IN THE HEADLINES King & Greisen: Paula Greisen (Employment Law – Individuals; Litigation – Labor and Employment, 2006) represented a 20-year-old transgender woman pro bono in her lawsuit against the Colorado Department of Corrections over “discriminatory and dangerous” conditions. Lindsay Saunders-Velez, who filed the suit, was transferred to a men’s prison from a center for female juveniles. Saunders-Velez was later placed in a “punishment pod” at the Colorado Territorial Correctional Facility, where she was sexually abused by male inmates. “This issue is not going to go away,” Greisen said. “We’re going to fight it until these individuals are treated with the respect they deserve.”

Leventhal & Puga: Hollynd Hoskins (Personal Injury Litigation – Plaintiffs, 2013) represented Curtis Brooks, who was arrested for a fatal carjacking when he was 15 years old. Brooks was sentenced as a juvenile to life without parole, a sentence deemed unconstitutional by the U.S. Supreme Court in a June 2012 ruling and made to apply retroactively in a January 2016 ruling. Brooks completed his GED and took college courses in prison as Hoskins and his other attorneys continued to petition for clemency. In December 2018, Brooks was praised for his rehabilitation and accountability, and was approved for release on parole in July 2019. “This is a great day,” Hoskins told press after the announcement. “Curtis wants everyone to know that he will not let them down.”

Tiftickjian Law Firm: Jay Tiftickjian (DUI/ DWI Defense, 2018) assisted the Colorado State Demographer’s Office in creating an interactive map of the state’s DUI arrests based on census data of those living in Colorado’s 5th Judicial District. Tiftickjian’s efforts coincided with the Colorado State Patrol’s DUI crackdown at the end of December 2018 to combat drunk driving during the holiday season.

Chris has long been interested in public service, and he will bring a strong skill set to this important role,” James M. Singer, chair of the firm’s nationwide intellectual property department, said in a statement to press.

Lewis Roca Rothgerber Christie: James M. Lyons (Arbitration; Bet-the-Company Litigation; Commercial Litigation; Criminal Defense: WhiteCollar; Mediation, 1991) presented a $36,000 grant from the government of Ireland to a memorial project, which will honor Irish miners buried in Evergreen Cemetery. The grant was presented at a black-tie fundraiser held for Irish Network Colorado, which raised $20,000 in funding to supplement the government grant.

Merchant & Gould: Timothy B. Scull (Copyright Law; Information Technology Law; Litigation – Intellectual Property; Litigation – Patent; Patent Law; Trademark Law, 2009) discussed Denver’s recent growth in an article for ColoradoBiz Magazine highlighting the city’s attraction for innovators and entrepreneurs in what he likens to a “present-day Colorado gold rush.” Among the reasons for the boom are the biomedical science and alternative energy sectors, the role of new technologies, and arrival of bigger companies.

A

fter three decades in the field, and three “Lawyer of the Year” award wins, Lesleigh Wiggs Monahan knows what it takes to succeed in family law. It’s about your client and honoring and improving the legal system. I strive to treat opposing counsel, and their clients, and the courts with the upmost courtesy—I think it’s easy to let your emotions or your fatigue or stress interfere with your ability to rise above the conflict. You can be effective, you can be strong, and you can get results that are the goals of your client without setting aside common decency.” Along with a wealth of career experience, Monahan’s 30-plus years in the courtroom has allowed her to look critically at the changing nature of family law. Turnover on the bench and a subsequent lack of institutional memory among newer judges can make cases more difficult, particularly when the stakes are as life-altering as divorce. Furthermore, a competitive mentality and focus on winning are often the big motivators for junior attorneys, but the experienced family lawyer respects and understands the bigger picture. “There’s a philosophy or culture of aggressiveness, and it’s really important for a good family lawyer to break through that and talk about finding common ground and resolving issues because a judicial officer, if the case goes to trial, is not going to pick a winner and a loser,” Monahan says. “It’s about what’s equitable and fair. I think that’s the part that I find the most difficult as I move into my third decade.” Family law, like any legal practice, has its challenges. But it also has its share of rewards. For Monahan, that reward is in getting to build meaningful relationships with her clients and making a material difference in their lives. “Without doubt, it’s connecting with a human being. It’s helping someone to move through this process at a difficult time in their life. And when you finalize divorce successfully—and in my mind that means settling the case through negotiation— they know that they can move on to their next phase. They’re better for it; they’re not worse. If you can relieve that anxiety with people, I think that’s the best thing you could possibly do.”

hat drives Michael S. Burg is something he never t houg ht he’d see in his lifetime— everyday people losing faith in the legal system. Serving as an adjunct professor at the University of Denver’s Sturm College of Law since 1995, Burg says real-life cases show students how important strategy is. “I teach trial tactics,” he explains. “Many times the case will change in the middle of the trial. You have to be listening to what’s going on, to be aware.” Knowing that strategy inside and out makes it possible to make changes on the fly. That’s what Burg Simpson does well. The lawyers work in teams in order to leverage the skills of multiple legal professionals. Burg uses the example of selecting witnesses to illustrate another aspect of the firm’s approach. “For example, in an insurance case we’re looking for an expert who has testified for both sides,” he says. “An expert for the plaintiff who has testified for an insurance company and worked

with them is going to come across as unbiased.” All a good plaintiff’s lawyer needs is a fair trial, but the playing field isn’t always level, Burg continues. That’s why Burg Simpson also pays attention to what’s happening in other court cases so that they’re prepared with current information. CHANGING TERRAIN in COLORADO SKI LAW

ntil recently, ski-area accident claims in Colorado were brought under the Ski Safety Act (SSA). But over the past year, both state and federal court rulings have found an intersection between the SSA and the Premises Liability Act (PLA). This development, plus the ubiquitous use of waivers, blurs the liability for ski-accident negligence once clearly defined under the SSA. The PLA protects landowners and defines when liability will be imposed. The statute provides the exclusive remedy against a landowner for injuries sustained on the landowner’s property. The SSA establishes reasonable safety standards and responsibilities of ski-area operators and skiers. Violating the SSA duties “shall…constitute negligence” by the ski-area operator. In prior cases, the SSA was held to establish statutory duties which could not be negated by a waiver.

SKI-AREA OPERATORS AND EXCULPATORY CLAUSES Two ski cases in federal court resulted in appellate decisions upholding waivers to bar the claims. In Raup v. Vail Summit Resorts, Inc., ____ Fed. Appx. ____ (10th Cir. 2018); 2018WL2110726, the court analyzed the case of a passenger injured on a chairlift in summer under the PLA. The court held that the unsigned exculpatory agreement printed on back of lift ticket was valid. The court further held that because the PLA does not expressly preclude waivers, a waiver is not void as contrary to the public policy expressed in the PLA. A skier was injured while unloading from a chairlift and filed a claim under the SSA. Brigance v. Vail Summit Resorts, Inc., 883 F.3d 1243 (10th Cir. 2018). The court held the exculpatory agreement was valid. Considering public policy concerns, the court held that the SSA essentially preserves common law negligence claims in certain instances, and common law negligence claims may be waived. In Mitchell v. Vail Summit Resorts, Inc., 2017CV30022 (Summit Dist. Ct.) (March 6, 2018), a skier was injured on a chairlift in winter. The state court, citing Brigance and following its analysis, held that the exculpatory clause printed on the lift ticket was valid. But in a case brought by parents of skier killed by an in-bounds avalanche, Ingalls et al. v. The Vail Corp., 2015CV15 (Eagle Dist. Ct.) (June 8, 2018), the court disagreed with the analysis in Brigance and held that the Ski Safety Act does articulate public policy regarding the duties imposed on a ski area operator, and therefore those duties cannot be modified by private agreement. Looking forward, snow sports enthusiasts should assume that the waiver language encountered at ski resorts will likely be enforced, giving ski-area operators even greater immunity than previously granted under the SSA.

WHEN IS A SKI-AREA OPERATOR A LANDOWNER? A skier at Keystone Resort, a Vail Resorts property, was a passenger on a chairlift. When unloading, she encountered other skiers who had fallen, creating a pileup. On a motion to dismiss, the court held the SSA controls over the PLA when the ski-area operator is alleged to have violated a duty of the SSA, but the PLA controls if the claim does not involve a breach of a duty imposed by the SSA and the alleged duty does not arise from an inherent risk of skiing. A plaintiff may therefore have a claim under the PLA or the SSA, but not both. Pakis v. Vail Summit Resorts, Inc., 2018CV30010 (Summit Dist. Ct.) (July 3, 2018).
