Moody’s to elevate PHL to ‘investment-grade’

MANILA, July 25, 2013 (AFP) – Moody’s Investors Service signaled Thursday it was likely to elevate the Philippine government’s debt rating to investment-grade, citing the former basket-case nation’s robust economic growth and political stability. Two other major credit rating agencies, Standard and Poor’s and Fitch, have already upgraded Philippine government securities to investment-grade earlier this year. “Moody’s Investors Service has placed the Ba1 foreign and local currency long-term issuer and bond ratings of the Government of the Philippines on review for upgrade,” the US ratings agency said in a statement. The next-highest rating on its scale is “Baa3”, considered the

lowest in the investment-grade ranks. Moody’s said a rating in the “Baa” ranks is “subject to moderate credit risk”, while “Ba” rates entail “substantial credit risk”. The Philippines last defaulted on its foreign debt in the early 1980s. “The Philippines’ economic performance has exceeded Moody’s expectations; supporting the view that the economy will grow significantly faster than similarly rated peers over at least the next two to three years,” it said. This growth came despite a global economic slump and with no signs that the economy was overheating or facing “imbalances”, it added. It credited the improvement to See MOODY’S, page 12

Hundreds protest China’s ‘bullying’ of PHL MANILA, July 24, 2013 (AFP) – Hundreds of Philippine activists on Wednesday accused China of “gunboat diplomacy”, demonstrating at a noisy Manila protest against the Asian giant’s moves to stake its claims in the South China Sea. Riot police cordoned off the entrance to an office building housing the Chinese consulate as an estimated one thousand demonstrators took Beijing to task for “bullying” the Philippines. The protest, which ended peacefully two hours later, came amid festering tensions between the two neighbors over Scarborough Shoal, a Philippineclaimed outcrop seized by China after a two-month naval stand-off last year. “Our simple message for China today is to

stop your intrusions, and stop your bullying of other claimant countries,” Risa Hontiveros, a former member of parliament and one of the protest leaders, told AFP. The demonstrators, who included politicians, former military officers and church officials, accused China in a statement handed out at the protest of implementing “gunboat diplomacy in the region”. They put up a portable stage on the street, snarling traffic as they sang patriotic songs, blew horns, danced and hoisted anti-Chinese slogans. MANILA, July 24 (Mabuhay) – Why is Danny Lim resigning from the Bureau of Customs? Six dead in Cagayan de Oro blast MANILA, July 27, 2013 (AFP) – Six people were killed and more than two dozen wounded when a bomb exploded at a restaurant in the southern Philippines, police and local officials said Saturday. Police said the improvised explosive device went off around midnight (1600 GMT Friday) at a popular restaurant in the southern port city of Cagayan de Oro. The motive for the blast was not immediately clear, Cagayan de Oro police chief Graciano Mijares said. “We will have to wait for the results of the investigation,” he added. Cagayan de Oro is located on the main southern island of Mindanao, which has been blighted by a decades-old rebellion by elements of the large Muslim minority in the mainly Catholic Asian nation. Local businessman Noel Arcenas, who owns an electronics shop at the shopping complex where the restaurant

is located, said at least 100 people were inside the popular establishment when the explosion occurred. “I felt then heard the blast,” said Arcenas, who added he was standing about 15 meters (49 feet) away. “I looked around and saw this ball of white smoke. People were running away bloodied and survivors were dragging at least seven or eight people away from the blast site.” The powerful explosion broke glass panels, upturned tables and chairs, and damaged cars parked up to 30 metres away, reporters at the scene said. The six dead included local politician Roldan Lagbas, a member of the provincial executive board of Misamis Oriental province, police said. Twenty-eight people were wounded, many of them representatives of pharmaceutical companies who were having a party at the restaurant, police added.

PDEA destroys P965-M worth illegal drugs MANILA, July 25 (Mabuhay) – The Philippine Drug Enforcement Agency Thursday destroyed over 700 grams of different illegal drugs worth P964.94 million. Undersecretary Arturo G. Cacdac, Jr., PDEA Director General, said the agency destroyed 722,446.5 grams (722.4 kilograms) of assorted pieces of drug evidence composed of methamphetamine hydrochloride, or shabu, cocaine, ephedrine, pseudoephedrine, marijuana, ecstasy, valium, expired medicines, and 4,300 milliliters (4.3 liters) of liquid dangerous drugs. “Based on the record and consolidated report of the PDEA Laboratory Service, these considerable volume of dangerous drugs and expired medicines were properly turned-over and endorsed with corresponding documentation to PDEA by other law enforcement agencies like the National Bureau of Investigation, PDEA Regional Offices, and various Regional Trial Courts ready for destruction,” said Cacdac.

He added that the destruction was held at the Clean Leaf International Corporation at 397 M. H. Del Pilar St., Barangay Maysilo, Malabon City.Cacdac said the thermal decomposition is the process by which various compounds are broken down into single units by the application of heat wherein reconstruction of the substances is impossible. “In today’s activity, we are informing the public and inculcating in the minds of the Filipino people that the dangerous drugs seized by authorities are not being reused, recycled or sold back in the streets”, Cacdac added. “These illegal drugs and substances are no longer needed as evidence in court,” PDEA chief added. The destruction of the dangerous drugs complies with the guidelines set on the custody and disposition of seized dangerous drugs required in Section 21, Article II of Republic Act 9165, or the Comprehensive Dangerous Drugs Act of 2002, and DDB Regulation No. 1, series of 2002. Cagayan de Oro Mayor Oscar Moreno told ABS-CBN television network that at least two of the wounded were in critical condition. “Doctors have been attending to them and we hope their situation will stabilise soon,” Moreno told the station. Asked who he thought was responsible for the attack, he said: “It’s hard to speculate at this time.” Muslim groups including the Moro Islamic Liberation Front (MILF) have waged a guerrilla war for a separate Islamic state in Mindanao since the 1970s, a conflict that has claimed an estimated 150,000 lives. President Benigno Aquino’s government and the MILF signed a preliminary deal in October last year outlining the broad terms for a peace treaty that is expected to be signed before he ends his six-year term in 2016. This is the second agreement that the government has had to forge with a Muslim insurgent group since the 70s.

Senate bill seeks to scrap ‘useless’ cedulas MANILA, July 24 (Mabuhay) – A bill was filed in the Senate on Wednesday seeking to stop the use of community tax certificates, commonly known as “cedulas.” In filing Senate Bill 1082, Sen. Francis Escudero proposed the scrapping of “cedulas” since there are “more competent” proofs of identification available to the public such as passports and drivers’ licenses. “The cedula now proves to be an unnecessary burden imposed on our people who are required to present it when doing public transactions. It was deemed useless by our forebears during the colonial times, it is more so today,” Escudero said in a statement. The measure seeks to repeal provisions of Republic Act No. 7160, the Local Government Code of 1991, which authorizes local government units to impose residence tax. The “cedula” currently serves as proof that a resident paid community tax. Escudero said these Spanish-era documents only serve as “a relic of our colonial past.” “The cedula is a thing of the past that should already be buried for its obsolescence,” he said. Last April, Internal Revenue chief Kim Henares also proposed the scrapping of “cedulas,” saying the government spends on printing and distributing these documents but gains no earnings in return. After a debtor receives a discharge in bankruptcy, CONSUMER creditors whose debts are discharged are required to MATTERS report that the account has a zero balance. The fact of the filing itself can remain on the credit report for 10 years from the date it was filed. A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out. If not, the debtor should contact the credit reporting agencies and ask that the record be corrected BY ATTY. PAUL ALLEN Methods of Re-Establishing Credit A debtor seeking to re-establish credit should consider applying for a secured card, usually a Visa or Master Card. This is a credit card issued by a bank to a customer who is required to establish a savings account at the bank, which is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that banks will issue them to persons with poor credit reports in the past, but who have the ability to pay the deposit to secure the account. Major store cards are also a good addition to building credit. Once you have a major credit card, even a secured card, it’s usually all that’s required to open an account at a major store, such as JCP, Kohls, etc. Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with bad credit or recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source. There are also financial institutions that target recent bankruptcy people seeking credit. This also includes mortgage companies. Several major companies will consider a mortgage within 1 to 2 years from the bankruptcy discharge. The reason these companies are interested in bankruptcy discharge consumers, is because they cannot file a bankruptcy again for 8 years, do not owe money, have a good debt to income ratio (Income from employment, all debts discharged in bankruptcy), and finally, they get to charge more than regular financial institutions. Bottom line – it’s a business, and a good business at that. Caution in Rebuilding Credit Ultimately, however, debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards. Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit. Debtors should avoid being enticed by so-called “credit repair” agencies. These are often simply unregulated rip-offs, who prey on the financially-distressed, and who do nothing more than what debtors themselves can do by exercising their legal right to have their reports properly list their outstanding obligations. PHL says Muslim veil directive only a request MANILA, July 25, 2013 (AFP) – A Philippine government directive for female Muslim teachers to take off their face veils in class is not mandatory nor meant to curtail religious rights, the education minister said Thursday. Education Secretary Armin Luistro issued guidelines last week on wearing the “niqab� in schools, intended mainly for the southern Philippines, where most of the country’s Muslim minority live. “I want to make it clear that the Department of Education order was not meant to impinge on the religious rights of Muslim teachers,� Luistro told AFP. He emphasized the directive was worded as a “request�. There was initial confusion because the guidelines were entitled an “order�. “If they feel that strongly about it, then they won’t be forced to do it. There will be no penalties imposed,� Luistro said. He said the reason for wanting the face veil lifted was so that teachers could be better understood, with students able to read their lips as well as hear their words. Many Filipino Muslim women traditionally wear the “hijab� veil which covers their hair and ears, neck and chest. But some of them additionally wear the “niqab� which covers the nose, cheeks, mouth and chin, leaving only their eyes exposed. The guidelines for Muslim teachers refer only to “the veil that covers the entire face�. The education ministry said it employed 1,635 Muslim teachers to teach 166,000 students for its Arabic Language and Islamic Education program, though it did not provide the total number of women in the list. The program is in place in 849 schools across the Catholic-majority country, with most located in the Muslim regions of the south.

Palace insists no need for peacekeepers in South MANILA, July 25 (Mabuhay) – A MalacaĂąang spokesman on Thursday said there is no need to send peacekeepers to Mindanao, contrary to what former Moro National Liberation Front (MNLF) leader Nur Misuari told the United Nations (UN) in a letter. During a press conference earlier in the day, Misuari said he wrote to UN Secretary General Ban Ki-moon to request for the deployment of peacekeepers in Mindanao. Misuari allegedly said the deployment of so many Filipino soldiers to Mindanao may be an indication of an impending war. Presidential spokesperson Edwin Lacierda, however, dismissed Misuari’s claims. “Anong giyera? We are having a war against poverty I can guarantee that. The war against poverty doesn’t need peacekeepers,â€? Lacierda told reporters at a press briefing. (MNS)

In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing. Income Tax Liability Under the Internal Revenue Code, as a general rule, forgiveness of indebtedness constitutes income to the debtor. However, there is an exception where the debtor receives a discharge in bankruptcy. Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is

included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cash-strapped debtor to simply pay the bill. PHL imports decline 2.9 percent in May – NSO MANILA, July 25 (Mabuhay) -- Philippine imports swung back to a decline in May after posting a slight gain a month earlier, reflecting a bleak state of global trade. In a statement, the National Statistics Office said imports in May fell 2.4 percent year-on-year to $5.257 billion from $5.385 billion. In April, imports registered a revised 7.4 percent annual growth after registering declines in the first three months of the year. Total imports for the first five months of 2013 amounted to $24.755 billion, down 3.6 percent a year earlier. The trade deficit registered at $3.66 billion after deducting the five-month imports tally from the $21.095 billion export bill as of May. Imports of electronic products, the top trade merchandise item for the Philippines, decreased by 10.6 percent in May to $1.275 billion. The latest import data “might forebode a sustained decline in exports in line with weakening of global trade,� Metropolitan Bank & Trust Co. research head Ildemarc Bautista told GMA News Online. “Trade has been erratic. But demand drivers are still intact and can support growth for the year,� he said. Bautista said “weak global demand is certainly bad news for the trade sector. But on a macroeconomic perspective, the trade sector’s drag is only a small portion.�

Aquino to welcome BRP Ramon Alcaraz Aug. 6 MANILA, July 25 (Mabuhay) – President Benigno Aquino III will head government and military officials during welcoming ceremonies for the BRP Ramon Alcaraz (PF-16) upon its arrival at Subic Bay on Aug. 6. “We will be having a meeting with the Presidential Management Staff regarding this (welcoming ceremonies) as President Aquino will be our guest of honor,� Navy spokesperson Lt. Cmdr. Gregory Fabic said. He said the Aug. 3 arrival of the ship refers to the vessel entrance into Philippine territory. Fabic said actual arrival date of the BRP Ramon Alcaraz in Subic Bay is actually Aug. 4 with the arrival ceremonies slated for Aug. 6

Before entering Subic Bay, a PN ship will head out to sea to escort the Filipino frigate for the traditional meeting point tradition. Fabic declined to reveal the exact location where this ceremony will take place for security reasons. He added Alcaraz, upon commissioning in the second week of October, will be deployed to help other PN ships in protecting the country’s exclusive economic zone. Fabic declined to give specifics, citing operational security. He added the ship will be dry-docked in Subic Bay where its white paint will be painted traditional haze gray. “The morale of the PN is very high with the arrival of the BRP Ramon Alcaraz as (it) will greatly boost the capabilities of our fleet,� Fabic stressed. Bill filed to allow foreign vessels greater flexibility in PHL waters MANILA, July 24 (Mabuhay) – Rep. Rufus Rodriguez of the second district of Cagayan de Oro on Wednesday filed a bill that will remove restrictions on foreign vessels entering the country. “[Should it be passed,] this bill will bring goods here. It will remove all limitations, and will allow foreign vessels to travel port by port,� Rodriguez said. House Bill 1789, or “An Act Allowing Foreign Vessels to Engage in Coastwise Trade in the Country and for other purposes,� otherwise known as the “Coastwise Trade Act of 2013,� repeals the Cabotage law. In his State of the Nation Address, President Benigno Aquino III also mentioned that he wants to see Congress amend the law. The Cabotage Law prohibits foreign vessels from serving domestic shipment routes, but Aquino said amendments will increase competition and strengthen industries. “Mapapalakas po nito ang kompetisyon,� he said. Rodriguez explained that with the passage of the Coastwise Trade Act of 2013, foreign vessels will be allowed more flexibility in Philippine waters, thereby ending the practice of foreign ships of using other

nearby ports with less restrictions. “The problem right now is that while [foreign vessels] can enter the country through one port, it’s very expensive to travel for example from Mindanao to Luzon. In contrast, it’s very cheap to move from Hong Kong to Luzon,� he said. Rodriguez also explained that a similar bill was filed in the 15th Congress, but that it failed to pass. “This bill was filed in the previous Congress, but we have refiled it, heeding the call of the President,� Rodriguez said, noting that he has high hopes for its passage in this Congress. “We are very optimistic that it will pass, especially since the President mentioned it, and with [the majority] in Congress,� he said. Rodriguez noted that he filed bill as a response to his constituents’ requests. “This bill will be good for the country. Especially for the people of Mindanao. It has been their clamor to lower the tariff rates in moving cargo from Mindanao to Manila,� he said. Aside from a mention in the President’s SONA, amendments to the Cabotage Law were also one of the administration economic cluster’s nine priority measures for the 16h Congress. (MNS)

LGUs surrounding Subic Freeport to receive P74.5-million from SBMA MANILA, July 25 (Mabuhay) – The Subic Bay Metropolitan Authority (SBMA) yesterday said it will remit to surrounding local government units (LGUs) P74.5 million, representing their share in the agency’s revenues. In a statement, SBMA chairman and administrator Roberto Garcia said the total amount includes P67.2-million for the first six months of this year, plus P7.3-million, which pertains to the 10 percent of the first-half 2011 revenues withheld from the LGUs. Garcia said the funds set for release are intended to supplement health, education, peace and order, and livelihood generation projects of LGUs surrounding the Subic Bay Freeport. “The SBMA is continuing with its task of attracting more investments. The more investments we generate, the more revenue share we can collect from corporate taxes. And these will be forwarded to neighboring communities of the Subic Bay Freeport,� Garcia said.

According to the SBMA, the recipients and their respective shares are as follows: Olongapo City, P18.12 million; Subic, Zambales, P11.05 million; Dinalupihan, Bataan, P9.35 million; San Marcelino, Zambales, P9.02 million; Hermosa, Bataan, P7.6 million; San Antonio, Zambales, P6.57 million; Morong, Bataan, P6.44 million; and Castillejos, Zambales, P6.36 million. The LGUs’ share is derived from their five-percent in corporate taxes paid by Subic Bay Freeport-registered businesses. LGUs get two percent of the total taxes collected, with the remaining three percent remitted to the national government. SBMA started releasing the revenue share of LGUs after it implemented a new tax collection scheme in August 2010. The LGU share is determined according to population (50 percent), land area (50 percent), and equal sharing (25 percent). (MNS)

The next day, the older daughter told the younger daughter that it was her turn to get their father drunk. The same thing happened. By this method, both daughters got pregnant. Whatever their justification, perhaps even survival of their family, I wish to say that, what Lot’s daughters did was morally and terribly wrong. Incest cannot be justified under any circumstance. But since Lot and his daughters had lived in Sodom for some time, perversion and depravity had infected them. If you recall, Lot even offered his two virgin daughters to the village people who demanded that Lot release the two angels who had assumed the form of men to them so that they may have sex with them. The Bible says that Lot was so drunk that he did not know what he did. This is akin to the plea of insanity when one is charged with murder. Lot is acquitted of being guilty of incest with his two daughters because he was so drunk that he had

no consciousness whatsoever of what he was doing. But what strikes me as unusual is that both of his sons with his daughters, who are also his grandsons, turned out to be normal, not retarded. The older daughter gave birth to a son whom she called Moab who became the progenitor of the Moabites. And the younger daughter gave birth to a son whom she called Ben Ammi who became the progenitor of the Ammonites. The descendants of the Moabites and Ammonites still live today in central Jordan. Despite the fact that two angels had to drag Lot and his two daughters out of Sodom, meaning they did not really want to leave because they had become perverted themselves having immersed themselves in the wicked activities of sin city, the Moabites and the Ammonites worshipped the false god Chemosh, a detestable concoction with the head of a bull the body of a man with outstretched arms. MANILA, July 26 (Mabuhay) – Senator Pia Cayeano, a health advocate, on Friday urged the government to make the metropolis friendlier to people who would prefer to ride a bike or take a walk to get to their destination. Cayetano made this appeal as she pushed for the alternative approaches, including biking or walking, to address traffic congestion in Metro Manila based on her Senate Bill No. 26. ”Yes to walking, biking but let’s make it safe and accessible,” Cayetano said. The lady lawmaker lauded the efforts of the government to solve traffic problem, saying one of the alternatives is to encourage the people to walk or bike to reach their destination. “I support government efforts to ease traffic congestion in Metro Manila. I think it is laudable that we are now talking more about walking and biking as serious alternative modes of transportation. But to truly encourage people to do so, we must provide the infrastructures that will make walking and biking safe, accessible and convenient,” said Cayetano. In her SB No. 26 or the “Sustainable Transportation Act of 2013,” Cayetano seeks to address the traffic situation, pollution and quality of time lost due to traffic by promoting alternative and sustainable modes of public transportation. She said the infrastructures would include more bicycle lanes and covered walkways and footbridges, given weather conditions such as heavy rains, to make biking and walking safe and appealing to the public, as well as the revival of the river ferry system through possible public-private partnerships.

Aquino gets OK grades for managing country – Pulse

MANILA, July 25 (Mabuhay) -- President Benigno Aquino III managed to get passing grades on issues ranging from managing the economy to poverty reduction, based on the latest Pulse Asia survey. Those grades were barely unchanged compared to when he took office in 2010. “On a scale of 0 to 100, with 75 as the passing grade, President Aquino’s average or mean grades range from 75 (or “barely passing”) on poverty reduction to 80 (or “good”) on the management of the economy and delivery of basic services to Filipinos in need. On the other hand, the President scores a median grade of 80 on all 11 issues on which he is performance-rated in this survey,” Pulse Asia said. On management of economy, he got a mean or average grade of 80 and a median grade of 80. In terms of strengthening political institutions such as the electoral system, he got a mean grade of 79 and a median grade of 80. On the issue of increasing peace in the country, he got a mean grade of 79 and a median age of 80. On ensuring delivery of basic services, he separately got mean and median grades of 80. On enforcing the law on both influential and ordinary people, Aquino got 78 mean and 80 median. On reducing poverty, Aquino got a barely passing average score of 75. His median grade was at 80. On strengthening relations with other countries, he got 79 mean and 80 median. On fighting graft and corruption, he got 79 mean and 80 median. On fighting criminality on the other hand, Aquino managed an average of 78 and a median grade of 80. In terms of fighting for the environment, he got an average of 78 and a median of 80. In controlling fast population growth, he got an average of 77 and a median grade of 80. The survey fieldwork was done between June 20 to July 4, during which happened several issues such as the continuing tension between the country and China and Taiwan, the sex for flight scandal, the resignation of key government officials such as PAGASA administrator Nathaniel Servando, the delay in the peace process with the MILF, the death of a drug mule in China, the crash of the stock market after a record-making performance, etc.(MNS)

Partnering with your aging parents for their future

(Part I) In our growing years, our parents have helped us go through life’s challenges. As they age, it is our turn to return the favor and apply the 70-40 rule. This rule occurs when your parents reach the age of 70 or older, while you are in your 40’s or older. Though it seems difficult to start a conversation with your parents about aging, it is better discussed earlier when they’re still in good health, rather than later when crisis occurs. Subject of conversations such as aging, needing help or planning to move to a retirement community or assisted living is sometimes left unsaid, as some of our parents might be in denial about their aging process and they might not have planned for their future. There are times when crisis hit and you become guilty of not having addressed the subject earlier. The emotional stress can be avoided when crisis arise. As adult children, we have to realize that currently, our parents live longer, but now they live with impairments which you are unable to recognize. Starting a shared conversation on sensitive topics such as planning for their future or asking them for their opinion on how they wish to live the rest of their lives would

BY MYRNA AQUITANIA seem less confrontational rather than offering them a ready-made plan. Reassure them that the conversation is about them and their wishes for the future and you’re partnering with them as a team player where your role is to listen to their needs and understand their goals and desires for the rest of their remaining lives. As adult children of our parents, we are not there to switch roles with them. Rather, we are there to honor them and show them to look forward to their future. The best approach is to plan carefully and write down what you think needs to be addressed, so you don’t forget to discuss important questions. The conversations you will have will be a series of conversations where you will discuss one issue at a time, “rather than trying

to resolve everything at once.” With this approach, you have the time “to build slowly and your discussions will center on the area of their life and health without panic or pressure.” In order to achieve a series of respectful conversations, you have to allow “a lot of time and patience.” It is particularly important that you create a “safe space” when you start these conversations. Holidays at the dinner table are usually not the right time to discuss sensitive issues with elderly parents. In order to create a “safe space,” you can probably invite them to a neutral site such as a quiet restaurant or their house, where you can invite family or friends whom they feel comfortable with. Finally, during your series of conversations, make sure you “ask open-ended questions, listen and encourage your parents to share their feelings.” The method of starting these conversations with your parents is a respectful way of “honoring them where they can maintain their dignity” and they can look forward to a smooth transition in their aging process. In Rio slum, pope defends poor and slams corruption BY GÉRARD AZIAKOU

RIO DE JANEIRO, July 25, 2013 (AFP) – Pope Francis waded into Brazil’s ramshackle slums and onto the front line of its fierce national battle over poverty and corruption on Thursday, borne along by adoring crowds. The Argentine pontiff urged young Brazilians not to be discouraged in their fight against exploitation and appealed for greater social inclusion during a visit to a Rio shantytown. And, on the fourth day of his visit to Brazil, he was confronted with starkly contrasting images of life in the dramatic tropical metropolis. To the obvious discomfort of his security detail, the pope traveled to Rio’s northern slums in an open-sided vehicle, before walking the streets, glad-handing crowds and kissing proffered babies. He then headed towards the opulence of its iconic beachfront area, where he was to be welcomed by hundreds of thousands of Catholic youths. “Dear young friends, you have a particular sensitivity towards injustice, but you are often disappointed by facts that speak of corruption on the part of people who put their own interests before the common good,” he said. “To you and to all, I repeat: never yield to discouragement, do not lose trust, do not allow your hope to be extinguished. Situations can change, people can change,” he told thousands gathered under pelting rain on a soccer field in the Varginha slum. Brazil was rocked by huge street protests last month, when more than a million people took to the streets to condemn corruption, poor public services and the cost of hosting the 2014 World Cup. The 1,000-resident Varginha slum is one of a dozen favelas where police have evicted drug gangs and restored security ahead of next year’s World Cup and the 2016 Olympic Games. The pope, referring to the police drive to restore security in the city’s violence-wracked favelas, said “pacification” was not in itself enough to combat poverty. “No amount of pacification will be able to last, nor will harmony and happiness be attained in a society that ignores, pushes to the margins or excludes a part of itself,” he said. “A society of that kind simply impoverishes itself, it loses something essential. Let us always

remember this: only when we are able to share do we become truly rich; everything that is shared is multiplied,” he added. The pope was greeted to the worn-down slum with banners, flags and two two-meter (six-foot) statues representing the pontiff and the venerated Black Virgin of Aparecida. Protected by a watchful security team, he walked through the streets, stopping to chat with delighted residents and accepting a flower lei around his neck. And the first Latin American pope entered the humble house of a seven-member family. “This is going to change my life for the better,” said 59-year-old Carmen Mendoca shortly before the pontiff dropped in. “I am waiting for him with cake and coffee.” He then went on to bless the altar of the tiny, 62-seat Sao Jeromino Emiliani church. “I would have liked to knock on every door, to say good morning, to ask for a glass of water, to take a coffee, but not cachaca,” he told the crowd, referring to the favored local liquor. Its residents are divided roughly equally between Catholics and Evangelical protestants. Vatican officials have made no secret of the fact that the pope’s first trip abroad since his election aims to re-energize his flock, at a time when Evangelical churches are gaining strength in Brazil. In the morning, the pope met with athletes, received the keys to the city and blessed the Olympic flag at the mayor’s official mansion. He then addressed thousands of fellow Argentines in Rio’s modernistic, cone-shaped Cathedral. Later, Pope Francis was to be officially welcomed by mammoth crowds of young Catholics attending World Youth Day on famous Copacabana beach. On Tuesday night, more than 500,000 wellwishers flooded the beach for a mass led by Rio Archbishop Orani Tempesta, amid scenes of chaos as the city’s transportation system was overwhelmed. That came a day after crowds of pilgrims were able to stop the pope’s convoy and reach their hands inside his car’s open window, after the driver made a wrong turn as he made his way into Rio from the airport. Rio Mayor Eduardo Paes said steps were being taken to avoid a repeat of such “deplorable incidents.”

BY KENNETH REYES & DARRICK TAN Beginning August 2013, the visa availability for F2A category of family based petitions will be current. Historically, the wait for this category was 3-4 years. The F2A category consists of spouses and single children under 21 years old of permanent residents. This means a permanent resident can now petition their spouse and simultaneously file an adjustment of status application if the spouse is inside the United States under a valid status or if the spouse is grandfathered by INA section 245(i). On the other hand if the spouse of the permanent resident is outside the United States, the permanent resident’s petition may be processed for immigrant visa issuance at the US Consulate abroad the moment the petition is approved. The spouse may also bring any minor children as derivative beneficiary under this petition. In addition, the permanent resident petitioner may also directly petition any unmarried children under 21 years old. The definition of child includes “step child.” The child may simultaneously file an application for adjustment of status to legal permanent resident if inside the United States provided the beneficiary is either in valid status or grandfathered by INA section 245(i). If the child is outside the United States, the child can apply for an immigrant visa through the US consulate overseas as soon as the petition is approved. Commuters group plans to sue Mayor Estrada vs bus ban in Manila MANILA, July 26 (Mabuhay) – The president of National Center for Commuter Safety and Protection (NCCSP) on Friday said that they are planning to sue Manila Mayor Joseph Estrada and other city official over the Resolution No. 48 banning city buses without existing terminals to enter roads in the city. In a press conference held in Makati City, Elvira Medina, president of NCCSP, said that they are filing a case against Estrada and other city officials to stop the implementation of the scheme which started last July 23. “It is going to be a long and tedious meeting among the board of trustees so that we can come out with a program to handle the situation and look for legal ways to address it and probably, still work with social pressure,” she told reporters. Medina said she and the other members of the board of NCCSP are also considering the possibility of asking the court for the issuance of a temporary restraining order against the scheme. “A TRO could be one of them. We have a track record on this already,” Medina added. Medina, who claims to be a staunch supporter of Estrada, also lashed at the Manila mayor for allegedly being blind to the rights of commuters and for the lack of transparency and consultation on the bus ban. She also said forcing commuters to alight from buses and ride on jeepneys when passing through Manila, would not only be inconvenient but also unsafe as commuters would be easy targets of criminals. Estrada challenged those opposing the resolution that bans buses from entering the city to take their grievances to court. Good sleep gives you younger-looking skin (Relaxnews) – Want better, younger looking skin? Get better sleep, a new study finds. In a small study at University Hospitals Case Medical Center in Cleveland, Ohio, poor sleepers were found “to show increased signs of skin aging and slower recovery from a variety of environmental stressors,” such as ultraviolet radiation, the researchers said. The study, presented at the International Investigative Dermatology Meeting in Edinburgh, Scotland, was commissioned by Estée Lauder. “While chronic sleep deprivation has been linked to medical problems such as obesity, diabetes, cancer and immune deficiency, its effects on skin function have previously been unknown,” said head researcher Dr. Elma Baron. The study involved 60 women between the ages of 30 and 49, with half of participants falling into the poor quality sleep category. The classification was made on the basis of average duration of sleep and the Pittsburgh Sleep Quality Index, a standard questionnaire-based assessment of sleep quality. Poor quality sleepers showed increased signs of intrinsic skin aging including fine lines, uneven pigmentation and slackening of skin and reduced elasticity. The researchers found that good quality sleepers recovered more efficiently from stressors to the skin, such as sunburns. Self perception of attractiveness was also significantly better among subjects who slept well compared to those who didn’t. If you think you fall in the poor sleeper category, WebMD and the Mayo Clinic offer the following tips to boost your zzzs: Stick to a regular sleep schedule, even on weekends. Eat well, and avoid caffeine in the evenings or overeating before bedtime. Also try sleep accessories, such as a white noise machine or ear plugs, to block out distractions. Exercise during the day, which can aid sleep, and try to clear your mind from too much clutter before bedtime by writing in a journal beforehand, for example. Asian group opposes GOP’s move to allow DREAMers only to legalize

WASHINGTON – In response to yesterday’s House Subcommittee on Immigration and Border Security hearing entitled “Addressing the Immigration Status of Illegal Immigrants Brought to the United States as Children,” Asian Americans Advancing Justice releases the following statement: Asian Americans Advancing Justice (Advancing Justice) rejects proposals offered by Congress that would limit a pathway to citizenship only to undocumented youth, leaving out millions of other immigrants who have come to the U.S. in search of new opportunities for their families. Anything less than a comprehensive solution that includes a swift and fair path to citizenship for all of the estimated 11 million undocumented individuals in the U.S. is not enough. Asian Americans and Pacific Islanders (AAPI) have much at stake in pushing for fair and inclusive immigration reform for the entire undocumented population. An estimated 1.3 million AAPIs are undocumented and 10 percent of undocumented youth are AAPIs.

Limiting the path to citizenship to undocumented youth perpetuates the failures of our curren timmigration system and will continue to tear apart families and communities. Undocumented youth often reside in mixed-status families, where parents and siblings may be undocumented, have green cards, or be citizens. Approximately 5.5 million children in the United States, including 4.5 million U.S.born citizens, live in families where at least one parent is undocumented. Nearly 23 percent of individuals deported between July 2010 and September 2012 left behind at least one child who is a U.S. citizen. Most House GOP members have not supported undocumented youth in the past, raising questions about this sudden interest. They declined to support the Dream Act in 2010, which would have provided immigration relief to undocumented youth, and earlier this year, several members of the House GOP voted to defund Deferred Action for Childhood Arrivals (DACA), a current policy that provides temporary relief to undocumented youth. If the House GOP truly supports undocumented youth, they would support legislation that provides relief not only to immigrant youth but to their families and communities. On Monday, over 30 undocumented youth with the National Immigrant Youth Alliance marched on the border asking to return to their homes and families in the United States. With no guarantee of being able to return to the U.S., the youth are challenging record levels of deportations and the separation of families. By speaking out in public, engaging in civil disobedience, and challenging unjust immigration laws, undocumented youth have fundamentally reshaped the immigration debate through profound acts of courage.

I only have $500,000. Can I still get the Green Card? Question: I have heard that you can only get the IMMIGRATION Green Card if you invest $1,000,000. However, I only TODAY have $500,000. Can I still do this? Answer: Congress created the EB-5 immigrant visa category in 1990 for immigrants seeking to enter to engage in a commercial enterprise that will benefit the U.S. economy and create at least 10 fulltime jobs. The basic amount required to invest is $1 million, although that amount may be $500,000 if the investment is made in a “targeted employment area.” Of the approximately 10,000 visas available for BY BRIAN D. LERNER this preference each year, 3,000 are reserved for entrepreneurs who invest in targeted employment areas. Question: In that case, what is a targeted employment area? Answer: The statute defines a “targeted employment area” as a rural area or an area that has experienced unemployment of at least 150 percent of the national average. An area not within a metropolitan statistical area (as designated by the Office of Management and Budget) or the outer boundary of any city or town having a population of 20,000 or more is considered a rural area. Each state notifies USCIS which state agency will apply these guidelines, and determines targeted employment areas for that state. Basically, if you have the $500,000, you must find a rural area (which are basically farming type areas), or places which have high unemployment. Question: I have a couple friends who want to invest with me. Can we all invest in the same business? Answer: The regulations specifically allow immigrant investors to pool their investments with others seeking EB-5 status. Each investor must invest the applicable statutory amount. All of the new jobs created by the new commercial enterprise will be allocated among those within the pool seeking permanent investor visas. Question: So how many jobs must be created? Answer: It will be 10 employees per investor. That means if you enter into a pooling arrangement with 2 other people, that there must be 30 employees in total that will be created and that the investment (if in a targeted area), must be $500,000 per person. Question: Must we show where we got the $500,000? Answer: You must show it is legal and that it was obtained legally and that it is your money. There are various challenges to show this, especially if it was obtained by inheritance. The importance of tracing funds is present in all situations and is very important to the ultimate approvability of the petition. The sticky issues involving gifting, disposition of a trust, inheritance, and other complex fact patterns must be accompanied by full documentation of the history of the funds and objective confirmation that all taxes have been paid on the acquisition and disposition of the funds. Question: Is it easy to get the EB-5? Answer: It is the opposite of easy. It must be prepared meticulously with all of the proper documentation, proof and supporting evidence. Short sale legal and tax implications The good news is that tax relief has been enacted MORTGAGE UPDATE for homeowners doing Short Sales. The Federal Mortgage Debt Relief Act of 2007 HR 3648 and Federal Bailout Legislation HR1424 extended until December 31,2013 tax relief for recourse debt forgiveness on principal residence indebtedness is excluded from taxable income. Qualified principal residence indebtedness is acquisition indebtedness secured by the principal residence of a taxpayer as defined for the deduction of residential mortgage interest, there are exclusion so please consult with your CPA and tax advisor. BY KEN GO A non-recourse loan is a secured loan that collateralized for a property, but for which the borrower is not personally liable. If the borrower defaults, the lender can seize the property ( via foreclosure) but the lenders recovery is limited to the collateral. Meaning, there has to be enough equity to cover the amount being in default, if not the lender may obtain a deficiency judgment from the borrower. A Deficiency Judgment is an unsecured money judgment against a borrower whose foreclosure sale did not have enough funds to pay for the promissory note in full. Therefore, if you are still deciding on a Short Sale now and your will qualify for the Debt Relief Act for mortgage debt forgiveness, you have to act now. This Legislation has only been extended till December 31, 2013. By doing a Short Sale if that is the option you are taking, most likely your lien will be release with the sale and the lenders might possibly not purse any Deficiency Judgment after the sale. The new Law SB 458 extends the protection of SB931 to ensure that any lender that agree to a Short Sale must accept the agreed upon Short Sale Settlement as payment in

The homeowner will not be held responsible for any additional payments on the property. A foreclosure will stay on your credit report for 7 years and the lien balance might remain longer. Consulate announces extension of visitors’ stay for 151 countries In line with the Philippine Government’s efforts to update its visa policies and further encourage tourism in the Philippines, the visa-free privilege granted to one-hundred fifty-one (151) countries is hereby extended from twenty-one (21) days to thirty (30) days. Ford secondquarter profits, sales jump

NEW YORK CITY, July 24, 2013 (AFP) – Ford on Wednesday reported strong second-quarter profit driven by robust sales and growing market share, especially in the US and China. The second-largest US automaker posted net income of $1.2 billion, up 18.6 percent from a year ago. Adjusted earnings of 45 cents per share topped Wall Street expectations of 37 cents. “The company had an outstanding quarter,” chief executive Alan Mulally said, noting this was Ford Motor Company’s 16th consecutive quarterly profit. Revenue rose 14 percent to a betterthan-expected $38.1 billion. Ford upped its forecast for 2013 pre-tax profit to be “about equal or higher than” the $8 billion gained last year, Mulally said in a conference call. While trouble in Europe continues to weigh down results, the automaker said it is making “great progress” in restructuring its European operations and expects the unit to be profitable again by “middecade.” Ford is shutting down three European plants to create a “more efficient manufacturing footprint” and expects to spend $1.2 billion on “separation costs,” chief financial officer Bob Shanks said. Some $419 million of that was recorded in the second quarter and another $400 million or so will be spent this year. The remaining $400 million will be recorded at the end of next year when a Belgian plant closes, Shanks said. “It is a major restructuring. It is in an environment that is not a great environment,” Shanks said in the conference call. “But we clearly are on a very good track to deliver the transformation plan that we laid out in October last year.”Ford is growing in Eastern Europe, with “very robust activity” in Russia, and believes that the industry conditions “may have begun to stabilize” in Western Europe, he added. The European unit, which lost $348 million in the second quarter, down from $404 million in the first quarter, is forecast to post a 2013 loss of $1.8 billion. That would be an improvement from an earlier forecast of a $2 billion loss this year.

Detroit residents accept bankruptcy as inevitable At a century-old Detroit fire station surrounded by boarded up storefronts and weed-choked lots, the Motor City’s bankruptcy filing wasn’t exactly a surprise. While his union sought a court injunction Friday to stop the proceedings and protect their retirement benefits, firefighter Frank Dombrowski resigned himself to the inevitable. “Basically we’re screwed,” Dombrowski, 48, said as he stood watch over an isolated corner of the city where thousands of abandoned buildings regularly go up in flames. The sweltering Engine 29 fire station encapsulates the city’s troubled history of boom and bust. Built in 1907 when Detroit was a hotbed of industrial innovation about to put the world on wheels, it now houses a rickety fire truck that has more than 100,000 miles (160,000 kilometers) on its odometer. “There is no central air and the basement floods,” said Dombrowski, who had shut the doors against the oppressive 96 degree Fahrenheit (36 degree Celsius) heat. Like many life-long Detroiters, Dombrowski blames

the city’s woes on decades of mismanagement, bad decisions and worse luck. “I’ll tell you what killed the city – bussing back in the 1970s,” Dombrowski, who grew up on Detroit’s east side, told AFP. Detroit was already experiencing white flight to the suburbs after the devastating 1967 race riots. The integration of public schools pushed more people out, he said. As the population and tax base shrank, city services got worse and worse and the gulf between the city and the suburbs got wider and wider. Motor City then saw its main employers go through round after round of mass layoffs as auto factories were automated or outsourced and Asian competitors siphoned away market share. Once the fourth largest US city, Detroit has seen its population shrink by more than half from 1.8 million in 1950 to 685,000 today. “The economy and Kwame Kilpatrick finished it off,” Dombrowski said, referring to the 2008 financial crisis that

sparked a lengthy downturn and Detroit’s former mayor who was recently convicted of federal bribery charges. His theory is backed up by the numbers: Detroit’s population has fallen by 28 percent since 2000. The city has been so strapped for cash that nearly half of the streetlights don’t work. A shrunken police force has been unable to clamp down on rampant crime. Just 8.7 percent of crimes are solved and the average response time is 58 minutes. Only a third of the city’s ambulances work. Frustration was evident among city employees interviewed outside the Coleman Young Municipal Building, which was built during the 1950s when the city was thriving. “The city government is very inefficient,” acknowledged one city employee, who asked not to be identified for fear of retaliation. “There’s all kinds of overlapping departments, which means you can’t get anything done.”

Worldwide Prius sales top 3-million mark Toyota City, Japan, July 3, 2013 – Toyota Motor Corporation (TMC) announces that as of the end of June, worldwide cumulative sales of the iconic Prius gasoline-electric hybrid vehicle passed the 3-million mark(2). In 1997, TMC launched the Prius, which was the world’s first mass-produced hybrid passenger car. The second generation followed in 2003, and the third generation in 2009. From the first to third generation, TMC greatly reduced the cost of the hybrid system by two-thirds while improving the EPA-estimated ratings for combined driving by nearly 22 percent(3). In addition, TMC applied for 1,261 patents relating to the third-generation Prius, achieving progress worthy of the Prius name (derived from a Latin word meaning “to go before”). Since the development of the first-generation Prius, TMC has positioned hybrid technology as a core technology required for the development of various types of environment-friendly vehicles and has placed emphasis on the development and production of core components such as motors, inverters, batteries and electronic control units (ECUs), giving rise to substantial investment in Japan. TMC will continue to conduct R&D and invest in facilities in Japan for the development of hybrid and other cutting-edge technologies and achieve sustainable growth by deploying these Japan-developed technologies across the globe. In the fiscal year ending March 2014, TMC expects to spend a consolidated 890 billion yen(4) (790 billion yen(5)unconsolidated) on environmental technology development, as well as on strengthening new platform and major component development. Toyota, Ford end hybrid partnership CHICAGO, July 23, 2013 (AFP) – Toyota and Ford have ended a partnership to jointly develop gas-electric hybrid systems for trucks and sport utility vehicles, the automakers said Tuesday. “We know what it takes to build world-class hybrids, and we now will build and leverage that expertise in-house,” said Raj Nair, Ford’s chief of global product development. “By continuing to develop a rear-wheel-drive hybrid system on our own, we can extend our advanced hybrid technologies to new vehicle segments and deliver even better fuel economy across our lineup.” Ford – the second-largest US automaker – said it is hiring more than 200 new electrification engineers and expanding its research facilities to speed development. “Toyota and Ford continue to evaluate the feasibility of working together on nextgeneration standards for telematics and will consider other areas for future collaboration as well,” Toyota said in a separate statement. The Japanese automaker said its commitment to hybrid technology is “unwavering” and that it remains on track to offer 18 new or redesigned hybrid models globally by the end of 2015. Toyota has already sold over two million hybrid vehicles in the United States – 70 percent of the nation’s hybrid sales – and over five million hybrids worldwide. It estimates that those vehicles have saved their owners more than 3 billion gallons (11.3 billion liters) of gasoline. Ford said it has invested $355 million within the past year to design, engineer and manufacture key components for its electrified vehicles. It plans to invest another $50 million to double its battery testing capabilities and speed electrified vehicle development by as much as 25 percent.

SPORTS LeBronmania hits the Manila MANILA, July 23, 2013 (AFP) – Fans of LeBron James in the basketball-crazy Philippines were in raptures Tuesday after queuing in sun and rain for up to three days to see their hoop god in the flesh. The Miami Heat star was greeted with indoor fireworks and chants of “MVP” (most valuable player) as he wowed about 15,000 fans with thunderous dunks and deadly threepoint shooting at an hour-long basketball clinic. “It’s unbelievable, man,” James gushed as he basked in the adulation before going on a scrimmage with the Philippines’ national team and selected stars from Manila’s collegiate basketball league. Manila businessman Franco Miguel, 32, said he and a friend took turns standing in line last week outside a US sporting apparel shop that had announced it was giving away free tickets to the clinic. “Seeing LeBron James, my God! Even though I fell in line for two days, to see him personally is huge,” Miguel told AFP.

Basketball is the number one sport in the Philippines, a former US colony in a region better known for its passionate soccer following. The visit, part of an Asian tour, came a month after the James-led Heat’s successful defence of their National Basketball Association championship. Government clerk Ian Castillo watched the clinic with his eight-year-old son, having gone on leave from work since last week to line up for tickets. “My friends and I were in line for three days. We organised a relay system so others could go home and grab a few hours’ sleep,” said Castillo, who was seated high in the bleachers. Local newspapers last week published front-page pictures of thousands of fans camped out in front of the shop at an upscale Manila shopping complex, with some asleep in tents. The papers said they endured torrential rain, heat and exhaustion as long lines began forming three days before the tickets were given out.

Local spokesmen for Nike, the apparel outfit that sponsored the James visit, said it gave away all 15,000 tickets for free. However some ended up on online auction at up to 10,000 pesos ($232) each, or three weeks’ pay for workers earning the minimum daily wage. Allan Casenas, 31, who runs his family’s safety equipment business, bought a pass for 3,500 pesos from somebody who had secured one from the queue. “He’s solid on defense, he dominates offensively, and he gets his teammates involved,” said Casenas, who wore a replica Heat jersey with James’s number 6. “I believe Michael Jordan is still the greatest, but LeBron has a chance to surpass him,” he said, referring to retired NBA star Michael Jordan. Asked why Filipinos preferred basketball to other sports more suited to their relatively modest height, Casenas said: “We Filipinos want fast-paced action and high-scoring games.”

Hernandez murder charge a ‘sad day’ – Belichick \NEW YORK, July 24, 2013 (AFP) – Famously taciturn New England coach Bill Belichick said Wednesday he was shocked and saddened by the case that has former Patriots tight end Aaron Hernandez facing a murder charge. Speaking publicly about the case for the first time as the NFL team gathered for training camp, Belichick offered his sympathy to the family of the victim and said the Patriots would continue to review their methods of evaluating players. “It’s really a sad day on so many levels. Our thoughts and prayers are with the family of the victim, and I extend my sympathy with everyone who has been impacted,” Belichick said at a press conference at the Patriots’ Gillette Stadium in Foxboro, Massachusetts. “A young man lost his life, and his family has suffered a tragic loss, and there’s no way to understate that.” Hernandez was arrested on June 26 and charged with murder in the death of Odin Lloyd on June 17. Lloyd’s bloodied body was found at an industrial park less than a mile from Hernandez’s luxury home. Hernandez pleaded not guilty, but less than two hours after he was arrested and led from his house in handcuffs, the Patriots cut ties with him. Hernandez appeared briefly in court on Wednesday in Attleboro, Massachusetts, where Judge Daniel O’Shea agreed to prosecutors’ request to reschedule a probable cause hearing for August 22. Prosecutors said the 30-day delay in the hearing – where a judge is asked to decide if a defendant should be held for trial – will allow a grand jury time to hear evidence and issue an indictment. It also meant prosecutors didn’t have to reveal evidence at the hearing. Hernandez will remain jailed without bail until August 22. Defense attorney James Sultan objected to the delay, arguing that prosecutors could have waited to bring charges if they hadn’t gathered enough evidence to support their case. Prosecutors say Hernandez and two associates murdered Lloyd in an executionstyle slaying because Hernandez was angry his friend had spoken with people he “had troubles with.”
