Frontier Justice Rough n’ Ready

The wheels of justice today move mighty slow. Wasn’t always that way.
Back in the Wild, Wild, West, frontier justice was administered rather quickly. Sometimes impulsively. More often than not, the justice applied was correct . . . but if, on occasion, the wrong person was hanged . . . well, the frontier had to move fast and rough.
That was probably of little comfort to the person who had been hanged in error, but it was a fact of life back then.
A number of historical events demonstrate how life was “in the good old days.” (We leave the reader to decide if all was “good.”) One example:
On May 3, 1917, James Ray Gibson, a 34-year-old traveling salesman and his 36-yearold wife, Florence, had visited his parents in Globe and were headed back to their Tucson, Arizona, home. The Apache Trail was the way back to The Paper - 760.747.7119

Tucson. It was a primitive dirt road full of dangerous curves and switchbacks. In those days, not many people risked driving at night. The Gibsons made camp near Week's Station, which was about 24 miles east of Mesa. People traveling long distances always kept camping gear and provisions with them. Shortly after dark, a young man named Starr Daley approached the camp on horseback and asked for a drink of water. Suddenly, Starr opened fire on James Gibson with a .32 rifle, shooting him six times, the last two at point-blank range in the head killing him.
According to the Arizona Daily Star, "Mrs. Gibson spent the whole night on the Apache Trail with her husband's murderer, her clothes taken from her and under the threat of death, subjected to every whim his seemingly degenerate mind could think of."
At sunrise, Daley forced Florence to cook breakfast and load up the car while he used the dead man's razor to
shave off his mustache in an attempt to disguise his appearance. He told her they were going to leave James' body there, get married, sell the car and go to Oklahoma.
Thinking quickly, she told him he would have to kill her before she would leave her husband's body in the desert. She said if he wanted to marry her, he would have to take her husband's body to a mortuary in Mesa for a proper burial. Surprisingly, he agreed.
Daley wrapped the body in a blanket and put it in the back seat of the Dodge touring car and covered it with camping equipment.
As they entered Mesa [suburb of Phoenix now], which then was a small Mormon farming community, the car ran out of gas on East Main Street. That is when Daley made the mistake that cost him his life. He left Florence with the car as he set out to find a gas sta-
tion. It was early in the morning when a local resident named H.S. Phelps came by while riding his bicycle to work. Florence hysterically told him what had happened and Phelps immediately rode his bicycle to the home of City Marshal Tom Peyton and relayed Florence's story. Peyton grabbed his .45 and handed Phelps a shotgun and the pair raced back to the Dodge. As they approached, they saw Daley pouring a can of gasoline into the tank. They arrested him without incident. Florence was taken to a doctor and Daley had a preliminary appearance before a Mesa judge before being transferred to the Maricopa County Jail in Phoenix. tions ran at a fever pitch as men and women from all quarters of society throughout the state cried out for justice. But they knew the worst sentence he could receive was life in prison since Arizona’s 1916's vote had done away with the death penalty.
Daley himself threw fuel on the fire by telling lawmen and newspaper reporters alike, "I was a fool to take the body in the car. Anyway, I read the papers. I know they can't hang me. And I know no jail can hold me for long."
Talk of vigilante justice raced through the streets of Phoenix. People found the crime so deplorable that life in prison seemed like a slap on the wrist.
On the evening of May 17, the talk of lynching Daley picked up steam and some 500 men, as well as a number of women, advanced on the Maricopa County Jail.

Since no one in the crowd had seen Daley, Wilky had two of his deputies lead Daley out of the courthouse unshackled and through the crowd into an awaiting car. When they left, Wilky allowed the leaders of the crowd to look in the jail cells to see Daley was not there. Since the leaders had not seen Daley, even if he were there, they would have a hard time finding him.
Somehow, some people realized the ruse and took off after the deputies' vehicle. Dozens of vehicles gave chase. One pursuer called ahead and a large number of cars and people blocked a road bridge just outside Florence. As the deputies approached they saw the angry mob and turned their car around only to be met by the convoy that was following them. Cars surrounded the vehicle with their lights shining. A leader was selected to approach the car. He wore a white handkerchief over his face as did

The leader, who was unarmed, told the deputies they wanted Daley. When they replied they couldn't give up the prisoner, two armed masked men came up to the car and grabbed Daley. The deputies gave up and headed back to Phoenix. The mob told Daley they were taking him back to the scene of the crime where he would be hanged. According to unsubstantiated accounts that were reported in the Tucson Citizen, Daley asked to make a final statement and the crowd obliged. Daley allegedly said his mother made him "what I am."
He said, "She ran a brothel when I was young and she used to make me go out and seduce girls and bring them to work there. I killed Gibson and did what I wanted to with his wife."

While I was gone, the mailman delivered my mail, the neighbor boy across the street mowed the yard, a girl walked her dog down the street, and quite a few cars stopped at the stop sign right in front of our house.

Daley was put on the trunk of a car with the noose around his neck, the car sped away, leaving Daley dangling from the pole. The New York Times reported, "And then the perpetrator of the most sensational crime in the history of Arizona was swung into eternity."
Although many newspapers reported numerous anonymous quotes from so many people in the mob, Arizona authorities were unable to identify anyone and no one was charged with Daley's lynching.
In 1918, by a vote of 20,443 to 10,602 capital punishment was restored in Arizona.

After about an hour, I checked on the gun. It was still sitting there in the wheelchair, right where I had left it. It hadn't rolled itself outside. It certainly hadn't killed anyone, even with the numerous opportunities it had been presented to do so. In fact, it hadn't even loaded itself.

The History of Frontier Justice
There was an author, R. Michael Wilson, who compiled a complete list of the lynchings, executions, and imprisonments that took place in territorial Arizona (1863-1912). Crime & Punishment In Early Arizona R. Michael Wilson
The unfortunate events described therein form the basis for many of the Wild West adventures that interest us today. According to the author, there were 46 lynchings with 63 men being dispatched during these events in territorial Arizona. (Some lynchings were with multiple condemned parties). No women were lynched.
Most of the men were killed by hanging. A number of the victims were described simply as an "un-named Mexican," indicating the insensitivity of the Anglo vigilantes who captured them.
Lynching was a semi-legal method of law enforcement in territorial Arizona. A group of vigilantes would be sent out from a town or village to hunt down horse thieves or stage robbers. If they caught the miscreants, often they would hang them on the spot without a formal trial. One has to speculate that occasionally an innocent man was strung up from a nearby tree.
After being tried and convicted of a capital crime, punishment by execution was practiced in Arizona during the territorial period. The author's research found that 53 men died during this time. Public hanging was the authorized method of dispatching the wrongdoers. No women were executed in Arizona during territorial days. Again, the newspapers were Wilson's primary sources of information. These events usually were front page news. The author appears to have been exhaustive in his research and his accounts make fascinating reading. The famous February 1884 lynching of

by The New York Times Detail of lynching of John Heith (Heath), February 24, 1884 TOMBSTONE, Arizona, Feb. 23.—At 9 o'clock on Thursday morning Judge Pinney sentenced John Heith to confinement in Yuma Penitentiary for life for complicity in the Bisbee murders.
Twenty-four hours later the dead body of Heith dangled from the cross bar of a telegraph pole near the foot of Toughnut Street, where it was suspended by a rope. The following are the particulars of the occurrence as near as can be gathered: About 8:30 yesterday morning a crowd of men, mostly miners, numbering about 150, proceeded to the Courthouse. Arriving there they detailed seven of their number from Bisbee, who entered and demanded that John Heith be turned over to them. The seven men approached the door leading to the corridor of the jail and one of them knocked. Being about time for the Chinaman who brings food for the prisoners to arrive, Jailer Ward opened the door unsuspiciously, and was immediately covered by weapons and told to give up the keys of the jail. Seeing any attempt at resistance would be useless he did as requested, and in a few minutes the deputation was in the presence of the sought-for man. The crowd, which by this time had filled the spacious hall, started for the street. At the door they were met by Sheriff Ward, who called on them in the name of the law to desist. The Sheriff was picked up and gently removed down the steps out of the way, while the crowd started down the street on a run. The rope had been placed around Heith's body, and about 20 men had hold of it. It never became taut during the run, the prisoner keeping up with the crowd, and showing no signs of the white feather. Arriving at the place selected for the hanging one of the party climbed a telegraph pole and passed the rope over the crossbar. Heith pulled a handker-
chief from his pocket and, placing it on his knee, coolly and deliberately folded it, and, placing it over his eyes, asked someone in the crowd to tie it. This being done, he informed the crowd they were hanging an innocent man, and would find it out when the others (meaning Dowd and his companions) were hanged. He told them he had faced death too often to be afraid, and had but one request to make, namely, that they would not shoot into his body. He was told his last wish would be respected and he told them he was ready. Countless hands grasped the rope. A run was made, and in a twinkling the man was suspended to the pole.
The news spread about town rapidly, and in a few minutes an immense crowd of men, women, and children congregated on the scene. The universal expression was, "Served him right." That this opinion should be so prevalent is no doubt the result of the testimony at the trial, which was convincing to any mind of ordinary intelligence, that Heith was a guilty accessory to the Bisbee murders. The Coroner's jury found as a verdict that Heith came to his death from "emphysema, which might have been caused by strangulation, self-inflicted or otherwise." A placard was posted on the telegraph pole where Heith was found suspended and dead with the following inscription: "John Heith was hanged to this pole by citizens of Cochise County for participation in the Bisbee massacre as a proved accessory at 8:20 A.M., Feb 22, 1884 to advance Arizona."
Twisting in the wind in Redding – July 24, 1892 –
John and Charles Ruggles were born 1860 and 1871, respectively, to prosperous parents near Woodland in Yolo County. Their father Lyman came out to California during the Gold Rush in 1850 and worked the mines until he realized that there was money to be made as a farmer. The hordes of people tromping around California needed to eat, and the restaurants that popped up all over the state needed fresh produce and meat. In time, Lyman was elected to the Yolo County Board of Supervisors. Having an eye for opportunity, he started farming in Tulare County and eventually acquired over

four hundred acres of prime farmland.
Young John was sickly, and so his father sent him to live in Stockton, closer to his doctor. John Ruggles had shown no inclination toward criminal behavior, but on October 31, 1878, he unexpectedly attempted to rob a couple who were out for a stroll. The man that he tried to rob pulled out a revolver and fired five shots, hitting John in the back. Wounded, he surrendered to the police immediately. His wound was serious, but he quickly recovered and was tried and convicted for robbery and assault. He was sent to San Quentin prison for seven years.
Governor George C. Perkins pardoned John Ruggles after he served fourteen months in San Quentin, thanks to some hefty donations to his political campaign chest. He was placed in the custody of his parents and seemed to go straight, working hard on his father’s farm, eventually buying several parcels of property near the town of Dinuba in the Sierra Nevada Mountains. By 1887, he was married and had a daughter, but luck was something that was always just out to reach for John Ruggles. His wife took ill and died in 1889, devastating Ruggles. Unable to care for a young child, he left his daughter with relatives. With little to live for, he neglected his crops, spending his time hunting and living off the land in the mountains.
In 1892, John’s little brother Charley came to visit his brother in the mountains. Charley had just come back from the gold fields in Shasta County where, instead of panning for gold, he allegedly robbed sixteen stagecoaches in the area with a buddy, Arizona Pete. After listening to Charley’s tales of his stagecoach-robbing exploits, John couldn’t resist hitting the outlaw trail with his little brother. He leased out his farm to a neighbor and rode north, stopping first in San Francisco for a little merrymaking. On May 10, 1892, the Ruggles boys robbed the Weaverville

Puppy Mills Target of Protest This Saturday
San Diego Puppy pet store, located 5825 Mission Gorge Rd. in San Diego will be the recipient of a lot of unwanted publicity this Saturday, March 30th, from 3pm to 4pm.
It’s all part of a major protest staged by the San Diego Animal Defense Team to both protest owner, David Salinas’s sale of puppies from puppy mills in the midwest, and to support a San Diego City Council ban on the pet store sale of dogs, cats and rabbits.
“These puppies trucked into San Diego Puppy pet store are products of the abusive industry of puppy mills,” says Janice Hatch, one of the co-founders of the group. “Whenever you purchase a puppy from San Diego Puppy pet store, all you do is create another market for yet another puppy from the puppy mills and cause more and more dogs to be bred over and over to turn out puppies assembly line style. We have proof that this store is trucking

puppies in from the Hunte Corp. in Goodman, Missouri. Hunte is the largest puppy mill broker in the country, processing 90,000 puppies a year. They ship 1,500 – 2,000 puppies a week to pet stores just like this one, all across the country.” Hatch goes on to say: “We are creating peaceful protests at the pet stores selling puppies and also lobbying for the San Diego City Council to pass an ordinance to end the sale of dogs, cats and rabbits in pet stores,”

Cute but sick baby sea lions continue to be found on North County beaches, including Carlsbad.
Malnourished and dehydrated, the pups are found daily in numbers that have not been seen since the 1980’s.

The Escondido Chamber Proposal

It was a perfect place to stage a holdup, because not only would the coach be traveling slowly as it reached the top of the hill, but the horses would be tired.
They stopped the stagecoach and demanded the driver to throw down the Wells Fargo boxes. As the second box hit the ground, simultaneous gunshots rang out and Charlie Ruggles was hit with buckshot fired by a guard riding in the coach with the passengers. More shots rang out, and the air filled with gunsmoke and dust kicked up by the panicked horse team. A passenger named George Suhr was hit by buckshot, as was the driver, Johnny Boyce. The guard, Amos “Buck” Montgomery, was also seriously injured and was bleeding profusely inside the coach.

Maybe we can blame the confusion of today on the illiteracy in the USA. I contend we have many reasons explaining the lack of common sense and present apathy. This state of inertia causes us to grab onto our solid roots. We have some. Marriage is defined as a legal contract between a man and a woman only, the relationship as husband and wife which procreates and propagates a healthy family. This has been forever and ever. When God gave us a good thing we do not need to change it because the nation is blessed.
The Supreme Court hearings are revisiting marriage. These same judges previously supported, the Defense of Marriage Act (DOMA).
The definition of “homosexual” is a person sexually attracted to another of the same sex. They are secure with legal benefits in civil union. Society does not need to address this issue any further. The nation is experiencing ramifications from adapting such laws. In the early morning hours of Sunday, July 24, a group of masked men entered the jail and broke into the prisoners’ cells. John tried to take all the blame for the crime to save Charlie, but the lynch mob showed no sympathy to the elder Ruggles’ final pleas. They hung the Ruggles brothers from a makeshift gallows near Etter’s Blacksmith Shop. With purple faces, they slowly twisted in the wind, greeting the townspeople of Redding on their way to church.
Near Agua Caliente Hot Springs, in Southwestern Arizona, stands the ruin of an old adobe stage station, one in the link of stations constructed by the Overland Stage Company in about 1860. Its thick walls withstood many attacks of the renegade Apaches and later the white
robbers. Though primarily a stage station, the building was also used on occasion as a courthouse. Harsh frontier justice was dispensed without the usual pomp, formality and dignified procedure usually associated with a courtroom. The stage station agent was usually the judge. If he was busy, someone else could and did pass judgment.
Nearby stood a large mesquite tree, one limb of which reached horizontally more than twenty feet, thus making it ideal for the needs of those seeking a place to carry out "western justice." Indeed, this same limb was reputed to have accommodated the figures of no less than seven notables of the equine larceny profession at one time. Fittingly enough, this tree, still standing, is known as Hangman's Tree. It is said to be the largest mesquite tree in Arizona.

Grown ups are choosing to live lives of unnatural relationships, statistics show them to be troubled, unsteady, riddled with disease, emotionally unstable, void of a wholesome intimate love and the inability to enjoy the awesomeness of procreating. My heart goes out to families entwined in the gay lifestyle. I would encourage them to pray and seek counseling to restore self-respect to these lost souls. We all need support, love and compassion. It takes perseverance and working together. That’s what families are for.
Everyone has the choice to commit to any gender and to live as she or he pleases with equal legal protection. Apparently, some of the homosexual groups are the ones who are not accepting and intolerable by not respecting our nation’s values and moral laws. Let’s keep protecting traditional marriage. NCTD’s budget shows that the Sprinter costs $6.05 per rider, with $4.74 of that subsidized by government grants. The agency’s bus service, the Breeze, costs $5.11 per mile, with $3.70 of that subsidized.
Wendell Cox, who runs a conservative public policy firm near St. Louis and is a public transit critic, said paying hundreds of millions for a rail line in North San Diego County was “one of the worst public policy decisions I can conceive of.” “One wonders how much additional bus service would have been created in North County had they done a bus expansion instead of the Sprinter,” Cox said.

State law requires that cities adopt a Housing Element with prescribed details and content. Escondido’s newly adopted General Plan contains a Housing Element that assesses the housing needs of all economic segments of the City. Staff was notified that in February 2013, Escondido’s Housing Element was approved by the California Department of Housing and Community Development.
Preparing the Housing Element involved extensive community outreach with workshops, surveys, study sessions and public hearings that included residents, developers, service organizations, nonprofit groups, and decision-makers to
establish Escondido’s three broad housing goals: 1) Plan for quality, managed, and sustainable growth; 2) Provide a range of housing opportunities for all income groups and households with special needs; 3) Enhance the quality of the City’s housing stock, preserve the integrity of neighborhood character and encourage home ownership.
State approval of Escondido’s Housing Element also affords the city certain economic benefits. A variety of grants for enhancing/improving infrastructure, recreation, transportation and other municipal services are designed to reward local governments for compliance with State Housing Element law. Escondido’s Housing Element will serve the City through December 31, 2020, with policies that guide the City’s approach to resolving housing needs and programs for implementing the General Plan’s long-term

We all get attacked by “phishing” exploits from time to time. Perhaps the Nigerian Minister of Treasury looking to park $35 million in your bank account. It could be a desperate message from a relative traveling abroad who was robbed and needed $1500 to get home. There have been dire messages from your bank, notices of an undelivered UPS package, warnings from your E-mail service, phone calls from Microsoft and demands for payment from the CIA, Dept of Justice and FBI.

You need to stay calm and act unaware of this situation and follow instructions because any move you make that is suspicious; you will DIE as your days are numbered.”
