n its more than 65 years of practice, Spangenberg Shibley & Liber has earned a nationwide reputation as a premier trial law firm. “Our firm is unique in that not only do we have a large traditional personal injury practice, but we also represent businesses of all sizes on issues ranging from insurance coverage denial to vendor contract disputes,” says managing partner Peter Weinberger. The firm has long been a leader in the health care litigation field, gaining national prominence in mass tort cases involving defective drugs and medical devices. It also regularly handles civil rights issues, such as police misconduct and discrimination. “Our firm continues to litigate large cases against powerful, well-funded defendants,” notes partner Peter Brodhead. “And we’re often called upon by other lawyers to help represent clients in some of their most complex cases.” Spangenberg Shibley & Liber has been ranked Tier 1 nationally for plaintiffs’ medical malpractice law by U.S. News– Best Lawyers “Best Law Firms,” as well as Tier 1 in Cleveland for multiple practice areas. In addition, five of the firm’s lawyers have been included in The Best Lawyers in America: Brodhead, Weinberger, William Hawal, Dennis Lansdowne, and John Liber. Of these lawyers, several have also been recognized as a Best Lawyers Lawyer of the Year in Cleveland: Lansdowne was named in 2012 for personal injury litigation; Liber was selected in 2013

for arbitration; and Weinberger was listed in both 2012 and 2013 for plaintiffs’ medical malpractice law and plaintiffs’ personal injury litigation, respectively. Above all, the lawyers at Spangenberg Shibley & Liber share a tremendous sense of service to their clients and the community. Indeed, the firm has a well-defined community outreach program called Help End Hunger, which centers on providing food to at-risk individuals and families through the Cleveland Foodbank and the Hunger Network of Greater Cleveland. “We view community service as part of our ongoing commitment to making a difference,” Weinberger says. “Ultimately, being able to do good work for the victims and corporate entities we represent is the most rewarding part of this practice.”

T

his list is excerpted from the 2013 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United States. Published since 1983, Best Lawyers lists attorneys in 124 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2013 edition of Best Lawyers is based on more than 3.9 million evaluations of lawyers by other lawyers. The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. Lawyers are chosen for inclusion based solely on the vote of their peers. Listings cannot be bought, and no purchase is required to be included. In this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings. The nomination pool for the 2013 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. In general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. Lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. Each year, half of the voting pool receives fax or email ballots; the other half is polled by phone.

Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “If you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality—a critical factor in the viability and validity of Best Lawyers surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process. Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases. For all these reasons, Best Lawyers lists continue to represent the most reliable, accurate and useful guide to the best lawyers in the United States available anywhere. hroughout his 24-year legal career, John A. Lancione has served as a tenacious advocate for victims of medical malpractice. While he handles all areas of medical negligence, he has developed a particular focus on obstetrical malpractice involving injuries to newborn infants. “Medical and obstetrical malpractice cases are challenging yet fulfilling,” Lancione says. “When you’re successful for these children—who because of their birth injuries are profoundly brain-damaged and will require 24/7 care for the rest of their lives— you know that you’ve somewhat eased the burden for their families.” Lancione has a national reputation for his medical knowledge and legal expertise in the field. Individually, he has been AV®-Preeminent™ rated by Martindale-Hubbell and included in The Best Lawyers in America and Super Lawyers. His firm, meanwhile, has been ranked Tier 1 nationally for plaintiffs’ medical malpractice law by U.S. News–Best Lawyers “Best Law Firms,” and Tier 1 in Cleveland for both plaintiffs’ medical malpractice law and plaintiffs’ personal injury litigation. As an accomplished litigator and educator, Lancione frequently lectures across the country on topics relating to obstetrical negligence and trial tactics. He is a past-president of the Ohio Association for Justice and he previously served as co-chair of the Birth Trauma Litigation Group of the American Association for Justice. In addition, he has testified before the Ohio Senate and House Committees on medical malpractice issues. Above all, Lancione is dedicated to holding negligent health care providers responsible for the harm they cause. While medical malpractice cases are often time-consuming and expensive to litigate, Lancione has achieved many multimillion-dollar verdicts and settlements for his clients. “A lot of lawyers don’t want to get involved in these cases because they are so costly and challenging to litigate,” Lancione notes. “It’s David against Goliath—my firm versus a multibillion-dollar malpractice insurance company with unlimited resources. But we have the wherewithal to bear the risk of these cases and the experience to win for our clients.”

t Elfvin & Besser, senior partners Bruce B. Elfvin and Barbara Kaye Besser draw on their decades of experience in employment-related matters to succeed for their clients. Representing a mix of individuals, private companies, and governmental entities, they focus on employment and civil rights cases, including statutory claims based on state and federal law. Still, Elfvin notes: “The strength of our firm is in representing individuals and groups of individuals. We take pride in the service we provide to people who are either caught up in the process, trying to avoid getting caught up in the process, or actually fighting it out.” Elfvin founded the firm in 1985 after leaving the Equal Employment Opportunity Commission (EEOC), where he was serving as assistant general counsel. Shortly thereafter, Besser—formerly the director of litigation for the Women’s Law Fund and a senior trial attorney for the EEOC—joined the firm. Stuart Torch joined the firm in 2005 and became a partner in March 2011. Last October, Katie Sanz joined the firm as an associate attorney. “Barbara, Stuart, and I have very similar core values when it comes to how we approach cases and serve clients,” Elfvin says. “And that’s important because at a boutique firm like ours, most matters end up being collaborative efforts.” Given their experience, Elfvin and Besser regularly speak on employment issues for organizations such as the National Employment Lawyers Association and the Ohio State Bar Association. Their firm has also been recognized nationally and ranked Tier 1 in Cleveland for labor & employment litigation by U.S. News–Best Lawyers “Best Law Firms.”

As the managing partner at Weisman, Kennedy & Berris, Eric Kennedy offers clients more than 30 years of experience in medical malpractice and product liability cases. During the past five years, he has been named as the Best Lawyers’ Lawyer of the Year in Cleveland three times: for personal injury litigation in 2009 and plaintiffs’ medical malpractice law in 2010 and 2013. Kennedy’s firm—a pioneer in the medical negligence arena since its inception in 1963—is also ranked Tier 1 nationally for plaintiffs’ medical malpractice law by U.S. News–Best Lawyers “Best Law Firms.” “We try to work harder than everyone else,” says Kennedy of the firm’s success. “We’re wildly detailed in our preparation, and I think that makes a real difference.” Over the last 15 years, Kennedy has further become known for his work in significant mass tort litigation. He has been involved in a number of notable medical product cases, and he is currently preparing to try the first federal DePuy hip recall case. “This is an interesting area of the law because the science, engineering, and medicine are different in every case,” Kennedy says. “It’s also very rewarding, as we help people in serious cases, including those involving families with injured children.” Outside of his practice, Kennedy is active in a number of community organizations, such as The Refugee Response, which helps refugees adjust to life in Northeast Ohio, and the Near West Theatre, an inner-city arts organization. n

While many family law attorneys work as solo practitioners, Andrew Zashin—co-managing partner at the firm Zashin & Rich—leads a team of domestic relations lawyers in handling some of the most challenging divorce cases in the region. “We have a lot of lawyers who are experienced in the full range of family law matters,” Zashin says, “and we’re all working toward the same goal, which is to achieve the best possible result for our clients.” The firm’s team approach also benefits clients in terms of its responsiveness: “Having so many professionals on our team allows us to respond to our clients and the demands of the practice with greater agility,” Zashin notes. Zashin has significant experience handling complicated interstate and international cases. He comments: “Our clients fall into four general categories—we represent business owners and their spouses, individuals with complex family problems, people with unusual parenting issues, and individuals with international divorce and child custody matters.” In 2013, Zashin was selected by his peers as the Best Lawyers’ Cleveland Lawyer of the Year for family law. He is also board-certified as a specialist in family relations law by the Ohio State Bar Association. Beyond his practice, Zashin serves as an adjunct professor at his alma mater, Case Western Reserve University School of Law, and is a sought-after presenter at national and international conferences. In addition to its domestic relations practice, Zashin & Rich exclusively represents employers in all aspects of employment, labor, and workers’ compensation matters. The firm has been ranked in U.S. News– Best Lawyers “Best Law Firms” since the survey’s inception. n
