AFP: Ex-generals can speak vs gov’t MANILA, July 31 (Mabuhay) – The Armed Forces of the Philippines on Thursday reiterated that it will respect its retired members’ right to a self-expression, as long as it will not lead to an armed movement against the government. “Kasi kung miyembro ka ng AFP, liberties mo tinatanggal – like freedom of expression – iyan ay babalik kapag retired ka na,” explained Armed Forces public information chief Lt. Col. Manila faces challenges to evacuate 13,000 amid renewed Libya clashes MANILA, August 1, 2014 (AFP) – A Philippine plan to evacuate all 13,000 of its workers in strife-torn Libya is a “challenge”, with many reluctant to leave despite the dangers, the Filipino foreign ministry said Friday. The ministry announced a “mandatory” evacuation of all 13,000 of its nationals living in Libya last month after the beheading of a Filipino construction worker abducted by unknown suspects. That killing was followed by the gang rape of a Filipina nurse in the capital Tripoli
on Wednesday. “Our target is 100 percent” evacuation, foreign department spokesman Charles Jose told AFP on Friday. Foreign Secretary Albert del Rosario left for Tunisia to arrange the evacuations on Thursday. He announced the government would charter ships to pick up Filipinos from Libyan ports, or transport them by land if the sea vessels failed to gain passage. Luy shocks defense lawyers, pulls nine folders of Revilla-Napoles transactions MANILA, July 31 (Mabuhay) -- Taking the witness stand anew on Senator Ramon Bong Revilla’s bail petition, principal whistleblower Benhur Luy presented on Thursday nine new folders as evidence that senators supposedly benefited from the bogus NGO scam masterminded by his former boss Janet Lim Napoles. The folders allegedly contain a summary of all transactions related to the pork barrel scam Luy himself facilitated from 2004 to 2012. Luy said he printed the documents from a hard drive.
During open court, the prosecution presented a hard drive containing the alleged Benhur files, and asked Luy to identify it. Why Senate can’t suspend Senator Enrile just yet MANILA, July 31 (Mabuhay) — The Office of the Senate President told the Sandiganbayan on Thursday that it could not yet suspend Senator Juan Ponce Enrile over his pork barrel scam cases. The letter, signed by Senate President Franklin Drilon’s chief of staff Atty. Renato Bantug Jr., said the body would still have to wait for the court’s decision on Enrile’s motion for reconsideration over his suspension. “This Office hereby manifests that it would take appropriate action on the suspension order upon the Honorable Court’s disposition of the motion for reconsideration..” the letter reads. But in a letter sent by Enrile’s chief of staff Cherbett Maralit sent to Drilon’s of-
fice, and attached to the letter sent to Sandiganbayan, Enrile’s camp said it would only file their motion for reconsideration on or before August 1, Friday. The Senate said it could only suspend Enrile ”upon the lapse of the prescribed period to file the motion for reconsideration and no such motion is filed,” Drilon’s letter read. The court gave Enrile 90 days upon receipt of the resolution to file his appeal. The anti-graft court has ordered Enrile’s suspension for 90 days, concurring with government prosecutors’ claims that the veteran lawmaker can use his position to influence witnesses and tamper with evidence. Miriam wants greater access to palliative care for seriously ill patients MANILA, Aug 1 (Mabuhay) – Over a month after she was diagnosed with lung cancer, Senator Miriam Defensor Santiago has filed a bill creating a patient-center quality of care initiative as well as palliative care for patients with chronic disease. Under her Senate Bill No. 2284, Santiago seeks the establishment of a stakeholder strategic summit, quality of life education, awareness initiative, health care workforce training, an advisory committee, and palliative care-focused research. “People living with a serious illness experience inadequately treated symptoms, fragmented care, poor communication with their doctors and enormous strains on their family caregivers,” Santiago explained in her bill. Santiago said even in the United States, studies show that seriously ill patients are
supposedly not satisfied with the quality of their medical care despite soaring the country’s health expenditures due to “untreated symptoms, unmet psychosocial and personal care needs, high caregiver burden, and low patient and family satisfaction.” “In order to improve the quality of life of the patients and even their families, there should be public outreach and education on pain and symptom management of chronic diseases,” she said. Santiago said palliative care is focused on the relief of the pain, stress, and other debilitating symptoms of serious illness, such as cancer; heart, renal, and liver failure; lung disease; and Alzheimer’s disease and related dementias. “This bill seeks to address the symptoms and needs of patients with chronic disease by providing the patients as well

House members back passage of information law MANILA, July 30 (Mabuhay) – President Benigno Aquino III may not have mentioned the Freedom of Information Bill in his State of the Nation Address, but lawmakers, at the prodding of Speaker Feliciano Belmonte Jr., expressed support Wednesday for its passage. In his speech at the opening of Congress’ regular session on Monday, hours before the Sona, Belmonte pushed for the passage of an FOI law in the spirit of Section 7, Article 3 of the Constitution that recognizes the right of the people to information on matters of public concern. “We must craft a viable FOI Law to promote greater transparency and strengthen accountability in government, without unduly restricting the latitude of options for government action in the delivery of services to the public and in responding expeditiously to the needs of our people,” he said. Responding to Belmonte’s call, a number of congressmen expressed support for the FOI bill, which would mandate the disclosure of public records. The Senate has passed its version of the FOI bill but it remains pending in the House of Representatives. In a statement, Deputy Speaker Giorgidi Aggabao said that with the Speaker himself making a special pitch, there was now “a big chance” the FOI bill would pass this session. “The only kink I see would be the busy schedule of Congress. The budget hearing plus the impeachment complaints would surely occupy a good part of our time,” said Aggabao, representative of Isabela. Pampanga Rep. Oscar Rodriguez, chair of the committee on good government and public accountability, also welcomed the Speaker’s commitment to prioritize the FOI bill. “It is nice to hear the Speaker pitching for support for the FOI bill. If I remember it right, I was the first one to file the original bill in the Eighth Congress because of my experience with the military then,” he said. Abakada Rep. Jonathan Dela Cruz, a member of the independent minority bloc, said it was high time the FOI bill was enacted into law. “The FOI is one law which should have been passed a long time ago and should have been one of the priorities under this administration of ‘daang matuwid’ (straight path),” said Dela Cruz. Parañaque Rep. Gus Tambunting, author of one of the pending FOI bills, lauded Belmonte for his declaration of support for the passage of the FOI law during the 16th Congress. as their caregivers and families with greater access to palliative care,” the lady lawmaker said. If passed into law, Santiago said the secretary of the Department of Health (DOH) should convene the strategic stakeholder summit one year after the effectivity of the law to analyze key health system barriers,

5 reasons to consider Chapter 13 Bankruptcy Some say the economic recession is leveling out, and there are signs of recovery on the horizon. However, like so many Americans today, you may feel otherwise. The past several years have been financially devastating to Americans. Millions have found themselves struggling to make their house payments and keep food on the table. Chapter 13 bankruptcy provides financial help for those who feel they have run out of options. Filing bankruptcy can give you the fresh start that so many Americans need today. Here are FIVE good reasons to consider filing for Chapter 13. (1) Stop Foreclosures and Repossessions Often by the time you decide to file for bankruptcy, your home could likely be in foreclosure. Wage garnishments and car repossessions are also a common among people seeking bankruptcy relief. When you file, all collection efforts, foreclosures, repossessions and garnishments are stopped. In a Chapter 7, you would receive this benefit of bankruptcy, but it would not last as long, perhaps only a few months. However, in a Chapter 13 these actions are stopped for the length of the bankruptcy, which can extend up to 5 years, (2) Saving Property Most people are under a mistaken impression that they will lose all of their property when they file. This belief often prevents people from filing and getting the help they need. This is actually not true. In bankruptcy, there are various exemptions available. If your assets come under one of these exemptions, you are allowed to keep it. The particular exemptions available to you will vary from state to state. But what if you have more assets than allowed by the exemptions? In a Chapter 7, you could lose some of your assets to the bankruptcy court. However, in a Chapter 13 if your assets exceed the amount of exemptions you have, you are given the opportunity to pay out the value of the asset in order to keep it. These payments would be divided over the length of the bankruptcy, three to five years. (3) Time to Catch Up on Home and Car Loans One big advantage to filing for Chapter 13 is you are allowed valuable time to catch up on payments that are in arrears. For example, if you are $10,000 behind your home loan, your mortgage lender may have already started foreclosure proceedings. Once you file bankruptcy, you will be able to make installment payments on the late mortgage payments. By the time the bankruptcy is over, assuming you have
remained current with your regular house payments, you will have also completely caught up with the back payments. (4) Payments May be Cheaper in Chapter 13 There are some instances where it is more cost effective to file for Chapter 13. Let’s say that you owe $10,000. on a car that is worth $5,000. If you file for Chapter 7, you would continue paying on the loan amount of the car ($10,000). However, in a Chapter 13, under the appropriate circumstances, you would only be required to pay for the value of the car ($5,000.). This not only saves you $5,000., but would also lower your car payment. How is this possible? Because bankruptcy can discharge the unsecured portion of a secured debt, just as if it was credit card debt. Or, let’s say you have a home loan and a second mortgage on your home. There is no value in the home over the pay off amount for the first mortgage, so there is no value securing the second. In Chapter 13, you are able to “strip off” the second mortgage completely. (5) Your Income is Too High Sometimes the monthly income of the bankruptcy filer is too high to qualify for a Chapter 7. Something called a “disposable income test comes into play here. If you were to file Chapter 7, a large portion of your debts would be wiped out, and you would be left with a lot more disposable income every month. If this amount of disposable income is too high, you would not be able to file for a Chapter 7. In a Chapter 13, this extra disposable income would be paid to the bankruptcy court, but only for the period of the bankruptcy. Chapter 13 can have some distinct advantages for individuals that need financial relief. You deserve to keep your home and have financial stability. More immigration personnel to man NAIA-3 MANILA, Aug 1 (Mabuhay) – At least 160 added Bureau of Immigration personnel are being readied for deployment to the Ninoy Aquino International Airport Terminal 3 to serve the passengers of five major airlines transferring their operations there. The BI said this is part of its preparations to ensure smooth operations of the NAIA-3 with the expected increase in volume of passengers. “We have augmented our existing manpower complement in NAIA-3 to properly meet the influx of passengers from the additional flights,” BI NAIA-3 Terminal head Mary Ann Velasco said. In a news release, the BI said the added personnel will include immigration officers, intelligence agents, security personnel and administrative staff. Other transfer plans include additional equipment such as computers and passport readers. “The deployment of 160 new immigration officers and coming in of new equipment in August is right in time for the transfer of the four other airlines in the coming weeks,” added BI Commissioner Siegfred Mison. Mison likened his agency’s preparations to a “photo finish.” Airlines that transferred operations to NAIA-3 included Delta Air Lines, Royal Dutch Airlines, Singapore Airlines, Etihad Airways, and Cathay Pacific Airways. Mison said he expects the added immigration officers assigned to NAIA 3 to be “highly trained and professional.”

INC’s 100th anniversary draws 2 million faithfuls BOCAUE, July 27, 2014 (AFP) – As many as two million people gathered in the Philippine capital on Sunday to mark the 100th anniversary of a powerful homegrown church, showcasing the conservative group’s discipline and influence. Some of the faithful waited overnight in the pouring Manila rain to attend the centennial celebration of the Iglesia ni Cristo (Church of Christ), in an event designed to show off the religion’s stunning success at home and abroad. Government officials monitoring the gathering estimated that 1.6 to two million people gathered for the INC centennial, packing out a massive new arena built to mark the occasion and the nearby 20,000seat Philippine Stadium, as well as huge tents erected on the grounds for the event. Eduardo Manalo, leader of the Iglesia, known as the INC, said in a special sermon broadcast live to the faithful that the swift completion of the new Philippine Arena was proof of the group’s divine support. “The Philippine Arena was finished in two years and nine months when it should have taken five years. This is the work of God,” he said at the sprawling compound being developed by the church. The occasion was also used as an attempt to set world records, with the 55,000-seat arena certified as the world’s biggest mixed-use theatre and the INC’s 4,745-member choir declared the world’s largest by an adjudicator from Guinness World Records. Although the INC is a minority in the Philippines, where 80 percent of the 100 million people are Catholics, the Iglesia has considerable clout. Media reports have estimated membership at around two to three million, with a rapid spread in scores of countries beyond the Philippines.
Outsize influence The Roman Catholic Church has for centuries been the dominant religious force in the former Spanish colony. The INC is at odds with the Church on many fundamental issues of doctrine, and numerous outsiders perceive it as a much more conservative brand of Christianity. INC’s teachings are based on a rigid following of the Bible, and it insists only its members qualify for salvation. Members are required to marry within the church and must give it a portion of their salaries as well. More significantly, they are required to vote as a bloc for political candidates given the blessing of INC leaders. As a result, many politicians are quick to pay it their respects. Ramon Casiple, head of the Manilabased Institute for Political and Electoral Reform, said Sunday’s massive gathering also served to project the INC’s influence on society at large. “It cannot be denied that they are making use of the occasion to flex their muscles,” he told AFP. “Their message is: we are here, you have to deal with us, particularly during the 2016 (national) elections,” he said. Although Philippine President Benigno Aquino is not an INC member, he paid tribute to the group when he attended the opening of the Philippine Arena on July 21. “From the bottom of my heart, I thank the Iglesia ni Cristo for the sympathy you have shown your brothers. You have truly displayed sympathy, not just in words but also in deeds,” he said, citing the aid provided to victims of the frequent natural disasters that hit the country. “Thank you also for the support you have shown my administration in furthering good governance,” he added.
Cojuangco pushes for reopening of Bataan nuclear power plant MANILA, July 31 (Mabuhay) – Former congressman Mark Cojuangco says had the government started running the Bataan Nuclear Power Plant (BNPP) in 2010, the country could have prevented an impending power crisis next year. Cojuangco, a staunch nuclear power advocate, had a tour and lecture sponsored for some residents of Morong, Bataan about the BNPP. Cojuangco says it will take 4 years to restart the BNPP. In his lecture, Cojuangco showed residents video and photo of his trip to various countries with nuclear facilities. He addressed residents’ fears of a nuclear meltdown. The BNPP was ready for operation since 1985. Government paid more than $2 billion including interest, and was fully paid in 2007.
Yet despite the enormous cost, consumers have not been able to benefit from the 620-megawatt plant. Cojuangco appealed to President Aquino, his second cousin, to make the reopening of Bataan nuclear plant his legacy in his remaining years in office. He noted this is not just for the Aquino administration but for future generation of Filipinos. But Bataan vice governor Efren Pascual says the reopening of the nuclear power plant and even the plan to put up a coal fired power plant within the BNPP compound needs their approval as host province. Pascual adds the provincial government has not made a decision on the reopening of the BNPP since it still wants to hear all sides of the arguments made by pro- and anti-nuclear power advocates. TESDA chief comes clean on ‘ghost scholars’ MANILA, July 31 (Mabuhay) – The Technical Education and Skills Development Authority (TESDA) debunked Thursday claims of irregularities in its use of funds from the disbursement acceleration program (DAP). TESDA Secretary General Joel Villanueva said contrary to a report by the Commission on Audit that part of the controversial fund may have financed 61 “ghost scholars” in 2011, an internal investigation revealed only 38 were questionable due to double availments. He also said TESDA has ordered schools that failed to implement the scholarship program to return the money allotted to them. “We closed some of the programs in schools. In Quezon City about 8 or 12. One in Metro Manila. It was corrected and COA agreed with us. This is why they did not issue a notice of suspension or disallowance,” he said. “[One school] said they had two shiftings. [Gusto kumita ng extra]. What we did is pinabalik natin. P40,000 binalik sa National Treasury.” In the COA report, the agency noted that 61 scholars “attended multiple training courses which were held simultaneously.”

of procedures: a catheter to ease pressure directly inside the heart, another to allow Dialysis. Somewhere in these maze of machines, was a patient still at death’s door. It was early morning when things have settled enough so I called the family for an update. The husband, her siblings, parents and in-laws all gathered in a conference room, where I explained what had happened and what we were going to expect. I told them that “some things were predictable but most things were not.� Their loved one was comatose after two cardiac arrests and remained in shock. Dialysis was being performed to control dangerous blood acid levels. The bleeding risks from the Alteplase and other blood thinners would be greatest in the first twenty-four hours, as our brainprotective cooling therapy also increased the tendency to bleed. The heart would be expected to be stunned and weak for a couple of days but all invasive monitors were already in place, to allow in immediate adjustments in therapy. At that moment in time, we had leveled the playing field, but the final outcome was still unknown. I also explained to them that “we can never promise outcomes, but we can promise an epic fight.�
The family meeting in a time of crisis is the most difficult part of our job. The challenge is to paint a picture without confusing details, deal with emotions in the room and still get a sense of the overall stance of the family in coping with the patient’s critical illness. As practicing doctors, we advise our medical students that the goal of critical care is “to protect the quality of life of a patient, not simply to save a life.� After our meeting, I stayed a few more minutes at the patient’s bedside and read the monitors heart rate at a reasonable 95, Bp 140/80, saturation 97% and temperature down to 33. This is the new baseline. I instructed all the nurses on duty, that if the patient wakes up whole, I will buy pizza for everyone in the ICU and ER departments, as a show of my confidence because our patient was pulseless for more than half an hour; had seven cardiac arrests which occurred over eighty minutes. Those eighty minutes were one of the longest in my life, but could also have been the last in our patient’s life. Three days later, I fulfilled my promise by buying pizza for everyone because thankfully, our patient woke up and survived.

US growth rebounds strongly but Fed sticks to policy By Paul Handley
WASHINGTON, July 30, 2014 (AFP) – The US economy rebounded vigorously in the second quarter, growing at a peppy 4.0 percent pace that erased the impact of the sharp winter contraction, the Commerce Department reported Wednesday. But the Federal Reserve remained cautious, sticking to its dovish stance after a twoday monetary policy meeting, still seeing some latent weakness that requires keeping interest rates low for the foreseeable future. The initial estimate of second-quarter growth was far better than expected and showed solid recovery in private investment and consumer spending, especially on durable goods like cars and appliances. In addition, government spending, which dragged on gross domestic product for the last six quarters, added to the expansion. That suggested that the severe weather and a modest slump in confidence between December and March were indeed behind the winter slowdown, as economists have said. But the fresh data, which included upward revisions for the past year, also showed the economy generally has more momentum than earlier thought. The Commerce Department said the January-March contraction was only 2.1 percent, compared to the more severe 2.9 drop percent previously reported, and it upped its estimate of growth in 2013 to 2.2
percent from 1.9 percent, due to a much stronger second half. “This is not just a case of better weather. There is evidence to indicate that there has also been an underlying improvement in the economy, and that robust growth will be sustained into the third quarter,� said Chris Williamson, chief economist at Markit. Fed still sees weakness The fresh data supported the rise in calls for the Fed to move more quickly to address allegedly overheated asset markets, the growth in risky investment, and a pickup in inflation. So-called “hawks� worried about inflation say the central bank’s Federal Open Market Committee needs to accelerate its plans to raise the benchmark federal funds rate up from near-zero only in the second half of next year. Indeed, one FOMC member dissented from Wednesday’s policy decision, saying its open-ended commitment to the ultralow rate “does not reflect the considerable economic progress that has been made,� including the sharp fall in joblessness and the pickup in prices. The committee as expected said the economy was strong enough to further reduce its monthly bond purchases by $10 billion to $25 billion a month. The program, which was at $85 billion last December, is slated to wind up in October.

Wage insecurity on security checks: Should employees be paid while at employer’s security line? Walgreens, the drug retail chain, was reportedly sued by its California employees for, among other things, failure to provide employees the required meal and rest breaks and for failing to pay employees for time spent at work undergoing security searches. The parties recently agreed to settle the case for about $23 million, which will benefit about 40,000 Walgreens employees in California. Of interest here is the employees’ claims of unpaid time for being subjected to security searches. This type of claim seems to be more and more in the news lately. Postshift security checks are nothing new. Retail companies, concerned with employee theft of their merchandise, set up detailed security measures to minimize their losses. However, the procedure may result in wage losses to employees who spend significant time going through security checkpoints. Under California law, employees should be paid for all hours worked. “Hours worked” is that time when an employee is subject to the control of an employer. When employees perform preparatory and concluding activities at work, it can be argued that they are under the control of the employer. However, an employees’ preparatory or concluding activity must be paid only if it is “integral and indispensable” to the employee’s principal activities, or is required by law or company rules. This means an activity must be (1) “necessary to the principal work performed” and (2) “done for the benefit of the employer.” Some months back, we reported on a case regarding warehouse employees at Integrity Staffing Solutions, Inc., a subcontractor to Amazon.com. The employees sued their employer in a class action, alleging that they spent an average of 25 minutes per day of unpaid time going through required security screenings at the end of their shifts. The Appellate Court decided that since
the required security screenings were intended to prevent theft, it is thus an integral and indispensable part of the employer’s business. Therefore, the employees may state a claim for back wages. The employer appealed to the U.S. Supreme Court, which agreed to review the case. The high court must decide, once and for all, whether warehouse employees must be paid for time spent undergoing security screenings to detect stolen merchandise. In an interesting twist, the U.S. Department of Labor (DOL) has filed a brief in support of the employer’s position. Aside from wanting to clarify how the law should be enforced, the DOL said the government is interested in the case’s outcome because it also has many employees who are required to undergo security checks at work. Of course, a change in federal law may or may not affect California’s own laws. However, since California’s enforcement policy on preparatory and concluding activities is similar to the federal position, the high court ruling in this case is hotly anticipated. [C. In Senate Resolution 798, Senators Vicente Sotto III and Gregorio Honasan said the three lawmakers should “have access to facilities and the space to continue to function as duty elected representatives of the people.” They said the three senators are presumed innocent until final conviction by the proper court citing Section 14, Article III of the 1987 Constitution which states that “in all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved.” The three senators are facing plunder and graft charges in connection with the alleged misuse of their Priority Development Assistance Fund (PDAF) allocations. Enrile is staying at the PNP General Hospital while Estrada and Revilla are detained at the PNP Custodial Center, both located at Camp Crame. Also detained there is Revilla’s staff, Richard Cambe. On the other hand, two of their coaccused, alleged pork scam brains Janet Lim-Napoles and lawyer Gigi Reyes, are both detained at Camp Bagong Diwa in Taguig City. This was according to her lawyer Bruce Rivera, who, after inspecting and being briefed about the security measures inside Camp Bagong Diwa, said they are now convinced that Napoles’ transfer from Fort Sto. Domingo in Sta. Rosa, Laguna was for the better. It was a Makati court, trying her on charges of serious illegal detention, that originally ordered Napoles’ detention in Laguna. But the Sandiganbayan, which is hearing separate cases of plunder and graft against Napoles, ordered her transfer to Taguig. Citing security reasons, Napoles’ camp initially opposed the transfer. But after the Makati court did not object to the transfer, Napoles was finally brought to Camp Bagong Diwa Monday night. “Initially, ang issue namin is security ... kasi di pa naman namin nakikita ang security set-up [that time],” Rivera said. “But now [after] looking at the security [aspect], wala naman kaming nakitang problema,” he said. Rivera accompanied Napoles from Laguna to Taguig. Inspector Aris Villaester, spokesman of the Bureau of Jail Management and Penology-National Capital Region, assured Napoles of her security while in their custody and added that she will have to first stay at a small “isolation room” inside Camp Bagong Diwa for about a week.

Aquino: Start thinking about 2016
MANILA, July 28 (Mabuhay) – President Aquino, in an emotional State of the Nation Address on Monday, challenged Filipinos to begin looking beyond his administration and decide who will continue - or stop - his reform and “transformation” agenda in 2016. Choking up towards the end of a 1.5-hour speech, the President said those currently criticizing the government and programs - particularly the controversial Disbursement Acceleration Program (DAP) - are anti-reform and anti-people. He then invoked the spirit and legacies of his father and mother - the martyred oppositionist Benigno “Ninoy” Aquino Jr., and former president Cory Aquino - in urging Filipinos to choose a successor with “not even an iota of doubt” (walang katiting na duda) in terms of commitment to his “Daang Matuwid” reform mantra. After listing achievements made possible by continuing reforms of his administration in the past four years, Mr. Aquino capped his speech with a challenge to the people to make sure they continue to reap the fruits of these by picking the right leader to succeed him. He began this drift with an emotional reminder of the legacy of his parents, the martyred senator Ninoy whose 1983 assassination hurtled the anti-dictatorship protests into the 1986 people power revolt; and Corazon Cojuangco-Aquino, who became the first president of that restored democracy. “Pag tinalikuran ko ang ating sinimulan, parang tinalikuran ko na rin ang aking ama’t ina [If I turn my back on what we’ve begun, it’s as if I’ve turned my back on my father and mother],” he said, his voice cracking. He said he would only suggest one yardstick for choosing the next leader of the land in 2016: “Sino ang wala ni katiting na dudang magpapatuloy sa repormang ating nasimulan [Who’s the one who without an iota doubt will pursue the reforms we’ve begun]?” Transformation, he added, can be made permanent, by God’s grace, if people are united. When that happens, he said, reminding people again of his parents, he paraphrased Ninoy: “we can prove again the Filipino is worth is dying for,” which was greeted by applause. NP unlikely to support impeach bid vs. Aquino – Sen. Villar MANILA, July 30 (Mabuhay) – President Benigno Aquino III can rely on the support of the Nacionalista Party with regards to the impeachment complaints filed against him at the House of Representatives, Senator Cynthia Villar said Wednesday. Villar said that even though the NP as a whole has yet to discuss and make an official stand on the impeachment complaints, she believes the party will not sever its ties with the ruling Liberal Party led by the Aquino. “He (can) rely on us and unless magbago yung NP, I don’t think (the) Nacionalista will support (the impeachment complaints). Wala pa silang pinag-uussapan pero we are part of the coalition. As a whole, hindi naman kami magbe-break ng coalition,” she said. Villar is the wife of NP president and former Senate President Manny Villar, who lost to Aquino during the 2010 presidential elections. She, however, said their members are still free to air their opinions and make a stand. The NP has 25 members in the House of Representatives where three impeachment complaints against the President have been filed. The House of Representatives is dominated by Aquino allies. “Of course, every person ...kahit you belong to a party and may personal decision ka, inaallow namin sila to make their own personal decision.
But, as a whole, tingin ko naman, they will support the President pero syempre, kung may members kami who feel strongly about certain issues, we allow them to exercise their own prerogative sa mga ganun,” Mrs. Villar said. In case the impeachment complaint reaches the Senate, Sen. Villar will serve as one of the judges of the Senate impeachment court. Aside from Sen. Villar, other NP members in the Senate are the Cayetano siblings (Alan Peter and Pia), Antonio Trillanes IV and Ferdinand Bongbong Marcos Jr. The President is currently facing three impeachment complaints – two over the Disbursement Acceleration Program and one over the Enhanced Defense Cooperation Agreement with the US. Sen. Villar, a businesswoman prior to her stint in politics, believes the DAP is a good strategy to boost the economy. “I’m a Business Administration major so I can understand the economic explanation that if you want to raise GNP (Gross National Product), then you have to encourage public spending so siguro yun ang reason for DAP, to encourage economic activities through increase in public spending. CASERTA, July 28, 2014 (AFP) - Pope Francis has asked forgiveness from Protestant Pentecostalists persecuted by Catholics under Italian fascism in the 1930s, religious news agency i.media said Monday. “Among those who persecuted and denounced the Pentecostalists – almost as if they were crazy people who tarnished the race – there were also Catholics,” Francis said during a meeting with 350 Protestant evangelicals in Caserta in southern Italy.
“I am the shepherd of Catholics, and I ask forgiveness for those Catholic brothers and sisters who did not understand and were tempted by the devil,” he said. Italian fascists persecuted Pentecostalists and other Protestants under laws that were not revoked until the 1950s, and the Catholic Church is widely held to have supported their harassment. A 1935 bill outlawed the Pentecostalist “cult” in Italy, saying it was “harmful to the physical and psychic integrity of the race”.
Binay suffers ratings drop after DAP ruling – Pulse Asia MANILA, Aug 1 (Mabuhay) – Like President Benigno Aquino III, four other top government officials suffered drops in their approval and trust ratings after the Supreme Court ruling on the Disbursement Acceleration Program (DAP), pollster Pulse Asia reported Friday. The SC’s adverse ruling on the DAP failed to improve Chief Justice Maria Lourdes Sereno’s approval ratings, which slid from 40 percent last March to 35 percent in June. Sereno’s trust ratings were also virtually unchanged from 36 percent last March to 32 percent in June. Vice President Jejomar Binay, whose opposition coalition has been criticizing the use of the DAP, also saw a decline in both his trust and approval ratings. Binay’s approval ratings dipped from 87 percent
in March to 81 percent in June. His trust ratings also decreased from 86 percent in March to 79 percent during the survey period. The Pulse Asia survey was conducted on 1,200 Filipino adults from June 24 to July 2 this year, covering the period the SC declared the DAP as partially unconstitutional. The pollster earlier reported a significant decline in President Aquino’s approval and trust ratings after the DAP ruling. Malacañang has appealed the SC decision on the controversial spending mechanism, maintaining that it was undertaken in good faith. The survey also covered the period of Senators Ramon Revilla Jr. and Jinggoy Estrada’s arrests on plunder charges for the alleged pork barrel scam. These arrests, however, failed to give a positive effect on Congress leaders’ ratings.

CRM Learning of Carlsbad, California, said it will also withdraw the training video from the market after the Philippine Embassy, the Philippine Nurses Association of America (PNAA) and the Migrant Heritage Commission (MHC) told the company the customer service training video violated cultural sensitivities. “We welcome the expeditious and comprehensive action taken by CRM Learning in addressing the concerns expressed by members of the Filipino Community in connection with their customer service video,�

Libya allows Pinoys to leave without exit visas MANILA, Aug 1 (Mabuhay) – Filipinos in Libya need not wait for their exit visas to leave the country, Labor Secretary Rosalinda Baldoz said Friday as the government works double time to extricate the estimated 13,000 Filipinos out of the African nation currently in the midst of a bloody civil war. In a statement, Baldoz said the Libyan Ministry of Labor has allowed Filipino workers there to leave even without exit visas from their employers. “Labor AttachĂŠ to Tripoli Nasser Mustafa has reported to Philippine Overseas Employment Administration Administrator Hans Cacdac that exit visa is no longer a problem for our OFWs,â€? she said. Baldoz added this means Filipino workers “who wish to avail of the mandatory repatriation need not beg with their
employers to allow them to leave Libya.� The order was signed by an undersecretary of the Libyan Ministry of Labor and Retraining, allowing Filipinos in Libya to exit through the Republic of Tunisia, the nearest country to Libya. The Philippines’ top diplomat, Foreign Affairs Secretary Albert Romulo, flew to Tunisia on Thursday night to personally oversee the country’s repatriation efforts. MANILA, Aug 1 (Mabuhay) – Neophyte Senator Grace Poe has asked the Senate to conduct a study on youth joblessness in the country, citing the government’s record of 1.4 million unemployed last April. Poe filed Senate Resolution 771 directing the committees on youth and on labor to do the study “with the objectives of strengthening policies and introducing dynamic measures aimed at generating opportunities for young people and the unemployed.� The resolution said based on the Philippines Statistical Authority’s (PSA) Labor Force Survey for April 2014, the number of unemployed Filipino youth reached 1.456 million. “The same PSA study states that jobless youth account for half of the country’s total unemployed and for 16 percent of the total youth workforce,� it said. “The youth unemployment rate of 15.4 percent is more than twice the reported national unemployment rate of 7 percent.�

Does the creation of a revocable living trust, during the marriage, transmute separate property to community property? Divorcing couples may have established revocable living trust for estate planning pusposes during their marriage which was funded primarily with assets acquired by one spouse prior to the marriage. The issue is what is the characterization of those property when the couple gets the divorce. Transmutation is the changing of the characterization of a property from community to separate or vice versa. For example, the language “I give to the account holder any interest I have in the funds deposited in this account,” is sufficient to establish transmutation. ( Ibid.) The express declaration must unambiguously indicate a change in character or ownership of property. In re Marriage of Koester (1999) 73 Cal.App.4th 1032, 1037, fn. 5, 87 Cal.Rptr.2d 76.) A party does not “slip into a transmutation by accident.” ( Ibid.) Does one spouse’s separate property become transmuted into community property by virtue of being funded into the revocable trust established during the marriage? One has to examine the trust document itself. A general provision in the parties’ trust agreement establishing a revocable trust for estate planning purposes and stating that property transferred to the trust is community property, unless either spouse as transferor identifies it as separate property, is not itself effective to transmute separate property transferred to the trust to community property. Marriage of Starkman (2005) 129 CA4th 659, 661, 28 CR3d 639, 640 . In addition Family Code § 852(a) writing requirement in Starkman is not by a General Assignment (conveying all of the parties’ assets to the trust) or stock brokerage transfer forms transferring husband’s securities into the trust (but not describing them as separate or community). However, a trust transfer agreement, even if executed only for estate planning purposes, effects a present transmutation when it includes language expressly stating the characterization or ownership of the subject property is being changed. Marriage of Holtemann (2008) 166 CA4th 1166, 1172–1173, 83 CR3d 385, 390–391.
In Hotermann, the trust transfer agreement unambiguously stated assets listed in incorporated exhibit are “hereby transmuted” from husbands separate property to community property. Another example is in Marriage of Lund (2009) 174 CA4th 40, 51–54, 94 CR3d 84, 94–96 where the trust transfer documents unambiguously stated all of husband’s property was “hereby converted” to spouses’ community property and each had a “present, existing and equal interest therein” The management and control of community property held in a revocable trust is subject to Family Code § 761 and Family Code § 1100(a). The trustee may “convey and otherwise manage and control” the trust property without either spouse’s joinder or consent unless the trust instrument expressly provides otherwise. In addition, except where the trust instrument expressly provides otherwise, either spouse acting alone may exercise the power of revocation. However, any power to modify rights and interests in the trust property during marriage may only be exercised with both spouses’ joinder or consent. Family Code § 761(a),(b) & (c)Marriage of Lund (2009) 174 CA4th 40, 54, 94 CR3d 84, 96. For divorcing couples that have a revocable trust during their marriage, it is important to analyze the wording of the trust document to determine the proper characterization of the trust assets to be divided in the divorce case. Filipina nurse kidnapped, raped in Libya TRIPOLI, July 30, 2014 (AFP) – Unknown gunmen kidnapped and raped a Filipina nurse Wednesday in the Libyan capital, medics and security officials said. The woman was seized early in the morning as she was on her way to work, said the health ministry spokesman, and was released several hours later after suffering an unspecified “aggression”. But a source within the security services said she had been raped by her captors. The ministry said the incident could push the Philippines to speed up the evacuation of its citizens, 3,000 of whom work in Libya as doctors and nurses, as the country sinks further into chaos. The spokesman said that following
Wednesday’s incident, Filipino medical personnel had left hospitals in Tripoli to await evacuation. On July 20, as the lawless North African country sank further into violence, the Philippines urged its estimated 13,000 citizens in Libya to leave and alerted them to prepare for a mass evacuation. Boxer, Collins introduce bill to boost training for military sexual assault
Washington, D.C. – U.S. Senators Barbara Boxer (D-CA) and Susan Collins (RME) today introduced the Military SAFE Standards Act, legislation to help survivors of military sexual assault get the justice they deserve by requiring the Department of Defense to standardize eligibility, assignment, training and certification requirements for sexual assault forensic examiners across all services. “Ensuring that survivors of military sexual assault have access to trained forensic examiners is critical to bringing the perpetrators of these heinous crimes to justice,” Senator Boxer said. “This bipartisan bill will expand access to these medical experts and improve training so that forensic examiners from every branch of the military meet the highest standards.”

Over 8.2 million seniors have saved more than $11.5 billion on prescription drugs since 2010 Information released Wednesday by the Department of Health and Human Services shows that more than 8.2 million seniors and people with disabilities with Medicare continue to enjoy prescription drug savings as a result of the Affordable Care Act, saving $11.5 billion since 2010. This news comes on the heels of continued historic low levels of growth in Medicare spending. According to the recent Medicare Trustees report, the life of the Trust Fund has been extended to 2030, up from its projection of 2017 in 2009, and Part B premiums are expected to stay the same rather than increase for the second year in a row. Additionally, a new HHS report found that per capita, Medicare spending growth has averaged 2 percent over 2009 – 2012, and nearly 0 percent in 2013, one-third of the growth rate over the 2000-2008 period. “Thanks to the Affordable Care Act, seniors and people with disabilities are saving on needed medications,� said HHS Secretary Sylvia M. Burwell. “By making prescription drugs more affordable, we are improving and promoting the best care for people with Medicare.� The Affordable Care Act makes Medicare prescription drug coverage more affordable by gradually closing the gap in coverage where beneficiaries had to pay the full cost of their prescriptions out of pocket, before catastrophic coverage took effect. This gap is known as the donut hole. Since the enactment of the Affordable Care Act, out-of-pocket savings on medications for people with Medicare prescription drug coverage continues to grow. More than 8.2 million seniors and people with disabilities with Medicare have saved over $11.5 billion on prescription drugs since 2010 as a result of discounts in the donut hole and rebates in 2010, for an average of $1,407. These figures are higher than last year at this time when over 6.6 million seniors and people with disabilities with Medicare had saved over $7 billion on prescription drugs averaging $1,061 per beneficiary in donut hole discounts.

address key issues of health and wellness. Apps that measure heart rate, blood pressure, glucose and other bodily functions are multiplying, while Google, Apple and Samsung have launched platforms that make it easier to integrate medical and health services. “We’ve gotten to a point where with sensors either in the phone or wearables gather information that we couldn’t do in

Patients take control The California startup MD Revolution has created a system adapted from a concierge medicine practice, which allows participants to track a variety of health indicators using mobile or wearable devices. The company uses fitness and other tracking devices to address “imminently preventable conditions such as diabetes or hypertension,” says spokeswoman Lisa
Peterson. “We are creating a new specialty in digital health in which people can interact with nutritionists, exercise physiologists to receive a plan and coaching, to prevent or reverse chronic diseases,” she told AFP. Peterson said the company using existing commercial devices from makers such as Fitbit or Jawbone and plans to launch its own app for its users. She noted that the launching of health platforms by Google and Apple “will make it easier for us to integrate more devices and apps.” Recent studies suggest that people who use connected devices to monitor health and fitness often do a better job of managing and preventing health problems. A study led by the Center for Connected Health found that people who use mobile devices did a better job of lowering dangerous blood pressure and blood sugar levels. A separate study published in the July 2014 issue of Health Affairs found that data collected by devices is not only useful for patients but can help doctors find better treatments. “When linked to the rest of the available electronic data, patient-generated health data completes the big data picture of real people’s needs, life beyond the health care system,” said Amy Abernethy, a Duke University professor of medicine lead author of the study.

Hearty Chickpea Vegetable Soup
Neopolitan Tuna Fettuccine
Servings: 6 1 tablespoon olive oil 1 medium onion, chopped 1 large garlic clove, minced 2 teaspoons ground cumin 2 (14.75-ounce) cans low sodium vegetable or chicken broth 1 cup water 4 cups cubed butternut squash, about 1 medium squash 1/4 teaspoon salt 1 (15.5-ounce) can Goya garbanzo beans, drained and rinsed 1 (14.5-ounce) can Del Monte sliced carrots, drained 3 cups escarole or kale, coarsely chopped In 4-quart saucepan over medium-high heat, in hot oil, cook onion and garlic until just softened, stirring frequently. Stir in cumin; cook 1 minute. Add canned broth, water, butternut squash and salt. Over high heat, heat to boiling. Reduce heat to low; cover and simmer 20 minutes until squash is tender. Add garbanzo beans, carrots and escarole. Continue to simmer about 5 minutes until vegetables are tender.
Servings: 2 8 ounces fettuccine pasta 1 tablespoon olive oil 1 small onion, diced 2 garlic cloves, minced 1 (14.5-ounce) can Red Gold diced tomatoes 2 teaspoons capers 1 (5-ounce) can tuna, packed in oil, drained 1 (2.2-ounce) can sliced ripe olives, drained Salt and ground black pepper to taste Cook fettuccine as label directs. Reserve 1 cup cooking liquid; drain. Meanwhile, in 10-inch skillet over medium heat, in hot oil, cook onion and garlic, about 5 minutes until just softened. Add diced tomatoes and capers; simmer 5 minutes. Add tuna, olives, salt and pepper to taste. Toss fettuccine with tuna mixture to mix well. Serve immediately. If necessary, add reserved cooking liquid.
Orange Pork Stir Fry Servings: 4 1 pound pork tenderloin 1 tablespoon cornstarch 1/4 teaspoon salt and ground black pepper 1 tablespoon peanut oil 1 tablespoon minced fresh ginger 3 cups baby spinach leaves 1 (15-ounce) can Del Monte mandarin oranges in light syrup, drained 1 (15-ounce) can KAME stir-fry vegetables, drained 3 tablespoons sweet Asian chili sauce 2 tablespoons low sodium soy sauce 2 teaspoons sesame oil 2 scallions, thinly sliced Cut pork tenderloin into 1/2-inch-thick rounds, then into 1/2-inch-wide strips. Place pork tenderloin strips in medium bowl; add cornstarch, salt and pepper; toss to mix well.

Remove vegetables to bowl of food processor. To food processor, add one-fourth of garbanzo beans, lemon juice and salt; pulse with spinach mixture until smooth paste. Add remaining garbanzo beans, bread crumbs and spinach; pulse until coarsely chopped. Shape mixture into four 4-inch patties. If desired, refrigerate until ready to cook. In 12-inch skillet over medium heat, in remaining tablespoon hot olive oil, cook falafel patties until golden and crisp, turning once. Serve on buns and top with tomato, onion and Tzatziki sauce, as desired.
In 12-inch skillet over mediumhigh heat, heat peanut oil; add ginger. Cook 30 seconds; add pork strips. Stirfry until pork is lightly browned, about 5 minutes. Add spinach; cook 2 minutes, stirring constantly until just wilted. Add mandarin oranges, stir-fry vegetables, chili sauce, soy sauce; cook over medium heat until mixture is coated and thickens slightly. Stir in sesame oil and sprinkle with scallions. Serve with rice.

Swimming Pools: Hidden dangers lurk below the surface
of the deaths and shocks occurred during attempted rescues of shock victims because the rescuers were unaware of the electrical hazards. Another safe move is to have an electrician downgrade pool lighting from a potentially deadly 120 volts to 12 volts. The 120-volt lighting systems are particularly prevalent in older pools and GFCIs are recommended on any lighting system 15 volts or greater. “The lower voltage is simply less dangerous,� said Neal “In case of a broken glass or leakage into an underwater light, you should avoid having 120 volts introduced into your water. Landscape lighting should also be powered by a low-voltage system to prevent shocks on a rain-soaked lawn.� A well-ground power system is also very important since it adds critical protection by guaranteeing that if something goes wrong, the power flows to the ground and not to those in the pool. “Pool owners should also make sure that electrical wires and junction boxes are a minimum of five feet away from water, as also required by the National Electrical Code,� said Neal. As for other hazards outside the water, a permanent or storable pool should never be built or set up underneath power lines (if this exists, there are clearance requirements, but pool owners should consult their local inspection agency). Long-handled cleaning tools also should be used away from power lines and electrical cords should be kept at least five feet away from the pool. Neal offers an additional warning on the electrical cords, suggesting that, “When possible, people should use battery-operated appliances and not cord-connected ones in and around a pool, spa or hot tub.� Meanwhile, pool owners should always have an emergency plan within view of pool users and power switches should be labeled for pool, hot tub and spa equipment and lighting so they can be turned off quickly during an electrical emergency. In addition, a fiberglass Shepherd’s crook should be used to remove any victims from the water, CPR should be administered and 911 should be called. As for rescuers not taking these precautions, they risk serious injury if they touch a conductive fixture or enter the water before the current is stopped. “Pool electrical accidents are easily prevented,� said Neal. “But pool owners must follow state-mandated codes, conduct proper inspection and maintenance and use qualified electricians to achieve that prevention.�

Faulty pool lighting and bad wiring are the greatest electrical threats to safety, but can easily be eliminated by regular inspection, maintenance and adherence to local and national codes. Don’t swim with shocks It’s a nice play on words in a Consumer Product Safety Commission fact sheet, but there’s nothing nice about the hidden dangers it warns of in and around swimming pools with the summer in full swing. The spring electrocution of a 7-year-old boy in his family’s Miami swimming pool is a tragic worst-case example, but another non-fatal Miami accident where three children were badly shocked is instructive as well. Faulty pool lighting and bad wiring, respectively, are suspected in both accidents. In fact, underwater lights and their wiring are the greatest potential electrical hazards inside a pool since it can’t be said enough that water and electricity don’t mix. A pane of glass and a rubber seal are often swimmers’ only protection from electrical wiring. Any water inside the underwater light fixture – the presence of mold or rust, buzzing noises or flickering lights is a tipoff – is very dangerous, but so is a power system that is not well-grounded and aging or corroded wires. These risks are only heightened if lighting and circuits aren’t protected by Ground Fault Circuit Interrupters (GFCIs). And older pools may not only have degraded lighting fixtures, but also may not have GFCIs on underwater lighting circuits. If these issues exist, they should be updated immediately. “People should have a qualified electrician inspect their underwater lights to make sure that junction boxes and wiring connections are properly and safely installed,� said Don Neal, director of Corporate Environmental, Health and Safety at Southern California Edison (SCE), which also offers a pool-pump rebate program to assist customers. “In addition to fixing any problems, that electrician should upgrade your pool, as well as your hot tub or spa, in accordance with local codes and the National Electrical Code.� GFCIs should also be used on pumps and electrical equipment, such as heaters, used with pools, spas and hot tubs and on all outlets within 20 feet of the water’s edge to protect people from shocks. These are all very important steps because there have been 60 electrocutions and nearly 50 serious electrical shocks in and around swimming pools in the U.S. since 1990, according to the safety commission. The commission said some

Asia tourist boom fuels airport binge By Martin Abbugao
SINGAPORE, July 30, 2014 (AFP) – Faced with snaking queues at immigration, overflowing baggage carousels and expensive flight delays, Asian nations are rushing to build hundreds of new airports to cope with surging demand for air travel in the region. From China and India to the Philippines and Indonesia, the fast-growing middle classes are looking to spend their cash by spreading their wings, leading to a boom in the Asia-Pacific region’s tourism sector. Airlines have responded by setting up several new budget carriers and flying new routes – but many airports are unable to
cope, forcing governments to either expand or simply build new airports. “Through the next 10 years, we see more than 350 new airports in the AsiaPacific and the investment cost will be well over $100 billion,” said Chris De Lavigne, a global vice president at business consultancy Frost & Sullivan Asia Pacific. “China is building over 100 airports, India is building over 60 airports and Indonesia will also have to follow suit with investments in its infrastructure,” said De Lavigne, who closely tracks Asia’s aviation industry. Upgrades of existing airports could cost an additional $25 billion, he told AFP by
telephone from his office in Jakarta. International tourist arrivals in AsiaPacific grew an annual 6.0 percent to 248 million last year, the strongest of any region worldwide, according to the UN World Tourism Organization. To cope with this, construction is being ramped up. The Canada-based Airports Council International (ACI) said in a report that Indonesia plans to build 62 new airports in the next five years, in addition to its existing 237. Soekarno-Hatta in Jakarta is improving capacity after handling 60 million passengers last year, nearly three times what it was designed for, ACI said. And Kuala Lumpur aims to double capacity to 100 million a year by 2020, while Hong Kong wants to handle 97 million annually by 2030, up from 60 million in 2013. In Beijing – which already has a hub servicing 80 million people – a second, $11 billion airport is being built to open in 2018 and handle 40 million passengers, Sydneybased consultancy Centre for Aviation said. There are also plans for a full replacement of Manila’s Ninoy Aquino International Airport, one of Asia’s most notorious for overcrowding and backward facilities. Its Terminal 1, which is undergoing a major makeover, was built in 1981 to handle six million passengers a year. Together with two extension terminals, the airport handled around 30 million passengers in 2013. ‘Bursting at the seams’ Even Singapore’s Changi – regarded by many as one of the world’s best – is expanding, with a $1.0 billion Terminal 4 opening in 2017 that will raise capacity to 82 million passengers from the current 54 million. Plans are already being made for a Terminal 5. Shukor Yusof, an analyst with Malaysia-based Endau Analytics, said airport infrastructure in many countries has lagged well behind travel growth. “Many governments have paid scant attention to developing new terminals and new tarmacs, that’s why you find that many
of the airports are bursting at the seams,” he told AFP. The focus is not just on capitals. The need for more space means much of the new construction is taking place in secondary cities, with some facilities potentially becoming hubs. De Lavigne cited the Kualanamu International Airport in Indonesia’s Medan, which opened last July and could become a hub for flights to Malaysia, Thailand, Myanmar, India and China. It was designed to handle eight million passengers a year but is already at capacity, he said. “By 2025, they’re forecasting 24 million passengers out of Medan, or a three-fold increase in just over 10 years,” De Lavigne said, adding that Indonesia’s aviation sector alone is growing 14-15 percent a year. Even less developed tourist destinations are pressing ahead with building. Myanmar—returning to the global fold after decades of junta-led isolation—is looking to upgrade 39 airports as tourist and domestic air passenger figures are seen surging to 30 million in 2030 from 4.2 million in 2013, the ACI said. The government is also building a new $1.5 billion Hanthawaddy International Airport to serve as Yangon’s second airport, it added. Bangladesh is constructing a new airport costing up to $7.2 billion about 60 kilometers (37 miles) from Dhaka, ACI said. Funding from governments and the private sector does not appear to be a problem. “There’s a lot of liquidity out there. There’s a lot of money in project financing,” Shukor said. Airports are now even targeting nontravelers, with the current trend for “aeroparks and aerotropolises” integrating lifestyle amenities, attracting diners and shoppers who won’t even board flights. “You get people who don’t fly to come into the airports for food, shopping and other lifestyle activities. That trend which started in the West is increasingly finding its way into Asia,” De Lavigne said.
Cebu Pacific, Tigerair make progress with interline agreement Cebu Pacific and Tigerair, the two largest low-cost carriers in the Philippines and Singapore respectively, have made further progress on their interline agreement with the first interline flights available on Cebu Pacific’s website from 23 July 2014. Tigerair flights will be available on Cebu Pacific’s website from September 2014. With the interline agreement facilitating both domestic and international collaboration between both airlines, Cebu Pacific and Tigerair have created the biggest network of flights from the Philippines to the region. The interline agreement is part of a wide-ranging strategic alliance entered into between the two carriers earlier this year and will enable both airlines to leverage their respective strengths to enhance their network coverage and jointly market interline routes. Travelers can enjoy seamless connections between the two airlines, with easy one-stop ticketing for connecting flights and baggage check-in. The ability to cross-book flights on a single itinerary will pave the way for greater connectivity between the two carriers, allowing customers to connect seamlessly within Asia Pacific and the Middle East. Specifically, Tigerair’s customers will be able to fly from South East Asia to 34 Philippine cities, Korea and Japan on
Cebu Pacific’s network, and Cebu Pacific’s customers in the Philippines will be able to add Tigerair’s destination calls in Australia (via Perth), India and China to their flight itineraries. Customers on such extended itineraries will be able to connect through Singapore Changi Airport and Ninoy Aquino International Airport in the Philippines. Chief Operating Officer of Tigerair, Mr. Ho Yuen Sang said, “The interline arrangement harnesses the strengths and networks of Tigerair and Cebu Pacific. Mexico, California officials question Texas border troop plan MEXICO CITY, July 28, 2014 (AFP) – Mexico’s foreign minister and the visiting governor of California questioned Monday plans by Texas to deploy troops to stem the flow of immigrant children, saying they need humanitarian aid instead. As this developed, in a last-ditch effort to schedule a vote dealing with a influx of undocumented Central American children, the US House of Representatives postponed its summer recess Thursday (July 31). The move came after the Republicancontrolled chamber scrapped a vote earlier in the day on a bill to provide $659 million in emergency aid for the humanitarian crisis at the border. “We’ll stay until we vote,” said Republican Congressman Darrell Issa. US officials have said that almost 57,000 unaccompanied children have arrived this year from Central America, fleeing poverty and violence at home, and hoping in many instances to reunite with relatives already in the United States. The huge exodus, mostly from El Salvador, Guatemala and Honduras, has overwhelmed US authorities lacking the financial and legal means to curb the illegal influx. The five-week recess that would have begun on Thursday night was pushed back to accommodate a Friday morning meeting
to try to reschedule the vote. Separately in the Senate late Thursday, Republicans blocked a Democratic border plan in a procedural vote. US border officials have warned that they will run out of money to deal with the humanitarian crisis without a fresh infusion of funds to house and care for the young migrants, and to pay for the immigration hearings to resolve their status. The amount of funding in the House bill is just a fraction of the $3.7 billion requested by President Barack Obama to increase border security and hire additional immigration court judges. California Governor Jerry Brown, on a visit focused on boosting trade with California’s southern neighbor, said the Texas plan must be a short-term measure and that he hopes “wiser minds will prevail over the next several months.” The Democratic politician was referring to a plan announced last week by Texas Governor Rick Perry, a Republican seen as a potential 2016 presidential election candidate, to send 1,000 National Guard reservists to the enormous and porous border US-Mexico border. More than 57,000 children, mostly from Central America, have entered the United States illegally and without adult supervision since October, many fleeing unrelenting gang violence in their home countries.
Smartphone app promises medical pot delivery SAN FRANCISCO, July 29, 2014 (AFP) – Startup Eaze on Tuesday released a smartphone application promising prompt, professional delivery of medical marijuana the doors of patients in San Francisco. Eaze said that drivers referred to as “caregivers” will get medicinal doses to their intended recipients in an average of 10 minutes in most cases. Eaze checks the medical eligibility of those who register at eazeup.com for the “on-demand healthcare delivery service” where users place orders using smartphones or tablet computers. Once an order is placed, Eaze dispatches a caregiver to hand deliver the marijuana from a selected dispensary. Those waiting for their cannabis can track progress of the driver in real time using mobile devices, according to Eaze. Eaze has automated the typically “slow, cumbersome, and unpredictable” process of checking dispensaries and confirming eligibility, according to startup founder and chief executive Keith McCarty. Delivery is free for patients, with money to pay drivers reportedly coming
from revenue that Eaze takes in from dispensaries for generating business. Prior to Eaze, McCarty was part of social networking technology firm Yammer which Microsoft bought two years ago in a deal valued at $1.2 billion. He backed Eaze with some of his Yammer windfall. Eaze said that it is eager to expand to Southern California as well as the US stats of Colorado and Washington. A long-term vision includes operating everywhere in the country where medical marijuana is legal. Medical marijuana delivery is already available in California and other US states, with an extensive list of dispensaries and services online at weedmaps.com. Eaze hoped to put itself on a higher plain by being fast, reliable and professional. “Although the healing effects of marijuana have been researched and documented, the medicine is still subject to much controversy,” McCarty said. “At Eaze, we developed technology to make it easier and quicker for patients to receive their medicine through professional delivery experiences.”
WASHINGTON, July 29, 2014 (AFP) – Just 108 of the thousands of unaccompanied minors illegally crossing the US border have been granted asylum in 2014, in a process that often takes more than a year, Congress heard Tuesday. Many more children who entered the country are likely to be provided asylum status later this year, and experts say there are several other avenues through which minors can seek to stay in the country. But the process, especially for asylum-seekers, is cumbersome and slow, contributing to what President Barack Obama labelled a humanitarian crisis on the southwest border. Since October more than 57,000 unaccompanied minors have been apprehended crossing the border, and about three-quarters of them are from El Salvador, Guatemala and Honduras, Central American countries where youths are fleeing poverty and gang violence. More than 1,500 child migrants who arrived in the United States without papers or parents applied for asylum in fiscal year 2014, according to US Customs and Immigration Services director Leon Rodriguez. But with immigrants usually making their formal asylum requests more than 10 months after first being apprehended, most of those applicants arrived the previous year. “Of the 167 unaccompanied children asylum cases adjudicated on the merits in FY14 through the third quarter, 108 have been granted asylum status,” Rodriguez told a House panel. But in a sign of how the process is
mired in legal hurdles and delays, only two of those minors granted asylum were apprehended this year, he said. “For those who do apply, the delays in the process are very significant,” Anwen Hughes, a senior counsel at Human Rights First told AFP. “It is taking over a year for asylum applicants to get an initial hearing before the immigration court in some jurisdictions.” Hughes also said that nearly half the child migrants are not represented by a lawyer when they appear in immigration court for the first time. Obama is seeking $3.7 billion in emergency funding aimed at boosting the number of immigration judges, improving care for detained minors and deterring illegal immigration. Congress is likely to trim his request dramatically. Senate Democrats have introduced a $2.7 billion package, but House Republicans on Tuesday unveiled funding pared down to just $659 million. The House plan would tweak a 2008 law targeting child trafficking that expanded legal rights for Central American child migrants, essentially revoking some of those rights to allow for speedier deportations. The Senate bill would not change the 2008 law, which many Republicans blame for fueling the immigration wave. House Speaker John Boehner said he hopes to pass legislation this week, before lawmakers leave town on a five-week recess, but that would require significant compromise between the two chambers before Friday.

SPORTS CGames: Boxing chiefs to probe headguard scrapping By Alistair Watson
GLASGOW, July 31, 2014 (AFP) – The International Boxing Association says it will carry out a detailed study of the impact of scrapping headguards for amateur contests following the conclusion of the Commonwealth Games. It follows a call from Australian boxer Daniel Lewis for the immediate return of the safety gear after a failed medical check ruled him out of his welterweight quarterfinal on Wednesday. The 21-year-old suffered a badly cut eye in his win against Nigeria’s Kehinde Ademuyiwa on Monday. The wound failed to sufficiently heal in time for him to meet Mandeep Jangra of India, who was given a walkover into the semi-finals. A growing number of cut head injuries have resulted from male boxers stepping into the ring without head protection after AIBA changed their rules last year. AIBA vice-president Dr Abdellah Bessalem from Algeria said his organisation was aware of the concerns and would address them after the Games. “We are looking at the number of cuts and after our study we will prepare our report,” the Commonwealth Games tournament supervisor said. “But we have to remember that without headguards the number of concussion injuries suffered by boxers has gone down.”
Following his withdrawal on Wednesday morning Lewis immediately took to social media to vent his frustration at having his medal hopes brought to an abrupt halt. He wrote: “For all these people debating about headgear for amateurs, bring the headgear back 100 per cent. “My journey is over. Got up at 6am this morning to lose weight. I made it and was ready to go to war only to be told by the doctor my journey is over. They won’t let me fight with the cut. “I had two fights, two comfortable wins with one TKO and a stupid elbow ruins it all. “My mum and dad paid to fly to the other side of the world to watch me win gold. “The past 10 weeks I’ve been away from everyone putting in the hard work, all for an elbow to ruin my dream.” This is the second injury setback to have ended Lewis’ hopes of boxing glory. Two years ago he broke his jaw in the Australian boxing team trials for the London 2012 Olympic Games. Australia media manager Ian Hanson said: “Daniel is bitterly disappointed. He came here to win a gold medal and, on top of his ill-fated Olympic preparations, this is a further blow to him. But he is a strong character and we are sure he’ll be back to fight another day.”
Raiders looking at move to San Antonio: report SAN ANTONIO, July 29, 2014 (AFP) – The Oakland Raiders, whose stadium lease expires next year, are reportedly looking at San Antonio as a possible new home should the National Football League team decide to relocate. The San Antonio Express-News, citing unnamed sources, said Raiders owner Mark Davis and two others with the team met with key people in the Texas city, including former mayor Julian Castro and city manager Sheryl Sculley. The Raiders would play in the Alamodome, which opened in 1993 and seats 65,000 for American football. Also reportedly in the talks was former US Secretary of Housing and Urban Development Henry Cisneros, who was San Antonio’s mayor from 1981-1989 and led the push to construct the Alamodome. Davis said he would ask the city to build a new stadium once the Raiders prove themselves. The Raiders have not had a winning season since 2002, which ended with Oakland losing the 2003 Super Bowl to Tampa Bay. Any relocation would have
to be approved by 75 percent of the NFL’s 32 club owners. The Raiders are the only NFL team that shares a home stadium with a Major League Baseball club. The Oakland A’s, who were also looking at potential new stadium sites in the area, signed a 10-year lease to remain in the stadium earlier this month. A move to Texas would not be the first for the franchise, which played in Oakland from 1960 to 1981, relocated to Los Angeles from 1982 to 1994 and then went back to Oakland for the 1995 campaign. San Antonio has been in consideration as the home of an NFL club before, most notably in 2005 when New Orleans Saints owner Tom Benson spoke with city officials about hosting the team after the Superdome, their home stadium, was devastated by Hurricane Katrina. The Saints played three games in the Alamo dome but returned to Louisiana the next year. The Raiders have won three Super Bowl titles, claiming the crown in 1976, 1980 and 1983.
Pistorius sells home for less than hoped to pay for murder trial JOHANNESBURG, August 1, 2014 (AFP) – South African Paralympian Oscar Pistorius has sold his Pretoria home where he killed his girlfriend last year for less than he hoped, to help pay legal fees for his ongoing murder trial, the real estate agent said on Friday. The athlete had hoped to raise at least five million rand ($470,000, 350,000 euros) when he put the small villa in a gated community on the market in March, said estate agent Ansie Louw, who is the wife of Pistorius’s coach. The buyer ended up paying 4.5 million rand ($420,000, 310,000 euros) – significantly less than the price paid for similar properties in the same neighbourhood. “This is a fact, but I am not going to comment any further,” Louw told AFP. Pistorius shot and killed his 29-year-old girlfriend Reeva Steenkamp in the house on February 14, 2013, claiming he mistook her for an intruder. His trial on charges of premeditated murder began in March this year and is expected to wrap up next week with closing arguments. Pistorius has not lived in the villa since the killing. The buyer of the house, Louwtjie Louwrens, told The Times newspaper that he bought the property because “it is in a safe area”.

US judge approves Clippers sale to ex Microsoft CEO By Veronique Dupont
LOS ANGELES, July 29, 2014 (AFP) A US judge on Monday gave the go-ahead for the $2 billion sale of the Los Angeles Clippers to former Microsoft chief executive Steve Ballmer, ruling that embattled owner Donald Sterling could not block the move. The ruling by California Superior Court Judge Michael Levanas came after a threeweek trial pitting the 80-year-old Sterling – barred from the National Basketball Association for life for making racist remarks – against his estranged wife Shelly, who made the deal with Ballmer. Levanas said the sale could go forward immediately, even if Donald Sterling – who had challenged his wife’s authority to sell the NBA franchise – appeals. He had 15 days to file an objection to the ruling. Shelly Sterling negotiated the sale on behalf of the family trust, after Donald Sterling’s position as co-trustee was terminated when two medical experts declared the billionaire real estate mogul mentally incompetent to handle trust affairs. “This is a good thing for the city, for the league and for my family,” she told reporters, adding she thought her husband would eventually be “happy” with the sale. Levanas rejected claims by Donald Sterling that his wife’s efforts to have him declared incompetent were based on fraud, saying the court “did not find any compelling evidence” of any wrongdoing and that Shelly Sterling’s testimony had been convincing. Donald Sterling’s attorney Max Blecher said after the ruling was read that he was “deeply disappointed.” In April, recordings of Sterling making racist comments to a girlfriend led NBA commissioner Adam Silver to ban him for life from the sport and launch proceedings to strip him of the team. Neurologist Meril Platzer told the court earlier this month that Donald Sterling was suffering from Alzheimer’s disease, and likely had been for at least three years. Sterling had argued that his decision in
June to dissolve the family trust – which came after he initially agreed to the team’s sale – kept his wife from making any move to sell the Clippers. Levanas rejected that claim. Sale deadline approaching An August 15 deadline to complete the sale to Ballmer is fast approaching. In a statement, NBA executive vice president of communications Mike Bass welcomed the ruling. “We are pleased that the court has affirmed Shelly Sterling’s right to sell the Los Angeles Clippers to Steve Ballmer. We look forward to the transaction closing as soon as possible,” Bass said. The sale would bring an end to an ugly chapter in NBA history – one that included player and fan protests. Sponsors abandoned the team, and the controversy clouded the Clippers’ run to the second round of the NBA playoffs. The $2 billion price tag, for a team that has never won a championship, would set an NBA record – well above the record $550 million paid for the Milwaukee Bucks in April. It also would mark a massive financial return for Sterling on a club he purchased in 1981 for just $12 million. Monday’s ruling may, however, be complicated by a separate suit filed by Donald Sterling against his wife, the NBA and Silver, claiming they defrauded him when they moved to sell the Clippers to Ballmer. He is seeking an injunction to halt the sale of the team, as well as unspecified damages. Pierce O’Donnell, the lead attorney for Shelly Sterling, said in his closing arguments earlier Monday that Shelly Sterling “cared about her husband” and was a “decent woman.” Blecher, however, denounced a “scheme” against his client, and said there was no proof that Sterling was no longer capable of making business decisions. “It was clear in the process of his testimony that he was alert,” he said, adding that Shelly Sterling had “unclean hands.”

(LONDON-AFP) – Driverless cars will be allowed on British roads from January 2015 as part of a pilot initiative in three cities, the government announced Wednesday. Cities nationwide are being invited to bid to host one of a series of trials that will last between 18 and 36 months, and to receive a share of the £10 million ($17 million, 12.5 million euros) of government funding for the scheme. Driverless vehicles, guided by a system of sensors and cameras, have already been tested in several countries, including the United States and Japan, with Sweden set to follow. wBusiness Secretary Vince Cable, outlining the plans, said British scientists and engineers were “pioneers” in the development of driverless vehicles. “Today’s announcement will see driverless cars take
to our streets in less than six months, putting us at the forefront of this transformational technology and opening up new opportunities for our economy and society,” he said at the headquarters of motor industry research organization MIRA in Nuneaton, central England. However motoring organizations warned that road users were skeptical of the technology. The Automobile Association said a recent survey of more than 23,000 of its members showed that 43 percent did not agree that the law should be changed to allow trials of the technology. AA president Edmund King said drivers were “still resistant to change” and that many people “enjoy driving too much to ever want the vehicle to take over from them”.
