I urge everybody from 8 years to 80 years to read the complete Development Plan review by Chandra Shekhar Prabhu on pages 12 & 13 – who has put the facts across in simple language, for us all to understand. Please urge all your family and friends to read this too, so that they can react in the right manner. Secondly, they have never gone for a site walk to see the sites they plan to cut through and make a road. Human Development Centre: Building Vocations, Building Lives

In a room, a mix of eight children and youth are sitting around a table, all engaged in different activities: some colouring, a few others designing envelopes, & the rest, engrossed in beadwork and other similar activities. No, this is no art class. This is a vocational centre for differently abled children. Founded back in 2000, the centre hosts children with learning and intellectual disabilities, behaviour problems, cerebral palsy, autism and the like. Back in 2000, at the turn of the millennium, and in fact even now, there are hardly any such centres in the city. Kirti Thakur along with Jehangir Afshari, saw the need for setting up such a centre, as many differently-abled children aren’t accepted even by special schools due to their disabilities as well as other behavioural problems. Located in Santacruz, the Human Development Centre Trust (HDC) takes on board children and youth, and provides them with vocational training. However, the most important skill the children are taught here is communication; then comes fine motor skills and skills for self-sufficiency. The children are also engaged in various sporting activities like basketball, judo/karate, swimming etc., and they are quite good at it. Further, their creative energies are also well directed. Most of the articles prepared and designed here are sold at various exhibitions held by corporate organisations, other NGOs, etc.

A few of the children from here also now work independently; one of them is involved in making chocolates, another is employed by a big hotel. They also go for training stints with Corporates and Hotels with the eventual aim of being employed by them, if found satisfactory. “Right now we try to accommodate as many children as we can here, but it’s still a little difficult given the space constraints we have. Jehangir and I have pooled in all our resources to give the best to these children, but we still need all the help we can get” says Kirti Thakur. “This is where Corporates can pitch in to fulfil their CSR requirements and also get blessings from these 'Special People'”.

The mix of children and youth are involved in making and designing of envelopes, jewellery, paper bags, showpieces, pencil stands, agarbatti, candles and numerous other things. They are also taught use of Computers, Baking and Cooking. During festive occasions, even Til Ladoos are pre-

pared and sold by them in bulk. They also undertake orders from the Corporate sectors for Packing and Labelling, Envelope and Bag making, Diya making, Jewellery making, Data Entry jobs, etc. The ultimate aim of the program is to make these individuals as self-sufficient as

At the Development Plan Protest Meeting on Sunday, 12th April 2015 at 5 pm, arranged by residents of Pali Hill against the proposed DP Plan & Hawking zone to highlight the absurd planing by the BMC – there was total commitment. Residents spoke out their feelings. Bollywood actors attended and actively participated. Local Corporator Asif Zakaria spoke to the crowd about various aspects of this draconian DP – and how we should react. There was a poster saying: Only Pali Hill Can Save Pali Hill. People slept on the

streets as a sign of protest. The air was tense. They vowed to take no nonsense from unscrupulous authorities. A local resident told us, “This is utter non-sense. Imagine, spoiling the serenity and greenery of Pali Hill with authorised hawkers all around. Making Mumbai an ‘International Financial Centre’ with You & Me evicted to ‘Some Distant Suburb’ We are now faced with a Development Plan which is going to determine the future of various areas of Mumbai city, for the next 20 years. The last DP was in 1991 – and the one before that was in 1967. The 1991 DP spoke about decongesting Mumbai & the present DP is an interesting document that most of us must read, as it says a lot of things about this city. Funnily enough the aim & objective of the DP 2014-2034, is to make Mumbai into an International Financial Centre. CITY: In this process, there are a lot of sacrifices that most of us would have to make, as one can see from the document. The draft DP document says that the FSI (or Floor Space Index) is going to be increased tremendously. For instance, the island city, i.e. between Mahim & Churchgate, on one side – and Colaba & Sion, on the other; has a general FSI of 1.33. This has sought to be increased to 5. It means that there would be FOUR island cities of Mumbai, with an FSI of 1.33, ONE on TOP of the OTHER. All this, without knowing whether the number of roads would grow, whether the schools & colleges would increase, or whether we would have more hospital beds. It doesn’t really matter, as long as we become an ‘International Financial Capital’. It doesn’t really matter, whether the roads should increase, the open spaces would increase or decrease & whether the schools and colleges become more and more difficult for students to get admission into. But then, that is what the island city is going to be. And, if you are lucky enough to live in & around a railway or specially a metro railway station; then you are entitled to an FSI of 6.5, 7, 8 & even more – all this for the island city. SUBURBS: If you take the suburbs of Mumbai, initially we had an FSI of 1. That 1 was increased to 2, with 0.33 being bought from the government and 0.67 being bought from the market as TDR (Transfer of Development Rights). Then this FSI of 2 was further increased to 35% fungible FSI, which means 2.7 – that’s where we stand today. Under the new regime, the minimum FSI that would be permitted to us would be 3.5 – and if you are lucky in some areas (lucky or unlucky, depending on which side of the table you are); you can get an FSI of 5.5, 6.5 & 8, if you live near the Andheri Metro Station lines that will be soon extended to underground stations & get connected to Linking road, in the near future. So, that means the suburbs will be increased in vertical layers of 3, 3.5, 5, 6 and more. And how are we going to take care of the amenities & facilities, the DP is very clear. It says: give permission for development – and the more you develop, the more there will be space. And more money will

be generated, as the surplus area will be sold – with the government getting 60% of the ready reckoner as a price in return. Once the money is there, then that money will go, if at all, towards creating amenities. So, first have development, have more development, again more development; which will generate some money, which will hopefully come back to the city. BMC Mess: Here is a small example of what happened in the past 3 years. We have this system called fungible FSI, which meant that suddenly whatever FSI was available to all of us, was increased by 35%. That is where this surplus FSI which was given for developers to sell, had to be sold at a premium – and the Municipal Corporation was permitted to collect this premium. With just one stroke of the pen, every year the BMC got a minimum of Rs 3,000 crores for 3 years plus; only from the premium of the fungible FSI. And with 10,687 crores paid by us to the BMC for the last 3 years, did our facilities increase? Has our life become better? When the money goes there, I must tell you that the lowest paid BMC employee, who does the worst of the menial jobs; gets Rs 35,000/- per month + a hefty bonus – which amounts to almost one and a half months salary, irrespective whether he works or not. There was an item in the TOI which stated that a driver working for the Municipal Commissioner gets paid almost 3 times the salary of the Municipal Commissioner (Rs. 80,000 per month). The driver’s extra working hours overtime money, added to his basic salary gives him a total pay cheque of around Rs. 2 lakhs, 10 thousand per month. So, as and when the revenue to the BMC keeps on increasing, the salaries become fatter and fatter. The BMC has several loans and most of the money that we contribute as property taxes, either goes for salaries or maintenance of their buildings - or goes for servicing the loans. There is hardly any money left for you and me. The system of property taxes in the “good old days”, used to be the ‘rateable value’. This has now been converted to a ‘capital value system’. Let’s understand these two terms. The rateable value was calculated on the basis of 11 months standard rent of the premises. As history has it, our rents were frozen due to several reasons, keeping our rateable values low. Hence, the property taxes were not as much the ‘experts’ felt they ought to be. And, so we went from one extreme of low rents and low

property taxes, to the other extreme; wherein irrespective of whether I live in a new building or whatever – if the neighbouring plot has been developed and the developer is selling the flat at Rs. 60,000 per sq. ft., then that becomes the capital value of my premises as well. I get a certain amount of depreciation. Then, on the basis of an increase in prices for life, as the selling price increases; my property tax will keep on increasing. Ideally property taxes should be connected with the services given by the BMC. Sure enough, you give good services, charge heavy taxes. But then you don’t improve on the services and keep on increasing the taxes, just because the neighbouring plot has been developed and the developer has been lucky enough to sell his flats at Rs. One lakh per sq. ft., I got to pay double the amount in property tax, compared to what I paid earlier. Now, all this put together is really going to put us into a situation, wherein many of us who’ve lived for generations in the older parts of the city; would find ourselves in a situation where our amenities are reduced by the day, yet we land up paying more for what we have. Whatever amenities we are getting in the form of water, drainage, sewage, etc. are going down by the day. The number of vehicles & pollution in the area keeps on increasing and then there is a DEVELOPMENT PLAN, which instead of thinking in terms of decongesting measures – is going exactly the reverse. In fact it is permitting a ‘free-for-all’ kind of situation by increasing the FSI. POLITICIAN’S PLOY Now all this has just been announced – and our great elected representatives from all political parties, DID NOT BAT AN EYELID, when the DP was introduced for suggestions and objections into the BMC. Everyone approved it without discussion, in a matter of – hold your breath – FOUR SECONDS. No one even asked to see the content. They may have thought, now this is done. ‘In any case, it will come up for suggestions and objections. So, this is not going to be final. People are going to suggest and object. Then there is going to be another committee, who will go into these suggestions and objections. This committee will give a hearing to all those who have objected – and make their recommendations. And on these recommendations, it may be accepted by the standing committee, thus changing the development plan and get reintroduced into the BMC. Then this will be followed by a series of deliberations, where our elected representatives will have the

right to talk about it on the floor of the house. After that, it will be approved and go to the government as law.’ Since, this is a long way off, our elected representatives have not even bothered to check anything. So it got introduced, without anybody even asking for a debate. That is how we have this DP 2014-2034, with 25th April as the last day for submission of objection. The letter format for suggestions / objections can be downloaded from: bandrabuzz.com/dp-2014-2034.html This should not be done as a signature campaign. Instead, separate letters should be sent (not xerox copies – with fill in the blanks). Please check the total DP and then send in your letters of suggestions / objections. BUILDER’S BOUNTY: A fantastic jugglery has been done in this DP, just with the stroke of the pen. The BMC exists – yet in a way, it does not exist, because they say: ‘We have been there, but the slums have come. We have not been able to stop the slums. So, what do we do? We permit more development, rather than stopping – because if we have not been able to control them, then let’s remove all the slum area reservations’. So, by one stroke of the pen, 3,000 reservations for gardens, playgrounds, hospitals, schools; where slums have encroached upon the plots that were reserved for specific purposes – have just been removed. The reasoning is that there are slums existing, so how can we wish them away? So, why keep these reservations that we can never follow. Just remove them. For builders, under the SRA Scheme earlier, if there were reservations in slum areas, in the process of developing the land, you could have the reservation as well as get an extra FSI, if you build it as per the reservation (say, a school). Then accommodate the slum dwellers somewhere else – and sell the rest. Now, this has been removed. For gardens, playgrounds or open spaces, the formula was: keep one-third for a playground or a garden, one-third for slum rehabilitation – and the remaining one-third can be developed and sold at market value. So, one-third of the plot is given back to the city. Now, instead of getting that one-third, the whole plot reservation seems to have been removed. Someone like me, who has been studying Urban Development all my life; feel that this DP would have disastrous consequences to the city and to its residents. If you too feel that this is going to happen, then please register your objections. Now is the time to do this. Go through the DP and learn the intent of those responsible in making this DP. DEVELOPMENT PLAN Making Mumbai an ‘International Financial Centre’ with You & Me evicted to ‘Some Distant Suburb’ Contd. from page 12 Earlier there used to be reservations for residential, meaning only residential. Commercial means a mix of commercial and residential. Now there are only two broad reservations. One is RC, which is residential and commercial – and the other is CR, meaning commercial and residential. There is no third. So, those of you who have been raising strong objections in your residential building, where someone comes on the ground floor and converts it into commercial, saying that this is not permissible – now, that is going to be the rule. And, you will be the ‘wrong’ person objecting to the ‘correct’ kind of rule. So, all this is happening – and we are going to face it, whether we like it or not. Hence, it is up to us to make up our minds and take decisions – whether we are going to take this lying low, or whether we are going to oppose it. We need to take charge of the situation, by checking up with our elected representatives, as to what they have been doing, when this type of a development plan has been thrown at us, without even checking with us, whether we want it or not. Please note that when this FSI is increased, it will have to be bought. It will not come as a right. This has to be bought by paying the ready reckoner price, or part of it. This means that huge amounts of money will have to be paid by builders to get this extra FSI. When they pay this their costs will go up substantially. Once the costs go up, the selling price will make it prohibitively expensive for anyone to buy a flat within the island city. Funnily enough, the DP also admits a few things. It admits that as per world standards, what is affordable to a person to buy a house – is considered to be 5 times his annual income – i.e. 5 years. This means that if you earn Rs. One lakh per month, then a flat for Rs. 60 lakhs would be affordable to you. So, the kind of loans you would take would be such that your income would be good enough to service the loan – and yet have enough funds to run your household and other expenses. This is a correct measure of practical property affordability. Taking the island city western coast, the rates vary from 1.50 lakhs to 1.75 lakhs per sq. ft. The cheapest is around 45 thousand per sq. ft. On the eastern side the going rate is 30 thousand to 40 thousand per sq. ft., with certain areas available for lower rates of 20 thousand to 25 thousand per sq. ft. So a reasonable sized 1 BHK would cost you 3 - 4 crores in the down market area. In the up market areas, the cost would be 10, 15, 20 or more crores. You cannot count correctly the zeroes that would need to be put after the numbers. Similarly in the suburbs, the western side would be the most expensive real estate, whether it is Bandra, Khar, Santacruz - and further north. The eastern

BANDRABUZZ areas are relatively cheaper, yet for a decent flat, the price would put you back by at least a crore. So, if you do not earn 1.5 lakhs to 2 lakhs per month, you just cannot afford to buy a decent flat even in the distant suburbs. This is the present situation. With the new DP, I have no doubt that the prices will go up so high, that most of us (98% of the population) would find it ‘just unaffordable’. SHOUT, OR GET OUT: So, what do we do? We chuck our present flat, take whatever money it fetches and go to the distant suburbs. Save some money from the difference and bank it as FDs. – so that the interest will help pay the property taxes of these new flats in the distant suburbs – Virar, Panvel, etc. This, to my mind – is a very ‘wise way’ of getting the city vacated. So that we can come back someday with our grand children and great grand children, like we do now – and go to the Prince of Wales Museum and tell them,“There used to be a person called Shivaji and this is his sword. Once upon a time, your great grandfather used to live here, in this place called Bandra, now it is called ‘Vandre’, or… And times came when the ‘Great Development Plan’ was introduced. In the interest of this Great Development Plan and to make Mumbai a Great City, as a Great Commercial Hub of the country and the world at large; we all decided to sacrifice our property and come to these distant suburbs. Those who could afford, survived and remained back.” This is essentially what the DP will throw at us, if we allow it to happen. I tried my level best to find at least 5 good points in this DP, but couldn’t really succeed, even after reading the whole document several times. So, I think it is time for us not to go by what I and others who are considered to be experts in this subject tell you; but to read for yourself, take advice from experts as to how it will affect your life – and then send in your objections. There are huge amounts of people with various objections pouring in. When the magnitude of objections is really huge, the government will surely realize that there is a major outcry against what they are trying to do. Perhaps some reasoning may dawn among them – and make them re-consider changing some of the draconian laws that are to be implemented. We really need to be very vigilant and impress upon them that we are not going to take things lying low, this time. We have understood the ‘game plan’ that is in store for us. Finally, this is an effort to throw us out of the city that we love the most. We are not going to tolerate this DP. We are going to protest against this DP. We are going to rise against this DP – and tell those people that enough is enough. No more nonsense. Not anymore. This is NOT a plan for our development. This is a plan for EVICTING us from our city - Mumbai. Chandra Shekhar Prabhu

‘Just Dump This DP’ The Salsette Society held a meeting at the DPRC, concerning the DP Plan; with two local corporators: Karen D’Mello & Asif Zakaria present. Bandra Gym Jt. Hon. Gen. Secretary & Hon. Treasurer, Cornel Gonsalves told the gathering of around 100 that “We were lethargic in 1991 and lost some of our properties, – so, today we need to wake up & act” A lot of unknown Salsette - related facts was discussed – with documented proofs. St. Dominic Road, St. Andrew Road, St. Francis Road, St. John Road, St. Paul Road ext., Chimbai Road, St. Andrew Church, St. Anne Church, Kantwadi scheme, Carmel Convent… would get affected. The Otters Club exit to the Sea Link across the two Bandra Promenades: Bandstand & Carter’s is another issue. Interaction with Jordan, the Salsette architect was encouraged – for clarifications. Letter formats would be distributed. Asif told the crowd, “It looks that the DP was made just looking at Google Maps. We need to think out of the box and give objections, based on logical facts – individually and collectively, using documents and photographs as proof. An acknowledgement is important. With awareness and activism, we can create an impact.”

In the public interactions, Cornel said that all internal roads of Salsette – i.e. St. Paul Road, St. Andrews Road, St. Dominic Road, etc. were developed by Salsette and given for public use with a BMC ‘sanad’ (deed). He also had proof that the Pali Market is a Salsette plot, (see proof at bandrabuzz.com/salsette.html) - given for public use. He said that a draft letter-of-objections format would be distributed to those who need it. MC Karen D’Mello told the crowd that she would help people of Ward 96, concerning the DP - to the best of her ability. People could approach her. She said, “I have already filed my letters of objections for St. Dominic Road, St. Andrew Road, because it affects the school and hospital (Holy Family). I can help people file individual building / plot complaints.” Co-ordination is important to get results and people need to react now. Snacks were served and interaction continued – even as the crowd appreciated the organizers of this important DP Meeting. In conclusion, the unanimous voice was to “Dump This DP” Flavia Mendes

Deciphering the BMC’s Draft Development Plan Contd. from page 1 He said that it was unfortunate that most of the suggestions and recommendations given during the public consultation meetings, which was a welcome step by MCGM - do not find a mention in the Draft DP. He highlighted many of the macro issues viz. purchasing of FSI as per the Ready Reckoner Values from MCGM, which does not result in "affordable housing", granting of FSI of 8 without any related infrastructure near Dadar & Andheri Station - which will cause chaos; no plans for storm water drains nor any reference to the Chitale Committee Report. There is a distortion of figures in relation to Solid Waste Management (SWM). MCGM in its own report which gives increased figures are conveniently reduced in the Draft DP. It is shocking that dumping grounds have been shown as ‘Residential Areas’. Meher Rafaat, NAGAR trustee spoke on the issue of open spaces and how the DP has changed the reservations on the plans. Mr Sukthankar, Chairman of AGNI appealed to all citizens to study the Draft and send in their letters of suggestions and objections by 25th April 2015 (To download the letter www.bandrabuzz.com/dp-2014-2034.html) He said, citizens must follow the 60 days deadline so as to hold MCGM accountable, unlike MCGM who has not kept their word. Mrs. Shyama Kulkarni, AGNI Trustee emphasized that these suggestions and objections should NOT follow the route of signature campaigns; instead letters must be written to the Municipal Commissioner by individual members of ALMs or of any other body. She also mentioned that the

doubling of open spaces is an ‘eye wash’ and areas like Raj Bhavan and private clubs have been shown as open spaces. It is evident that such areas are not accessible to the public and huge amounts of membership fees have to be paid to be part of clubs and gymkhanas! An interactive session followed, where many questions were raised as to the difference in the Draft DP and the actual ground reality. For e.g. Church authorities and Principals of Bandra schools were shocked as new connecting roads were being shown cutting through their properties. Bandraites were wondering how the Coastal Road would affect the promenades. There was concern that if mangroves were encroached upon and salt pans were being included under the Residential Commercial (RC) /zone; it could lead to major flooding in Mumbai. Many felt that this Draft DP lacked vision - and if it is implemented, many Mumbaikars would be forced to leave the city. The meeting was well attended by more than 500 Mumbaikars from Bandra, Borivali, Mahim, Chembur, Powai and Kandivli. AGNI distributed over 400 informative flyers to guide citizens on how to send their letters to the concerned authorities and 75 CDs of the Draft DP. Mumbaikars have already started protesting against the turning of Aarey into a Development Zone and this agitation must be translated into letters to the Municipal Commissioner. We were informed that Pune had sent over 80,000 letters of Suggestions and Objections for their Draft DP - and we Mumbaikars need to WAKE UP now - and do the same, if not more. Nadine Razzak
