. Wherever you are positioned within the rail industry, it is prudent to have in place clearly articulated and consistent practices for document control. This way, the business can be confident – should it find itself involved in litigation – that the protections offered by the law are working for it to the maximum possible extent.

Legal Professional Privilege To briefly set document control in its legal context, the source of the protection referred to above is Legal Professional Privilege (LPP). If a document is privileged, it does not need to be provided to the other side. A good starting point in ensuring good document control is to encourage everyone across the organisation to become familiar with the basic operation of LPP which has two strands: Legal Advice Privilege – confidential communications between lawyers and their clients made for the dominant purpose of seeking or giving legal advice; and

Litigation Privilege – confidential communications made for the dominant purpose of litigation at a time where litigation is pending, reasonably contemplated or existing, between a lawyer acting in a professional capacity and their client or between the lawyer and a third party or between the client and a third party.

Controlling communications with the legal team Not all communications between the legal team (both internal and external) and employees of the business will be covered by legal advice privilege. Where legal advice is sought, only the body of people authorised to give instructions and act on the advice of the lawyer are considered to be the ‘client’. The consequence of this is that documents sent between ‘non-client’ employees of the business and the legal team will not be privileged. A couple of simple practical steps can ensure that the organisation is better protected in the face of litigation: Make clear to everyone in the organisation that privilege will not automatically attach to all communications involving the legal team; and

define a small group who have responsibility for seeking out instructions from the legal team and acting on those instructions and document this decision. Ensure no-one from outside this group seeks or receives legal advice. While, instinctively, it might make sense to define the internal ‘client’ team widely, the court may reject any artificially wide definition of ‘client’.

Maintaining confidentiality In order to benefit from the protection of privilege, communications must be confidential. There are some practical steps which can be taken to make sure documents are treated as confidential: Keep a list of legally privileged documents, recording the people who have received the documents and when they were received; when circulated, keep the documents in folders marked ‘privileged and confidential’; keep the documents outside of shared network drives or folders accessible to everyone in the business; be careful about forwarding email chains; start a new chain where privileged information is or may be referred to; enter into confidentiality agreements with any third parties to whom you must provide the documents.

Labelling documents Teams within the business should make it plain when they are asking for confidential legal advice. A straightforward way of doing this is using headers on all emails, internal memos and so on, clearly stating that the communication is intended to be privileged and confidential and has been prepared for the purpose of obtaining legal advice or for the purposes of litigation or arbitration. Such labelling is not conclusive but it focuses the mind of the recipient on the question of privilege and the need for the email to be treated as a confidential document (i.e. not circulated widely) in order for privilege to apply.

As well as labelling communications, it is also wise to record the existence of a real likelihood of litigation (insofar as this is possible), in board minutes for example. Again, this will not determine whether a document is privileged, but it could help to persuade the court.

Avoid creating ‘mixed’ documents Some documents will contain a mixture of legal advice and commercial observations. Where this is the case, only the legal advice will attract privilege. The correct approach is for such documents to be disclosed with the privileged parts blanked out. It is sensible to avoid creating such ‘mixed’ documents where possible to avoid facing an argument that privilege may have been waived in the whole document, for example as a result of errors in the blanking out of the privileged materials.

Scope of Legal Advice Privilege Legal Advice Privilege does not extend beyond qualified lawyers. Always ask third parties to communicate any confidential information orally to the lawyer so the lawyer can then provide legal advice to you on that information under the cloak of privilege.

Training Training for all staff should make clear the boundaries of LPP and emphasise that in creating a document – whether it be an email, an internal memo or similar – that document stands to be disclosed in any future litigation where privilege does not apply. For those giving and receiving legal advice, care should be taken to mark documents appropriately and maintain the confidential character of documents. Those employees not within the defined ‘client’ group should be wary about their communications with lawyers, internal or external. A better approach for ‘non-client’ employees may be to raise any queries in person with a member of the ‘client’ group who can then seek advice in writing with the benefit of privilege.

he rail industry received a shock in the run-up to Christmas when the Department for Transport (DfT) slipped out the fact that Network Rail’s debt, amounting to roughly £30bn, would go on the Government’s books from September this year. This has been portrayed by the Department as a merely administrative matter that will not change the status of Network Rail and will not affect the rail industry’s investment plans. Indeed, it has been a long time coming. It has for several years been an anomaly that the growing debt, which is expected to

reach a staggering £50bn in 2019 by the end of the five-year Control Period that starts this April, was technically a private matter, though guaranteed by government. The DfT issued a “Memorandum of Understanding” which stressed that: “The Government’s general approach to this reclassification is therefore only to make changes where they are required to satisfy Government and Parliamentary budgeting and accountability requirements.” But then there was an extra section which has some in the industry worried: “...or justified to deliver value for money.”

That second phrase is seen as a bit of a catch-all. Any aspect of Network Rail’s work could come under scrutiny to be assessed as to whether it was “value for money”. One former railway manager, who now works for a government-owned company, said it is certain the Government and ministers will involve themselves in the running of Network Rail: “I’ve worked for a so-called arm’s length organisation for the past four years and the level of government interference is frightening, far more, I would imagine, than the BR Board ever had to cope with.” There are, indeed, serious concerns among railway managers about the impact of the change, especially in the longer term. While reluctant to come forward publicly, in private many railway managers see the move as a chance for the Government to increase its influence on the industry and attempt to micro-manage. One area that will definitely face much closer scrutiny is bonuses, especially for senior staff. Coalition ministers have, in the past, expressed concerns about the bonuses paid to Network Rail managers but have been powerless to do anything about it because to interfere would have meant the debt being counted on the Government’s books. Now that this has happened anyway, there is nothing to stop ministers putting pressure on the Network Rail board to limit these payments. In fact, it is inevitable that this will be the case because otherwise the press, very hot on the issue of bonuses these days, will blame ministers for not taking action. Many rail passengers, angered by six-figure bonuses paid to Network Rail’s senior managers even when performance has been patchy, will in fact welcome such interference. A Network Rail source raised another area of concern, saying: “I am convinced that the regulator [The Office of Rail Regulation] will be emboldened by this move and be more prepared to take a more active role in policing Network Rail. The regulator will want to show ministers that he is keeping a close eye on Network Rail’s spending, which will be seen as taxpayers’ money.” Again, there are many

Inside Network Rail, the biggest fear is that it will be more difficult to attract the best senior staff taxpayers and even rail passengers who may be glad of such increased scrutiny. Inside Network Rail, the biggest fear is that it will be more difficult to attract the best senior staff. “Already”, according to the insider, “it is noticeable that when our teams are negotiating with their counterparts in train operating companies [TOC], there is a considerable disparity between what our people are paid and what the TOC managers are getting.” There are real concerns that Network Rail will now be seen as a less good option for ambitious staff keen to make rapid progress in the industry. The biggest fear, though, is whether the change will affect investment. In the bad old days of British Rail, ministers would often make quite radical changes to the railways’ budget at a very late stage, leading to cuts in much needed improvement schemes or, at times of feast, a rapid need to spend money which led to much waste. However, thanks to the complicated way in which investment in the industry is determined, there is no risk of returning to the vagaries of the old annual announcements. The fact that Network Rail, in conjunction with the rest of the industry, draws up an overall investment plan for a five-year period in line with the requirements of the DfT and this is then assessed by the Office of Rail Regulation, gives a strong element of protection to the industry’s long-term plans. The change, too, has come at a rather fortunate time since the next five-year period (CP5) will start in April 2015 and it will be impractical to make radical changes to the programme. While few in the industry believe the Government’s assertion that this reclassification is a mere technical matter, there is no mood of panic as yet, despite considerable degrees of apprehension.

ll the attention on rolling stock in recent years has been on the big orders for Thameslink and the InterCity Express Programme (IEP), both of which have been extremely complicated financial deals. These orders signified a move away from the previous model of train operators obtaining new trains through the rolling stock companies (ROSCOs) and were particularly large orders stretching across several parts of the network. Then there is Crossrail, whose fleet, which will be built at Bombardier’s Derby works, will start coming on stream in 2017, and HS2, which will also create a step change increase in the supply

of stock across the network – but that is at least a dozen years away. Meanwhile, with the increase in train movements and passenger numbers, there is going to be a significant requirement for additional trains on the rest of the network. For the past year, train operators, Network Rail, manufacturers, the rolling stock companies and various other players have been meeting under the auspices of the Rolling Stock Strategy Steering Group in order to work out the long-term needs of the industry. Such forward thinking has been absent since the days of British Rail and, more recently, the Strategic Rail Authority, and to some extent rail passengers are already paying the price of this failure.

The key issue is the shortage of Diesel Multiple Units (DMUs) across the network. For example, Abellio would like to run an hourly service between Ipswich and Peterborough but is unable to do so because there is not enough rolling stock available. In many other parts of the country, trains are simply too crowded to carry all the passengers wanting to travel because of the lack of DMUs. Long-term planning is therefore well overdue. The report of the Steering Group, first published a year ago, has just been updated but the recommendations have changed little. On the basis of a growth rate in passenger numbers of 2.5 per cent, there will be a requirement for between 13,000 and 19,000 passenger vehicles over the next 30 years. Malcolm Brown, who is chief executive of Angel Trains and chairman of the Steering Group, says that this is a conservative estimate. “Passenger miles nearly doubled in the 16 years between 1996 and 2012, which represents an average of 4.1 per cent annually. So this is by no means likely to be an overestimate.”

The emphasis, too, is very much on electric vehicles. The programme to electrify large swathes of the network is well under way and it is noticeable how this has expanded incrementally with additions such as the Cardiff Valleys and a new section in the North. The logic is inexorable. Electrification not only offers a better journey experience but also provides environmental benefits. Therefore the focus will be on acquiring electric vehicles over the next few years as by 2042 Brown reckons the overall stock will consist of barely six per cent diesels. The implications for the manufacturers are encouraging. With the recent growth and the life-expired nature of swathes of the stock, notably the widely disliked Pacers, Brown reckons the demand needs to be front-loaded, which implies building up quickly to a production level of “8 to 12 vehicles per week”. Indeed, Brown reckons that a reasonable estimate of the number of coaches required by the end of Control Period 5 (March 2019) is between 3,200 – the central forecast – and 4,150, the upper estimate. With Crossrail, IEP and Thameslink providing roughly 2,200, cars, that implies at least around 1,000 for general use around the network if the central forecast is borne out – and nearly 2,000 with the higher estimate. The question remains as to how this will be done. The Department for Transport (DfT) has for some time been hostile to the ROSCOs, even though accusations that they took advantage of their dominant market position were not borne out in the subsequent lengthy and expensive inquiry into their behaviour by the Competition Commission published in 2009. While train operators have long argued that they should have more say over acquiring new trains, there is no getting away from the fact that the Department will always have a key role, given that for the most part it is the paymaster and has the strategic role of analysing future trends. However, Brown is confident that the ROSCOs will also be playing a key role in future acquisition programmes: “The ROSCOs have the financial capability to buy the stock and this ensures that the trains are not on the Government’s balance sheet. Ministers

really do not want to see an increase in borrowing.” This is especially true, given that Network Rail’s £31.5bn debt has now been incorporated on the Government’s books. Brown also emphasises that the experience of the ROSCOs is useful to the industry: “We have the project management skills required to deal with the manufacturers and ensure that the trains are procured as cheaply and efficiently as possible. And we are able to take a long-term view.” Vast savings could be made by ensuring that particular types of vehicle are specified. Brown reckons that there should be a series of basic products to ensure that trains can be bought off the shelf rather than, as has happened in the past, being specified for a particular line.

On the basis of a growth rate in passenger numbers of 2.5 per cent, there will be a requirement for between 13,000 and 19,000 passenger vehicles over the next 30 years “Product One” would be a suburban commuter EMU that would typically operate on routes of 30 miles and have a top speed of between 75mph and 100mph. “Product Two” would be a regional and commuter express with high acceleration and a top speed of 100mph to 125mph. The other question is how much of this will be built in the UK. Increasingly, in fact, rolling stock manufacture has become a global industry with parts being sourced across the world. Manufacturing plants have by and large become assembly plants but even these do generate considerable numbers of jobs. After the widespread criticism over the decision to source the Thameslink trains from German manufacturer Siemens, it is highly likely that most of these new carriages will be assembled in the UK. It seems, therefore, that the rolling stock industry is in for a rosy future.

S2 is still only stumbling towards the start line but there is renewed confidence among its promoters that the scheme, which is not due to start being built until 2017, will get the go-ahead. For the most part, recent progress has been relatively smooth, albeit with the occasional mishap. Therefore, despite shadow chancellor Ed Balls expressing some doubts about the project, the Labour Party has remained supportive. Indeed, the new shadow transport secretary, Mary Creagh, appears to be just as much in favour as was her predecessor, Maria Eagle. This is important since David Cameron has said that without Labour support, the project cannot go ahead. The key recent event was the publication of the HS2 Bill late last year. The document is not an easy read – indeed it is unlikely that anyone has read the whole of it since it consists of 49,814 pages. Even then, there were apparently 877 pages missing, which led to an extension of two weeks in the consultation process following a ruling by a Parliamentary Committee after protests by opponents. However, this has been the only major setback for the supporters of the Bill who, privately, are much more confident of success than previously. The attempt by opponents to derail the project in the courts failed spectacularly. Last year, virtually all their objections were thrown out by the High Court and the Appeal Court and in January the Supreme Court finally laid to rest any chance of halting the process. Although some opponents were talking of going to Europe to continue their campaign, their chances of success were reckoned to be thin. Infrastructure law expert Patrick Twist of Pinsent Masons said on the firm’s

website, Out-Law.com, that with the legal challenges out of the way the Government could now concentrate on obtaining Royal Assent for the HS2 Hybrid Bill: “The DfT and HS2 Ltd will feel that this outcome supports the way that the project has been promoted. Of 10 judicial reviews sought, only one, concerning limited aspects of the consultation process, was granted. The Government has taken this on board and has revised the consultation.” He added that “the debate now moves away from any legal challenge and exclusively into the parliamentary and political arena” but suggested that hopes of seeing the Bill through Parliament by the next election were “ambitious”.

All attempts by opponents to derail the project in the courts failed spectacularly. The second reading, delayed slightly by the missing pages, is now expected to be in late April, with the initial London-to-Birmingham section of the route currently scheduled for completion in 2026. This first Bill, however, covers only the route between London and the West Midlands. The northern sections, the two legs to Leeds and Manchester respectively, will require a repeat of this process with possibly an even longer Bill and cannot be introduced until after the first Bill has completed its Parliamentary process. This section is not due to be completed until 2033 at the earliest. The supporters of the Bill have also been encouraged by the appointment

of David Higgins, the former boss of Network Rail, as the chairman of HS2 Ltd. Higgins started work in January and immediately announced the appointment of one of his former colleagues at Network Rail as the new chief executive of the project. Simon Kirby, who has been responsible for Network Rail’s major projects for many years, is replacing Alison Munro, who becomes HS2’s managing director of development to oversee the Bill’s passage through Parliament and the development of the second phase. On taking up his post, Mr Higgins immediately said that cost savings were the priority. He told BBC News: “The first thing I want to look at is the overall deliverability. Time – can we make it quicker? Can we get benefits to the north earlier? And then how can we deliver it most effectively? Hopefully that will deliver cost savings.” Currently the cost is estimated to be £42.6bn but with rolling stock the total will reach £50bn. He added that he had been asked to report back to Transport Secretary Patrick Mcloughlin by early to mid-March on savings. So while the HS2 Ltd team are clearly feeling more confident of the project making progress, the issue of costs remains. Any unexpected rise will undoubtedly lead to renewed questions over the scheme’s future. The other uncertainty is over the Parliamentary process. An early attempt to get Crossrail built failed in Parliament in 1994 when the committee responsible for the Bill decided that the case for the project had not been made. Although this is highly unlikely to be repeated this time, it demonstrates that nothing can be taken as certain in politics. So far the supporters of HS2 Ltd have gained the upper hand but there is nevertheless no room for complacency.

The HS2 project has the potential to transform rail travel, deliver vital capacity and bring major benefits to our cities. I was delighted to have the opportunity to help make HS2 a reality.

What experience from your previous roles can you bring to the HS2 project? I have spent much of my career working on major projects, including HS1. Also, the early stages of project planning and development, understanding of the wider political, funding, economic and social issues is essential.

What do you enjoy most about your job? The sense of purpose and achievement, in delivering such an important project, and there are so many different aspects of the project, that make it challenging and interesting.

How important is the HS2 project to improving the UK rail network? Demand has been growing across the railway network, for both passenger services and freight. This growth puts increasing strain on the resilience and performance of the network. HS2 is a key element of the future rail network, improving capacity, connectivity and performance on services between our cities. It will also free up capacity and enable better reliability on the existing network.

How important do you think HS2 is to maintaining economic growth in the UK? Good transport infrastructure is fundamental to Britain’s ability to prosper. Capacity constraints on the railway will increasingly put a brake on economic growth. HS2 provides vital additional capacity, and will also increase the economic potential of our other cities. It will create development and regeneration opportunities around the eight new stations that we plan to build, and 400,000 jobs according to the core cities. Analysis by KPMG shows that HS2 could boost the economy by up to £15bn per year (2013 prices) and concludes that the regions – not London as some have suggested – will be the biggest winners from the new rail line.

Do you think other areas of infrastructure will suffer from the large investment in HS2? HS2 is not at expense of other projects: the Government is investing more than £56bn on roads, other rail and local transport between 2015 and 2021.

Are you concerned about Labour repeating the same mistakes with HS2 as Harold Wilson’s Labour government made in 1974, when they cancelled both the Channel Tunnel and London airport? On a long term project like HS2 cross party political support is vital. The project still enjoys support from the three main parties and we are now progressing the Bill to build and operate the first phase of the network. I recognise that keeping costs under control will be vital to maintaining support. I always say that we do not want a blank cheque. We are absolutely focused on delivering this project on time and within budget.

How significant will the HS2 project be to the UK rail supply chain? And will the project offer support to SMEs in order for them to compete for work along the way? HS2 offers a major opportunity to the supply chain, offering a pipeline of work over nearly 20 years, and generating thousands of construction and operational jobs. Our recent Supply Chain conference (5th November 2013) was oversubscribed with over 1400 individuals registering interest to attend the event, representing over 600 organisations. 55% of organisations attending were SMEs. We will be seeking to maximise the opportunities for SMEs.

HS2 is not scheduled to take passengers until 2033, how important is it that the next generation get behind the project, as well as the current? We plan to start carrying passengers in 2026 on the first part of the network between London and the West Midlands. It is important that we get the next generation to understand why we need HS2, because this is a vital investment for future generations, which will help shape future growth and where we live and work. Furthermore they have a key role in delivering HS2. The planning, development and construction of HS2 will require a wide range of engineering skills. To enable us to build a skilled workforce for HS2, and to fill the tens of thousands of specialist jobs we will create, HS2 Ltd is already working with the National Skills Academy for Rail Engineering and CIBT Construction Skills to identify a potential skills gap and create opportunities for engineers and construction workers. On the 14th January 2014 we announced plans for a new college to train the next generation of world-class engineers to work on the construction of High Speed 2 (HS2). The college will deliver the specialised training and qualifications needed for high speed

rail, which will benefit HS2 and other future infrastructure projects across the country. It will offer the necessary technical training to make HS2 a success and ensure it can be built by skilled British workers including; rail engineering, environmental skills and construction. It will be the first new incorporated Further Education College in over 20 years. It is also expected that HS2 will create up to 2,000 apprenticeships during the lifetime of construction. This ensures the new north-south railway delivers a tangible skills legacy that will serve the UK for the next century.

There are concerns about how HS2 will harm the environment. What steps are being made to help reduce the environmental impact of the project? We are very sensitive to the impact on the environment and environmental considerations have been at the heart of our selection of routes, development of design and arrangements for construction of the railway. We have incorporated substantial mitigation works, such as tunnels, cuttings, and landscaping to reduce noise and screen the railway from view.

We will be planting up to 4 million new trees resulting in there being more woodland when HS2 is completed than there is now. We are also working closely with a wide range of environmental groups such as Natural England and the National Trust to manage the effect that HS2 has on the landscape.

How confident are you that HS2 will be carrying passengers in 2033? And what other developments do you expect to see in the UK rail industry by that time? We plan to be carrying passengers on the first part of the network from 2026, and on the second phase to Manchester and Leeds by 2033. We are also closely looking at whether we can deliver the benefits of the second phase north of Birmingham more quickly. Alongside HS2, there will be continuing investment in the rest of the rail network, and we will be working with the industry to ensure that our plans are integrated to deliver the maximum benefit for the country as a whole. HOW GIS TECHNOLOGY IS REVOLUTIONISING ECOLOGY MANAGEMENT ON BRITAIN’S RAILWAYS Words: Tim Donoyou, Technology Lead, Thomson Ecology

T

here are over 30,000 hectares of vegetation running in corridors next to railway lines in the towns and countryside of the UK – an area equivalent to the Isle of Wight. Rail tracks run through, or adjacent to, nearly 300 Sites of Special Scientific Interest (SSSIs) in Britain, as well as through locally important wildlife sites. Biodiversity therefore plays an important part in the running of a railway. Any planned work taking place on railway land must include an ecological assessment as a central part of the planning process. Thomson Ecology, the UK’s leading independent ecology specialist, has been working closely with Network Rail and its partners providing strategic ecological advice and habitat mitigation measures for a number of rail projects. These

include Phase 2 of the East West Rail project, which will run from Bedford to Bicester, with spurs leading to Milton Keynes and Aylesbury (East West Rail partnership), and the extensive nature reserve creation on Wallasea Island (Crossrail team). The company has also provided training on ecology and biodiversity issues for Network Rail project managers. Ecological assessment takes place in the early stages of any new scheme and, as part of this, wildlife on site must be accurately located so that adverse impacts on species can be appropriately mitigated. Mapping takes place at all stages, from receiving the site boundary and base mapping from Network Rail, to collating information through a desk study, collecting data on site and finally drawing up the proposed mitigation and landscaping plans.

Until recently, this kind of mapping was a time-consuming and laborious process. However, Thomson Ecology has been pioneering the application of GIS technology and the use of mobile mapping for field data collection, which has removed the need for paper maps and made the whole process for mapping large schemes more streamlined, effective and efficient. The GIS team has already won an award for cutting-edge work in the field from the Association for Geographic Information (AGI). Tim Donoyou, technology lead at Thomson Ecology, takes up the story: “When we were working on the East West Rail project, the linear nature and length of the railway survey area meant that reams of paper field maps would have been required for each species survey. “Instead we used mobile mapping devices which were pre-loaded with all the available site information and could record data to sub-metre accuracy. Captured data was then regularly uploaded from devices to our servers via the latest wireless technology. The immediacy of this solution has given us tremendous advantages and allowed decisions to be made quickly and efficiently. “The field devices allow surveys to be undertaken in all weather, removing the need for pens, paper

maps and survey forms in the field, and the frequent upload of data maximises security and minimises the potential for data loss. In addition they provide a health and safety function by pinpointing the location of the surveyor at all times.

To support the ecology surveys, our GIS specialists developed an interactive mapping tool to give all team members fingertip access to the latest project information. As a result, the principal ecologists and GIS team were easily

able to devise the most efficient survey programme by dividing the route into manageable sections, grouping ponds and ditches for great crested newt surveys and identifying ecologically important habitats. Once the surveys were underway, the interactive mapping tool proved to be hugely powerful and beneficial, allowing project managers to monitor survey progress, identify any issues and make key decisions, saving time and money. “Using GIS technology and mobile mapping on the East West Rail project is a great example of how it is revolutionising a central part of the services we provide to our clients. In the short time we have been using the new devices they have already recorded locations and detailed information for over 10,000 different habitats, plants and animals, and, for the first time, it has allowed our team to upload and download data remotely from anywhere in the UK. “We see this as just the start. Spatial data pinpoints ecological issues Mapping ecological survey findings is as old as the science itself, but as technology has evolved so has the way in which data is recorded in the field. Mapping a development or conservation area helps the ecologists to plan a survey and provides advance information about habitat and terrain. This type of data is now available to combine with base maps and aerial photography which Thomson Ecology’s GIS team do as soon as a project location is defined. Once the ecologist is in the field he or she has this information on a rugged device with a high quality satellite positioning system which enables them to enter observations, for example a protected species sighting, and the data is recorded with the geographical location. This is critical for pinpointing where ecological issues may be situated in the project area. Using the latest technology makes it easier to record, upload, analyse and present ecological data. This in turn helps clients to understand the potential impact of ecology on their project and make decisions on design and mitigation.

TRAINING FOR THE FUTURE

Keltbray explains how their industry and academia partnership programme is helping to support the continued growth of the rail network.

eltbray Group, which is a UK leader in specialist rail engineering, construction, demolition, decommissioning and environmental management services, provides training in the areas of rail asbestos management, demolition and civils. Every year, Keltbray’s 14-strong training department delivers more than 36,500 hours’ worth of training and assessments to the company’s 800 employees and many more of its external clients. Keltbray’s wider commitment to training and development has meant that the company provided more than 41 people with apprenticeships, internships, undergraduate and graduate traineeships in 2013. “That is one for nearly every 20 of Keltbray’s 800 employees, and considerably more than most construction companies,” explains Keltbray’s Training and Development Director, Holly Price: “Over the past year, Keltbray also had 117 employees in vocational training to ensure the company develops highly skilled employees for the future.”

New dedicated training facility in Basildon Around 60% of this provision will now be provided at a new, state of the art training centre in Basildon, which was recently opened to consolidate most of Keltbray’s training facilities. Up to 36 candidates can now use the Basildon facilitates at any one time, and the class rooms are complemented with a practical training

area for rail, while a practical area for asbestos management will follow. While this training centre primarily caters for Keltbray’s own employees, many of the company’s external clients, such as Network Rail, Balfour Beatty and Carillion also send candidates to attend Keltbray’s training courses. Following a recent change in Network Rail’s step change approach to procurement, which means a larger proportion of work is contracted at a very early stage, suppliers such as Keltbray, have better visibility of future work programmes.

“Over the past year, Keltbray had 117 employees in vocational training to ensure the company develops highly skilled employees for the future.” According to Keltbray’s Managing Director of Rail and Infrastructure, Phill Price, this means we can hire and train the people we need, secure in the knowledge that there will be work for them: “This should increase the amount of directly employed rather than temporary labour on projects – one of Network Rail’s goals – which it is hoped will also make it easier to raise their safety standards and skills.

Early procurement also leads to early contractor involvement. This means we can get involved at an earlier stage and influence the design for safer construction.”

Pioneering Apprentice Programme in Crewe On the back of Keltbray’s track record, increased market confidence and the need to meet future skills shortages in the rail industry, Keltbray Aspire, which is part of Keltbray Group and provides electrification services on the rail infrastructure, now has twenty five apprentices in place. Seven of these are part of a pioneering apprentice programme that Keltbray recently launched in partnership with South Cheshire College in Crewe. In the first year of the scheme, seven apprentices were recruited from the College’s engineering courses and selected from a shortlist of 30 candidates who were put through their paces with assessments. The apprentices will also be assessed against the Rail Overhead Line Electrification Competence throughout the training programme. The two-year apprentice programme focuses on railway overhead line installation and maintenance, and by gaining experience on Keltbray sites, the apprentices will learn new engineering skills and gain the essential qualifications required to work in the industry. The apprenticeship scheme has been designed to meet the demands associated with traditional

construction, but importantly also the new design ranges that will be installed as part of National Rail’s, National Electrification Programme, through comprehensive training at Keltbray’s state of the art and dedicated rail electrification training centre in Crewe. Keltbray’s rail business continues to grow and was responsible for the largest turnover increase in the company’s 2012 results on the back of its £46m contract with Network Rail to provide power supply upgrade on the West Coast mainline from Wembley to Crewe; a contract which is ongoing. The apprentice scheme was established to meet this continued growth, and ensure that the Keltbray has the skills required to provide a first class and specialist service going forward: “There is a shortage of engineers in the UK generally, and so we see this as a great opportunity to invest in young people and recruit locally in Crewe; a town at the heart of the rail industry. The apprentice scheme will help ensure we are well positioned for the future, and we very much see this as a visionary and exciting partnership, and one which

we hope will be a win-win situation for both our own company and for that of South Cheshire College,” said Director of Keltbray Rail Electrification, Martin Brown. igh profile projects such as Crossrail, Thameslink and HS2 are among the biggest infrastructure projects anywhere in Europe each bringing their own issues. No single company is able to carry out the entirety of the work required for any of the projects with vital elements such as electrification not having been carried out in the UK for 30 years or more. Such a combination – large, complex projects and a workforce that may not necessarily have the right skills to deliver – has driven an increasingly collaborative business model for the railway industry. Specialist rail companies such as Alstom now work increasingly closely with infrastructure partners to bring projects to reality while, at the same time, helping to develop the next generation of engineers by sharing

new skills that may only be available initially by bringing in experienced people from overseas who will then transfer their knowhow. Terence Watson, Alstom UK President, said: “We recognised that, with both new build programmes and also with the modernisation of existing routes we had local expertise in certain areas but obviously not in all of them, so we adopted a partnering approach, and we are not alone in this. “It was also important to us to ensure that the industry in the UK was re-skilled, by sharing knowledge and experience, sometimes from countries that have gone through a similar period of investment, in order to ensure that future schemes can be brought to fruition. “We have to accept that some skills have almost been lost in the UK simply because there has been no major

investment for decades. That’s where large companies, in co-operation, can help make a real difference to the industry – by leveraging their preexisting skills base and then mentoring a new generation.” For example, Alstom is working in partnership with track and civil engineering specialist TSO and Costain, a major civil engineering and construction company, to deliver the fit out and commissioning of Crossrail’s tunnels. “The challenge for Alstom is to bring a world best project together – that means integrating and bringing into service all of the systems that will enable Crossrail to work. This includes testing and commissioning our own systems, signalling, telecoms and rolling stock, all of which need to be carried out to make sure Crossrail is open as planned in 2018,” said Watson.

While it is relatively early days for the joint venture, there will be further opportunities to develop new skills in a fresh generation of railway engineers, as is already happening on Network Rail’s massive investment in electrification. Network Rail has hailed its current plans as ‘the biggest investment since the Victorian era’ and, together with the new rolling stock that will take passengers to their destinations, new infrastructure is going to play a vital part in making that investment happen. ABC Electrification Ltd, an equal partnership between Alstom, Babcock and Costain, was specifically created in order to leverage the expertise on offer from the three companies, establishing a collaboration that could compete for major electrification contracts. Alstom provides international expertise alongside a significant UK presence for power supply technology. Babcock brings a significant amount of experience of maintaining and renewing railway specific infrastructure; and Costain offers major project and programme management experience often acquired on projects associated with railway industry. Given the scale and complexity of the UK projects, the individual companies realised that attempting them on their own would be a challenge but, together, they have already had some success, becoming overnight one of the largest electrification companies in Europe. Most recently, the company was named as one of four suppliers tasked with delivering Network Rail’s £2bn programme to electrify more than 2,000 miles of Britain’s railways over the next seven years. ABC’s framework agreement covers the Central (London North Western, South) region and the Valley Lines Electrification (VLE), in addition to the Edinburgh-Glasgow (EGIP) and West Coast Power Supply (WCPSU) work already awarded, and forms a vital part of the National Electrification Plan. Importantly, the partners are using their contract wins to develop a new generation of railway engineer who can transfer their skills to other projects. A two-week training course for new starters has been developed with trainees serving a six month apprenticeship working with a mentor before being allowed to work on their

own. The course has been approved by the National Skills Academy for Railway Engineering and the partners aim to provide around half of the workforce through this route. There are also plans to establish a training centre for rail electrification at existing training bases in Manchester and Blantyre in order to increase the skills and experience of the teams working on the company’s projects.

“It is only by working together that companies operating in the rail sector can hope to meet the challenges and opportunities of today’s booming rail industry.” The partnership or joint venture route is one that Alstom values and employs elsewhere in the rail sector, with other organisations also having a strong commitment to skills development. The Taylor Woodrow Alstom (TWA) joint venture, currently building the extension to Nottingham’s tram, has a target of taking on 60 people aged 16 and above for internships and has also partnered with local colleges. In addition, TWA also uses the colleges to upskill its own people. Also working recently in Nottingham was Signalling Solutions Ltd (SSL), a joint venture between Alstom and Balfour Beatty Rail Projects. The company has delivered signalling renewal works at sites around the UK – including the modification of the Great Western Main Line to support new Crossrail trains, but also has an eye to the future, taking on 13 graduates to work across project management, planning, test, estimating and engineering. “It is only by working together that companies operating in the rail sector can hope to meet the challenges and opportunities of today’s booming rail industry,” said Watson. “Whether it’s to deliver commercial and technical objectives – or even social objectives such as skills and supply chain development, no one company can go it alone. We have to collaborate to be successful.”

sk anyone on a train today what they think of Britain’s railway network, and you should expect to hear some ill-informed nonsense. As a public member of Network Rail, I am perhaps more up to speed than the average rail traveller, but it still surprises me how little people know about ongoing investment in the rail network. People know about HS2, of course, but they don’t realise that investment in existing lines and stations is already going on at just as large a scale. Look at stations. Investment is having a hugely positive effect on commuter experience. You only have to spend time at two of the busiest stations in the country, namely Kings Cross and Birmingham New Street, to see how such physical transformations influence daily commutes. Investment in stations, including lengthening platforms, means fewer delays, increasing capacity throughout the timetable, and of course providing a more pleasant journey. It is done with passengers in mind. This is all great, but we need much more, and not just in the rail sector but in airports and the whole joined up business of transport infrastructure. There are massive benefits for the economy. Major projects that increase capacity lead to demand for more materials and support services, and create jobs because improved efficiency benefits businesses. When Network Rail announced a £37bn upgrade of 28,000 signal boxes, what it got instead of praise for tackling this major project, was criticism for doing away with quaint Victoriana.

The will-they-won’t-they saga around HS2 is played out in a similar story of politics and infrastructure when it comes to air travel. Britain is losing business to Germany, France, and Holland, who have a joined up transport network, and have invested in airports. This is having a detrimental long-term effect on the UK economy. Lack of investment has another, darker consequence. The public and private sectors have been under immense pressure to cut costs ever since the banking crisis plunged us into recession, and the fallout in lost jobs and failed firms has been well reported.

The notion that Britain’s rail network is falling apart and starved of investment is hard wired into the nation’s psyche, but it is far from the truth. There is a less well-documented effect, one that even as the recovery arrives has yet to be felt, and when it does come, the results could be literally catastrophic. I am talking about decisions that have been made to cut corners to save money. In many organisations, public and private, purchasing departments have been given unprecedented buying power, even the ability to overrule engineers and specify inferior components. Under pressure to make savings, managers have delayed vital upgrades.

These decisions store up costly refits and put systems at risk, in some cases with disastrous consequences. We all know what can happen when money talks and priorities get skewed. A decade after the Potters Bar crash when seven people died after their train was derailed by faulty points, unions were still lambasting the government about cuts and their potential for fatal consequences. Just this summer, the cargo ship Swanland sank off Wales with the loss of six crew. Money saving played a major part with insufficient maintenance and a lack of repairs resulting in a vessel severely weakened by corrosion to the point of structural failure. Similarly, a report into the Gulf of Mexico oil spill that killed 11 men concluded that cost cutting greatly contributed to the accident with managers making “decisions that reduced costs and increased risk.” So while there are no indicators about corner cutting to appear on the nightly news alongside the latest unemployment figures, we know it is happening, and when the results come to light in the worst-case scenarios, it is all over the newscasts. Like other businesses, we at Texane have had to cope with these incredibly tough past few years, and I do not for a minute underestimate the pressure on businesses large and small, or the public sector, to cut costs.

It is, however, a fundamental truth of business and life in general that if you don’t pay your dues now, you will have to pay later. When the time of reckoning comes for corner cutting in this recession, let’s hope the price is paid in money and not lives. What would it be like if we weren’t so piecemeal and short term about transport? The long-term view creates solutions to problems that currently seem intractable. For example, with HS2 in place, Birmingham could be considered as the next airport for expansion rather than focusing on the southeast. London may be the preferred destination for most UK travellers, but with HS2, Birmingham would be only an hour away. The notion that Britain’s rail network is falling apart and starved of investment is hard wired into the nation’s psyche, but it is far from the truth. Nevertheless, we need much more focus on improving our rail capacity and all aspects of our transport infrastructure. Right now, we need to change our mindset, and invest in a long term joined up transport strategy for Britain.
