Steve Yerrid is no stranger to achievement and recognition in America’s legal arena.

S

ince graduating from Georgetown Law Center in the mid-’70s, Yerrid has established an outstanding national reputation as a powerhouse trial lawyer and a well-known philanthropist. He’s obtained more than 275 multi-milliondollar verdicts and settlements. He has received the Perry Nichols Award (the Florida Justice Association’s highest honor), has been recognized as one of the Top 10 Litigators in Florida by the National Law Journal, has been inducted into the National Trial Lawyers Association Hall of Fame as its forty-seventh inductee, is a member of the invitation-only Inner Circle of Advocates (the best 100 plaintiff’s lawyers in the country), serves on the Board of Governors as a Distinguished Fellow of the Academy of Florida Trial Lawyers, and has continuously been included in Best Lawyers® since the 1980s. He’s been honored with the Best Lawyers “Lawyer of the Year” award in Tampa for Medical Malpractice Law (2012), Personal Injury Litigation - Plaintiffs (2014), and Medical Malpractice Law - Plaintiffs (2015), and has received a multitude of professional recognitions and awards throughout his career. Yet, with all these accomplishments under his belt, Yerrid is still modest about what he’s done. “I’ve never achieved any real success without the help of others,” he said. “I’ve truly been blessed by having great people in my life who have given me more opportunities and support than I could have ever envisioned. My life has been and continues to be a great journey and one in which I have already outlived my dreams.” In 1980, after one of the largest maritime disasters in history, he successfully defended and obtained the total exoneration of John Lerro, the harbor pilot whose 608-foot ship struck the mammoth Sunshine Skyway Bridge spanning Tampa Bay, causing its fatal collapse and the death of 35 people. The case received international attention—and many believed the case was unwinnable. Defying the odds, Yerrid won Lerro’s complete exoneration using an “Act of God” defense, which required him to prove that nothing humanly possible could have been done to change the outcome or alter the course of events that took place.

He was the youngest member of the late Governor Chiles’s hand-selected “Dream Team” that took on previously unbeaten Big Tobacco in the mid-1990s and obtained a $13 billion settlement, the largest in the nation’s history. Additionally, the settlement terms included landmark advertising curtailments which eliminated the Marlboro Man, Joe Camel, vending machines, billboards, most forms of media advertising, and halted the industry’s pandering to America’s youth. He won a 2006 jury verdict of $217 million, the largest medical malpractice verdict ever awarded in Florida; a $330 million verdict in 2009, the nation’s largest that year in a wrongful death suit; and a $27.4 million BP payout for Tampa following the disastrous Deepwater Horizon oil spill, the largest amount any city received. Last year, he obtained a $15 million wrongful death verdict and the year before a $64 million verdict in a personal injury case. He is currently one of the lead trial lawyers working on the Nevada litigation arising from the tragic shooting rampage at the Mandalay Bay Hotel in Las Vegas. In addition to his career as a trial lawyer, Yerrid is known for his philanthropy and commitment to giving back. He is the Chairman of the Board of The Yerrid Foundation, a self-funded organization that has supported more than 500 charitable causes. His family foundation has given decades-long support to the National Pediatric Cancer Foundation, Ronald McDonald House, 1Voice Foundation, Boys and Girls Clubs, the Special Olympics, Make-a-Wish Foundation, as well as a large number of other national and local charitable efforts. He has been honored by many of these entities with the highest awards of recognition these organizations can bestow. Yerrid attributes his efforts to a motivation and fervent desire to make a difference and provide others with a chance for a better life. But most likely, it is his excellence as a trial lawyer that will truly be his legacy. “I think the law is wonderful,” he said. “In many instances, it’s the only force that holds the pieces of civilization and society together. When the system of justice works as it should, it addresses wrongdoing and protects our most vulnerable citizens by leveling the playing field. I believe strongly that justice is the greatest equalizer our democracy offers. The courtroom can cause much-needed change and make a real difference in life when government and lawmakers cannot. If I had the opportunity to live another lifetime, I would want to come back as a trial lawyer and enjoy this marvelous journey again.”

Marine’s Wife ‘Self-Deports’ to Avoid Detainment

M

aney Gordon Zeller: Richard Maney (Immigration Law, 2018) represented the wife of a U.S. Marine who left her home in Davenport for a new life in Mexico after her deportation became inevitable. Alejandra Juarez, a mother of two, was denied citizenship in 2001 over statements she made in 1998 while seeking asylum at the border. While her immigration status did not pose a significant problem in the past—she had been checking in with Immigration and Customs officials since a traffic stop in 2013—Trump’s “zero-tolerance” immigration policy rapidly changed Juarez’s circumstances. Juarez decided to “self-deport” to the country she has not lived in for 20 years to avoid detainment by immigration authorities. She elected to settle in Merida, where a “community of deported military spouses might

help her,” the Orlando Sentinel reported. According to data from one organization—the immigration advocacy group American Families United—roughly 11,800 serving in the military have a spouse or family facing deportation. Juarez’s 8-year-old daughter, Estela Juarez, spoke at a press conference on the day Trump announced a new military budget at the Wounded Warrior Project Soldier Ride. “I ask President Trump to please let my mom stay because she is a great mom and I don’t understand why we have to leave her,” Estela Juarez said. “She has been there every day of my life and I can’t imagine leaving her. Please, President Trump, I ask that you let her stay.” Speaking to the Sentinel, Maney said, “This is not going to be the last case like this . . . this is potentially the first of many. There are many military spouses in the same situation.”

Morgan & Morgan: John A. Yanchunis (Mass Tort Litigation/Class Actions – Plaintiffs, 2018) and the firm are suing the marketing and data firm Exactis for leaving 230 million consumers vulnerable by leaving data exposed to the public. In a press release, Yanchunis wrote, “Exactis must be held accountable for purportedly leaving hundreds of millions of individuals and businesses vulnerable to identity theft, fraud, and loss of privacy.” Attorneys from Morgan & Morgan previously filed class action suits over data breaches at Yahoo and Equifax. Shutts & Bowen: Suzanne Labrit (Commercial Litigation, 2018) represented the United States Automobile Association in a dispute against the Herssein Law Group over attorney fees and an alleged breach of contract. The case escalated to the Supreme Court when an attorney for Herssein asked the judge be dismissed over her friendship with a lawyer on the opposing side. Labrit disagreed, telling the justices that friendship on Facebook does not necessarily imply an intimate, off-screen relationship. “LeBron James and I are friends on Facebook,” she told the court. “He probably couldn’t pick me out in a lineup.”

Maney Gordon Zeller: Jack Gordon (Consumer Protection Law; Medical Malpractice Law – Plaintiffs; Personal Injury Litigation – Plaintiffs, 2018) represented the parents of a 6-year-old boy in their lawsuit against the Pasco County School Board. The conflict began after the first-grader kneeled during a classroom recitation of the Pledge of Allegiance, prompting a letter home to the family from the boy’s teacher that the parents found threatening. While the school argued that parents are required to notify teachers if their children wish to kneel during the pledge and anthem, Gordon said that his clients were not informed of this policy until after the boy was reprimanded.

The Barry A. Cohen Legal Team: Renowned criminal defense attorney Barry Cohen, recognized in The Best Lawyers in America © for Criminal Defense since its first edition in 1983, passed in his Florida home September 22 after a battle with leukemia. A fixture in the Tampa legal community, Cohen notably defended Steven and Marlene Aisenberg, who came under scrutiny after the disappearance of their 5-month-old baby. Cohen successfully got the charges dropped—and won the clients $3 million in legal fees. Cohen frequently supported liberal candidates as they ran for office, even maintaining a friendship with U.S. Rep. Nancy Pelosi, the Tampa Bay Times reported. “His legacy is as a fighter, standing up for the weak and the marginalized and those who needed help,” Hillsborough County’s State Attorney Andrew Warren told the Times in its tribute to Cohen. Gunster, Yoakley & Stewart: Aaron Horowitz (Commercial Litigation, 2018) received the inaugural young lawyer member of the year award by the Florida Bar Association’s alternative dispute regulation section. Per a release by the firm, the award honors attorneys who have shown “leadership and dedication to the Florida Bar, the ADR section, or the section’s mission through executive council or committee service, volunteerism, significant professional contributions, or the creative exchange of ideas.” Horowitz presently oversees the bar’s alternative dispute regulation section and chairs its business, real property, and disputes committee. Jung and Sisco: William F. Jung (Bet-theCompany Litigation; Criminal Defense: General Practice; Criminal Defense: White-Collar, 2006) was confirmed by the Senate on September 6 to serve as Tampa’s next federal judge. Jung was nominated to serve twice previously under Presidents George W. Bush and Barak Obama in 2008 and 2016, respectively. He was re-nominated by President Donald Trump in 2017. Prior to starting his practice, Jung was an assistant United States attorney for six years in the state’s middle and southern districts.

This is especially true for lawyers, who must keep up to speed with new regulations, policies, and decisions—all of which can frequently turn on a dime. “You have to be detail-oriented, which is generally true in law, but in a health care practice you have to really pay attention,” says Bruce D. Lamb of Gunster, Yoakley & Stewart. “These regulations are not always intuitive. You might think you have an understanding of what the government was trying to do, but that’s not always the right answer.” For Lamb, a three-time “Lawyer of the Year” winner for Health Care Law in Tampa and the head of his practice, the rapid pace of development in his field is part of its appeal. “You constantly have to educate yourself to keep up with both the changes in the regulations and also the interpretations of the regulations. You have situations where the regulatory agencies are giving advisory publications, they’re asking for advisory opinions, and when those are published it’s incumbent upon health care practitioners to keep up with those things. We’re all constantly reading the latest publications to keep up with changes. It makes it intellectually challenging.” After decades in the business, Lamb is in a better position than most to observe and understand the industry’s profound changes. From the growth of computer-assisted diagnostic tools to electronic records, he has seen how technology influences the way practitioners operate. The trend towards larger conglomerations over more personal mom-and-pop health care operations is also giving clues to how your visit to the doctor might change in the future. The relationships between patients and providers might be in flux, but for health care lawyers, the community is as tight-knit and consistent as it’s ever been. “Within the community, you know the other heath care lawyers pretty well. Even on a national scale—I’m in the American Health Lawyers Association—you’ll find it’s a fairly narrow practice area, which is rewarding economically and because you’re able to distinguish yourself from some of the other practices. That’s one thing that’s really nice about the practice.”

STEVE YERRID, A CAREER AS ONE OF AMERICA’S TOP TRIAL LAWYERS

I

n the mid-1990s, Steve Yerrid and the rest of Florida’s “Dream Team,” a group of 11 top trial lawyers handpicked by the late Governor Lawton Chiles, took on the previously unbeaten Big Tobacco—and won. The odds weren’t in their favor. Through more than four decades of litigation and more than 800 cases, no one had been able to beat Big Tobacco. Despite the fact that he was the team’s youngest member, Yerrid was given the task of adding racketeering and conspiracy charges to Florida’s lawsuit, thereby tripling the potential damages that could be awarded. In the third week of trial, while his fellow team members Bob Montgomery and Shelley Schlesinger were picking the jury, the defense approached Yerrid with a $3 billion settlement offer. He conveyed the offer that evening during a dinner meeting with several members of the trial team, Governor Chiles, and Attorney General Bob Butterworth. When the governor asked if the offer should be accepted, Bob Montgomery of Palm Beach, one of Yerrid’s closest friends and a great trial lawyer who acted as the leader of the Dream Team, answered immediately. “I will never forget his response, ‘Turn it down! We can get more.’” When he answered next, Yerrid had 10 |

little choice but to quickly agree. Still, he recalls that moment as one of the most nerve-wracking in his career: with his stomach in knots, he didn’t sleep at all that night. Fortunately, early the next afternoon, the offer was doubled. Each day for the next several days, the settlement offer grew larger. That weekend, the case was resolved for almost $13 billion. At the time, it was the largest settlement in the nation’s history. But even more important than the money, the terms of the settlement required Big Tobacco to permanently retire the Marlboro Man and the Joe Camel character, eliminate all cigarette vending machines, prohibit all television and billboard advertising, stop the sexist Virginia Slims campaign that targeted women, and immediately halt the industry’s pandering to children and teenagers. Additionally, Big Tobacco was forced to permanently fund the “Truth Campaign,” which exposed the dangers of nicotine addiction to America and its youth. These advertising concessions ultimately resulted in a $200 billion settlement with 46 other states and a drastic decline in cigarette use nationwide. The resultant societal seachange in curbing nicotine and cigarette addiction has saved millions of lives. However, it wasn’t all good news. “I was the only member of the team to leave Palm

I arrived back at the courthouse Monday morning to hear not only the announcement of the multibilliondollar settlement, but also to hear Governor Chiles and Attorney General Butterworth boast that one of the best aspects of the settlement would be that Florida wouldn’t have to pay its attorneys a dime.” This meant the Dream Team had one final battle to fight. “We had to sue our own client, the State of Florida, in an effort to get the well-deserved fee to which we were entitled under our contingent fee contract,” Yerrid said. While the case was pending before the Florida Supreme Court, the Dream Team and Big Tobacco agreed to go to arbitration. Fortunately, a very favorable multibilliondollar arbitration award resulted. Ironically, only weeks later, the Florida Supreme Court declared Florida’s contingent fee contract

with the Dream Team to be “null and void.” But this legendary case is just one of his many legal accomplishments. By any measure of success, Steve Yerrid has established his place among the best to ever enter a courtroom, obtaining more than 275 verdicts and settlements of a million dollars or more, including three $100 million-plus verdicts, as well as more than a dozen eightfigure verdicts. In 1980, Yerrid defended Captain John Lerro, the harbor pilot who, amid a horrific storm, crashed a 608-foot freighter into the mammoth Sunshine Skyway Bridge, resulting in its fatal collapse and the deaths of 35 people. Yerrid was 30 years old, and the tragedy received worldwide attention. “Virtually no one gave us a chance of winning, except maybe my mother, and I’m sure even she had her doubts,” he recalls.

However, at trial, he obtained the complete exoneration of Lerro using an “Act of God” defense, meaning Yerrid had to prove that nothing humanly possible could have been done to change the outcome or alter the course of events. In 2006, Yerrid obtained a $217 million jury verdict, still the largest medical malpractice award in Florida’s history. Last year, he obtained a $15 million wrongful

death verdict and the year before that a $64 million verdict in a personal injury case. He continues to be very active and hugely successful with no intentions of slowing down. He is currently one of the lead trial lawyers working on the Nevada litigation arising from the tragic shooting rampage at the Mandalay Bay Hotel in Las Vegas. Yerrid is a member of the invitation-only Inner Circle of Advocates, which is made up of the top 100 trial lawyers in the nation. He’s received the Perry Nichols Award, the Florida Justice Association’s highest honor, and has been recognized as one of the Top Ten Litigators in Florida by the National Law Journal. He has been continuously included in Best Lawyers ® since the 1980s. He has been honored with the Plaintiffs’ “Lawyer of the Year” award on several occasions in

Center, among others. He has been honored by a number of these charitable entities with the highest awards of recognition these organizations bestow. Yerrid was appointed to serve as special counsel to the president of United Way of America at its headquarters in Washington, D.C., participating pro bono in a $3 billion worldwide fundraising effort, and the launch of several programs, many of which are still in use today. He was honored to be selected and serve as special counsel to the Office of the Chief Judge of the 13th Judicial Circuit and the Florida Conference of Circuit Judges. Representing Florida’s judiciary, he successfully argued before the Florida Supreme Court for the protection of confidential records and internal communications within the court system. In 2010, confronted by the nation’s largest environmental catastrophe in its history, Governor Charlie Crist appointed Mr. Yerrid as special counsel to the governor regarding the Deepwater Horizon oil spill disaster and its aftermath. He provided his service to the people of Florida pro bono and personally paid the entirety of the associated costs involved with the representation. Subsequently, he was asked to represent Tampa and successfully procured a $27 million settlement, the largest payout made to any city by BP.

the areas of personal injury, wrongful death, medical malpractice, and product liability and has received a multitude of professional recognitions and awards throughout his career. In 2016, he was inducted into the National Trial Lawyers Hall of Fame as its 47th inductee. A graduate of Georgetown Law Center, he’s taught for a number of years as an adjunct professor at his alma mater and has also served as an adjunct professor at Stetson Law School. He is a frequent lecturer at continuing legal education seminars both in Florida and across the nation. Yet with all these accomplishments under his belt, Yerrid is still modest about what he’s done. “I’ve never achieved any real success without the help of others,” he said. “I’ve truly been blessed by having great people in my life who have given me more opportunities and support than I could

have ever envisioned. My life has been, and continues to be, a great journey and one in which I have already outlived my dreams.” Yerrid is a recognized fighter outside the courtroom, as well. Based on his undefeated amateur boxing career (a 17-0 record), his leadership role in the 2000 Olympic Boxing Qualifiers, a promoter of two HBO televised world championship fights, and his longtime assistance to retired and impaired professional boxers, he was inducted into the Florida Boxing Hall of Fame in 2011. Additionally, he’s also been able to accomplish a great deal as CEO of The Yerrid Foundation, a self-funded organization that has supported more than 500 different charitable causes. Many of those efforts are children-oriented, including the National Pediatric Cancer Foundation, the Ronald McDonald House, Boys and Girls Clubs, the Make-A-Wish Foundation, 1Voice Foundation, and the Children’s Cancer

The essence of his career and his life’s work can be traced to Yerrid’s fervent desire to help people less fortunate, as well as an unconditional commitment to making a positive difference in the lives of others. “I think the law is truly wonderful,” he said. “In many instances, it’s the only force that brings order to our civilization and society. When the system of justice works properly, it addresses wrongdoing and protects our most vulnerable citizens by providing a level playing field. I believe true justice is the greatest equalizer our democracy offers and a forum in which a lone individual can take on the most powerful of corporations. The courtroom can cause much needed change and make a real difference in life when government and lawmakers do not. Ron has consistently earned from his peers and judges an AV Martindale-Hubbell rating (which is the highest possible rating) and recognition as one of Florida’s Super Lawyers.
